<congress>One Hundred Seventeenth Congress of the United States of America</congress><session display="yes">2d Session</session><enrolled-dateline display="yes">Begun and held at the City of Washington on Monday, the third day of January, two thousand and twenty two</enrolled-dateline><legis-num display="yes">S. 3580</legis-num><current-chamber display="no">IN THE SENATE OF THE UNITED STATES</current-chamber><legis-type display="yes">AN ACT</legis-type><official-title display="yes">To amend title 46, United States Code, with respect to prohibited acts by ocean common carriers or marine terminal operators, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="idab7ca743-929d-4a39-b4f3-3ea9d4cdf449" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Ocean Shipping Reform Act of 2022</short-title></quote>.</text></section><section section-type="subsequent-section" id="idc3e8d689-fb8d-4412-aaad-e1874fa7dda6" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>2.</enum><header display-inline="yes-display-inline">Purposes</header><text display-inline="no-display-inline">Section 40101 of title 46, United States Code, is amended—</text><paragraph id="id5f063b1c-d8ca-4fa5-978e-b7c7c42d56bb" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">by striking paragraph (2) and inserting the following: </text><quoted-block style="USC" display-inline="no-display-inline" id="id68b324f6-b865-4513-bcf1-2c57a2afee8e" changed="not-changed"><paragraph id="id75bd06f9-7f42-439b-af59-bb3894f983c4" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">ensure an efficient, competitive, and economical transportation system in the ocean commerce of the United States;</text></paragraph><after-quoted-block display="yes">; </after-quoted-block></quoted-block></paragraph><paragraph id="id21e84797-1b6d-4978-8acc-bc30fa7ffd32" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">in paragraph (3), by inserting <quote>and supporting commerce</quote> after <quote>needs</quote>; and</text></paragraph><paragraph id="idb4589c57-4621-4a28-95b9-4f9fdf9601c1" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(3)</enum><text display-inline="yes-display-inline">by striking paragraph (4) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idc9c9e60a8d7e452e93435787af1c4ea7" changed="not-changed"><paragraph id="id6111e0c54d454d1996a1cba341f0b794" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(4)</enum><text display-inline="yes-display-inline">promote the growth and development of United States exports through a competitive and efficient system for the carriage of goods by water in the foreign commerce of the United States, and by placing a greater reliance on the marketplace.</text></paragraph><after-quoted-block display="yes">.</after-quoted-block></quoted-block></paragraph></section><section commented="no" id="idd8791554-a0c1-4d40-9827-cb383a9c2b70" changed="not-changed" display-inline="no-display-inline" section-type="subsequent-section"><enum>3.</enum><header display-inline="yes-display-inline">Service contracts</header><text display-inline="no-display-inline">Section 40502(c) of title 46, United States Code, is amended—</text><paragraph commented="no" id="id23168b1c-2dc1-48e6-84c8-d2bc3ac1549b" changed="not-changed" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (7), by striking <quote>; and</quote> and inserting a semicolon;</text></paragraph><paragraph commented="no" id="id874ca2e6-90f1-4f8c-9f3a-2f748af76cab" changed="not-changed" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">in paragraph (8), by striking the period and inserting <quote>; and</quote>; and</text></paragraph><paragraph commented="no" id="ide47da9c3-a21d-4ba9-a63a-88befa96f930" changed="not-changed" display-inline="no-display-inline"><enum>(3)</enum><text display-inline="yes-display-inline">by adding at the end the following: </text><quoted-block style="USC" display-inline="no-display-inline" id="id288de634-eb0e-4018-8eeb-09fd4c59b757" changed="not-changed"><paragraph commented="no" id="id1be8e0a2-56a5-4afc-b855-7aac694336dc" changed="not-changed" display-inline="no-display-inline"><enum>(9)</enum><text display-inline="yes-display-inline">any other essential terms that the Federal Maritime Commission determines necessary or appropriate through a rulemaking process.</text></paragraph><after-quoted-block display="yes">.</after-quoted-block></quoted-block></paragraph></section><section id="id3fc22634-4e44-4abb-a222-01066ee4c53b" changed="not-changed" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>4.</enum><header display-inline="yes-display-inline">Shipping exchange registry</header><subsection id="id4ed768c3-84cc-48c9-93fa-228bc2321162" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/46/405">Chapter 405</external-xref> of title 46, United States Code, is amended by adding at the end the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="idf20a06f0-8aef-4901-b508-07e28d0f866c" changed="not-changed"><section id="id4a72776a-6c66-41bd-ac6c-4f90adf85ad7" changed="not-changed" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>40504.