which was read twice and referred to the <committee-name committee-id="SSFR00">Committee on Foreign Relations</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require the Secretary of State to submit annual reports to Congress on the assistance provided to Somaliland and to conduct a feasibility study, in coordination with the Secretary of Defense, on establishing a security partnership with Somaliland, without recognizing Somaliland as an independent state.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Somaliland Partnership Act</short-title></quote>.</text></section><section id="idb5444781d2ff471dad8340864859e624"><enum>2.</enum><header>Sense of Congress</header><text display-inline="no-display-inline">It is the sense of Congress that—</text><paragraph id="id60a34261d6304730b3af18bbb3ced77d"><enum>(1)</enum><text>a stronger relationship between the United States and Somaliland would provide numerous, mutually beneficial, strategic opportunities due to Somaliland’s—</text><subparagraph id="idD7318308740749EFBB65AE3B7F1254EA"><enum>(A)</enum><text>geographic location in the Horn of Africa and next to the Gulf of Aden; </text></subparagraph><subparagraph id="idE92AE39B00314453AE3D667C88674B5A"><enum>(B)</enum><text>democratic credentials, including peaceful transfers of power following elections; and </text></subparagraph><subparagraph id="id124D7409FA554EC18E3591D326EA964E"><enum>(C)</enum><text>relative stability in the Horn of Africa;</text></subparagraph></paragraph><paragraph id="ida35571b8f91e49da8671f4edc322681c"><enum>(2)</enum><text>Somaliland’s security situation, level of development, and other challenges differ significantly from the situation in Mogadishu and other regions of Somalia, which necessitates—</text><subparagraph id="id3E5F4136F096495D98E85F72FBD9A83D"><enum>(A)</enum><text>a different approach to engagement, assistance, and travel by personnel of the Department of State and the United States Agency for International Development; and</text></subparagraph><subparagraph id="id5B5D0752D4394B02BA30B4631DD519A1"><enum>(B)</enum><text>the avoidance of a <quote>one-size-fits-all</quote> policy approach to Somalia; and</text></subparagraph></paragraph><paragraph id="id85FE47F9669A4C0B8F3E8DAF3EE20E28"><enum>(3)</enum><text>the status of Somaliland should not serve as an obstacle for deeper and meaningful cooperation that will serve the mutual interests of our two governments.</text></paragraph></section><section id="id93c2b7c6083b4f2d870a5cbd420dc384"><enum>3.</enum><header>Defined term</header><text display-inline="no-display-inline">In this Act, the term <term>Somaliland</term> means the territory that—</text><paragraph id="idC4559CC7D8BA46448E39A5AB726233E0"><enum>(1)</enum><text>received its independence from the United Kingdom on June 26, 1960, before the creation of the Somali Republic;</text></paragraph><paragraph id="id79955E1EFEEF410A9C6FB5081BC0F8A9"><enum>(2)</enum><text>has been a self-declared independent and sovereign state since 1991 that is not internationally recognized; and</text></paragraph><paragraph id="id8B4BA77BCAAA4673B7740AF2ECFFD092"><enum>(3)</enum><text>exists as a semi-autonomous region of the Federal Republic of Somalia. </text></paragraph></section><section id="idc336652eb84e43c4b5d15648d2da3361"><enum>4.</enum><header>Report on foreign assistance and other activities in Somaliland</header><subsection id="id3e12b29965b646f5975379c5a89f9742"><enum>(a)</enum><header>Defined term</header><text>In this section, the term <term>appropriate congressional committees</term> means—</text><paragraph id="id116cbc37aec244bf8498f0534cf236e1"><enum>(1)</enum><text>the <committee-name committee-id="SSFR00">Committee on Foreign Relations of the Senate</committee-name>; and</text></paragraph><paragraph id="id8d90c2d6ab0d436a8a89d4fb480fe268" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text>the <committee-name committee-id="">Committee on Foreign Affairs of the House of