which was read twice and referred to the <committee-name committee-id="SSAF00">Committee on Agriculture, Nutrition, and Forestry</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Cooperative Forestry Assistance Act of 1978 to provide States and communities with additional assistance to plant and maintain trees, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Neighborhood Tree Act of 2022</short-title></quote>.</text></section><section id="idE042C9097306492E8693DFFBBE502A2A"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds that—</text><paragraph id="id380e22163a6d42c8846c3c1ac226bc1e"><enum>(1)</enum><text>the presence of a healthy and well-maintained urban forest can—</text><subparagraph id="id38CA0E1131A74D838B8EBFA3F708B80E"><enum>(A)</enum><text>support—</text><clause id="id4A86BC18B77F4215BD0FCC12C0434B68"><enum>(i)</enum><text>the physical and mental health of community residents;</text></clause><clause id="id5A2474241E374F34B14ED5275222AF90"><enum>(ii)</enum><text>the regulation of air quality;</text></clause><clause id="id9931C0E3346F4F42BB0C2AC30A16822E"><enum>(iii)</enum><text>the mitigation of the urban heat island effect;</text></clause><clause id="id1E060608B19149D9824A2D8BFAEEE3F3"><enum>(iv)</enum><text>the reduction of energy demand; and</text></clause><clause id="id52F99642833A42B9AC637B5E8B4146C7"><enum>(v)</enum><text>stormwater management; and</text></clause></subparagraph><subparagraph id="id0B7BDB170C3E4E1FAD87E9DB9D5AFED1"><enum>(B)</enum><text>provide other benefits;</text></subparagraph></paragraph><paragraph id="id3DC08CF0125547518FFCF99536F914E8"><enum>(2)</enum><text>according to research of the Forest Service, the estimated value of benefits described in paragraph (1) exceeds $18,000,000,000;</text></paragraph><paragraph id="id8d36881f31934cca8a06d52bd88c1491"><enum>(3)</enum><text>the maintenance and management of an urban forest offers additional opportunities relating to workforce development, job creation, and enhancement of property values;</text></paragraph><paragraph id="id4524f8a96c0f496095d7f4882fa2be69"><enum>(4)</enum><text>urban forest canopy cover is inequitably distributed among racial groups and income levels, exacerbating disparities in exposure, for example, to the urban heat island effect and in related health risks or financial burdens relating to cooling;</text></paragraph><paragraph id="id63a4f89f80af417c862aa1aa358356a4"><enum>(5)</enum><text>the effects of historical discriminatory policies, such as redlining, continue to have effects on urban environments;</text></paragraph><paragraph id="idF1E33ABCF20D4FBA89442F86F8A981D9"><enum>(6)</enum><text>a recent analysis shows that—</text><subparagraph id="idC2BF41C7FD544E349932B5C0ECCB4DB0"><enum>(A)</enum><text>urbanized neighborhoods with mostly people of color have 33 percent less tree canopy on average than majority white neighborhoods; and</text></subparagraph><subparagraph id="id05D33F724285490596173454C7ED2C0B"><enum>(B)</enum><text>low-income neighborhoods have 41 percent less tree cover than neighborhoods with low rates of poverty;</text></subparagraph></paragraph><paragraph id="id165561B1C27E44AEB1DD880CD1135433"><enum>(7)</enum><text>additional analyses of cities in the United States found that—</text><subparagraph id="id53BC5B0233984471AA0C0E58BAD1E99B"><enum>(A)</enum><text>communities primarily inhabited by United States-born, white populations contain more than twice the urban forest canopy cover of communities primarily inhabited by racial and ethnic minorities; and </text></subparagraph><subparagraph id="id4C0A9B6204E34201A5DBC4712533AAE0"><enum>(B)</enum><text>there were elevated land temperatures in formerly redlined areas compared to their nonredlined counterparts, by an average 2.6 degrees Celsius and up to 7 degrees Celsius; and</text></subparagraph></paragraph><paragraph id="id67a98887464f4367804d371cd0ba6394"><enum>(8)</enum><text>to reduce disparities in the enjoyment of the social, environmental, and economic benefits of healthy and well-maintained urban forests and manage risks relating to heat exposure and other urban stressors, the Federal Government should accelerate actions to enhance the health and resilience of urban forests, with investment in priority communities. </text></paragraph></section><section id="idA8C235B99D1B40B9B3B99B0A7C55E411"><enum>3.