Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Higher Education Act of 1965 to improve the financial aid process for homeless and foster care youth.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause" id="H09D085A63EEA47F5AC6C66651B6DB58F"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Higher Education Access and Success for Homeless and Foster Youth Act of 2022</short-title></quote>.</text></section><section id="idD7C612C8992048108958A1DEC9866730"><enum>2.</enum><header>Definitions</header><subsection id="idef248748342f40beb2198a4077674df5"><enum>(a)</enum><header>Homeless and foster youth</header><text>Section 103 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1003">20 U.S.C. 1003</external-xref>) is amended—</text><paragraph id="id5DE49EF268EF4C12AC9F4BFCEE38250C"><enum>(1)</enum><text>by redesignating paragraph (10), paragraphs (11) through (22), and paragraphs (23) through (24), as paragraph (11), paragraphs (13) through (25), and paragraphs (26) through (27), respectively;</text></paragraph><paragraph id="idC637A33503AA4CCF9726F0E5CDE297CD"><enum>(2)</enum><text>by inserting after paragraph (9) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idD16381D86D4941A1A7FB835789893EAB"><paragraph id="id34bcaef2f39e4cc99090ec3db9af08f3"><enum>(10)</enum><header>Foster care youth</header><text>The term <term>foster care youth</term>—</text><subparagraph id="id4f2df2d2a94141a4831c7c14f7a8d660"><enum>(A)</enum><text>means children and youth whose care and placement are the responsibility of the State or Tribal agency that administers a State or Tribal plan under part B or E of title IV of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/621">42 U.S.C. 621 et seq.</external-xref> and 670 et seq.), without regard to whether foster care maintenance payments are made under section 472 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/672">42 U.S.C. 672</external-xref>) on behalf of such children and youth; and</text></subparagraph><subparagraph id="id855ca2a5b3e34996acc38b1d0dd3fcf8"><enum>(B)</enum><text>includes individuals who were age 13 or older when their care and placement were the responsibility of a State or Tribal agency that administered a State or Tribal plan under part B or E of title IV of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/621">42 U.S.C. 621 et seq.</external-xref> and 670 et seq.) and who are no longer under the care and responsibility of such a State or Tribal agency, without regard to any such individual’s subsequent adoption, guardianship arrangement, or other form of permanency outcome.</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="id0951F824E38E4222A405806682290D3A"><enum>(3)</enum><text>by inserting after paragraph (11), as redesignated by paragraph (1), the following: </text><quoted-block style="OLC" display-inline="no-display-inline" id="id6DE17F98F5AE439E82EAF67CC1A27B60"><paragraph id="idf8f7d9849f334205969e40849704ecbb"><enum>(12)</enum><header>Homeless youth</header><text>The term <term>homeless youth</term> has the meaning given the term <term>homeless children and youths</term> in section 725 of the McKinney-Vento Homeless Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/11434a">42 U.S.C. 11434a</external-xref>).</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="idFE51EEE44F564F9BB87BB5E1EA67D330"><enum>(4)</enum><text>by inserting after paragraph (24), as redesignated by paragraph (1), the following: </text><quoted-block style="OLC" display-inline="no-display-inline" id="id5DDC9864A18B47A198AC074A5BD91CFD"><paragraph id="ida000b28fc8704ba2bd8462d856788807"><enum>(25)</enum><header>Unaccompanied</header><text>The terms <term>unaccompanied</term> and <term>unaccompanied youth</term> have the meaning given the term <term>unaccompanied youth</term> in section 725 of the McKinney-Vento Homeless Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/11434a">42 U.S.C. 11434a</external-xref>).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection commented="no" id="id5281d765f45e40d7bcf219c2cec9dbc4"><enum>(b)</enum><header>Technical correction</header><text>Section 480 of the Higher Education Act of 1965, as amended by section 702(l)(2) of the FAFSA Simplification Act (title VII of division FF of <external-xref legal-doc="public-law" parsable-cite="pl/116/260">Public Law 116–260</external-xref>), is amended by striking subsections (m) and (n).</text></subsection></section><section commented="no" id="idBC2B1201E3A0469F8679F6C1805881EA"><enum>3.