</enum><header display-inline="yes-display-inline">Shipping exchange registry</header><subsection id="id00ca96c5-80e3-448f-942e-733e3ce3a1e7" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">No person may operate a shipping exchange involving ocean transportation in the foreign commerce of the United States unless the shipping exchange is registered as a national shipping exchange under the terms and conditions provided in this section and the regulations issued pursuant to this section.</text></subsection><subsection id="id7d2c7d2a-7d0d-4b05-ab38-02063f352571" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header display-inline="yes-display-inline">Registration</header><text display-inline="yes-display-inline">A person shall register a shipping exchange by filing with the Federal Maritime Commission an application for registration in such form as the Commission, by rule, may prescribe, containing the rules of the exchange and such other information and documents as the Commission, by rule, may prescribe as necessary or appropriate to complete a shipping exchange’s registration.</text></subsection><subsection id="idf288b3a1-64d1-4592-9782-4389d1a9ea19" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(c)</enum><header display-inline="yes-display-inline">Exemption</header><text display-inline="yes-display-inline">The Commission may exempt, conditionally or unconditionally, a shipping exchange from registration under this section if the Commission finds that the shipping exchange is subject to comparable, comprehensive supervision and regulation by the appropriate governmental authorities in a foreign country where the shipping exchange is headquartered.</text></subsection><subsection id="id9a332d7a-5b88-4399-bece-983c82a5b64b" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(d)</enum><header display-inline="yes-display-inline">Regulations</header><text display-inline="yes-display-inline">Not later than 3 years after the date of enactment of the <short-title>Ocean Shipping Reform Act of 2022</short-title>, the Commission shall issue regulations pursuant to subsection (a), which shall set standards necessary to carry out subtitle IV of this title for registered national shipping exchanges. For consideration of a service contract entered into by a shipping exchange, the Commission shall be limited to the minimum essential terms for service contracts established under section 40502 of this title.</text></subsection><subsection id="id50f0d779133d4f06a14a7351aae991e5" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(e)</enum><header display-inline="yes-display-inline">Definition of shipping exchange</header><text display-inline="yes-display-inline">In this section, the term <term>shipping exchange</term> means a platform (digital, over-the-counter, or otherwise) that connects shippers with common carriers for the purpose of entering into underlying agreements or contracts for the transport of cargo, by vessel or other modes of transportation.</text></subsection></section><after-quoted-block display="yes">.</after-quoted-block></quoted-block></subsection><subsection id="id90dff59d-48b4-40b2-bec2-b785f4c31f7c" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header display-inline="yes-display-inline">Applicability</header><text display-inline="yes-display-inline">The registration requirement under section 40504 of title 46, United States Code (as added by subsection (a)), shall take effect on the date on which the Federal Maritime Commission states the rule is effective in the regulations issued under such section.</text></subsection><subsection id="id3c82d17a-d6dd-42be-ab39-42165ac82f5a" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(c)</enum><header display-inline="yes-display-inline">Clerical amendment</header><text display-inline="yes-display-inline">The analysis for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/46/405">chapter 405</external-xref> of title 46, United States Code, is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id05614c82-7c3b-4e4c-ad1f-bcbea33c37fe" changed="not-changed"><toc changed="not-changed"><toc-entry bold="off" level="section" changed="not-changed">40504. Shipping exchange registry.</toc-entry></toc><after-quoted-block display="yes">.</after-quoted-block></quoted-block></subsection></section><section id="id056e1507-16b5-48d0-8b5b-bcede98283cd" changed="not-changed" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>5.