which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To improve services for trafficking victims by establishing, in Homeland Security Investigations, the Investigators Maintain Purposeful Awareness to Combat Trafficking Trauma Program and the Victim Assistance Program.</official-title></form><legis-body id="H39602132EE8342078677D9E447C48E0D" style="OLC"><section section-type="section-one" id="H41398EBAE2FE4B579EC1125C46A525A1" changed="not-changed"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>IMPACTT Human Trafficking Act</short-title></quote>.</text></section><section section-type="subsequent-section" id="HE33645D9D1D544FAADA0D9AC90400E6B" changed="not-changed"><enum>2.</enum><header>Investigators Maintain Purposeful Awareness to Combat Trafficking Trauma Program</header><subsection id="H652B103B868E4382B99E42EB672AE867" changed="not-changed"><enum>(a)</enum><header>Establishment</header><text>There is established, in Homeland Security Investigations of U.S. Immigration and Customs Enforcement, the Investigators Maintain Purposeful Awareness to Combat Trafficking Trauma Program (referred to in this Act as the <quote>IMPACTT Program</quote>).</text></subsection><subsection id="HFA1716F4C93247FFA2CFEFB3F5D882C0" changed="not-changed"><enum>(b)</enum><header>Functions</header><text>The IMPACTT Program shall—</text><paragraph id="H9F80514D72614DF9BAD21287AED5681B" changed="not-changed"><enum>(1)</enum><text>provide outreach and training to Homeland Security Investigations employees who have been exposed to various forms of trauma in working with victims of human trafficking, including—</text><subparagraph id="HDA51B62B0D624B459F2F016D0C99BBB7" changed="not-changed"><enum>(A)</enum><text>self-awareness training for the relevant employees on recognizing the signs of burnout, compassion fatigue, critical incident stress, traumatic stress, posttraumatic stress, secondary traumatic stress, and vicarious trauma;</text></subparagraph><subparagraph id="H1D4DB8521CA641D9A022486AAD2B00B8" changed="not-changed"><enum>(B)</enum><text>training material that—</text><clause changed="not-changed" commented="no" display-inline="no-display-inline" id="H93DA821E901845D88D6B57A356D6FDE2"><enum>(i)</enum><text display-inline="yes-display-inline">provides mechanisms for self-care and resilience and notification of resources that are available through U.S. Immigration and Customs Enforcement, such as the Employee Assistance Program, the Peer Support Program, the Chaplain Program, and other relevant accredited programs that are available; and</text></clause><clause changed="not-changed" commented="no" display-inline="no-display-inline" id="HD585A5BFE40F4B8F9F270788D5D5501B"><enum>(ii)</enum><text>provides examples of potential resources that are available outside of U.S. Immigration and Customs Enforcement, which may include, faith-based and community-based resources; and</text></clause></subparagraph><subparagraph id="H1F59FE3778D746BAB5752DCBE132DEB8" changed="not-changed"><enum>(C)</enum><text>provide additional training to first line supervisors of relevant employees on recognizing the signs referred to in subparagraph (A) and the appropriate responses to employees exhibiting such signs;</text></subparagraph></paragraph><paragraph id="H1C71A789A430433DB8369D36AE424C16" changed="not-changed"><enum>(2)</enum><text>include training modules that are carried out by—</text><subparagraph id="HDC49705DFE26492E86350007B38E6C50" changed="not-changed"><enum>(A)</enum><text>licensed and accredited clinicians who—</text><clause changed="not-changed" commented="no" display-inline="no-display-inline" id="H7D06E246405A45A7B91B72AA12807887"><enum>(i)</enum><text display-inline="yes-display-inline">have been trained on the exposure of various forms of trauma and other stressors experienced in working with victims; and </text></clause><clause changed="not-changed" commented="no" display-inline="no-display-inline" id="HD4374CF6675B4D3EB04F0425BB06C251"><enum>(ii)</enum><text