Representatives</committee-name>. </text></paragraph></subsection><subsection id="idD9A037206F8B462B800BF1F442E586FE"><enum>(b)</enum><header>Report</header><paragraph id="id85B2597988D248CA829AA82293D830DC"><enum>(1)</enum><header>In general</header><text>Not later than September 30, 2022, and annually thereafter until the date that is 5 years after the date of the enactment of this Act, the Secretary of State, in consultation with the Administrator of the United States Agency for International Development, shall submit a report to the appropriate congressional committees that, with respect to the most recently concluded 12-month period—</text><subparagraph id="ida0e23e99ac7a4a0a8335b60447834fb3"><enum>(A)</enum><text>describes United States foreign assistance to Somaliland, including—</text><clause id="idB66A6995F2994379A205BC547A46A564"><enum>(i)</enum><text>the value of such assistance (in United States dollars);</text></clause><clause id="id0B3AC3DA615D47FCB888EDB7466E4ADB"><enum>(ii)</enum><text>the source from which such assistance was funded;</text></clause><clause id="idCAC6ACACEEDD437999B57FD57CED969A"><enum>(iii)</enum><text>the names of the programs through which such assistance was administered;</text></clause><clause id="idFEBEC107CEC74DAC9EABBEA1CEB81C25"><enum>(iv)</enum><text>the implementing partners through which such assistance was provided; </text></clause><clause id="id57456BEBB7394E7B92A7549153B2E4B7"><enum>(v)</enum><text>the sponsoring bureau of the United States Government; and</text></clause><clause id="idBD193EE60F5F45AF8A7D89F255CA1373"><enum>(vi)</enum><text>if the assistance broadly targeted the Federal Republic of Somalia, the portion of such assistance that was—</text><subclause id="id6C292F62D68F4E6DA84133219BEA5336"><enum>(I)</enum><text>explicitly intended to support Somaliland; and</text></subclause><subclause id="id479E3EDA9C534B17AAAB566BFCBC887A"><enum>(II)</enum><text>ultimately employed in Somaliland;</text></subclause></clause></subparagraph><subparagraph id="id6b4a92ab32c1437fb861b3e5ceaf6b8f"><enum>(B)</enum><text>details the staffing and responsibilities of the Department of State and the United States Agency for International Development supporting foreign assistance, diplomatic relations, consular services, and security initiatives in Somaliland, including the location of such personnel (duty station) and their corresponding bureau;</text></subparagraph><subparagraph id="id25b002d2538c4c68a17dd912f3616b4e"><enum>(C)</enum><text>provides—</text><clause id="idACC5644859514BBEB530E5ABE04DC85E"><enum>(i)</enum><text>a detailed account of travel to Somaliland by employees of the Department of State and the United States Agency for International Development, if any, including the position, duty station, and trip purpose for each such trip; or</text></clause><clause id="id9FFA9FCCFA58444DA7A60AB4DACD84CC"><enum>(ii)</enum><text>the justification for not traveling to Somaliland if no such personnel traveled during the reporting period;</text></clause></subparagraph><subparagraph id="id2f6cda07fa8e4816ae194d7134fc0873"><enum>(D)</enum><text>describes consular services provided by the Department of State for the residents of Somaliland;</text></subparagraph><subparagraph id="idb105d3fb8a35480dbb8aa599768b8b4b"><enum>(E)</enum><text>discusses the Department of State’s Travel Advisory for Somalia related to the region of Somaliland; and</text></subparagraph><subparagraph id="id70C6D6216A91486CA2F3B27216E94200"><enum>(F)</enum><text>if the Travel Advisory for all or part of Somaliland is identical to the Travel Advisory for other regions of Somalia, justifies such ranking based on a security assessment of the region of Somaliland.</text></subparagraph></paragraph><paragraph id="id52a23d1d4bfc4fd2b52ff6c8c608d1ef"><enum>(2)</enum><header>Form</header><text>The report required under paragraph (1) shall be submitted in unclassified form, but may contain a classified annex.