</enum><header display-inline="yes-display-inline">Prohibition on retaliation</header><text display-inline="no-display-inline">Section 41102 of title 46, United States Code, is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idc9d4abeab78c47a0b1435be895171146" changed="not-changed"><subsection id="ida728b60908b4430a8dbc5ae8a12116c3" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(d)</enum><header display-inline="yes-display-inline">Retaliation and other discriminatory actions</header><text display-inline="yes-display-inline">A common carrier, marine terminal operator, or ocean transportation intermediary, acting alone or in conjunction with any other person, directly or indirectly, may not—</text><paragraph id="idcba039a794d141b08e92ee7292c93385" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">retaliate against a shipper, an agent of a shipper, an ocean transportation intermediary, or a motor carrier by refusing, or threatening to refuse, an otherwise-available cargo space accommodation; or</text></paragraph><paragraph id="id53d8a1168800455c8ee200f66b5d3b54" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">resort to any other unfair or unjustly discriminatory action for—</text><subparagraph id="id364ec4738bc746fb9ec8bccde3fd4d59" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">the reason that a shipper, an agent of a shipper, an ocean transportation intermediary, or motor carrier has—</text><clause id="idb652fc00ae0a4da0866e6fc0de947981" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">patronized another carrier; or</text></clause><clause id="id639cc355b8ab4f7a840c19efb9458dac" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">filed a complaint against the common carrier, marine terminal operator, or ocean transportation intermediary; or</text></clause></subparagraph><subparagraph id="id0e322f27809d43338b90c18fae1962ca" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">any other reason.</text></subparagraph></paragraph></subsection><after-quoted-block display="yes">.</after-quoted-block></quoted-block></section><section id="idc07ec90b-0663-44e5-ba89-589a9edad85b" changed="not-changed" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>6.</enum><header display-inline="yes-display-inline">Public disclosure</header><text display-inline="no-display-inline">Section 46106 of title 46, United States Code, is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id0D84378BE9BF4A48A775C7CA46C0DFC4" changed="not-changed"><subsection id="id09acca47-2a86-4962-aa44-55d015cdb3fc" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(d)</enum><header display-inline="yes-display-inline">Public disclosures</header><text display-inline="yes-display-inline">The Federal Maritime Commission shall publish, and annually update, on the website of the Commission—</text><paragraph id="id553607d329f0413b8e7e2d49c987e064" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">all findings by the Commission of false detention and demurrage invoice information by common carriers under section 41104(a)(15) of this title; and </text></paragraph><paragraph id="ide6bfe474d797498e9acee99e677dedb7" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">all penalties imposed or assessed against common carriers, as applicable, under sections 41107, 41108, and 41109, listed by each common carrier.</text></paragraph></subsection><after-quoted-block display="yes">.</after-quoted-block></quoted-block></section><section id="id4a971e81b7fe4c82a511d804d4401b55" changed="not-changed" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>7.</enum><header display-inline="yes-display-inline">Common carriers</header><subsection id="id0ccec91590914333bdb6ec5a6120cd69" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 41104 of title 46, United States Code, is amended—</text><paragraph id="id35ad296468974d4789e94e75bc5f4025" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a)—</text><subparagraph id="id5dcc82d5b91942c79fe67daf50fae2e4" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">in the matter preceding paragraph (1), by striking <quote>may not</quote> and inserting <quote>shall not</quote>;</text></subparagraph><subparagraph id="idbfb016b546344fc7895b402e08f410ef" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">by striking paragraph (3) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id2519f6debc804c8ba77bc197bac5c9f7" changed="not-changed"><paragraph id="id21a8daa8e33f42b090d304e7ef79a442" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(3)</enum><text display-inline="yes-display-inline">unreasonably refuse cargo space accommodations when available, or resort to other unfair or unjustly discriminatory methods;</text></paragraph><after-quoted-block display="yes">;</after-quoted-block></quoted-block></subparagraph><subparagraph id="idf5a0d4aa6ffb4539b9cd5db938db9b3b" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">in paragraph (5), by striking<quote> in the matter of rates or charges</quote> and inserting <quote>against any commodity group