<section id="id939811417EA6438C84C379F524BF1E59"><enum>2.</enum><header>Definition of Secretary</header><text display-inline="no-display-inline">In this Act, the term <term>Secretary</term> means the Secretary of the Army.</text></section> <section id="id3E96F97E2ED640A0A02F62F08C2827E4"><enum>3.</enum><header>Shoreline and riverbank protection and restoration mission</header> <subsection id="id493bb397be084887b3a313454f53fb5e"><enum>(a)</enum><header>Declaration of policy</header><text>Congress declares that—</text> 
<paragraph id="id9E4D95A9FAD34B55A2F062A1BD0B9E7F"><enum>(1)</enum><text>it is the policy of the United States to protect and restore the shorelines of the United States, which include each beach and shore of the Atlantic and Pacific Oceans, the Gulf of Mexico, the Great Lakes, and lakes, estuaries, and bays directly connected to those bodies of water, from the damaging impacts of climate change and other factors contributing to the vulnerability of coastal communities and ecosystems;</text></paragraph> <paragraph id="id8E8F979F49394001845C82C86D778627"><enum>(2)</enum><text>the protection and restoration of shores, and of the banks of rivers and streams, from erosion and other damaging forces exacerbated by climate change shall be restored to a primary mission of the Corps of Engineers in carrying out water resources development projects;</text></paragraph> 
<paragraph id="idF5A40FD7A22F434A8A12293068775520"><enum>(3)</enum><text>projects and measures for the protection and restoration of shores, and of the banks of rivers and streams, shall be formulated to increase the resilience of such shores, and of such banks, from the damaging impacts of climate change and other factors contributing to the vulnerability of coastal and riverine communities and ecosystems using measures described in section 1184(a) of the Water Resources Development Act of 2016 (<external-xref legal-doc="usc" parsable-cite="usc/33/2289a">33 U.S.C. 2289a(a)</external-xref>) to the maximum extent practicable; and</text></paragraph> <paragraph id="idF22A8090F12A4FEF905EBF21C13E8933"><enum>(4)</enum><text>periodic nourishment shall be provided, in accordance with subsection (c) of the first section of the Act of August 13, 1946 (60 Stat. 1056, chapter 960; <external-xref legal-doc="usc" parsable-cite="usc/33/426e">33 U.S.C. 426e(c)</external-xref>), and subject to section 156 of the Water Resources Development Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/42/1962d-5f">42 U.S.C. 1962d–5f</external-xref>), for projects and measures carried out for the purpose of restoring and increasing the resilience of ecosystems to the same extent as periodic nourishment is provided for projects and measures carried out for the purpose of coastal storm risk management. </text></paragraph></subsection> 
<subsection id="id5888574127254083908139E8F443443F"><enum>(b)</enum><header>Shoreline and riverine protection and restoration</header> 
<paragraph id="id771867A6E8DF4FA8A7463EEF6BCEB1FA"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Section 212 of the Water Resources Development Act of 1999 (<external-xref legal-doc="usc" parsable-cite="usc/33/2332">33 U.S.C. 2332</external-xref>) is amended—</text> <subparagraph id="idD2FB6A729DC74D58A7ED2E270ADAC396"><enum>(A)</enum><text>in the section heading, by striking <quote><header-in-text level="section" style="OLC">Flood mitigation and riverine restoration program</header-in-text></quote> and inserting <quote><header-in-text level="section" style="OLC">Shoreline and riverine protection and restoration</header-in-text></quote>;</text></subparagraph> 
<subparagraph id="idE3D3FC7310CA4C09B0509C7A9FC4D084"><enum>(B)</enum><text>in subsection (a)—</text> <clause id="id70E7F2FB1D634592B15482D5FB769BEB"><enum>(i)</enum><text>by striking <quote>undertake a program for the purpose of conducting</quote> and inserting <quote>carry out</quote>;</text></clause> 
<clause id="idD304A803C31A470697A102BB9732087C"><enum>(ii)</enum><text>by striking <quote>to reduce flood hazards</quote> and inserting <quote>to reduce erosion and flood and coastal storm hazards</quote>; and</text></clause> <clause id="idEA5E4FF3BB764975A4B0CBFE2A02F8F9"><enum>(iii)</enum><text>by inserting <quote>and shorelines</quote> after <quote>rivers</quote>;</text></clause></subparagraph> 
<subparagraph id="idF486B6BFD5CB47DABCFF7CD207E72BD9"><enum>(C)</enum><text>in subsection (b)—</text> <clause id="id7141894F913B45A0964AFCCEA33E56B7"><enum>(i)</enum><text>in paragraph (1)—</text> 
<subclause id="idE770B258EBD443ACBA69C4CDDC20E257"><enum>(I)</enum><text>by striking <quote>In carrying out the program, the</quote> and inserting <quote>The</quote>;</text></subclause> <subclause id="id425AE7D084C24054A28B230D107C6BF5"><enum>(II)</enum><text>by inserting <quote>and coastal storm</quote> after <quote>flood</quote>; and</text></subclause> 
<subclause id="idA43FB0AD9D7C4167BEEE74116C0516CF"><enum>(III)</enum><text>by inserting <quote>erosion mitigation,</quote> after <quote>reduction,</quote>;</text></subclause></clause> <clause id="id8743D054AD3147F883003E34E75C7AD5"><enum>(ii)</enum><text>in paragraph (3), by striking <quote>flood damages</quote> and inserting <quote>flood and coastal storm damages, including the use of measures described in section 1184(a) of the Water Resources Development Act of 2016 (<external-xref legal-doc="usc" parsable-cite="usc/33/2289a">33 U.S.C. 2289a(a)</external-xref>)</quote>; and</text></clause> 
<clause id="idF68FDD5B226C4F9A88E8B94FC9A03C93"><enum>(iii)</enum><text>in paragraph (4)—</text> <subclause id="id3A3BE8AF17E04B1B98EC70502361BC9F"><enum>(I)</enum><text>by inserting <quote>and coastal storm</quote> after <quote>flood</quote>;</text></subclause> 
<subclause id="idC8C69CCB00EF459A8416EB0F701D5726"><enum>(II)</enum><text>by inserting <quote>, shoreline,</quote> after <quote>riverine</quote>; and</text></subclause> <subclause id="id45B9548009704D5F9ED6BA60761F67AE"><enum>(III)</enum><text>by inserting <quote>and coastal barriers</quote> after <quote>floodplains</quote>;</text></subclause></clause></subparagraph> 
<subparagraph id="id2A69352217DA4BF08EFB4D172ADC4CC5"><enum>(D)</enum><text>in subsection (c)—</text> <clause id="idA955407015214E408859E17FF2E8B064"><enum>(i)</enum><text>by striking paragraph (1) and inserting the following:</text>

<paragraph id="id47BCAC1EBE1341488B57EAF7992F5868"><enum>(1)</enum><header>Studies</header><text>The non-Federal share of the cost of a study under this section shall be—</text> <subparagraph id="id02F4E6A7585A4DB38948322AB9FC62B6"><enum>(A)</enum><text>20 percent; and</text></subparagraph> 