</enum><header>Technical corrections to FAFSA Simplification Act</header><text display-inline="no-display-inline">Section 479D of the Higher Education Act of 1965, as in effect on the effective date of the FAFSA Simplification Act (title VII of division FF of <external-xref legal-doc="public-law" parsable-cite="pl/116/260">Public Law 116–260</external-xref>), is amended—</text><paragraph commented="no" id="id7C5C128345734D81A86A6E8568AEF42C"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a)(1)(D), by inserting <quote>the same or</quote> before <quote>a prior award</quote>;</text></paragraph><paragraph commented="no" id="id3841ABD6A3CF415581670D2774D22D44"><enum>(2)</enum><text>in subsection (b)(5), by inserting <quote>the same or</quote> before <quote>a prior award</quote>; and</text></paragraph><paragraph commented="no" id="id55D56C15A7AE4D1CB261F936D9AAF840"><enum>(3)</enum><text>in subsection (d)(2)—</text><subparagraph commented="no" id="idDCDE1E0761B34E9B9DEC8AF4B4811B74"><enum>(A)</enum><text>by inserting <quote>this section, or paragraph (2), (8), or (9) of section 480(d),</quote> after <quote>pursuant to section 479A(c),</quote>; and</text></subparagraph><subparagraph commented="no" id="id85400E11440346949B04187C53530889"><enum>(B)</enum><text>by striking <quote>under such paragraph in the same award year</quote> and inserting <quote>under such provisions in the same or a prior award year</quote>.</text></subparagraph></paragraph></section><section id="id898CFF1345A64361B5D771C142E4CDBF"><enum>4.</enum><header>Student loan ombudsman assistance for homeless and foster youth</header><text display-inline="no-display-inline">Section 141(f)(3) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1018">20 U.S.C. 1018(f)(3)</external-xref>) is amended—</text><paragraph id="idAD022DAE2E834AE6A40830FAF2919DCF"><enum>(1)</enum><text display-inline="yes-display-inline">in subparagraph (A), by striking <quote>and</quote> after the semicolon;</text></paragraph><paragraph id="id98C2E887F0E84E5A8797D5279E3E5D5A"><enum>(2)</enum><text>in subparagraph (B), by striking the period at the end and inserting <quote>; and</quote>; and</text></paragraph><paragraph id="id98DD9F14B1F9406488CA1F82C69DD6C4"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idd268579711e6437e8c2f0e8a2dee9459"><subparagraph id="id9608cd09e46749fa92bb3d2833bf38b8"><enum>(C)</enum><text>receive, review, and resolve expeditiously complaints regarding a student’s independence under paragraph (2) or (8) of section 480(d), in consultation with knowledgeable parties, including child welfare agencies, local educational agency liaisons for homeless youth designated under section 722(g)(1)(J)(ii) of the McKinney-Vento Homeless Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/11432">42 U.S.C. 11432(g)(1)(J)(ii)</external-xref>), or State Coordinators for Education of Homeless Children and Youth established in accordance with section 722 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/11432">42 U.S.C. 11432</external-xref>).</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="id962B4E872AA34CE5A53DE1685701179B"><enum>5.</enum><header>Liaisons and Access to Housing for Homeless and Foster Youth</header><subsection id="idA8ECCED61BAD4452BC5B1DC126B481AA"><enum>(a)</enum><header>Access to housing</header><text display-inline="yes-display-inline">Section 487(a)(19) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1094">20 U.S.C. 1094(a)(19)</external-xref>) is amended— </text><paragraph id="id8DBA3D366B8C4F0F84E561A4D649D8E8"><enum>(1)</enum><text>by striking <quote>The institution will not</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="yes-display-inline" id="id2A3B96DB0CA540ABA368C28F9EC54A30"><text>The institution—</text><subparagraph id="idA006E606CA384660922ECB0D2B54A43F"><enum>(A)</enum><text>will not</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="id6D645DC0F21746C4BD623FB51C57E496"><enum>(2)</enum><text>by inserting <quote>housing facilities,</quote> after <quote>libraries,</quote>;</text></paragraph><paragraph id="id05CA6330C7FC4D9BBD6E97F50B44647B"><enum>(3)</enum><text>by striking <quote>institution.</quote> and inserting <quote>institution; and</quote>; and</text></paragraph><paragraph id="id11dd696db0354102b781c1d342f8c1ca"><enum>(4)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idE6BEB7E261CD4225A169D0F18138DEA2"><subparagraph id="id589E38332FA84F60BF68804CC7E09ABE"><enum>(B)</enum><text>will provide a means for students to access institutionally owned or operated housing if a student is temporarily unable to meet financial obligations related to housing, including deposits, due to delayed disbursement of vouchers for education and training made available under section 477 of part E of title IV of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/677">42 U.S.C. 677</external-xref>) or delays attributable to the institution.