display-inline="yes-display-inline">may have experience working with faith-based organizations, community-based organizations, counseling programs, or other social service programs; and </text></clause></subparagraph><subparagraph id="H815DB6B50987430287B03FEC771C4302" changed="not-changed"><enum>(B)</enum><text>additional subject matter experts who are available; and</text></subparagraph></paragraph><paragraph id="HA212CB78AA684BE28E6E957A4793B6C5" changed="not-changed"><enum>(3)</enum><text>be overseen and coordinated by the Department of Homeland Security Center for Countering Human Trafficking to ensure that—</text><subparagraph id="H3DB1E76466D94B56A7779D5EE46745C2" changed="not-changed"><enum>(A)</enum><text>appropriate program materials are distributed;</text></subparagraph><subparagraph id="H64F626B7388C4234A4DCE559E0833852" changed="not-changed"><enum>(B)</enum><text>training is offered to all relevant employees; and </text></subparagraph><subparagraph id="HFB0071FA6F304953A2EEDDA19A42CFE5" changed="not-changed"><enum>(C)</enum><text>any needed travel and equipment is provided.</text></subparagraph></paragraph></subsection></section><section id="H4732A6C95421476F909004F6E810613F" changed="not-changed"><enum>3.</enum><header>Homeland Security Investigations Victim Assistance Program</header><subsection id="H8299104CF12342B98A1A13FD7521FB71" changed="not-changed"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Subtitle D of title IV of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/251">6 U.S.C. 251 et seq.</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H9967717E020D4B2AA2DC08B3DCCE0F2E" changed="not-changed"><section id="HB1AD1D5B678243659E25B65FF05B067A" changed="not-changed"><enum>447.</enum><header>Homeland Security Investigations Victim Assistance Program</header><subsection id="HE71B4A29FF5C413C9B04A873A7100A1F" changed="not-changed"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H5CF6D9F990AD49DB8E20F5A1C29871F6" changed="not-changed"><enum>(1)</enum><header>Forensic interview specialist</header><text>The term <term>forensic interview specialist</term> is an interview professional who has specialized experience and training in conducting trauma-informed forensic interviews with victims of crime.</text></paragraph><paragraph id="HD8992C015B40404CB94B6958387C8C6D" changed="not-changed"><enum>(2)</enum><header>Victim</header><text>The term <term>victim</term> has the meaning given such term in section 503(e)(2) of the Victims’ Rights and Restitution Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/34/20141">34 U.S.C. 20141(e)(2)</external-xref>). </text></paragraph><paragraph changed="not-changed" commented="no" display-inline="no-display-inline" id="HA0D10B2989FE4331912414EA43CFCFD6"><enum>(3)</enum><header display-inline="yes-display-inline">Victim assistance specialist</header><text>The term <term>victim assistance specialist</term> is a victim assistance professional who—</text><subparagraph id="H7FFA20413F37496B94175D6BE951754B" changed="not-changed"><enum>(A)</enum><text>has experience working with victims of crime in a service capacity;</text></subparagraph><subparagraph id="H6095968DF0FB4003916E46C061A40969" changed="not-changed"><enum>(B)</enum><text>has been trained on the exposure of various forms of trauma and other stressors experienced in working with victims; and</text></subparagraph><subparagraph changed="not-changed" commented="no" display-inline="no-display-inline" id="H39457280953B45EFBC83DDA1F0084693"><enum>(C)</enum><text>may have experience working with local government and community-based organizations, including victim advocacy centers, child advocacy centers, child welfare agencies, faith-based organizations, and other social service programs. </text></subparagraph></paragraph></subsection><subsection id="H664DFBF176D34326875ACE50B798DAFA" changed="not-changed"><enum>(b)</enum><header>In general</header><text>There is established, in Homeland Security Investigations of U.S. Immigration and Customs Enforcement, the Victim Assistance Program.