<subparagraph id="id32A0ABB4F5A240BFA9654180E5EDA0B2"><enum>(B)</enum><text>10 percent, in the case of a study benefitting an economically disadvantaged community (as defined pursuant to section 160 of the Water Resources Development Act of 2020 (<external-xref legal-doc="usc" parsable-cite="usc/33/2201">33 U.S.C. 2201</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/116/260">Public Law 116–260</external-xref>)).</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause> <clause id="idAEF590EC662B4DB9AAF875B726F10023"><enum>(ii)</enum><text>in paragraph (2)—</text> 
<subclause id="id9C3EB66F3F0F4E769EC84CF28D97BBA3"><enum>(I)</enum><text>in the paragraph heading, by striking <quote><header-in-text level="paragraph" style="OLC">flood control</header-in-text></quote>; and</text></subclause> <subclause id="idA0C707FAAC69409ABA77170DE42FCB9A"><enum>(II)</enum><text>by striking subparagraph (A) and inserting the following:</text> 
<quoted-block style="OLC" display-inline="no-display-inline" id="id22C4A922773F42D48F6BCA2E299C5D01"> 
<subparagraph id="id0164D8CBDB0046ED944086012D930AFC"><enum>(A)</enum><header>In general</header><text>Design and construction of a nonstructural measure or project, a measure or project described in section 1184(a) of the Water Resources Development Act of 2016 (<external-xref legal-doc="usc" parsable-cite="usc/33/2289a">33 U.S.C. 2289a(a)</external-xref>), or for a measure or project for environmental restoration, shall be subject to cost sharing in accordance with section 103(b) of the Water Resources Development Act of 1986 (<external-xref legal-doc="usc" parsable-cite="usc/33/2213">33 U.S.C. 2213(b)</external-xref>). </text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subclause></clause> <clause id="id9154E2C058124343A77A1635477A1A30"><enum>(iii)</enum><text>in paragraph (3)—</text> 
<subclause id="id8124BCFE69C24681B426AA0EF8492279"><enum>(I)</enum><text>in the paragraph heading, by inserting <quote><header-in-text level="paragraph" style="OLC">or hurricane and storm damage reduction</header-in-text></quote> after <quote><header-in-text level="paragraph" style="OLC">flood control</header-in-text></quote>;</text></subclause> <subclause id="id25CD0F04117246788E455CDC3ACAB1D3"><enum>(II)</enum><text>by inserting <quote>or hurricane and storm damage reduction</quote> after <quote>flood control</quote>; and</text></subclause> 
<subclause id="id178F430BF93F4CEC80850143AA8598A1"><enum>(III)</enum><text>by striking <quote>section 103(a) of the Water Resources Development Act of 1986 (<external-xref legal-doc="usc" parsable-cite="usc/33/2213">33 U.S.C. 2213(a)</external-xref>)</quote> and inserting <quote>section 103 of the Water Resources Development Act of 1986 (<external-xref legal-doc="usc" parsable-cite="usc/33/2213">33 U.S.C. 2213</external-xref>), except that the non-Federal share of the cost to design and construct a project benefitting an economically disadvantaged community (as defined pursuant to section 160 of the Water Resources Development Act of 2020 (<external-xref legal-doc="usc" parsable-cite="usc/33/2201">33 U.S.C. 2201</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/116/260">Public Law 116–260</external-xref>)) shall be 10 percent</quote>;</text></subclause></clause></subparagraph> <subparagraph id="id73279619E8EF4D578A9DB8BC90C9E4BD"><enum>(E)</enum><text>in subsection (d)—</text> 
<clause id="id025349C29BF54958A2B8750246879D3E"><enum>(i)</enum><text>by striking paragraph (2);</text></clause> <clause id="id1EEF4A1B7D954B7D88D4B797742EC86F"><enum>(ii)</enum><text>by striking the subsection designation and heading and all that follows through <quote>Notwithstanding</quote> in paragraph (1) in the matter preceding subparagraph (A) and inserting the following:</text>

<subsection id="id7CE473099580425DBED0AE400FCD24A8"><enum>(d)</enum><header>Project justification</header><text>Notwithstanding</text></subsection><after-quoted-block>; </after-quoted-block></quoted-block></clause> <clause id="idA3F0F2F9FFB54188B24F6F427E3845CE"><enum>(iii)</enum><text>by redesignating subparagraphs (A) through (C) as paragraphs (1) through (3), respectively, and indenting appropriately; and</text></clause> 
<clause id="id4781BF869E894068B6DE46AC36DA788E"><enum>(iv)</enum><text>in paragraph (1) (as so redesignated), by striking <quote>flood damages</quote> and inserting <quote>flood, coastal storm, or erosion damages</quote>;</text></clause></subparagraph> <subparagraph id="idD3B510E5DF164A17AF1BB7C72FF4D538"><enum>(F)</enum><text>in subsection (e)—</text> 
<clause id="id94F8EECBC1834AAE9278B46BB4FFC3C3"><enum>(i)</enum><text>by redesignating paragraphs (1) through (33) as subparagraphs (A) through (GG), respectively, and indenting appropriately;</text></clause> <clause id="idD3A0920EB35A43FFBE044CCAFABD6CE8"><enum>(ii)</enum><text>in the matter preceding subparagraph (A) (as so redesignated), by striking <quote>In carrying out</quote> and inserting the following:</text>

<subparagraph id="id227B900BBBAB4233823E63770BC146D0"><enum>(B)</enum><text>Louisiana Coastal Area, Louisiana.</text></subparagraph> <subparagraph id="idEE743C801A664D6C99DFCF706D6FC164"><enum>(C)</enum><text>Great Lakes Shores and Watersheds.</text></subparagraph> 
<subparagraph id="idC36DECE10FDA4BA29E96B056738BAD78"><enum>(D)</enum><text>Oregon Coastal Area, Oregon.</text></subparagraph> <subparagraph id="idD5D0355A5BA8459A8DC146B5B2F85A4E"><enum>(E)</enum><text>Upper Missouri River Basin.</text></subparagraph> 
<subparagraph id="idDDDBD7FC9704426ABE0C765CF20D0000"><enum>(F)</enum><text>Kanawha River Basin, West Virginia.</text></subparagraph> <subparagraph id="idF6A2E2D51A844BD29A5C84B606D05D77"><enum>(G)</enum><text>Any additional locations, as determined annually by the Secretary.</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></clause></subparagraph> 
<subparagraph id="idD08C8DDFB8274436A3583D45EB725A42"><enum>(G)</enum><text>by striking subsections (f), (g), and (i);</text></subparagraph> <subparagraph id="id138BAD7C1493404EBC90D07B89786D20"><enum>(H)</enum><text>by redesignating subsection (h) as subsection (f); and</text></subparagraph> 
<subparagraph id="id7E600B9F6FEC43A4A38BA776F04A1766"><enum>(I)</enum><text>in subsection (f) (as so redesignated), by striking paragraph (2) and inserting the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="id48EC0CD74219456EB53DF94D9B4C17BF"> <paragraph id="id9D6C1065C90146CC95FE21C9EDE51C29"><enum>(2)</enum><header>Projects requiring specific authorization</header><text>The Secretary shall not carry out a project until Congress enacts a law authorizing the Secretary to carry out the project, if the Federal share of the cost to design and construct the project exceeds—</text> 