or type of shipment or in the matter of rates or charges</quote>;</text></subparagraph><subparagraph id="id4a56d858c19a45b4872cd655c7cfa5d4" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(D)</enum><text display-inline="yes-display-inline">in paragraph (10), by adding <quote>, including with respect to vessel space accommodations provided by an ocean common carrier</quote> after <quote>negotiate</quote>;</text></subparagraph><subparagraph id="id36005989303f4b52ab5ddf07e98e930b" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(E)</enum><text display-inline="yes-display-inline">in paragraph (12) by striking <quote>; or</quote> and inserting a semicolon;</text></subparagraph><subparagraph id="idca702edde37d42ccb9ed24a8f8db9e77" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(F)</enum><text display-inline="yes-display-inline">in paragraph (13) by striking the period and inserting a semicolon; and</text></subparagraph><subparagraph id="id60dc3722d36e466c834db33142b3fe97" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(G)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idb09b467e9fe04b55b2633ba74dce1e44" changed="not-changed"><paragraph id="id29c753e59cd24d1cab6eda8e8a0675a9" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(14)</enum><text display-inline="yes-display-inline">assess any party for a charge that is inconsistent or does not comply with all applicable provisions and regulations, including subsection (c) of section 41102 or part 545 of title 46, Code of Federal Regulations (or successor regulations); </text></paragraph><paragraph id="id5de8f00203404d08a561317094d303db" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(15)</enum><text display-inline="yes-display-inline">invoice any party for demurrage or detention charges unless the invoice includes information as described in subsection (d) showing that such charges comply with—</text><subparagraph id="id224c5719f02e47d4b372c5f79a5bd946" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">all provisions of part 545 of title 46, Code of Federal Regulations (or successor regulations); and</text></subparagraph><subparagraph id="idc72533059b584117b4a7bf44ebdddd45" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">applicable provisions and regulations, including the principles of the final rule published on May 18, 2020, entitled <quote>Interpretive Rule on Demurrage and Detention Under the Shipping Act</quote> (or successor rule); or</text></subparagraph></paragraph><paragraph id="id64464E1FE3634D63AD96F02ECED82EB2" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(16)</enum><text display-inline="yes-display-inline">for service pursuant to a service contract, give any undue or unreasonable preference or advantage or impose any undue or unreasonable prejudice or disadvantage against any commodity group or type of shipment.</text></paragraph><after-quoted-block display="yes">; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="id5bbb0bc8df734e1d97ca6fba119ba49c" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="ideb2ac2c43ebe42bdab1ca82e8ff280d8" changed="not-changed"><subsection id="id401d3a414ae14aefa4f76f9c0316dac4" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(d)</enum><header display-inline="yes-display-inline">Detention and demurrage invoice information</header><paragraph id="id30A283C91DF946DE8ACF9FBE73D7A6E8" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">Inaccurate invoice</header><text display-inline="yes-display-inline">If the Commission determines, after an investigation in response to a submission under section 41310, that an invoice under subsection (a)(15) was inaccurate or false, penalties or refunds under section 41107 shall be applied. </text></paragraph><paragraph id="id85F829198FB446F69CF5D8670DA2EB42" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Contents of invoice</header><text display-inline="yes-display-inline">An invoice under subsection (a)(15), unless otherwise determined by subsequent Commission rulemaking, shall include accurate information on each of the following, as well as minimum information as determined by the Commission:</text><subparagraph id="idb7099133327a4c99b33ff0e86b99a018" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">Date that container is made available.</text></subparagraph><subparagraph id="id71d1255b8fc843e48fda05b4e95a4cd2" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">The port of discharge.</text></subparagraph><subparagraph id="id4a9d4b12abdc440eaf404d39ee13ec5d" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">The container number or numbers.</text></subparagraph><subparagraph id="idb1ae998ccbab4738af1f433c0e133038" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(D)</enum><text display-inline="yes-display-inline">For exported shipments, the earliest return date.