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id23B141E5E47F4113ABEAC87636CF79CA"><enum>(b)</enum><header>Liaisons</header><text>Section 485 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1092">20 U.S.C. 1092</external-xref>) is amended by adding at the end the following: </text><quoted-block style="OLC" display-inline="no-display-inline" id="idC9E680842EAC47D1A8FE78356EAA5273"><subsection id="idc08150d9b92d4027aedaa83ea297ad95"><enum>(n)</enum><header>Liaisons and Access to Housing for Homeless and Foster Youth</header><text>Each institution of higher education participating in any program under this title shall—</text><paragraph id="id6d9c77e2fea34be4987cad98f996e3d5"><enum>(1)</enum><text>have designated an appropriate staff person with sufficient capacity and training to act as a liaison to assist homeless youth, students who are unaccompanied, at risk of homelessness, and self-supporting, and foster care youth in accessing and completing postsecondary education, including by ensuring that those individuals are connected to applicable and available student support services, programs, and community resources such as financial aid, academic advising, housing, food, public benefits, health care, health insurance, mental health care, child care, transportation benefits, and mentoring;</text></paragraph><paragraph id="id2c0949dce8094259bdc63ef4e40e079d"><enum>(2)</enum><text>post on the institution’s website—</text><subparagraph id="idade2f3a7faae42349d49c0ef71a6221c"><enum>(A)</enum><text>the contact information for the liaison designated under paragraph (1);</text></subparagraph><subparagraph id="id3c1c8764d239430cb6a68188e74dfa0a"><enum>(B)</enum><text>information on the process for providing documentation for a determination of independence under section 479D; and</text></subparagraph><subparagraph id="id3d309c12e96c4321a48488cb1a07eab1"><enum>(C)</enum><text>information about student financial assistance and other assistance available to homeless youth, students who are unaccompanied, at risk of homelessness, and self-supporting, and foster care youth, including their eligibility as independent students under paragraphs (2) or (8) of sections 480(d);</text></subparagraph></paragraph><paragraph id="id16f57f68ae75404cb98e0a10dea11375"><enum>(3)</enum><text>give priority for any institutionally owned or operated housing facilities, including student housing facilities that remain open for occupation during school breaks or on a year-round basis, to—</text><subparagraph id="id6c3f4c72a7f14072853125fda6ebf0f4"><enum>(A)</enum><text>homeless youth;</text></subparagraph><subparagraph id="id10722f8c2fba47ca80fa90502f56ba42"><enum>(B)</enum><text>youth who are unaccompanied, at risk of homelessness, and self-supporting; and</text></subparagraph><subparagraph id="id93e9e55a4bcb4e6497f4e299989e891a"><enum>(C)</enum><text>foster care youth;</text></subparagraph></paragraph><paragraph id="id7e3d5faff6d94517a6dd2589e2fdfa39"><enum>(4)</enum><text>have developed a plan for how such homeless youth, youth who are unaccompanied, at risk of homelessness, and self-supporting, and foster care youth can access housing resources during and between academic terms, through means that may include access to institutionally owned or operated housing during breaks and a list of housing resources in the community that provide short-term housing; and</text></paragraph><paragraph id="id91cf76e7e3e440f5a95dfcbdc6d94b6e"><enum>(5)</enum><text>include, in its application for admission, questions (to be answered voluntarily) regarding the applicant’s status as a homeless youth (including unaccompanied homeless youth), youth who is unaccompanied, at risk of homelessness, and self-supporting, or foster care youth, that—</text><subparagraph id="id869ca19fb2a346e69a1c426d97c66f17"><enum>(A)</enum><text>can be answered by the applicant voluntarily for the limited purpose of being provided information about financial aid or any other available assistance;</text></subparagraph><subparagraph id="idf2d8ff273801499dbc8b4f9152386e35"><enum>(B)</enum><text>explain the key terms in the question in a manner that applicants can understand in order to self-identify with such status; and</text></subparagraph><subparagraph id="id8c9a60e3421c46e280644dc6008d845f"><enum>(C)</enum><text>with consent of the applicant, may be shared with the liaison after admission but prior to the beginning of the next academic term.