<subparagraph id="idF926338229E34290992F214BCD697CE9"><enum>(A)</enum><text>$26,000,000, in the case of a project benefitting an economically disadvantaged community (as defined pursuant to section 160 of the Water Resources Development Act of 2020 (<external-xref legal-doc="usc" parsable-cite="usc/33/2201">33 U.S.C. 2201</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/116/260">Public Law 116–260</external-xref>));</text></subparagraph> <subparagraph id="id9032B06441444066AA409BD1E2891BBC"><enum>(B)</enum><text>$23,000,000, in the case of a project other than a project benefitting an economically disadvantaged community (as so defined) that—</text> 
<clause id="idD40DF693864C4B39AA0286804B139AFB"><enum>(i)</enum><text>is for purposes of environmental restoration; or </text></clause> <clause id="id7E27C9D8641D4655B0A0ADBCF54F3415"><enum>(ii)</enum><text>derives not less than 50 percent of the erosion, flood, or coastal storm risk reduction benefits from nonstructural measures or measures described in section 1184(a) of the Water Resources Development Act of 2016 (<external-xref legal-doc="usc" parsable-cite="usc/33/2289a">33 U.S.C. 2289a(a)</external-xref>); or</text></clause></subparagraph> 
<subparagraph id="id13547E74A9AC473F9B14D6983673B4DC"><enum>(C)</enum><text>$18,500,000, for a project other than a project described in subparagraph (A) or (B).</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph> <paragraph id="id72F11E1FF2B841A69388387E9EC039E2"><enum>(2)</enum><header>Clerical amendment</header><text>The table of contents in section 1(b) of the Water Resources Development Act of 1999 (113 Stat. 269) is amended by striking the item relating to section 212 and inserting the following: </text>

<subsection id="id821f6b591716409b87dbb1c488fa5659"><enum>(c)</enum><header>Special rule</header><text>For purposes of the project described in subsection (a)(1), periodic nourishment shall include reimbursement of the Federal share of the cost to the non-Federal interest for the project to operate and maintain a sand bypass plant. </text></subsection></section> <section id="id3abc084fe5ac49859b8a3ba9d08c3e35"><enum>7.</enum><header>Special rule for certain beach nourishment projects</header> <subsection id="idc481bceacdbf4dde9b4f23788a338274"><enum>(a)</enum><header>In general</header><text>In the case of a water resources development project described in subsection (b), the Secretary shall—</text> 
<paragraph id="id06d0661f8baf4caeae41bfc531814a61"><enum>(1)</enum><text>fund, at full Federal expense, any incremental increase in cost to the project that results from a legal requirement to use a borrow source determined by the Secretary to be other than the least-cost option; and </text></paragraph> <paragraph id="id28a54a39bab844bdaea0a46825a4c48e"><enum>(2)</enum><text>exclude the cost described in paragraph (1) from the cost-benefit analysis for the project.</text></paragraph></subsection> 
<subsection id="ide617b4eba30c45c7b3bc190d741bc6ae"><enum>(b)</enum><header>Authorized water resources development projects described</header><text>An authorized water resources development project referred to in subsection (a) is any of the following:</text> <paragraph id="iddb475974232d4286abd8ca9c75c04103"><enum>(1)</enum><text>The Townsends Inlet to Cape May Inlet, New Jersey, coastal storm risk management project, authorized by section 101(a)(26) of the Water Resources Development Act of 1999 (113 Stat. 278).</text></paragraph> 
<paragraph id="id9f4d33aa125943fd8c1f95747eae1815"><enum>(2)</enum><text>The Folly Beach, South Carolina, coastal storm risk management project, authorized by section 501(a) of the Water Resources Development Act of 1986 (100 Stat. 4136) and modified by section 108 of the Energy and Water Development Appropriations Act, 1992 (105 Stat. 520).</text></paragraph> <paragraph id="idfee6e6e89f174082890c0bf85931bb52"><enum>(3)</enum><text>The Carolina Beach and Vicinity, North Carolina, coastal storm risk management project, authorized by section 203 of the Flood Control Act of 1962 (76 Stat. 1182) and modified by section 401(7) of the Water Resources Development Act of 2020 (134 Stat. 2741).</text></paragraph> 
<paragraph id="id41c4902d874d413f9bc745b4e81e6afb"><enum>(4)</enum><text>The Wrightsville Beach, North Carolina, coastal storm risk management project, authorized by section 203 of the Flood Control Act of 1962 (76 Stat. 1182) and modified by section 401(7) of the Water Resources Development Act of 2020 (134 Stat. 2741).</text></paragraph> <paragraph id="idd8991fb10a50480690d14c0bd1d2ac4c"><enum>(5)</enum><text>A project for coastal storm risk management for any shore included in a project described in this subsection that is specifically authorized by Congress on or after the date of enactment of this Act.</text></paragraph> 
<paragraph id="idade2f0327ad64603be7c13fbea4c266b"><enum>(6)</enum><text>Emergency repair and restoration of any project described in this subsection under section 5 of the Act of August 18, 1941 (commonly known as the <quote>Flood Control Act of 1941</quote>) (55 Stat. 650, chapter 377; <external-xref legal-doc="usc" parsable-cite="usc/33/701n">33 U.S.C. 701n</external-xref>). </text></paragraph></subsection></section> <section id="idB777457DDF1342039641292C086AE1E4"><enum>8.</enum><header>Protection and restoration of other Federal land along rivers and coasts</header> <subsection id="id1868de343c1d4af9bc3e5fec48c3398b"><enum>(a)</enum><header>In general</header><text>The Secretary is authorized to use funds made available to the Secretary for water resources development purposes to carry out, at full Federal expense, a measure located on, or benefitting, Federal land under the administrative jurisdiction of another Federal agency, if the measure—</text> 
<paragraph id="iddcd9c75a6a714a928a3cb19b0ae5c3d8"><enum>(1)</enum> 
<subparagraph commented="no" display-inline="yes-display-inline" id="idAFA10BCE0CAC4E17BF49EFBFCF7C2152"><enum>(A)</enum><text>is for purposes of ecosystem restoration or the protection and restoration of shores; and</text></subparagraph> <subparagraph id="id01F63E8B305C49698CC37AC0BA697DA3" indent="up1"><enum>(B)</enum> <clause commented="no" display-inline="yes-display-inline" id="id6945C5EA36C745FFAC90FBE7498435BB"><enum>(i)</enum><text>utilizes dredged material from a water resources development project beneficially; or</text></clause> 