</text></paragraph></subsection></section><section id="id27c5ee7aed22407aabbc459d4124800f"><enum>5.</enum><header>Feasibility study on improved diplomatic relations and a security and defense partnership with Somaliland</header><subsection id="id4331cc394f1e4cf68f5741af5a8fba52"><enum>(a)</enum><header>Defined term</header><text>In this section, the term <term>appropriate congressional committees</term> means—</text><paragraph id="idE19A6B5C3C3C455299F0AB8969352A04"><enum>(1)</enum><text>the <committee-name committee-id="SSFR00">Committee on Foreign Relations of the Senate</committee-name>;</text></paragraph><paragraph id="id3EED52EE83AF40A9A4337790923E3E5A"><enum>(2)</enum><text>the <committee-name committee-id="SSAS00">Committee on Armed Services of the Senate</committee-name>;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id19CAFB47BDCF4078BAC0F1B41CA709E4"><enum>(3)</enum><text>the <committee-name committee-id="">Committee on Foreign Affairs of the House of Representatives</committee-name>; and</text></paragraph><paragraph id="idF54B0D49F555473BB2D56EE669619FE1" commented="no" display-inline="no-display-inline"><enum>(4)</enum><text>the <committee-name committee-id="">Committee on Armed Services of the House of Representatives</committee-name>.</text></paragraph></subsection><subsection id="idd973502d1b4a4f989196519d40ab7817"><enum>(b)</enum><header>Feasibility study</header><text>The Secretary of State, in coordination with the Secretary of Defense, shall conduct a feasibility study regarding the establishment of a partnership between the United States and Somaliland that—</text><paragraph id="idece459f706d44f7889af3ea6a3bdb605"><enum>(1)</enum><text>includes coordination with Somaliland government security organs, including Somaliland’s Ministry of Foreign Affairs and Ministry of Defense;</text></paragraph><paragraph id="id9ce5735a6d9f48c9b180f013a991dca1"><enum>(2)</enum><text>determines opportunities for collaboration in the pursuit of United States national security interests in the Horn of Africa, the Gulf of Aden, and the broader Indo-Pacific region;</text></paragraph><paragraph id="id26027c8f2c3d4f8689498929bb55f676"><enum>(3)</enum><text>identifies opportunities for United States training of Somaliland security sector actors to improve their professionalization and capacity; and</text></paragraph><paragraph id="id02022349dcc44dc79beefaa52f5b6535"><enum>(4)</enum><text>assesses the prospect of establishing a nonprofit corporation, to be known as the <quote>American Institute of Somaliland</quote>, for the purpose of conducting and carrying out programs, transactions, and other relations with Somaliland in the City of Hargeisa on behalf of the United States Government.</text></paragraph></subsection><subsection id="id09e384e541b140ad820285ed1b1eae98"><enum>(c)</enum><header>Report to Congress</header><text>Not later than 180 days after the date of the enactment of this Act, the Secretary of State, in coordination with the Secretary of Defense and the heads of other relevant Federal departments and agencies, shall submit a classified report to the appropriate congressional committees that contains the results of the feasibility study required under subsection (b), including an assessment of the extent to which—</text><paragraph id="idc850d6f2ad4c4f68bdb1b1a2b5005070"><enum>(1)</enum><text>opportunities exist for the United States to support the training of Somaliland’s security sector actors with a specific focus on counterterrorism and border and maritime security;</text></paragraph><paragraph id="idf7799aeb5adb40efac4cae8a74a1b4fa"><enum>(2)</enum><text>Somaliland’s security forces were implicated, if any, in gross violations of human rights during the 3-year period immediately preceding the date of the enactment of this Act;</text></paragraph><paragraph id="id6c4c3de3a216462f9054c366276b72dc"><enum>(3)</enum><text>the United States has provided or discussed with government and military officials of Somaliland the provision of training to security