</text></subsection><subsection id="H7984A428031E496FAA1EDDAF20FA99A9" changed="not-changed"><enum>(c)</enum><header>Functions</header><text>The Victim Assistance Program shall—</text><paragraph id="H880B4844AF4349EDBB26A29ECE654714" changed="not-changed"><enum>(1)</enum><text>provide oversight, guidance, training, travel, equipment, and coordination to Homeland Security Investigations victim assistance personnel throughout the United States;</text></paragraph><paragraph id="H186538EFBCFB49B69C000823D40B856A" changed="not-changed"><enum>(2)</enum><text>recruit not fewer than—</text><subparagraph id="H3A3BB9FAABCF40999761E9057528C1C8" changed="not-changed"><enum>(A)</enum><text>1 forensic interview specialist and 1 victim assistance specialist for each Homeland Security Investigations Special Agent in Charge office;</text></subparagraph><subparagraph id="H77864A88735449F6A69E95B62223DCE1" changed="not-changed"><enum>(B)</enum><text>1 victim assistance specialist for—</text><clause id="HE57EB79F9D6D402AA5552011F5E17BC2" changed="not-changed"><enum>(i)</enum><text>every Homeland Security Investigations office participating in a human trafficking task force; and</text></clause><clause id="H17DA9FCC532C475EA6664479E2F04E1C" changed="not-changed"><enum>(ii)</enum><text>every Homeland Security Investigations office participating in a child sexual exploitation task force;</text></clause></subparagraph></paragraph><paragraph id="HA3506C1C2E3E4D57AC64A7BE443C558E" changed="not-changed"><enum>(3)</enum><text>support Homeland Security Investigations regional attaché offices, to the extent necessary; </text></paragraph><paragraph changed="not-changed" commented="no" display-inline="no-display-inline" id="H740C3511CF8445AA91ACCAC6FE859720"><enum>(4)</enum><text display-inline="yes-display-inline">provide training regarding victims’ rights, victim-related policies, roles of forensic interviewers and victim assistance specialists, and an approach that is—</text><subparagraph id="H20BBAA8F2A61451ABDBE616BB04A02C7" changed="not-changed"><enum>(A)</enum><text>victim-centered; </text></subparagraph><subparagraph id="H8D3527EB0F804F3599DEAEC3DA2111AB" changed="not-changed"><enum>(B)</enum><text>trauma-informed; and</text></subparagraph><subparagraph id="H685B7441256844E8AAE27BDCF1D29D39" changed="not-changed"><enum>(C)</enum><text>linguistically appropriate, to the extent feasible; and</text></subparagraph></paragraph><paragraph id="H819F23C8CD6A4670949EA91EAFEDC076" changed="not-changed"><enum>(5)</enum><text>purchase emergency items that are needed to assist identified victims in Homeland Security Investigations criminal investigations, including food, clothing, hygiene products, transportation, and temporary shelter that is not otherwise provided by a nongovernmental organization.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H474E7F0F8C5B457F82CCDD7DD134C399" changed="not-changed"><enum>(b)</enum><header>Technical and conforming amendments</header><text>The Homeland Security Act of 2002 (<external-xref legal-doc="public-law" parsable-cite="pl/107/296">Public Law 107–296</external-xref>) is amended—</text><paragraph id="H70E1FBC59BC64D70A447851FF944BA76" changed="not-changed"><enum>(1)</enum><text>in section 1(b) (<external-xref legal-doc="usc" parsable-cite="usc/6/101">6 U.S.C. 101</external-xref> note)—</text><subparagraph id="H7812BA2AF2724FAFB4506C381C4A5381" changed="not-changed"><enum>(A)</enum><text>by striking the item relating to section 442 and inserting the following:</text><quoted-block style="OLC" id="H575A2DFE4E0B49A3B57706E2BD5D8F6B" changed="not-changed"><toc changed="not-changed"><toc-entry level="section" changed="not-changed">Sec. 442. U.S. Immigration and Customs Enforcement.