<clause indent="up1" id="id86B8F4E3C20E41E681CAE3AB8C8FD977"><enum>(ii)</enum><text>is included in a report of the Chief of Engineers or other decision document for a water resources development project that is specifically authorized by Congress;</text></clause></subparagraph></paragraph> <paragraph id="id8ab8bf429ea14eb68adfd346df120ca7"><enum>(2)</enum><text>is for purposes of mitigation of damages to Federal land caused by a water resources development project operated and maintained by the Secretary; or</text></paragraph> 
<paragraph id="id61F2DDF16EB5470986AEA45CEC617D9E"><enum>(3)</enum><text>is for purposes of mitigating damages to fish and wildlife resources resulting from a water resources development project.</text></paragraph></subsection> <subsection id="id1924D2D185CC4437B0F529F6E015EF15"><enum>(b)</enum><header>Applicability</header><text>This section shall apply to a measure for which construction is initiated after the date of enactment of this Act.</text></subsection> 
<subsection id="id4e41a51fb6b04016ad4716274e32e290"><enum>(c)</enum><header>Savings provision</header><text>Nothing in this section precludes a Federal agency with administrative jurisdiction over Federal land from contributing funds for any portion of the cost of a measure described in subsection (a) that is located on, or benefitting, that land.</text></subsection> <subsection id="idf534e1e97d15480eb4c2136a62db1d2c"><enum>(d)</enum><header>Repeal</header> <paragraph id="idB8B7E6CAA7C343F5865C213BD7D111A4"><enum>(1)</enum><header>In general</header><text>Section 1025 of the Water Resources Reform and Development Act of 2014 (<external-xref legal-doc="usc" parsable-cite="usc/33/2226">33 U.S.C. 2226</external-xref>) is repealed.</text></paragraph> 
<paragraph id="id70EA04A0D0204FE1A4D28B935840EF38"><enum>(2)</enum><header>Conforming amendment</header><text>The table of contents in section 1(b) of the Water Resources Reform and Development Act of 2014 (128 Stat. 1193) is amended by striking the item relating to section 1025. </text></paragraph></subsection></section> <section id="ida021c9ab037f49f0878f579efddeff5d"><enum>9.</enum><header>Flood and coastal storm risk management feasibility studies</header><text display-inline="no-display-inline">In carrying out a feasibility study for flood or coastal storm risk management, the Secretary, at the request of the non-Federal interest for the study, shall formulate alternatives to maximize net benefits from the reduction of the comprehensive flood risk that results from the isolated and compound effects of—</text> 
<paragraph id="idA40C638DA3AC4CC2AC7075B733F45F34"><enum>(1)</enum><text display-inline="yes-display-inline">a riverine discharge of any magnitude or frequency;</text></paragraph> <paragraph id="id18A3055C7E6747A0963B2D364F411FA7"><enum>(2)</enum><text>inundation, wave attack, and erosion coinciding with a hurricane or coastal storm;</text></paragraph> 
<paragraph id="id0F1B138DE5C24991B679931DC5D2E393"><enum>(3)</enum><text>a tide of any magnitude or frequency;</text></paragraph> <paragraph id="id71BCF100766E4161B5F600E8729E528E"><enum>(4)</enum><text>a rainfall event of any magnitude or frequency;</text></paragraph> 
<paragraph id="id75752E1344DB40CCA3539D399040B460"><enum>(5)</enum><text>seasonal variation in water levels;</text></paragraph> <paragraph id="id4C1C6115E9A3480E985BA01286A098F9"><enum>(6)</enum><text>groundwater emergence;</text></paragraph> 
<paragraph id="id40D1B1B136054636B667757EA5493CC0"><enum>(7)</enum><text>sea level rise; </text></paragraph> <paragraph id="id3474485AA97F40679688C6928E1E3328"><enum>(8)</enum><text>subsidence; and</text></paragraph> 
<paragraph id="id9F7DF748E50C403D9CCAF9844173FA36"><enum>(9)</enum><text>any other driver of flood risk affecting the study area.</text></paragraph></section> <section id="id6f13e6482e3542918840ff9c2aa2b6e1"><enum>10.</enum><header>Credit in lieu of reimbursement</header> <subsection id="idECAD93A8790A4F96843891C01EDB33E6"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 1022 of the Water Resources Reform and Development Act of 2014 (<external-xref legal-doc="usc" parsable-cite="usc/33/2225">33 U.S.C. 2225</external-xref>) is amended—</text> 
<paragraph id="id8ec7f66c56624092a6003a5366be39fd"><enum>(1)</enum><text>in subsection (a)—</text> <subparagraph id="id22fb18ea48844bdca56a2f7e352da94f"><enum>(A)</enum><text>by striking <quote>or</quote> before <quote>an authorized coastal navigation project</quote>;</text></subparagraph> 
<subparagraph id="iddb79cbcb4ebe455a9f352e72b7c1807a"><enum>(B)</enum><text>by inserting <quote>or any other water resources development project for which the Secretary is authorized to reimburse the non-Federal interest for the Federal share of construction or operation and maintenance,</quote> before <quote>the Secretary</quote>; and</text></subparagraph> <subparagraph id="id9e963e7071d04747b35733a4aecb59b6"><enum>(C)</enum><text>by striking <quote>of the project</quote> and inserting <quote>to construct, periodically nourish, or operate and maintain the project</quote>; </text></subparagraph></paragraph> 
<paragraph id="id4c3bdcf10f1f4e87b2d5106018ecde6f"><enum>(2)</enum><text>in each of subsections (b) and (c), by striking <quote>flood damage reduction and coastal navigation</quote> each place it appears and inserting <quote>water resources development</quote>; and</text></paragraph> <paragraph id="idE67B28B7B2E844DBA49E58F00FCF0D73"><enum>(3)</enum><text>by adding at the end the following:</text> 
<quoted-block style="OLC" display-inline="no-display-inline" id="idF7CB034C0BDF4D569AC55924ACA2BFFF"> 
<subsection id="idEAAEA93037444592AF254F3EFEEFDCC0"><enum>(d)</enum><header>Applicability</header><text>With respect to a project constructed under section 204 of the Water Resources Development Act of 1986 (<external-xref legal-doc="usc" parsable-cite="usc/33/2232">33 U.S.C. 2232</external-xref>), the Secretary shall exercise the authority under this section to apply credits and reimbursements related to the project in a manner consistent with the requirements of subsection (d) of that section.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> <subsection id="idC35DB96A0C064B9E8AC2D97F37197E46"><enum>(b)</enum><header>Treatment of credit between projects</header><text>Section 7007(d) of the Water Resources Development Act of 2007 (121 Stat. 1277; 128 Stat. 1226) is amended by inserting <quote>, or may be applied to reduce the amounts required to be paid by the non-Federal interest under the terms of the deferred payment agreements entered into between the Secretary and the non-Federal interest for the projects authorized by section 7012(a)(1)</quote> before the period at the end. </text></subsection></section> 