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="id187E669FC75B45B681BEBB8350D08643"><enum>6.</enum><header>Serving homeless and foster youth in Federal TRIO programs</header><text display-inline="no-display-inline">Section 402A of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1070a-11">20 U.S.C. 1070a–11</external-xref>) is amended—</text><paragraph id="idd72089e551b04e988b4b7bb854e237d9"><enum>(1)</enum><text>in subsection (c)(6), by striking the last sentence and inserting the following: <quote>The Secretary shall require each applicant for funds under the programs authorized by this chapter to identify and conduct outreach to homeless youth and foster care youth, and make available to homeless youth and foster care youth services under such programs, including mentoring, tutoring, and other services provided by such programs.</quote>; and</text></paragraph><paragraph id="id5fc3c60fb1cd4156ba46c74baa6e60f4"><enum>(2)</enum><text>in subsection (f)(2), by striking <quote>college students, and</quote> and inserting <quote>college students, homeless youth, foster care youth, and</quote>. </text></paragraph></section><section id="id239E4647675348ACA07EBDAD1C7D3DD2"><enum>7.</enum><header>Serving homeless and foster youth in talent search</header><text display-inline="no-display-inline">Section 402B(d) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1070a-12">20 U.S.C. 1070a–12(d)</external-xref>) is amended—</text><paragraph id="id7AB08BC044024AFA97A58BD9B17015D4"><enum>(1)</enum><text>in paragraph (3), by striking <quote>and</quote> after the semicolon;</text></paragraph><paragraph id="id47EC010920D8452B860AB45E116B0381"><enum>(2)</enum><text>in paragraph (4), by striking the period at the end and inserting a semicolon; and</text></paragraph><paragraph id="id7D474F100ACF4E21B70376D72AA568E6"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id116e8f6712ed4de6bd26585e6713431a"><paragraph id="idd0e56bba100149b4a0db810cb8aba831"><enum>(5)</enum><text>require an assurance that the entity carrying out the project has reviewed and revised policies and practices as needed to remove barriers to the participation and retention in the project of homeless youth and foster care youth;</text></paragraph><paragraph id="id5865d5d4525e446e885caebaf3f4338a"><enum>(6)</enum><text>require that such entity submit, as part of the application for the project, a description of the activities that will be undertaken to reach out to such homeless youth and foster care youth as part of the project; and</text></paragraph><paragraph id="id9c074b3c02314dbca86dbad5e13b7eb5"><enum>(7)</enum><text>require an assurance that such entity will prepare and submit the report required under section 402H(e) at the conclusion of the project regarding such homeless youth and foster care youth.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="id8120436E38EF464286C57D21175B3B27"><enum>8.</enum><header>Serving homeless and foster youth in upward bound</header><text display-inline="no-display-inline">Section 402C(e) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1070a-13">20 U.S.C. 1070a–13(e)</external-xref>) is amended—</text><paragraph id="id4EF2DED0161744208AB0F1C030E013FF"><enum>(1)</enum><text>in paragraph (4), by striking <quote>and</quote> after the semicolon;</text></paragraph><paragraph id="id1B50DEE227D7475DB948FA30B8DAED06"><enum>(2)</enum><text>in paragraph (5), by striking the period at the end and inserting a semicolon; and</text></paragraph><paragraph id="idBCE7A655AD6D4E9ABF3D88E0F688532C"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idBA00EA24BFF344D083C84B2437E95E2D"><paragraph id="idfc6253681e3648c8891f77738aef2cd8"><enum>(6)</enum><text>require an assurance that the entity carrying out the project has reviewed and revised policies and practices as needed to remove barriers to the participation and retention in the project of homeless youth and foster care youth;</text></paragraph><paragraph id="id40a4ef367f6e4a5bb988e06f07145e43"><enum>(7)</enum><text>require that such entity submit, as part of the application, a description of the activities that will be undertaken to reach out to such homeless youth and foster care youth regarding the project; and</text></paragraph><paragraph id="id6cb5aed3ae514e44a505060495d5da9a"><enum>(8)</enum><text>require an assurance that such entity will prepare and submit the report required under section 402H(e) at the conclusion of the project regarding such homeless youth and foster care youth.