which was read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require the Secretary of Commerce to establish the Manufacturing Communities Support Program, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H8A5CA4A5B1D44DF79B54741BC97AED31"><section section-type="section-one" id="HA9B27E66BC774A3AB75E97EA3ECB01A6"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Made in America Manufacturing Communities Act of 2022</short-title></quote>.</text></section><section id="H1AD33CA1875B4041B93EA1DAA62A1E09"><enum>2.</enum><header>Manufacturing communities</header><subsection id="HE5FF7FFEBA5440AB83BB0A97CB9FA3AE"><enum>(a)</enum><header>Definitions</header><paragraph id="H9D5CCEF8A31A41BDAC3916DFE2910239"><enum>(1)</enum><header>Eligible consortium</header><text display-inline="yes-display-inline">The term <quote>eligible consortium</quote> means a consortium that meets the eligibility criteria established by the Secretary under subsection (c)(2)(A).</text></paragraph><paragraph id="HF84CB9D937B045879C35082EFBDB7D04"><enum>(2)</enum><header>Manufacturing community</header><text display-inline="yes-display-inline">The term <quote>manufacturing community</quote> means an eligible consortium designated by the Secretary under subsection (c)(1).</text></paragraph><paragraph id="H2977D7531151408BA8C871C8185F2BD2"><enum>(3)</enum><header>Nonprofit organization</header><text display-inline="yes-display-inline">The term <quote>nonprofit organization</quote> means an organization exempt from taxation and described in paragraph (3), (5), or (6) of <external-xref legal-doc="usc" parsable-cite="usc/26/501">section 501(c)</external-xref> of the Internal Revenue Code of 1986.</text></paragraph><paragraph id="HBC51F434746A408E9610D4017059D0C7"><enum>(4)</enum><header>Program</header><text display-inline="yes-display-inline">The term <quote>Program</quote> means the Manufacturing Communities Support Program established under subsection (b)(1).</text></paragraph><paragraph id="H8184D9B7A91D47DD952CB9FA1ED64462"><enum>(5)</enum><header>Secretary</header><text display-inline="yes-display-inline">The term <quote>Secretary</quote> means the Secretary of Commerce.</text></paragraph><paragraph id="HB9AAC3C62F3D4AAAAC0C3B1F6FA877B7"><enum>(6)</enum><header>Small business concern</header><text display-inline="yes-display-inline">The term <quote>small business concern</quote> means the term as defined under section 3 of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/632">15 U.S.C. 632</external-xref>). </text></paragraph></subsection><subsection id="H2D0BCEC344F44ADC8915BFFF1CA5EB9F"><enum>(b)</enum><header>Program authorized</header><paragraph id="HEE6AA85B3D164753B89ABCCB313E6EA5"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall establish a program to be known as the <quote>Manufacturing Communities Support Program</quote>, under which the Secretary shall designate and support eligible consortiums as manufacturing communities.</text></paragraph><paragraph id="H432540BBD9144DA2AAEB43DA5B3525FB"><enum>(2)</enum><header>Purpose</header><text display-inline="yes-display-inline">The purpose of the Program shall be to strengthen the manufacturing base of the United States by making long-term investments in manufacturing communities by supporting—</text><subparagraph id="HD6F758621DA34D34AB214E83B67D48FE"><enum>(A)</enum><text>critical skills;</text></subparagraph><subparagraph id="H1D954D12751948648533FC514A3E1824"><enum>(B)</enum><text>facilities;</text></subparagraph><subparagraph id="H903AB1E12D3D4BC08C5541713E7FF198"><enum>(C)</enum><text>research and development; and</text></subparagraph><subparagraph id="HE6EC0C16BB1846178A4706D98FEE89F1"><enum>(D)</enum><text display-inline="yes-display-inline">small business concerns.</text></subparagraph></paragraph></subsection><subsection id="HD2EA3ACB3DE04EBA9F7E3760D32135F0"><enum>(c)</enum><header>Designation of manufacturing communities</header><paragraph id="H4FA8C543BB264A87862A85CDBAAA99CA"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall designate an eligible consortium as a manufacturing community through a competitive process.</text></paragraph><paragraph id="H0744EAAB741B4983BFA127F92C0330AE"><enum>(2)</enum><header>Eligible consortiums</header><subparagraph id="HFFC324733CD74419A8F41A1898393453"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall establish criteria for a consortium to be eligible for a designation as a manufacturing community under paragraph (1).