<section id="id3CC8C081078B4CD89C7B17D84929A2F0"><enum>11.</enum><header>Coastal cost calculations</header><text display-inline="no-display-inline">Section 152(a) of the Water Resources Development Act of 2020 (<external-xref legal-doc="usc" parsable-cite="usc/33/2213a">33 U.S.C. 2213a(a)</external-xref>) is amended by inserting <quote>or coastal storm risk management</quote> after <quote>flood risk management</quote>. </text></section> <section id="id85EB5CD9B2034D49839CA1BBA2471E2A"><enum>12.</enum><header>Advance payment in lieu of reimbursement for certain Federal costs</header><text display-inline="no-display-inline">The Secretary is authorized to provide in advance to the non-Federal interest the Federal share of funds required for the acquisition of land, easements, and rights-of-way and the performance of relocations for a project or separable element—</text> 
<paragraph id="id4773f709ccbc4d6389fc93110562098d"><enum>(1)</enum><text>authorized to be constructed at full Federal expense; or</text></paragraph> <paragraph id="ide66e7b04c1684d11858ff8f27f2ef1c0"><enum>(2)</enum><text>described in section 103(b)(2) of the Water Resources Development Act of 1986 (<external-xref legal-doc="usc" parsable-cite="usc/33/2213">33 U.S.C. 2213(b)(2)</external-xref>). </text></paragraph></section> 
<section id="idFD26F172EAA540E4A89E80AFAD98BBF8"><enum>13.</enum><header>Cost sharing for nonstructural projects</header> 
<subsection id="idA9C017A5680F4343A144447DDE103AEF"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 103(b) of the Water Resources Development Act of 1986 (<external-xref legal-doc="usc" parsable-cite="usc/33/2213">33 U.S.C. 2213(b)</external-xref>) is amended—</text> <paragraph id="id260d7793214d4d4486dd847f895916fd"><enum>(1)</enum><text>in paragraph (1)—</text> 
<subparagraph id="id97c333eb77d142a4bdb98be03f1955c0"><enum>(A)</enum><text>in the first sentence, by striking <quote>The</quote> and inserting <quote>Except as provided in paragraph (3), the</quote>; and</text></subparagraph> <subparagraph id="id793d19fecd5b4895a98a6fffc9c9e8c9"><enum>(B)</enum><text>by striking <quote>35 percent</quote> each place it appears and inserting <quote>20 percent</quote>;</text></subparagraph></paragraph>

<paragraph id="id689fe9dc8d544e0d8056702e0ce9c628"><enum>(3)</enum><header>Certain projects</header><text>The non-Federal share of the cost of a measure described in paragraph (1) that benefits an economically disadvantaged community (as defined pursuant to section 160 of the Water Resources Development Act of 2020 (<external-xref legal-doc="usc" parsable-cite="usc/33/2201">33 U.S.C. 2201</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/116/260">Public Law 116–260</external-xref>)) shall be 10 percent.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> <subsection id="id879f7fbbfed64eafb055c79a35e2b33a"><enum>(b)</enum><header>Application</header><text>The amendments made by subsection (a) shall apply to—</text> 
<paragraph id="id395a359449d347b7a41d796d386b8573"><enum>(1)</enum><text>any project that is authorized on or after the date of enactment of this Act; and</text></paragraph> <paragraph id="idfb38a950d9de4b4daa41c6893f7175cb"><enum>(2)</enum><text>any project that is not specifically authorized by Congress, for which—</text> 
<subparagraph id="idb18f05ef7d4149a4adc38e774f62b24e"><enum>(A)</enum><text>a Detailed Project Report is approved after the date of enactment of this Act; or</text></subparagraph> <subparagraph id="id167af226468c47edb3caa04d1444cf65"><enum>(B)</enum><text>in the case of a project for which no Detailed Project Report is prepared, construction is initiated after the date of enactment of this Act. </text></subparagraph></paragraph></subsection></section> 
<section id="id1E3F69C5D3DC459EAC8EE234508EC1DE"><enum>14.</enum><header>Coastal community flood control and other purposes</header><text display-inline="no-display-inline">Section 103(k)(4) of the Water Resources Development Act of 1986 (<external-xref legal-doc="usc" parsable-cite="usc/33/2213">33 U.S.C. 2213(k)(4)</external-xref>) is amended—</text> <paragraph id="idAA0E76FB475A4B3093C5D25DB8A6D4A6"><enum>(1)</enum><text>by redesignating subparagraphs (A) and (B) as clauses (i) and (ii), respectively, and indenting appropriately;</text></paragraph> 
<paragraph id="id258A8425F8D84330BFA2676438E6BC6E"><enum>(2)</enum><text>in the matter preceding clause (i) (as so redesignated), by striking <quote>Notwithstanding</quote> and inserting the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="id3EC50ABDC29C48BBABBE97E94FE16499"> <subparagraph id="id1F3DE958BC4242B098155FA4C8632BD9"><enum>(A)</enum><header>In general</header><text>Notwithstanding</text></subparagraph><after-quoted-block>; </after-quoted-block></quoted-block></paragraph>

<subparagraph id="id3d6a6bf3a7064268915e0ed7accca616"><enum>(B)</enum><header>Repayment options</header><text>Repayment of a non-Federal contribution under subparagraph (A)(iii) may be satisfied through the provision by the non-Federal interest of fish and wildlife mitigation for one or more projects or separable elements, if the Secretary determines that—</text> <clause id="idc56ca7647e564101a4e0dd37d2d9acc7"><enum>(i)</enum><text>the non-Federal interest has incurred costs for the provision of mitigation that—</text> 
<subclause id="idA746930DB5C54BA6BB3E931C15BD0056"><enum>(I)</enum><text>equal or exceed the amount of the required repayment; and</text></subclause> <subclause id="id222188BB8CD84BBEB84846754662F2FD"><enum>(II)</enum><text>are in excess of any required non-Federal contribution for the project or separable element for which the mitigation is provided; and</text></subclause></clause> 
<clause id="id62034ce7ecf140129d6c3ac26a1b5a68"><enum>(ii)</enum><text>the mitigation is integral to the project for which it is provided.</text></clause></subparagraph><after-quoted-block>. </after-quoted-block></quoted-block></paragraph></section> <section id="idEF8CFB42214C47538C62D4B2A7398444"><enum>15.</enum><header>Port Fourchon, Louisiana, dredged material disposal plan</header><text display-inline="no-display-inline">The Secretary shall determine that the dredged material disposal plan recommended in the document entitled <quote>Port Fourchon Belle Pass Channel Deepening Project Section 203 Feasibility Study (January 2019, revised January 2020)</quote> is the least cost, environmentally acceptable dredged material disposal plan for the project for navigation, Port Fourchon Belle Passe Channel, Louisiana, authorized by section 403(a)(4) of the Water Resources Development Act of 2020 (134 Stat. 2743). </text></section> 
<section id="id94c239e367c6458e8e8af05fbb020429"><enum>16.</enum><header>Delaware shore protection and restoration</header> 
