<legis-type>AN ACT</legis-type> 
<official-title display="yes">To amend title 38, United States Code, to allow for the electronic request of certain records, and for other purposes.</official-title> 
</form>

<section id="HE2E826D783874F7AB1557D184041378B" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Wounded Warrior Access Act</short-title></quote>.</text></section> <section id="H1E181BF97A444AE59936CB47E64D70DE" section-type="subsequent-section"><enum>2.</enum><header>Electronic request of certain records maintained by the Secretary of Veterans Affairs</header> <subsection id="H226E1E8973AE495EA09E3C44371ADE51"><enum>(a)</enum><header>Electronic record requests</header><text display-inline="yes-display-inline">Section 5702 of title 38, United States Code, is amended—</text> 
<paragraph id="HAF7621829A5549D3995F5907909CBD4E"><enum>(1)</enum><text>by redesignating subsection (b) as subsection (c); and</text></paragraph> <paragraph id="H392DFAD10DBA4802982EFB1E0E1E13E9"><enum>(2)</enum><text display-inline="yes-display-inline">by inserting after subsection (a) the following: </text> 
<quoted-block style="USC" id="H4FB91EFF90ED497EBA1DC61044852A17" display-inline="no-display-inline"> 
<subsection id="HC31E2C85AC324F599AAF706B6EF7ACBE"><enum>(b)</enum> 
<paragraph commented="no" display-inline="yes-display-inline" id="H4FAE1688F3E3430C8F98DB151E9E2833"><enum>(1)</enum><text display-inline="yes-display-inline">The Secretary shall establish and maintain a secure website or online tool for a claimant or a duly recognized agent or representative of that claimant to submit an electronic request for such records. </text></paragraph> <paragraph id="HC48F183667C44EB680F13978D3B22184" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">The Secretary, upon receipt of a valid request made through the website or online tool established under paragraph (1), shall provide to the requestor—</text> 
<subparagraph id="HF8BBF3BF77A844FF9FF726D4E9902B5C"><enum>(A)</enum><text>not later than 10 days after receipt, confirmation of such receipt; and</text></subparagraph> <subparagraph id="H66600FDC77474B3FBCB81D41FB632146"><enum>(B)</enum><text>not later than 120 days after receipt, such records requested in the form selected by the requestor. </text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H8D71E7BF50684A17A9B6F3EB07BBD7E1"><enum>(b)</enum><header>Conforming amendments</header><text>Section 5702(a) of title 38, United States Code, is amended—</text> <paragraph id="HC70FCF947BAA4119B1FE8C9CA606038E"><enum>(1)</enum><text>in the matter preceding paragraph (1), by striking <quote>in writing</quote> and inserting <quote>in writing, including an electronic request submitted through the website or online tool established under subsection (b),</quote>;</text></paragraph> 
<paragraph id="HC6D5FB1E0EB047F0B5D0913DEA2B9F0F"><enum>(2)</enum><text>in paragraph (1), by striking <quote>and</quote> at the end;</text></paragraph> <paragraph id="H7976390450AF4226A5D9CEB4788EB9C7"><enum>(3)</enum><text>in paragraph (2), by striking the period at the end and inserting <quote>; and</quote>; and</text></paragraph> 
<paragraph id="H5F0457EE34264A799E55BBE092EE02E7"><enum>(4)</enum><text>by adding at the end the following:</text> <quoted-block style="USC" id="H932C1660ACF548BF8F69349C9C684E5A" display-inline="no-display-inline"> <paragraph id="HED943C8399214204B6C9B9B7EB0B8476"><enum>(3)</enum><text display-inline="yes-display-inline">the format in which such copy is desired, including whether in printed form or by downloadable file.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="HD7773266BADB4EF890532F643591E7CA"><enum>(c)</enum><header>Deadline; establishment of website or online tool</header><text display-inline="yes-display-inline">Not later than one year after the date of the enactment of this Act, the Secretary of Veterans Affairs shall establish the website or online tool required under section 5702(b)(1) of title 38, United States Code, as added by this Act, and, to the extent practicable, the Secretary shall utilize existing online resources of the Department of Veterans Affairs for the purposes of such establishment.</text></subsection></section> <section id="H8F571B55BADE4D32B42FF8BCA3AE7323"><enum>3.</enum><header>Warnings to claimants under laws administered by the Secretary of Veterans Affairs regarding unrecognized representatives</header> <subsection id="H238E528B2B2E465287FC853DA69AC662"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 5901 of title 38, United States Code, is amended—</text> 