forces, including—</text><subparagraph id="id0d81b0262e3a4c7381d3b1c04fbfe6da"><enum>(A)</enum><text>where such training has occurred;</text></subparagraph><subparagraph id="idfb5c5501dc4249849b57652fa8b158ed"><enum>(B)</enum><text>the extent to which Somaliland security forces have demonstrated the ability to absorb previous training; and</text></subparagraph><subparagraph id="id57789cb444e343099c9b94a617a7d815"><enum>(C)</enum><text>the ability of Somaliland security forces to maintain and appropriately utilize such training, as applicable;</text></subparagraph></paragraph><paragraph id="id2e54e4835d6344dc91ddf75b646f8833"><enum>(4)</enum><text>a United States security and defense partnership with Somaliland would have a strategic impact, including by protecting the United States and allied maritime interests in the Bab-el-Mandeb Strait and at Somaliland’s Port of Berbera;</text></paragraph><paragraph id="ide5e5163695754d7fb433af82de1228bb"><enum>(5)</enum><text>Somaliland could—</text><subparagraph id="id33018a6257cb43c0a15e495bc5934f51"><enum>(A)</enum><text>serve as a maritime gateway in East Africa for the United States and its allies; and</text></subparagraph><subparagraph id="id049a1b164dab45aaa47adf1c4b455ab8"><enum>(B)</enum><text>counter Iran’s presence in the Gulf of Aden and China’s growing regional military presence;</text></subparagraph></paragraph><paragraph id="id6876f0fc66724c79b39980178c6a5989"><enum>(6)</enum><text>a United States security and defense partnership would—</text><subparagraph id="idafd66c61bd0a4f829182dbb229235cd4"><enum>(A)</enum><text>bolster security and defense cooperation and capabilities between Somaliland and Taiwan;</text></subparagraph><subparagraph id="id8ab32740bfac4c1fa4217754af5dea58"><enum>(B)</enum><text>stabilize this semi-autonomous region of Somalia further as a democratic counterweight to anti-democratic forces in the greater Horn of Africa region; and</text></subparagraph><subparagraph id="id11a3b1e1074648dc87467cb7e8e7d762"><enum>(C)</enum><text>impact the capacity of the United States to achieve policy objectives in Somalia, particularly to degrade and ultimately defeat the terrorist threat posed by Al-Shabaab, the Islamic State in Somalia (the Somalia-based Islamic State affiliate), and other terrorist groups operating in Somalia;</text></subparagraph></paragraph><paragraph id="id236ff1e1ea7a4bd0888ecfa081a9cf11"><enum>(7)</enum><text>the extent to which an improved diplomatic relationship with Somaliland could—</text><subparagraph id="idc394c77aa44841a3a68f61554642d56b"><enum>(A)</enum><text>support United States policy focused on the Red Sea corridor, the Indo-Pacific region, and the Horn of Africa;</text></subparagraph><subparagraph id="idde09731e516a4123ade7145477c448e9"><enum>(B)</enum><text>improve cooperation on counterterrorism and intelligence sharing;</text></subparagraph><subparagraph id="idec730c8c48594f01bd91d2fa63814863"><enum>(C)</enum><text>enable cooperation on counter-trafficking, including the trafficking of humans, wildlife, weapons, and illicit goods; and</text></subparagraph><subparagraph id="idda81b864d1d14798934184388d169df5"><enum>(D)</enum><text>support trade and development, including how Somaliland could benefit from Prosper Africa and other regional trade initiatives.</text></subparagraph></paragraph></subsection><subsection id="idbedccb4891c14ce4b2f09ed84240eef8"><enum>(d)</enum><header>Form</header><text>The report required under subsection (c) shall be submitted in unclassified form, but may contain a classified annex.</text></subsection></section><section id="id9bb3faf44bab4b9f94071f0764e19a16"><enum>6.</enum><header>Rule of construction</header><text display-inline="no-display-inline">Nothing in this Act, including the reporting requirement under section 4 and the conduct of the feasibility study under section 5, may be construed to convey United States recognition of Somaliland as an independent state.</text></section></legis-body></bill>