<subsection id="idb348d14e5cbc4a4cba3833c9635029a9"><enum>(a)</enum><header>Delaware beneficial use of dredged material for the Delaware River, Delaware</header> 
<paragraph id="id589B723B2E21432EA80EB30C396E5CD9"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The project for coastal storm risk management, Delaware Beneficial Use of Dredged Material for the Delaware River, Delaware, authorized by section 401(3) of the Water Resources Development Act of 2020 (134 Stat. 2736) (referred to in this subsection as the <quote>project</quote>), is modified—</text> <subparagraph id="idFCE84CADADF64EF3AEB27B2D5570C04D"><enum>(A)</enum><text display-inline="yes-display-inline">to direct the Secretary to implement the project using alternative borrow sources to the Delaware River, Philadelphia to the Sea, project, Delaware, New Jersey, Pennsylvania, authorized by the Act of June 25, 1910 (chapter 382, 36 Stat. 637; 46 Stat. 921; 52 Stat. 803; 59 Stat. 14; 68 Stat. 1249; 72 Stat. 297); and</text></subparagraph> 
<subparagraph id="idF7929E0164E742BD927E9819FD0DD40D"><enum>(B)</enum><text>until the Secretary implements the modification under subparagraph (A), to authorize the Secretary, at the request of a non-Federal interest, to carry out initial construction or periodic nourishments at any site included in the project under—</text> <clause id="id9BB9D0D4257D48A48E4E846086CAB380"><enum>(i)</enum><text>section 1122 of the Water Resources Development Act of 2016 (<external-xref legal-doc="usc" parsable-cite="usc/33/2326">33 U.S.C. 2326</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/114/322">Public Law 114–322</external-xref>); or</text></clause> 
<clause id="id27240E89780E4963B3CF453341BC1D7A"><enum>(ii)</enum><text>section 204(d) of the Water Resources Development Act of 1992 (<external-xref legal-doc="usc" parsable-cite="usc/33/2326">33 U.S.C. 2326(d)</external-xref>).</text></clause></subparagraph></paragraph> <paragraph id="idBD03172969F5489FAC0E2C5CB908E971"><enum>(2)</enum><header>Treatment</header><text>If the Secretary determines that a study is required to carry out paragraph (1)(A), the study shall be considered to be a continuation of the study that formulated the project.</text></paragraph></subsection> 
<subsection id="idC7E58BB2DC5E444EBB09CBBE1F44394E"><enum>(b)</enum><header>Indian River Inlet Sand Bypass Plant, Delaware</header> 
<paragraph id="id70597c85221e4a12b82baeacb42cfc75"><enum>(1)</enum><header>In general</header><text>The Indian River Inlet Sand Bypass Plant, Delaware, coastal storm risk management project (referred to in this subsection as the <quote>project</quote>), authorized by section 869 of the Water Resources Development Act of 1986 (100 Stat. 4182), is modified to authorize the Secretary, at the request of a non-Federal interest, to provide periodic nourishment through dedicated dredging or other means to maintain or restore the functioning of the project when—</text> <subparagraph id="id411c8b286c3b49768d3af57904e0c1df"><enum>(A)</enum><text>the sand bypass plant is inoperative; or</text></subparagraph> 
<subparagraph id="idbb7282bc6f2d46ffb803dc2b568f3596"><enum>(B)</enum><text>operation of the sand bypass plant is insufficient to maintain the functioning of the project.</text></subparagraph></paragraph> <paragraph id="id66c23ef5684541a88c64d35c2e2ad919"><enum>(2)</enum><header>Requirements</header><text>A cycle of periodic nourishment provided pursuant to paragraph (1) shall be subject to the following requirements:</text> 
<subparagraph id="id7c33a265aa7b4530ac6bc0a8b29abd6e"><enum>(A)</enum><header>Cost share</header><text>The non-Federal share of the cost of a cycle shall be the same percentage as the non-Federal share of the cost to operate the sand bypass plant.</text></subparagraph> <subparagraph id="id3406cf74295a40a69b310f7799b6f92e"><enum>(B)</enum><header>Decision document</header><text>If the Secretary determines that a decision document is required to support a request for funding for the Federal share of a cycle, the decision document may be prepared using funds made available to the Secretary for construction or for investigations. </text></subparagraph> 
<subparagraph id="id0095d3535a7d40f28f055905040e59d6"><enum>(C)</enum><header>Treatment</header> 
<clause id="idAF0A75949A5A4D51BAF0E325BD014F2C"><enum>(i)</enum><header>Decision document</header><text>A decision document prepared under subparagraph (B) shall not be subject to a new investment determination.</text></clause> <clause id="id734D664C1C8F4375B1B75E5CE936F5BB"><enum>(ii)</enum><header>Cycles</header><text>A cycle shall be considered continuing construction. </text></clause></subparagraph></paragraph></subsection> 
<subsection id="idA9D7C45D43EF458ABBE6C055D1862742"><enum>(c)</enum><header>Delaware emergency shore restoration</header> 
<paragraph id="ida0e7c807ebea47a297dd18bcc667d297"><enum>(1)</enum><header>In general</header><text>The Secretary is authorized to construct, repair, or restore a federally authorized hurricane or shore protective structure or project located in the State of Delaware pursuant to section 5(a) of the Act of August 18, 1941 (commonly known as the <quote>Flood Control Act of 1941</quote>) (55 Stat. 650, chapter 377; <external-xref legal-doc="usc" parsable-cite="usc/33/701n">33 U.S.C. 701n(a)</external-xref>), if—</text> <subparagraph id="id2DD8FAE421554752A1C8B0A8C8B84BAA"><enum>(A)</enum><text>the structure, project, or shore is damaged by wind, wave, or water action associated with a storm of any magnitude; and</text></subparagraph> 
<subparagraph id="id58AED1D7F3BE41908FCF7C204ABDC149"><enum>(B)</enum><text>the damage prevents the adequate functioning of the structure, project, or shore. </text></subparagraph></paragraph> <paragraph id="idfc606b8efc0147b4a316aae94daaf8ce"><enum>(2)</enum><header>Benefit-cost analysis</header><text>The Secretary shall determine that the benefits attributable to the objectives set forth in section 209 of the Flood Control Act of 1970 (<external-xref legal-doc="usc" parsable-cite="usc/42/1962-2">42 U.S.C. 1962–2</external-xref>) and section 904(a) of the Water Resources Development Act of 1986 (<external-xref legal-doc="usc" parsable-cite="usc/33/2281">33 U.S.C. 2281(a)</external-xref>) exceed the cost for work carried out under this subsection. </text></paragraph> 