</text></subparagraph><subparagraph id="ide924a655d2f94809b21549d27d6bfcea" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(E)</enum><text display-inline="yes-display-inline">The allowed free time in days.</text></subparagraph><subparagraph id="idbbc106a1d2504a54907a27938050a4be" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(F)</enum><text display-inline="yes-display-inline">The start date of free time.</text></subparagraph><subparagraph id="id944cdddf0c97431c86ba1fca00fe70be" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(G)</enum><text display-inline="yes-display-inline">The end date of free time.</text></subparagraph><subparagraph id="ida5edf2859caa41f79273b6b439592b49" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(H)</enum><text display-inline="yes-display-inline">The applicable detention or demurrage rule on which the daily rate is based.</text></subparagraph><subparagraph id="id68d7cfb985994ebba19f28dce20c8771" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(I)</enum><text display-inline="yes-display-inline">The applicable rate or rates per the applicable rule.</text></subparagraph><subparagraph id="id93098284eb5b42a5ad78c5a1f747ccc9" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(J)</enum><text display-inline="yes-display-inline">The total amount due.</text></subparagraph><subparagraph id="idbe391d0fba474b3db052e482fe7bb818" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(K)</enum><text display-inline="yes-display-inline">The email, telephone number, or other appropriate contact information for questions or requests for mitigation of fees.</text></subparagraph><subparagraph id="ide59c7ac9f09e4355837cfca567d61d58" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(L)</enum><text display-inline="yes-display-inline">A statement that the charges are consistent with any of Federal Maritime Commission rules with respect to detention and demurrage.</text></subparagraph><subparagraph id="id1f90ab75ff0d47168e786a767737da3d" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(M)</enum><text display-inline="yes-display-inline">A statement that the common carrier’s performance did not cause or contribute to the underlying invoiced charges. </text></subparagraph></paragraph></subsection><subsection id="idae2a4f3e1b724bbab1227e24d3b89d9f" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(e)</enum><header display-inline="yes-display-inline">Safe harbor</header><text display-inline="yes-display-inline">If a non-vessel operating common carrier passes through to the relevant shipper an invoice made by the ocean common carrier, and the Commission finds that the non-vessel operating common carrier is not otherwise responsible for the charge, then the ocean common carrier shall be subject to refunds or penalties pursuant to subsection (d)(1).</text></subsection><subsection id="ide689189883264207a4e0b4b5ac0fe66b" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(f)</enum><header display-inline="yes-display-inline">Elimination of charge obligation</header><text display-inline="yes-display-inline">Failure to include the information required under subsection (d) on an invoice with any demurrage or detention charge shall eliminate any obligation of the charged party to pay the applicable charge. </text></subsection><after-quoted-block display="yes">.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="idEED12940106D4B7092218A6275A50317" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header display-inline="yes-display-inline">Rulemaking on demurrage or detention</header><paragraph id="idDEF1AEFF188849518089734564F02A4E" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 45 days after the date of enactment of this Act, the Federal Maritime Commission shall initiate a rulemaking further defining prohibited practices by common carriers, marine terminal operators, shippers, and ocean transportation intermediaries under section 41102(c) of title 46, United States Code, regarding the assessment of demurrage or detention charges. The Federal Maritime Commission shall issue a final rule defining such practices not later than 1 year after the date of enactment of this Act.</text></paragraph><paragraph id="id075697d821304fe59c639f738bf182dd" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Contents</header><text display-inline="yes-display-inline">The rule under paragraph (1) shall only seek to further clarify reasonable rules and practices related to the assessment of detention and demurrage charges to address the issues identified in the final rule published on May 18, 2020, entitled <quote>Interpretive Rule on Demurrage and Detention Under the Shipping Act</quote> (or successor rule), including a determination of which parties may be appropriately billed for any demurrage, detention, or other similar per container charges.