<paragraph id="H9EC61244D0A94342989C142294B521BF"><enum>(1)</enum><text>by inserting <quote><header-in-text level="subsection" style="USC"><enum-in-header>(a) </enum-in-header></header-in-text><header-in-text level="subsection" style="USC">In general.—</header-in-text></quote> before <quote>Except</quote>;</text></paragraph> <paragraph id="HB9D0EE1EF1144A34BA63D2E39CFC6535"><enum>(2)</enum><text>by adding at the end the following new subsection:</text> 
<quoted-block style="USC" id="HAC2EEAE21CD14DFCA9CDEB451BECB910" display-inline="no-display-inline"> 
<subsection id="H3190D8D9B9EB46618C97F832D4EFEE80"><enum>(b)</enum><header>Warnings about potential predatory practices</header> 
<paragraph id="HEFF128786B5241AEAE85F2AF2515E0C2" display-inline="yes-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">The Secretary shall ensure that, each time a claimant under a law administered by the Secretary logs in to a website or online tool of the Department, such website or online tool issues to the claimant, in plain language—</text> <subparagraph id="H79AF5891C3E5468F85E267E8A8E9BE0C" indent="up1"><enum>(A)</enum><text display-inline="yes-display-inline">a warning about individuals who seek to act in violation of this chapter;</text></subparagraph> 
<subparagraph id="H596A876C211A428D9DC8002189068DD8" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">a link to an online tool of the Department through which the claimant may report such an individual; </text></subparagraph> <subparagraph id="H6CAA94320EB64429A06173C2446634C1" indent="up1"><enum>(C)</enum><text display-inline="yes-display-inline">a link to an online tool of the Department through which the claimant may search for a recognized agent, attorney, or other entity recognized by the Secretary for the preparation, presentation, or prosecution of any claim under laws administered by the Secretary; and</text></subparagraph> 
<subparagraph id="H68A7FE8097A1411D922607E53863B13A" indent="up1"><enum>(D)</enum><text display-inline="yes-display-inline">a link to a website or an online tool of the Department providing final decisions on discipline of agents, attorneys, and entities, described in subparagraph (C), by the Secretary for violations of this chapter.</text></subparagraph></paragraph> <paragraph id="HDB8604FE615A4FBFA65FC776A8FDF5A5" indent="up1"><enum>(2)</enum><text>The Secretary shall provide all information under paragraph (1) in the following languages:</text> 
<subparagraph id="H555CBB832648454A8309C9000C494C38"><enum>(A)</enum><text>English.</text></subparagraph> <subparagraph id="HAE412679417F40D7BEDF69E21A146866"><enum>(B)</enum><text>Spanish.</text></subparagraph> 
<subparagraph id="H1701AECA72034BB1B6BEAC5CF48F3054"><enum>(C)</enum><text>Tagalog.</text></subparagraph> <subparagraph id="HE7FDB739106043F288B276E41C3CFC06"><enum>(D)</enum><text display-inline="yes-display-inline">The seven other languages most commonly spoken in the United States.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="HA6A032A5AA184BEDBC49D8548E137767"><enum>(b)</enum><header>Implementation</header><text display-inline="yes-display-inline">The Secretary of Veterans Affairs shall carry out subsection (b) of such section, as added by subsection (a) of this section—</text> <paragraph id="HED3303F1C3664CB59B654F61FB63D62E"><enum>(1)</enum><text>after consulting with stakeholders (including veterans service organizations recognized under section 5902 of such title) regarding the wording of the warning under such subsection; and</text></paragraph> 
<paragraph id="HD2AA0F890BF642A590E12566B4828780"><enum>(2)</enum><text>not later than one year after the date of the enactment of this Act.</text></paragraph></subsection></section> <section id="H1A6C12DAEFA247D1ACD3876D2366ECD8"><enum>4.</enum><header>No additional funds authorized</header><text display-inline="no-display-inline">No additional funds are authorized to be appropriated to carry out the requirements of this Act.</text></section>