<paragraph id="id3797E122FA454111A2297C611885F720"><enum>(3)</enum><header>Savings provision</header><text>The authority provided by this subsection shall be in addition to any authority provided by section 5(a) of the Act of August 18, 1941 (commonly known as the <quote>Flood Control Act of 1941</quote>) (55 Stat. 650, chapter 377; <external-xref legal-doc="usc" parsable-cite="usc/33/701n">33 U.S.C. 701n(a)</external-xref>) to repair or restore a federally authorized hurricane or shore protection structure or project located in the State of Delaware damaged or destroyed by wind, wave, or water action of other than an ordinary nature. </text></paragraph></subsection> <subsection id="id5f28d393fbc24d8b9970757e552317fc"><enum>(d)</enum><header>Indian River Inlet and Bay, Delaware</header><text display-inline="yes-display-inline">In carrying out major maintenance of the project for navigation, Indian River Inlet and Bay, Delaware, authorized by the Act of August 26, 1937 (50 Stat. 846, chapter 832), and section 2 of the Act of March 2, 1945 (59 Stat. 14, chapter 19), the Secretary shall repair, restore, or relocate any non-Federal facility or other infrastructure, that has been damaged, in whole or in part, by the deterioration or failure of the project. </text></subsection> 
<subsection id="id837991B8F7844A2C90D10F161D120C68"><enum>(e)</enum><header>Reprogramming for coastal storm risk management project at Indian River Inlet</header> 
<paragraph id="id2909720F33CB4B4EAA7666E0D7416166"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, for each fiscal year, the Secretary may reprogram amounts made available for a coastal storm risk management project to use such amounts for the project for coastal storm risk management, Indian River Inlet Sand Bypass Plant, Delaware, authorized by section 869 of the Water Resources Development Act of 1986 (100 Stat. 4182). </text></paragraph> <paragraph id="id5D7ACB05E70E461FA0747B4C1F37CF8D"><enum>(2)</enum><header>Limitations</header> <subparagraph id="id5DB27142344B4D8B8231344110581432"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary may carry out not more than 2 reprogramming actions under paragraph (1) for each fiscal year. </text></subparagraph> 
<subparagraph id="idB8AAFDA1D58F410083049F911E867EAE"><enum>(B)</enum><header>Amount</header><text display-inline="yes-display-inline">For each fiscal year, the Secretary may reprogram—</text> <clause id="id2376DFD4C1AB43D8971CF84B95D96C73"><enum>(i)</enum><text display-inline="yes-display-inline">not more than $100,000 per reprogramming action; and</text></clause> 
<clause id="id153E40EA246641BC88C8FCB62188757D"><enum>(ii)</enum><text>not more than $200,000 for each fiscal year. </text></clause></subparagraph></paragraph></subsection></section> <section id="id43B2F56C986C448487A1CA310E32C8E1"><enum>17.</enum><header>Great Lakes advance measures assistance</header><text display-inline="no-display-inline">The following requirements shall apply to the provision of advance measures assistance under section 5(a) of the Act of August 18, 1941 (commonly known as the <quote>Flood Control Act of 1941</quote>) (55 Stat. 650, chapter 377; <external-xref legal-doc="usc" parsable-cite="usc/33/701n">33 U.S.C. 701n(a)</external-xref>), in the Great Lakes Region:</text> 
<paragraph id="idFBF14D6DDE084C44B5A51BAEED4C520B"><enum>(1)</enum><text>The Secretary shall not deny a request from the Governor of a State to provide advance measures assistance to reduce the risk of damage from rising water levels in the Great Lakes solely on the basis that the damage is caused by erosion. </text></paragraph> <paragraph id="id98BA8200A4D34A859EDC1B35A21BBA2B"><enum>(2)</enum><text>Advance measures assistance provided by the Secretary to reduce the risk of damage from rising water levels in the Great Lakes shall be provided at full Federal expense. </text></paragraph></section> 
<section id="id18293E4D196749438D594E98C863F2DA"><enum>18.</enum><header>Forecasting models for the Great Lakes</header> 
<subsection id="id565ae91681f44c95b3a1ce330952d570"><enum>(a)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to the Secretary for the Engineer Research and Development Center to complete and maintain a model suite to forecast water levels, account for lake level variability, and account for the impacts of climate change in the Great Lakes—</text> <paragraph id="id63cdbbc836de49fa87872c3b58c543b5"><enum>(1)</enum><text>$10,000,000 to complete the model suite; and</text></paragraph> 
<paragraph id="id4a80e95327e243beb38df49db2902fec"><enum>(2)</enum><text>$250,000 for each fiscal year following the fiscal year during which the model suite is completed, for maintenance of the model suite.</text></paragraph></subsection> <subsection id="id441d1e128acb40bca7b99883a67c6bcd"><enum>(b)</enum><header>Savings provision</header><text>Nothing in this section precludes the Secretary from using funds made available under the Great Lakes Restoration Initiative established by section 118(c)(7) of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1268">33 U.S.C. 1268(c)(7)</external-xref>) for activities described in subsection (a), if funds are not appropriated for those activities pursuant to subsection (a). </text></subsection></section> 
<section id="id6562d5a6ac9843a3b029f4466f6c06a0"><enum>19.</enum><header>Chattahoochee River program</header> 
<subsection id="id230fd6cb040c4af4ba4dc7289c990ad4"><enum>(a)</enum><header>Establishment</header> 
<paragraph id="ida605017669364fef918d86943304806f"><enum>(1)</enum><header>In general</header><text>The Secretary shall establish a program to provide environmental assistance to non-Federal interests in the Chattahoochee River Basin.</text></paragraph> <paragraph id="id37ed4f47ea7540ccb67e2a879b20954d"><enum>(2)</enum><header>Form</header><text>The assistance under paragraph (1) shall be in the form of design and construction assistance for water-related resource protection and restoration projects affecting the Chattahoochee River Basin, based on the comprehensive plan under subsection (b), including projects for—</text> 
<subparagraph id="id0f6d93e300c5489296d31a0020e00648"><enum>(A)</enum><text>sediment and erosion control;</text></subparagraph> <subparagraph id="idfd140c4f441e407e8bfee23f0424206b"><enum>(B)</enum><text>protection of eroding shorelines;</text></subparagraph> 
<subparagraph id="id2dfccc06123a4ef793f548087def01b2"><enum>(C)</enum><text>ecosystem restoration, including restoration of submerged aquatic vegetation;</text></subparagraph> <subparagraph id="idf0ecedc62a554a209834845bc1840504"><enum>(D)</enum><text>protection of essential public works;</text></subparagraph> 
<subparagraph id="idc2c7c76c64834e11a863d0cdefeb8200"><enum>(E)</enum><text>beneficial uses of dredged material; and</text></subparagraph> <subparagraph id="id2aed8b687a0c46a9bf7da4825ff2f142"><enum>(F)</enum><text>other related projects that may enhance the living resources of the Chattahoochee River Basin.</text></subparagraph></paragraph></subsection> 