</text></subparagraph><subparagraph id="HB40B41EBB30B4536AD1979B54BF2B6A8"><enum>(B)</enum><header>Considerations</header><text display-inline="yes-display-inline">In developing eligibility criteria under subparagraph (A), the Secretary shall consider the merits of—</text><clause id="HCC545EC0BE404745A1AEF6A5DBAE4E82"><enum>(i)</enum><text display-inline="yes-display-inline">including members from academia, commercial industry, nonprofit organizations, and State and local governmental organizations;</text></clause><clause id="H130EEC8945C048DDB22233D023AD51A2"><enum>(ii)</enum><text display-inline="yes-display-inline">supporting efforts in geographical regions that have capabilities in key technologies or manufacturing base supply chains that the Secretary determines to be critical to codifying the supply chains of the United States; and</text></clause><clause id="H5C4DF28550B64D05BFB0BC390B177743"><enum>(iii)</enum><text display-inline="yes-display-inline">the optimal composition and size of a consortium to promote effectiveness, collaboration, and efficiency.</text></clause></subparagraph></paragraph><paragraph id="HC48ED91B4CB9457F821970E8B70F5D27"><enum>(3)</enum><header>Duration</header><text>Each designation under paragraph (1) shall be for a 5-year period.</text></paragraph><paragraph id="H01B6BD4ADE694D8EBCE17B189321E432"><enum>(4)</enum><header>Renewal</header><subparagraph id="HDE8F45C44D774F05ABF44A88FC43D021"><enum>(A)</enum><header>In general</header><text>The Secretary may renew a designation made under paragraph (1) for not more than 2 additional 2-year periods. </text></subparagraph><subparagraph id="H3DAA20B7097F4942AB001C6758974308"><enum>(B)</enum><header>Criteria for renewal</header><clause id="H40914DA1B35E4FF499FB6BDA3380AB3C"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall establish criteria for the renewal of a designation under subparagraph (A).</text></clause><clause id="HC646BE623ECF4F39A6C450EBD3FC687B"><enum>(ii)</enum><header>Considerations</header><text display-inline="yes-display-inline">In establishing criteria for a renewal under clause (i) the Secretary shall consider, with respect to the manufacturing community seeking a renewal—</text><subclause id="H611E574CE95F4183888DC4DEB17AB760"><enum>(I)</enum><text display-inline="yes-display-inline">the performance of the manufacturing community in meeting the established goals of the Program;</text></subclause><subclause id="H881EEAD6C9EC4A968E43466DB94ACCC9"><enum>(II)</enum><text display-inline="yes-display-inline">the progress the manufacturing community has made with respect to project-specific metrics, particularly with respect to metrics designed to help manufacturing communities track their own progress;</text></subclause><subclause id="HD9CD1E411C5D4AF6A5CDEA8D02A75AA2"><enum>(III)</enum><text display-inline="yes-display-inline">whether any changes to the composition of the manufacturing community or revisions of the plan of the manufacturing community would improve the capabilities of the manufacturing base of the United States; and</text></subclause><subclause id="H50FC3628E22E47EB8892691F7703EECA"><enum>(IV)</enum><text>any other criteria the Secretary determines appropriate.</text></subclause></clause></subparagraph></paragraph><paragraph id="H455DE40F9ADB4A3FB046F4AB142C5506"><enum>(5)</enum><header>Application for designation</header><subparagraph id="H532C6D4754894F65A0E55B4643E680B2"><enum>(A)</enum><header>In general</header><text>An eligible consortium seeking a designation under paragraph (1) shall submit an application to the Secretary at such time and in such manner as the Secretary may require.</text></subparagraph><subparagraph id="H1AB4DB3F6450478E81C9AC5DC59FEBDB"><enum>(B)</enum><header>Considerations</header><text display-inline="yes-display-inline">In developing application procedures under subparagraph (A), the Secretary shall consider the inclusion of, with respect to an eligible consortium—</text><clause id="HFCE50927188644D7A166B35EE535FC2D"><enum>(i)</enum><text display-inline="yes-display-inline">a description of the regional boundaries of the eligible consortium and the manufacturing capacity of the region;</text></clause><clause id="H2C7214B9384244B0849E72A25953A631"><enum>(ii)</enum><text display-inline="yes-display-inline">an evidence-based plan for enhancing the manufacturing base in the United States through the efforts of the eligible consortium;</text></clause><clause id="H2977979A7F15476586891A19C7F0A6CE"><enum>(iii)</enum><text display-inline="yes-display-inline">the investments the eligible consortium proposes and the strategy of the eligible consortium to address gaps in the manufacturing base of the United States; </text></clause><clause id="H8AFD5DD0A66B4335B3C189CE6AFF00FC"><enum>(iv)</enum><text display-inline="yes-display-inline">a