which was read twice and referred to the <committee-name committee-id="SSFR00">Committee on Foreign Relations</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To provide security assistance for Ukraine, and for other purposes.</official-title></form><legis-body><section id="id5d2aa4c98af34f4cb6a3d276ac9d700c" section-type="section-one"><enum>1.</enum><header>Security assistance for Ukraine</header><subsection id="idd211b6e5fa134e02a293af87792cf64a"><enum>(a)</enum><header>Authority</header><paragraph id="idF1490E7A99014032818137CB56766C61"><enum>(1)</enum><header>In general</header><text>Subject to subsections (b) and (c), the Secretary of Defense, in consultation with the Secretary of State, may, as necessary to assist Ukraine or a member country of the North Atlantic Treaty Organization in the defense of its territorial integrity—</text><subparagraph id="id1300DB2D1F3C4FC9AA62AA563DEAB229"><enum>(A)</enum><text>transfer to the military and security forces of Ukraine, or of a member country of the North Atlantic Treaty Organization, defense articles, defense services, equipment, and other defense support capabilities that have been authorized, procured, and contracted by, and are available to, the Department of Defense; and </text></subparagraph><subparagraph id="idFDF5451A6EF34A1AABB7560B4EAB8B50"><enum>(B)</enum><text>provide other security assistance to the military and security forces of Ukraine or of a member country of the North Atlantic Treaty Organization. </text></subparagraph></paragraph><paragraph id="idE53623E3DA9C4357BC4D0351AE5B8470"><enum>(2)</enum><header>Defense support capabilities</header><text>The defense support capabilities referred to in paragraph (1) include the following:</text><subparagraph id="idd7fac4adef6648199a7e752e78ccf3eb"><enum>(A)</enum><text>Defensive lethal assistance, including military aircraft, vehicles, weapons, and ammunition.</text></subparagraph><subparagraph id="id9ae853e47f394bbb911736e9e72f989f"><enum>(B)</enum><text>Intelligence, operational, logistical, planning, communications, and other sustainment capabilities.</text></subparagraph></paragraph></subsection><subsection id="ide1845cf717884e4db1aa26203a8a93f7"><enum>(b)</enum><header>Limitations</header><paragraph id="id60fb1ecedb3c49db9f8283e330beee89"><enum>(1)</enum><header>Determination</header><text>The Secretary of Defense may only make a transfer or provide assistance under subsection (a) if the Secretary determines that making such a transfer or providing such assistance will not negatively impact the military preparedness of the United States.</text></paragraph><paragraph id="id6BF16AB444A342709199AACD7AA0B48B"><enum>(2)</enum><header>Certain withdrawals</header><text>The transfer authority under subsection (a) shall be limited to capabilities considered readily available by the logistics community of interest of the Department of Defense, including capabilities referred to in that subsection that are stored and maintained by the Aerospace Maintenance and Recovery Group.</text></paragraph></subsection><subsection id="ida94d8cf557bb425ba9db4a027319b025"><enum>(c)</enum><header>Notice to Congress</header><paragraph id="idD1898AF87A78422A9E9913C580FD0B72"><enum>(1)</enum><header>In general</header><text>Not later than 15 days before making a transfer or providing assistance under subsection (a), the Secretary of Defense shall submit to the appropriate committees of Congress a notification containing the following:</text><subparagraph id="id4e7ea6e46929458b9e55941b0e363012"><enum>(A)</enum><text>A detailed description of the transfer to be made or the assistance to be provided, including—</text><clause id="ide505b9967b0741af80fbc75a8d70b530"><enum>(i)</enum><text>the budget for such transfer or assistance; and</text></clause><clause id="idf5f3cf3eaf8c4abca2a736f5edf3dc09"><enum>(ii)</enum><text>the expected or estimated timeline for delivery of such transfer or assistance.</text></clause></subparagraph><subparagraph id="id60139aab246e40718e2b1cb231d136b1"><enum>(B)</enum><text>Such other matters as the Secretary of Defense considers appropriate.</text></subparagraph></paragraph><paragraph id="id2E36FE9DD5E3451290A59510D4A859C2"><enum>(2)</enum><header>Exemption</header><text>Notwithstanding paragraph (1), if the Secretary of Defense determines that a transfer under subsection (a) is necessary to counter an existential threat to the sovereignty of Ukraine or a member country of the North Atlantic Treaty Organization, the Secretary may submit notice of such transfer to the appropriate committees of Congress not later than 15 days after the date on which the transfer is made. </text></paragraph><paragraph id="id8DAC619EBB7C45DA8CBE714312E9023F"><enum>(3)</enum><header>Appropriate committees of Congress</header><text>In this subsection, the term <term>appropriate committees of Congress</term> means—</text><subparagraph id="id75C8686F3E1F427C8B09A0A0E1C4AFBE"><enum>(A)</enum><text>the Committee on Armed Services, the Committee on Appropriations, and the Committee on Foreign Relations of the Senate; and </text></subparagraph><subparagraph id="id96E4EE4731E8464ABC5F990252380EE2" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text>the Committee on Armed Services, the Committee on Appropriations, and the Committee on Foreign Affairs of the House of Representatives. </text></subparagraph></paragraph></subsection><subsection id="id6d8c6b916cba4c2388285c1958cbd7e5"><enum>(d)</enum><header>Termination</header><text>The authority in subsection (a) shall terminate on December 31, 2022. </text></subsection></section></legis-body></bill>