</enum><header>Neighborhood Tree Fund</header><text display-inline="no-display-inline">Section 9 of the Cooperative Forestry Assistance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/16/2105">16 U.S.C. 2105</external-xref>) is amended—</text><paragraph id="id70C15B60991846C98F022B099F8777F0"><enum>(1)</enum><text>by redesignating subsections (h) and (i) as subsections (i) and (j), respectively; and</text></paragraph><paragraph id="id2E777D67A710408887469E38DB96A243"><enum>(2)</enum><text>by inserting after subsection (g) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id989B852896404976930D43D712D4CFFC"><subsection id="idD3DAB826732543419787B07946250A6E"><enum>(h)</enum><header>Neighborhood Tree Fund</header><paragraph id="id7120C4227C4547C691F028188679612E"><enum>(1)</enum><header>In general</header><text>Consistent with the purposes described in subsection (b), the Secretary shall establish the Neighborhood Tree Fund (referred to in this subsection as the <term>Fund</term>).</text></paragraph><paragraph id="id6FEF1733E686441C84F1B982F883ABD2"><enum>(2)</enum><header>Assistance</header><text>The Secretary shall use amounts from the Fund to provide assistance to eligible entities described in paragraph (3) to increase and improve the overall health of the tree canopy in a community.</text></paragraph><paragraph id="id0B83D8F72B5E4C8EAB5B8805E558B17B"><enum>(3)</enum><header>Eligibility</header><text>An entity that is eligible to receive assistance under paragraph (2) is—</text><subparagraph id="id5E500F291C154A8BA00502D5DCB606AA"><enum>(A)</enum><text>a State;</text></subparagraph><subparagraph id="idC2CC126C61464E78ADB3AA27A5B44C9E"><enum>(B)</enum><text>an Indian Tribe; and</text></subparagraph><subparagraph id="id65283F13934F458C83C96659B26085DC"><enum>(C)</enum><text>a local unit of government, approved organization, or local community tree volunteer group described in subsection (b)(4).</text></subparagraph></paragraph><paragraph id="id1AC89F2005C7405A88EFF21C80C6CFE8"><enum>(4)</enum><header>Requirements</header><text>The Secretary, in consultation with the Secretary of Housing and Urban Development, shall establish requirements for the receipt of assistance under paragraph (2), including requirements with respect to—</text><subparagraph id="idF50C5435E7F548478233B1A4A20DB08E"><enum>(A)</enum><text>engagement with communities and stakeholders;</text></subparagraph><subparagraph id="id93266E38FD0445AA977657A49DC6BB77"><enum>(B)</enum><text>the conduct of a tree canopy assessment;</text></subparagraph><subparagraph id="idEFF6AB4CD1C1452AB26D1446805FD775"><enum>(C)</enum><text>the use of climate change science in the design of a project using the assistance;</text></subparagraph><subparagraph id="id77E220974C1946F9B5FEC2703EF009DB"><enum>(D)</enum><text>the conduct of site preparation and tree species selection; and</text></subparagraph><subparagraph id="id547EB5F4667F41E38DA0D1BAEA00C4AC"><enum>(E)</enum><text>the conduct of monitoring and maintenance to ensure the successful establishment of the tree canopy.</text></subparagraph></paragraph><paragraph id="id5D326A24C45343598256B6AC30491F68"><enum>(5)</enum><header>Priority</header><text>The Secretary shall give priority to the provision of assistance under paragraph (2) to eligible entities that propose projects that—</text><subparagraph id="id9E8B8F8B0B23422A9E3354D9262E9EBA"><enum>(A)</enum><text>include and prioritize tree planting and tree maintenance in—</text><clause id="id21EE4D27473B474E88D1214B58A28E9B" commented="no"><enum>(i)</enum><text>a census tract with a poverty rate of not less than 20 percent, as measured by the 5-year data series available from the American Community Survey of the Bureau