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="id5B07EA1763BF41AB8E69F8A12B9B415D"><enum>9.</enum><header>Serving homeless and foster youth in student support services</header><text display-inline="no-display-inline">Section 402D(e) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1070a-14">20 U.S.C. 1070a–14(e)</external-xref>) is amended—</text><paragraph id="id04466417C1D0497BB98A4DADC00CCF11"><enum>(1)</enum><text>in paragraph (5), by striking <quote>and</quote> after the semicolon;</text></paragraph><paragraph id="idA62CE145743A42D0AE80D4ED4E78DAEC"><enum>(2)</enum><text>in paragraph (6)(B), by striking the period at the end and inserting a semicolon; and</text></paragraph><paragraph id="id9661579A08284456AAA3715D32964CE2"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id4cc361f89cce40e1b325145af776a30f"><paragraph id="idc22859de45f644ee98878b5bf9253ed3"><enum>(7)</enum><text>require an assurance that the entity carrying out the project has reviewed and revised policies and practices as needed to remove barriers to the participation and retention in the project of homeless youth and foster care youth;</text></paragraph><paragraph id="id6ac6fadc34304c57946aa66ee47e4746"><enum>(8)</enum><text>require that such entity submit, in the application for the project, a description of the activities that will be undertaken to reach out to such homeless youth and foster care youth, who are enrolled or accepted for enrollment at the institution; and</text></paragraph><paragraph id="id6385a9861c724ffe953404ec8f0d1651"><enum>(9)</enum><text>require an assurance that such entity will prepare and submit the report required under section 402H(e) at the conclusion of the project regarding such homeless youth and foster care youth.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="idBDE222CB4CD7439AB01E9BED5BE5C4FA"><enum>10.</enum><header>Serving homeless and foster youth in educational opportunity centers</header><text display-inline="no-display-inline">Section 402F(c) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1070a-16">20 U.S.C. 1070a–16(c)</external-xref>) is amended—</text><paragraph id="id3D672178395245728A353D9A239A57E8"><enum>(1)</enum><text>in paragraph (2), by striking <quote>and</quote> after the semicolon;</text></paragraph><paragraph id="id5A43763CF21A4967AF0BA156EEA5E665"><enum>(2)</enum><text>in paragraph (3), by striking the period at the end and inserting a semicolon; and</text></paragraph><paragraph id="id2600C80E4C9E4D36ABFC58A0C7ACADC9"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id5AD7BE80328D4C3EA923171DC5654204"><paragraph id="id5a28ef75f7404e15853db7c6caf3a5e7"><enum>(4)</enum><text>require an assurance that the entity carrying out the project has reviewed and revised policies and practices as needed to remove barriers to the participation and retention in the project of homeless youth and foster care youth;</text></paragraph><paragraph id="id74723d1d153845fea8440f8cb5e1f1d4"><enum>(5)</enum><text>require that such entity submit, as part of the application, a description of the activities that will be undertaken to reach out to such homeless youth and foster care youth regarding the project; and</text></paragraph><paragraph id="idfc951e0a973040709e910024a7d0aea2"><enum>(6)</enum><text>require an assurance that such entity will prepare and submit the report required under section 402H(e) at the conclusion of the project regarding such homeless youth and foster care youth.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="idB23790D6779149D698E03DA5E12B898E"><enum>11.</enum><header>Reports and evaluations</header><text display-inline="no-display-inline">Section 402H of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1070a-18">20 U.S.C. 1070a–18</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idCCC8838DBA6D446DB58A33B1610482A8"><subsection id="id058a84002e94447d83649ca5ead6b41b"><enum>(e)</enum><header>Report regarding homeless and foster youth</header><text>Each entity carrying out a project under section 402B, 402C, 402D, or 402F shall, at the conclusion of the project, prepare and submit a report to the Secretary that includes—</text><paragraph id="ida9eeac4a31ab4567b4650a6d6380b474"><enum>(1)</enum><text>data on the number of homeless youth and foster care youth served through the project; and</text></paragraph><paragraph id="id55d7e7781da44582a8ecb35fe5786dd0"><enum>(2)</enum><text>a description of any strategies or program enhancements that were used in the project and that were effective in meeting the needs of such homeless youth and foster care youth.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="idCC2D787F63DC4EF3B570D1AEB91A88DF"><enum>12.