<subsection id="idd1cb4ef06b394f5ca58e6d7bd7f731cd"><enum>(b)</enum><header>Comprehensive plan</header> 
<paragraph id="id9db16178fe2341579f2df0ff2f6e7489"><enum>(1)</enum><header>In general</header><text>Not later than 2 years after the date of enactment of this Act, the Secretary, in cooperation with State and local governmental officials and affected stakeholders, shall develop a comprehensive Chattahoochee River Basin restoration plan to guide the implementation of projects under subsection (a)(2).</text></paragraph> <paragraph id="id6e5e36c5f994471fa53a7677218dd240"><enum>(2)</enum><header>Coordination</header><text>The restoration plan described in paragraph (1) shall, to the maximum extent practicable, consider and avoid duplication of any ongoing or planned actions of other Federal, State, and local agencies and nongovernmental organizations.</text></paragraph> 
<paragraph id="id963d2b0e88e84cc388a2905506bc59aa"><enum>(3)</enum><header>Prioritization</header><text>The restoration plan described in paragraph (1) shall give priority to projects eligible under subsection (a)(2) that will also improve water quality or quantity or use natural hydrological features and systems.</text></paragraph></subsection> <subsection id="id67c4a70210ab4feab6283bc725d96bb9"><enum>(c)</enum><header>Agreement</header> <paragraph id="iddc4ac5c4782a4269899e70b44bd56bd7"><enum>(1)</enum><header>In general</header><text>Before providing assistance under this section, the Secretary shall enter into an agreement with a non-Federal interest for the design and construction of a project carried out pursuant to the comprehensive Chattahoochee River Basin restoration plan described in subsection (b).</text></paragraph> 
<paragraph id="id7a4609993eb542cc8f4afc9165fa1afc"><enum>(2)</enum><header>Requirements</header><text>Each agreement entered into under this subsection shall provide for—</text> <subparagraph id="ide4755881abe9433ea53315afb440e62c"><enum>(A)</enum><text>the development by the Secretary, in consultation with appropriate Federal, State, and local officials, of a resource protection and restoration plan, including appropriate engineering plans and specifications and an estimate of expected resource benefits; and</text></subparagraph> 
<subparagraph id="id4b1096f7ec104ddfb3552c5f4d305f02"><enum>(B)</enum><text>the establishment of such legal and institutional structures as are necessary to ensure the effective long-term operation and maintenance of the project by the non-Federal interest.</text></subparagraph></paragraph></subsection> <subsection id="id8b205e7a65764aeaacae3b6c1630bb12"><enum>(d)</enum><header>Cost sharing</header> <paragraph id="ide4000059509f4527b90a4c2243e9b4a5"><enum>(1)</enum><header>Federal share</header><text>Except as provided in paragraph (2)(B), the Federal share of the total project costs of each agreement entered into under this section shall be 80 percent.</text></paragraph> 
<paragraph id="ideb1467f270a54e2ba1163a4b562d6103"><enum>(2)</enum><header>Non-federal share</header> 
<subparagraph id="id094d0ff4af51422baa0555a6f1e3701d"><enum>(A)</enum><header>Value of land, easements, rights-of-way, and relocations</header><text>In determining the non-Federal contribution toward carrying out an agreement entered into under this section, the Secretary shall provide credit to a non-Federal interest for the value of land, easements, rights-of-way, and relocations provided by the non-Federal interest, except that the amount of credit provided for a project under this paragraph may not exceed 20 percent of the total project costs.</text></subparagraph> <subparagraph id="ida465b8c88d034a40b4297100dffd8a96"><enum>(B)</enum><header>Operation and maintenance costs</header><text>The non-Federal share of the costs of operation and maintenance of activities carried out under an agreement under this section shall be 100 percent.</text></subparagraph></paragraph></subsection> 
<subsection id="id2a32cd85aa6f4dc1aa5587cfd6e478bf"><enum>(e)</enum><header>Cooperation</header><text>In carrying out this section, the Secretary shall cooperate with—</text> <paragraph id="id1cfe5a8890fe4050b96a08447e2d0bac"><enum>(1)</enum><text>the heads of appropriate Federal agencies, including—</text> 
<subparagraph id="id9ed7dddfc9814cd198115b106009a563"><enum>(A)</enum><text>the Administrator of the Environmental Protection Agency;</text></subparagraph> <subparagraph id="idfb5c2b9f5c104396a643282b30490b32"><enum>(B)</enum><text>the Secretary of Commerce, acting through the Administrator of the National Oceanic and Atmospheric Administration;</text></subparagraph> 
<subparagraph id="idc9000dcb5379431e804fb901dbd5a819"><enum>(C)</enum><text>the Secretary of the Interior, acting through the Director of the United States Fish and Wildlife Service; and</text></subparagraph> <subparagraph id="ida12fe6d785724ac2bb319b1be67cf08b"><enum>(D)</enum><text>the heads of such other Federal agencies as the Secretary determines to be appropriate; and</text></subparagraph></paragraph> 
<paragraph id="id78932ea456d0438a80f643312e2f2f1a"><enum>(2)</enum><text>agencies of a State or political subdivision of a State.</text></paragraph></subsection> <subsection id="id1437009e8a01485fb054464a56b54f5b"><enum>(f)</enum><header>Protection of resources</header><text>A project established under this section shall be carried out using such measures as are necessary to protect environmental, historic, and cultural resources.</text></subsection> 
<subsection id="ida241af1f719f470298909c93812aafb5"><enum>(g)</enum><header>Project cap</header><text>The total cost of a project carried out under this section may not exceed $15,000,000.</text></subsection> <subsection id="ide9f1ee8619f04a25b56beb5f0f46f616"><enum>(h)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to carry out this section $90,000,000. </text></subsection></section> 
<section id="id4A49689C79B249A3BBE122436DED93F5"><enum>20.</enum><header>Mississippi River mat sinking unit</header><text display-inline="no-display-inline">The Secretary shall expedite the replacement of the Mississippi River mat sinking unit. </text></section> <section id="id5482D5B67E484827BFFA1936F5E43C99"><enum>21.</enum><header>Rehabilitation of existing levees</header><text display-inline="no-display-inline">Section 3017 of the Water Resources Reform and Development Act of 2014 (<external-xref legal-doc="usc" parsable-cite="usc/33/3303a">33 U.S.C. 3303a</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/113/121">Public Law 113–121</external-xref>) is amended by striking subsection (e). </text></section>