</toc-entry></toc><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="H9F2E19D4EC0B419BA8141AAAB4EC976D" changed="not-changed"><enum>(B)</enum><text>by inserting after the item relating to section 446 the following: </text><quoted-block style="OLC" id="H67D261EA29EE4336B1DDD9790C7BE80A" changed="not-changed"><toc changed="not-changed"><toc-entry level="section" changed="not-changed">Sec. 447. Homeland Security Investigations Victim Assistance Program.</toc-entry></toc><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="HA3517E3D80594D8987815CF042B1D225" changed="not-changed"><enum>(2)</enum><text>in section 442—</text><subparagraph id="HC0DE8AA86384457C9A0690D53D8D1FEA" changed="not-changed"><enum>(A)</enum><text>by amending the section heading to read as follows: <quote><header-in-text level="section" style="OLC">U.S. Immigration and Customs Enforcement</header-in-text></quote>;</text></subparagraph><subparagraph id="HEF9E4400D6E84B31B1708C9307467521" changed="not-changed"><enum>(B)</enum><text>by striking <quote>bureau</quote> each place such term appears (except in subsection (a)(1)) and inserting <quote>agency</quote>;</text></subparagraph><subparagraph id="H894C59AE03C7423DB08D050CB0E06277" changed="not-changed"><enum>(C)</enum><text>by striking <quote>the Bureau of Border Security</quote> each place such term appears and inserting <quote>U.S. Immigration and Customs Enforcement</quote>;</text></subparagraph><subparagraph id="H2A35F00E62E6412080051437170DA38B" changed="not-changed"><enum>(D)</enum><text>in subsection (a)—</text><clause id="H112CDD70BD6C44ABAC90AEABA424CDD9" changed="not-changed"><enum>(i)</enum><text>in the subsection heading, by striking <quote><header-in-text level="subsection" style="OLC">of Bureau</header-in-text></quote>;</text></clause><clause id="H4F3878C6C4714926BFBD4E2881F078A1" changed="not-changed"><enum>(ii)</enum><text>in paragraph (3)(C), by striking <quote>affecting the Bureau of</quote> and inserting <quote>affecting U.S.</quote>; and</text></clause><clause id="H371F7E4DEDB342388B248612F4216E7D" changed="not-changed"><enum>(iii)</enum><text>in paragraph (4), by striking <quote>the Bureau.</quote> and inserting <quote>the agency.</quote>; and</text></clause></subparagraph><subparagraph id="HF78B94BA21C34E36948EFAFB0C3E2464" changed="not-changed"><enum>(E)</enum><text>in subsection (b)(2)—</text><clause id="H4B7A2D9669604281A75939ABCA389D16" changed="not-changed"><enum>(i)</enum><text>in the matter preceding subparagraph (A), by striking <quote>Bureau of Border Security</quote> and inserting <quote>U.S. Immigration and Customs Enforcement</quote>; and</text></clause><clause id="H84B77F254A9E440E8049453F6FFB1A89" changed="not-changed"><enum>(ii)</enum><text>in subparagraph (B), by striking <quote>the Bureau of</quote> before <quote>Citizenship and Immigration Services</quote> and inserting <quote>U.S.</quote>; and</text></clause></subparagraph></paragraph><paragraph id="HD02B05A6A7C04A3E8601ED4E90E59F40" changed="not-changed"><enum>(3)</enum><text>in section 443(2), by striking <quote>such bureau</quote> and inserting <quote>such agency</quote>.</text></paragraph></subsection></section><section id="H6D861ECD6084457D92A42E7E4E2F8A52" changed="not-changed"><enum>4.</enum><header>Annual report</header><text display-inline="no-display-inline">Not later than 1 year after the date of the enactment of this Act, and annually thereafter, the Secretary of Homeland Security shall submit a report to Congress that identifies, with respect to the reporting period—</text><paragraph id="H3A14272ED3C44884A6AE2615D280D7CC" changed="not-changed"><enum>(1)</enum><text>the number of trainings that were provided through the IMPACTT Program and the number of personnel who received such training; and</text></paragraph><paragraph id="H8F462A8187DA409B8341809DD268C390" changed="not-changed"><enum>(2) </enum><text>the number of human trafficking victims who were assisted by the Homeland Security Investigations Victim Assistance Program.</text></paragraph></section></legis-body></bill>