</enum><header>Serving homeless and foster youth in gaining early awareness and readiness for undergraduate programs</header><subsection commented="no" id="id3F32FDA89558450CA02EDF2084237418"><enum>(a)</enum><header>Applications</header><text display-inline="yes-display-inline">Section 404C(a)(2) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1070a-23">20 U.S.C. 1070a–23(a)(2)</external-xref>) is amended—</text><paragraph id="id77554C00A6364A4C9BE7F88CCF417C22"><enum>(1)</enum><text>in subparagraph (I), by striking <quote>and</quote> after the semicolon;</text></paragraph><paragraph id="idE844F7CCCE214523BC8715872CB40ED6"><enum>(2)</enum><text>in subparagraph (J), by striking the period at the end and inserting <quote>; and</quote>; and</text></paragraph><paragraph id="idA7B113CA08154762839FF3DC0EFC80C9"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idD3F1D7FEFEF54ABF9BE72FDEAA1B4FEA"><subparagraph id="id0625d9b482b04588bcd9b0998f34f8ff"><enum>(K)</enum><text>require an assurance that the entity carrying out the project has reviewed and revised policies and practices as needed to remove barriers to the participation and retention in the project of homeless youth and foster care youth;</text></subparagraph><subparagraph id="id21bf163c139f40f7ad702ebcaf7583f3"><enum>(L)</enum><text>require that such entity submit, as part of the assurance, a description of the activities that will be undertaken to reach out to such homeless youth and foster care youth regarding the project; and</text></subparagraph><subparagraph id="idb756f2de9b65445b88cd73a83b1f2c1a"><enum>(M)</enum><text>require an assurance that such entity will prepare and submit the report required under section 404G(c) at the conclusion of the project regarding such homeless youth and foster care youth.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection commented="no" id="id9d5ce14a86f2466fb92ee8f3e8bb82c7"><enum>(b)</enum><header>Permissible activities</header><text>Section 404D(b) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1070a-24">20 U.S.C. 1070a–24(b)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id0602471554C245CBAA839E9E4E6191BE"><paragraph id="id790bfc5423e34f64beea321f1be955e8"><enum>(16)</enum><text>Facilitating the recruitment, participation, and retention of homeless youth and foster care youth, which may include—</text><subparagraph id="ide4965a8f2f304bb1950b4871fb4dd8af"><enum>(A)</enum><text>establishing partnerships with community-based organizations, child welfare agencies, homeless shelters, and local educational agency liaisons for homeless individuals designated under section 722(g)(1)(J)(ii) of the McKinney-Vento Homeless Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/11432">42 U.S.C. 11432(g)(1)(J)(ii)</external-xref>) to identify students, improve policies and practices, and to establish data sharing agreements;</text></subparagraph><subparagraph id="ide7218d3db16642308c5503a5582067e8"><enum>(B)</enum><text>carrying out—</text><clause id="iddbfd35ba5abe47e8bcd31250eec0635d"><enum>(i)</enum><text>activities to facilitate continued participation despite changes in residence resulting from homelessness or foster care placement; and</text></clause><clause id="idbf085a7ad0a74fe08835431016906d72"><enum>(ii)</enum><text>policies consistent with the McKinney-Vento Homeless Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/11301">42 U.S.C. 11301 et seq.</external-xref>) to allow for such participation and retention, including allowing continued participation when an eligible student is no longer enrolled in a school served under this chapter on a temporary basis, or providing transitional services and referrals when an eligible student is no longer enrolled in a school served under this chapter on a permanent basis; and</text></clause></subparagraph><subparagraph id="idb5297199bf2645859b8bbb645978a346"><enum>(C)</enum><text>carrying out other activities to meet the needs of such homeless youth and foster care youth.