of the Census for the period of 2014 through 2018, including such a census tract that includes an area that was designated as <quote>hazardous</quote> or <quote>definitely declining</quote> in maps drawn by the Home Owners’ Loan Corporation; or </text></clause><clause id="id3E83B7261E2F42C5B3A0731E424EB8C7"><enum>(ii)</enum><text>a community or neighborhood with lower tree canopy and higher maximum daytime summer temperatures compared to surrounding communities or neighborhoods, as determined by the Secretary, based on publicly available information; or</text></clause></subparagraph><subparagraph id="id0874503D4B874941A6B462B1264977F9"><enum>(B)</enum><text>optimize outcomes for climate mitigation and resilience for the purpose of public health, as determined by the Secretary.</text></subparagraph></paragraph><paragraph id="idC18445635180400DB55DFEFB8B63D70F"><enum>(6)</enum><header>Limitations on use of amounts for community tree assessments</header><text>Not more than 10 percent of the amount made available under paragraph (7) for a fiscal year may be used for the development of community tree assessments.</text></paragraph><paragraph id="id6CBF23EAC4E84EB8BE5C7C3F811D1D5C"><enum>(7)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated for deposit into the Fund, for use by the Secretary to carry out this subsection, not less than—</text><subparagraph id="idAECEEB8F791C4D8281D26797A406E146"><enum>(A)</enum><text>$100,000,000 for fiscal year 2023;</text></subparagraph><subparagraph id="idE8F8B3A145F14AFD88F5620F819F1C2E"><enum>(B)</enum><text>$200,000,000 for fiscal year 2024;</text></subparagraph><subparagraph id="id0FB9D0A37EC44345A27F4CE7D5A99D7E"><enum>(C)</enum><text>$400,000,000 for fiscal year 2025;</text></subparagraph><subparagraph id="id55039BA0F1044F879DCB680A3FC89396"><enum>(D)</enum><text>$600,000,000 for fiscal year 2026; and</text></subparagraph><subparagraph id="id81A2DF3B3E4F479D8D2F4CED0A7A76CA"><enum>(E)</enum><text>$700,000,000 for fiscal year 2027.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="id582E8F16132F4749842C65943267EDFC"><enum>4.</enum><header>National Urban and Community Forestry Advisory Council composition</header><text display-inline="no-display-inline">Section 9(g)(2)(A) of the Cooperative Forestry Assistance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/16/2105">16 U.S.C. 2105(g)(2)(A)</external-xref>) is amended—</text><paragraph id="idC1210C23BB0B44DB8EE1F606CEEBBD8E"><enum>(1)</enum><text>in the matter preceding clause (i), by striking <quote>15</quote> and inserting <quote>16</quote>;</text></paragraph><paragraph id="idEBDBA75AACE0409CBA802F3BE1769EE3"><enum>(2)</enum><text>in each of clauses (i) through (viii), by striking the comma at the end and inserting a period;</text></paragraph><paragraph id="id5E40F288AD2D4C958F91285909634B0A"><enum>(3)</enum><text>in clause (ix), by striking <quote>, and</quote> at the end and inserting a period; and</text></paragraph><paragraph id="id4565FFEE44B2434A83155BBDED457EF3"><enum>(4)</enum><text display-inline="yes-display-inline">by striking clause (x) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id19B2476A5BCE43F98DC86C31099E22C7"><clause commented="no" display-inline="no-display-inline" id="IDC26E156F0EC54C538592142FE010F49D"><enum>(x)</enum><text display-inline="yes-display-inline">3 members who are not officers or employees of any governmental body and who have expertise and have been active in urban and community forestry, of whom—</text><subclause commented="no" display-inline="no-display-inline" id="idAD3F82BBD7354146BE62F16326FD7051"><enum>(I)</enum><text display-inline="yes-display-inline">1 is a resident of a community with a population of less than 50,000 as of the most recent census; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id671669DC93B8491088FA9587685DE2EA"><enum>(II)</enum><text display-inline="yes-display-inline">1 is a resident of a low-income community, as determined by the Secretary.</text></subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