description of the outcome-based metrics, benchmarks, and milestones that will track and the evaluation methods that will be used to gauge performance of the eligible consortium;</text></clause><clause id="H1CF2543690F04ABE85388D2C2982F151"><enum>(v)</enum><text display-inline="yes-display-inline">a plan to ensure that members of the eligible consortium are representative of the proposed location of the manufacturing community;</text></clause><clause id="HA37D2CB989B34B4481689E7A48C66F89"><enum>(vi)</enum><text display-inline="yes-display-inline">a community that had previously received a designation by the Investing in Manufacturing Communities Partnership of the Economic Development Administration; and</text></clause><clause id="H513D159E4B0E4368BBC1C5BF219DA19F"><enum>(vii)</enum><text>any other matters the Secretary determines appropriate.</text></clause></subparagraph><subparagraph id="H39A960F9BC55482DA7AFF6BEBDEF1C83"><enum>(C)</enum><header>Strategic planning assistance</header><text display-inline="yes-display-inline">The Secretary shall provide strategic planning assistance for eligible consortiums that lack experience applying for Federal assistance to ensure such eligible consortiums may submit an application that meets the procedures established by the Secretary under this paragraph. </text></subparagraph></paragraph></subsection><subsection id="HF61ADEBDEA1144BBB80C827DA930A189"><enum>(d)</enum><header>Financial and technical assistance</header><paragraph id="H5C330208D8E549A898380796E3C4A0ED"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">As appropriate and for purposes of the Program, the Secretary may award financial or technical assistance to a member of an eligible consortium that has been designated as a manufacturing community.</text></paragraph><paragraph id="HB436FE819C774C0092C715BC57EC7302"><enum>(2)</enum><header>Use of funds</header><text display-inline="yes-display-inline">A recipient of financial or technical assistance under paragraph (1) shall use the financial or technical assistance to support an investment that will improve the manufacturing base of the United States.</text></paragraph><paragraph id="HA7956C2E007D4068BF3039BA88AB2EA6"><enum>(3)</enum><header>Investments supported</header><text>Investments supported under this subsection may include activities relating to—</text><subparagraph id="HB97BB074627E436795F6CA4D991BEC2D"><enum>(A)</enum><text>equipment or facility upgrades;</text></subparagraph><subparagraph id="HDE3D597C088E4CFBB700591BE368061A"><enum>(B)</enum><text>workforce training, retraining, or recruitment and retention, including for women, underrepresented minorities, and veterans;</text></subparagraph><subparagraph id="H9F40768433634B51A75D0688259828B0"><enum>(C)</enum><text>business incubators;</text></subparagraph><subparagraph id="H2812CF26BC8B48D39DE592E3682B349C"><enum>(D)</enum><text>advanced research and commercialization, including with Federal laboratories and depots;</text></subparagraph><subparagraph id="HD56069D1B90B47DB800D403D3FCD0B02"><enum>(E)</enum><text>supply chain development; and</text></subparagraph><subparagraph id="H9FD25DE29FD6405F9B3ED43F8F53371A"><enum>(F)</enum><text display-inline="yes-display-inline">assistance for small business concerns.</text></subparagraph></paragraph></subsection><subsection id="HCAED24AE1E984F7385E25CD92A1C9FE7"><enum>(e)</enum><header>Other Federal assistance</header><text display-inline="yes-display-inline">The Secretary may make a Federal point of contact available to each eligible consortium designated as a manufacturing community to help such consortium and the members of such consortium access Federal financial and technical assistance.</text></subsection><subsection id="H3F2BD00A45DD4FE9BFA4D75AA8AB1C44"><enum>(f)</enum><header>Receipt of transferred funds</header><text>The Secretary may accept amounts transferred to the Secretary from the head of an agency or a State or local governmental organization to carry out this section.</text></subsection><subsection id="HDF11FF8E95D44D06A132A151FFA16568"><enum>(g)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 6 years after the date of the enactment of this Act, the Secretary shall submit to the Congress, and make publicly available, a report that identifies the best practices for an eligible consortium—</text><paragraph id="HC6F18EF971A44B69A2C6DD9D31D8854C"><enum>(1)</enum><text>to be designated as a manufacturing community; and</text></paragraph><paragraph id="H486A813BB4E1472E8108B240B79135A7"><enum>(2)</enum><text>to renew the manufacturing community designation.</text></paragraph></subsection></section></legis-body></bill>