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" id="idc22fb7246fe64dd6bf2a57a350e6c286"><enum>(c)</enum><header>Evaluation and report</header><text>Section 404G of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1070a-27">20 U.S.C. 1070a–27</external-xref>) is amended—</text><paragraph commented="no" id="idF7439C44439A4245BFB52BAE599C7711"><enum>(1)</enum><text>by redesignating subsections (c) and (d), as subsections (d) and (e), respectively; and</text></paragraph><paragraph id="id0b2146a0296342a48c10da95da4838e3"><enum>(2)</enum><text>inserting after subsection (b) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idC5E6647E48CB4796B93124FD02F5B5EA"><subsection id="id153b4715f2ca4e6484fa6d75a9483333"><enum>(c)</enum><header>Report regarding homeless and foster youth</header><text>Each entity carrying out a project under section 404A shall, at the conclusion of the project, prepare and submit a report to the Secretary that includes—</text><paragraph id="idb13a1c95c8b2415b866acd41172ebc2c"><enum>(1)</enum><text>data on the number of homeless youth and foster care youth served through the project; and</text></paragraph><paragraph id="idfb9bb13e9880419fb8d03708c5eb5e76"><enum>(2)</enum><text>a description of any strategies or program enhancements that were used in the project and that were effective in meeting the needs of such homeless youth and foster care youth.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section><section id="id988D157CF5D14A57906C580C71455B69"><enum>13.</enum><header>Priority for Federal work-study programs for homeless and foster youth</header><text display-inline="no-display-inline">Section 443(b)(6) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1087-53">20 U.S.C. 1087–53(b)(6)</external-xref>) is amended by inserting <quote>, and prioritize employment for students who are homeless youth or foster care youth</quote> after <quote>thereof</quote>. </text></section><section id="id76d0c6dc10394460a5ae9fcd496b87ca"><enum>14.</enum><header>Data transparency on the number of pending requests for determination by homeless youth</header><text display-inline="no-display-inline">Section 483(c)(2)(B) is amended—</text><paragraph id="id1BAB9BA5F1AD488499E73257F77C0A22"><enum>(1)</enum><text>in clause (i), by striking <quote>and</quote> after the semicolon;</text></paragraph><paragraph id="id2EA594E4471340EA82F5D9F0E7525D84"><enum>(2)</enum><text>in clause (ii), by striking the period at the end and inserting <quote>; and</quote>; and</text></paragraph><paragraph id="idDFBA1C32EEE148D6B034EA8B8D152495"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="ide57fd48ae884462297aa3a2caf498729"><clause id="id57971e187c79456fbe934f1ed0e66a95"><enum>(iii)</enum><text>the number of undetermined requests for homelessness consideration, including statuses that remain unknown because no determination had been made in response to the applicant’s request for the institution to consider the applicant’s special circumstance of being homeless.</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="idf57f318307f64b9eb5bb65fc6c41b1af"><enum>15.</enum><header>In-State tuition rates for homeless and foster youth</header><text display-inline="no-display-inline">Section 135 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1015d">20 U.S.C. 1015d</external-xref>) is amended—</text><paragraph id="idce84a362c3ff4c50a87b1aed6ba335f3"><enum>(1)</enum><text>in the section heading, by inserting <quote><header-in-text level="section" style="OLC">, homeless youth and foster care youth</header-in-text></quote> after <quote><header-in-text level="section" style="OLC">children</header-in-text></quote>; </text></paragraph><paragraph id="id32d139413d3a4ad28a4247c1b320ea25"><enum>(2)</enum><text>in subsection (a)—</text><subparagraph id="idec8a94a8cc7948f8a4785680e69767e1"><enum>(A)</enum><text>by striking <quote>(a) <header-in-text level="subsection" style="OLC">Requirement</header-in-text>.—In the case</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idf152374eb15142c6af29c289ad567839"><subsection id="id1e704919295b4b72aea0dc4a45e95f7b"><enum>(a)</enum><header>Requirement</header><paragraph id="iddedc49d190474a76b62606d96080cbc3"><enum>(1)</enum><header>Armed forces</header><text>In the case</text></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="idf4faa066a8ec472dafc5b979f34d41d5"><enum>(B)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id2d105b4f749f40a6a0289a542eaf503b"><paragraph id="id0fbaa676c6384522ab8cf0e88b656404"><enum>(2)</enum><header>Homeless and foster youth</header><text>In the case of a homeless youth or a foster care youth, such State shall not charge such individual tuition and required fees for attendance at a public institution of higher education in the State at a rate that is greater than the rate of tuition and required fees charged for residents of the State.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="idc320f24a5bff4f2d9b588d7b89fee02b"><enum>(3)</enum><text>by striking subsections (c) and (d) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="iddc4bd586b44c4180ac08de2314f2b775"><subsection id="id8543a8630e0049128796ecaa9b03e113"><enum>(c)</enum><header>Effective date</header><paragraph id="id1a532d9ed3b04b9db78aa5d27de9d0e2"><enum>(1)</enum><header>Armed forces</header><text>With respect to an individual described in subsection (a)(1), this section shall take effect at each public institution of higher education in a State that receives assistance under this Act for the first period of enrollment at such institution that begins after July 1, 2009.</text></paragraph><paragraph id="idff7e58d1c0a740fca90744a2db79c4f6"><enum>(2)</enum><header>Homeless and foster youth</header><text>With respect to an individual described in subsection (a)(2), this section shall take effect at each public institution of higher education in a State that receives assistance under this Act for the first period of enrollment at such institution that begins during the first full award year following the effective date of the <short-title>Higher Education Access and Success for Homeless and Foster Youth Act of 2022</short-title>. </text></paragraph></subsection><subsection commented="no" id="id12cd50cac0b9477a9d77147ed8e45e64"><enum>(d)</enum><header>Definitions</header><text>In this section, the terms <term>armed forces</term> and <term>active duty for a period of more than 30 days</term> have the meanings given those terms in section 101 of title 10, United States Code.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="id8B8E03546563411389C2405C9D89F51D"><enum>16.</enum><header>Secretarial support and guidance for homeless and foster youth</header><text display-inline="no-display-inline">Part B of title I (<external-xref legal-doc="usc" parsable-cite="usc/20/1011">20 U.S.C. 1011 et seq.</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id9352B62110A8402F83CACC9B3337E17D"><section id="idF6A946DA30FE4C57B523DAA9DB9029DD"><enum>124.</enum><header>Secretarial support and guidance for homeless and foster youth</header><subsection id="idB12962FC3C494B819B0555D1C4594039"><enum>(a)</enum><header>Guidance</header><text>Not later than 120 days after the date of enactment of the <short-title>Higher Education Access and Success for Homeless and Foster Youth Act of 2022</short-title>, the Secretary shall issue revised guidance for institutions and financial aid administrators regarding serving homeless youth (including unaccompanied homeless youth), students who are unaccompanied, at risk of homelessness, and self-supporting, and foster care youth, including the requirements of the determination process for financial aid administrators as specified in section 479D. </text></subsection><subsection id="idCDD96481F65A48A1A83591EC18EDE36E"><enum>(b)</enum><header>Professional development</header><text>Beginning not later than 1 year after the date of enactment of the <short-title>Higher Education Access and Success for Homeless and Foster Youth Act of 2022</short-title>, the Secretary shall conduct an annual professional development or training program, such as a webinar, for liaisons described under section 485(n) and interested faculty or staff regarding postsecondary education services for such homeless youth (including unaccompanied homeless youth), students who are unaccompanied, at risk of homelessness, and self-supporting, and foster care youth.</text></subsection><subsection id="id925F4A9C0A3040CFBAC47F300FD99C46"><enum>(c)</enum><header>Report</header><text>Not later than 1 year after the date of enactment of the <short-title>Higher Education Access and Success for Homeless and Foster Youth Act of 2022</short-title>, and not less than once every 5 years thereafter, the Secretary shall prepare and submit to Congress a report containing strategies used by institutions, financial aid administrators, and liaisons described under section 485(n) that were effective in meeting the needs of such homeless youth (including unaccompanied homeless youth), students who are unaccompanied, at risk of homelessness, and self-supporting, and foster care youth, including strategies relating to streamlining financial aid policies and procedures and postsecondary education recruitment, retention, and completion.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="id7132c56bcf924005b2522035ef291272"><enum>17.</enum><header>Effective date</header><text display-inline="no-display-inline">The amendments made by this Act shall take effect and apply as if included in the FAFSA Simplification Act (title VII of division FF of <external-xref legal-doc="public-law" parsable-cite="pl/116/260">Public Law 116–260</external-xref>) and in accordance with section 701(b) of such Act.</text></section></legis-body></bill>