</text></paragraph></subsection><subsection id="idC072446A17884E44994BD9ABDAE42860" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(c)</enum><header display-inline="yes-display-inline">Rulemaking on unfair or unjustly discriminatory methods</header><text display-inline="yes-display-inline">Not later than 60 days after the date of enactment of this Act, the Federal Maritime Commission shall initiate a rulemaking defining unfair or unjustly discriminatory methods under section 41104(a)(3) of title 46, United States Code, as amended by this section. The Federal Maritime Commission shall issue a final rule not later than 1 year after the date of enactment of this Act.</text></subsection><subsection id="idbc70bc5a720a42ed84bed176a7ac9248" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(d)</enum><header display-inline="yes-display-inline">Rulemaking on unreasonable refusal to deal or negotiate with respect to vessel space accommodations</header><text display-inline="yes-display-inline">Not later than 30 days after the date of enactment of this Act, the Federal Maritime Commission, in consultation with the Commandant of the United States Coast Guard, shall initiate a rulemaking defining unreasonable refusal to deal or negotiate with respect to vessel space under section 41104(a)(10) of title 46, as amended by this section. The Federal Maritime Commission shall issue a final rule not later than 6 months after the date of enactment of this Act. </text></subsection></section><section id="id0a229cbd-fe19-43a0-a7a1-42714df8cad4" changed="not-changed" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>8.</enum><header display-inline="yes-display-inline">Assessment of penalties or refunds</header><subsection id="id6d1d7ecb-f14f-4b42-8849-f4b39d6eb7b4" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Title 46, United States Code, is amended—</text><paragraph id="id565e9c56-b3df-47d8-acbe-7eecaa8f35b6" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">in section 41107—</text><subparagraph id="id2d3093a9-6ff9-4e07-ae29-c24089edf820" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">in the section heading, by inserting <quote><header-in-text level="section" style="USC">or refunds</header-in-text></quote> after <quote><header-in-text level="section" style="USC">penalties</header-in-text></quote>;</text></subparagraph><subparagraph id="id0fd516ce-8474-4025-b600-cfbce8441ce0" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">in subsection (a), by inserting <quote>or, in addition to or in lieu of a civil penalty, is liable for the refund of a charge</quote> after <quote>civil penalty</quote>; and</text></subparagraph><subparagraph id="idbc8357d2-404b-4aa8-ab5d-ebca25fc65ad" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">in subsection (b), by inserting <quote>or, in addition to or in lieu of a civil penalty, the refund of a charge,</quote> after <quote>civil penalty</quote>; and</text></subparagraph></paragraph><paragraph id="idd7db0ac2c86c4d168f6b5a1b8d26ff19" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">section 41109 is amended—</text><subparagraph id="id3447b1b109b3430d8f4eb268fc6f5bf5" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">by striking subsections (a) and (b) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id3d24bf58c1114aa9b4adc458a0e9cfb8" changed="not-changed"><subsection id="id2497b1756e564b9c8fbe333522f9568f" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header display-inline="yes-display-inline">General authority</header><text display-inline="yes-display-inline">Until a matter is referred to the Attorney General, the Federal Maritime Commission may—</text><paragraph id="idea240b1724074cebbf361657d574fb65" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">after notice and opportunity for a hearing, in accordance with this part—</text><subparagraph id="idd59dc60b00544c538488d186b93d7685" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">assess a civil penalty; or</text></subparagraph><subparagraph id="idaca2d9772ab4441f98949a2d0ff99a7a" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">in addition to, or in lieu of, assessing a civil penalty under subparagraph (A), order a refund of money (including additional amounts in accordance with section 41305(c)), subject to subsection (b)(2); and</text></subparagraph></paragraph><paragraph id="id753c855a1a294ea198650b4f9dabb51b" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">compromise, modify, or remit, with or without conditions, a civil penalty or refund imposed under paragraph (1).</text></paragraph></subsection><subsection id="idfcc562e255a84465a6f80165d82611aa" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header display-inline="yes-display-inline">Determination of amount</header><paragraph id="id825120da64454527bbfd97f3ad15a12b" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">Factors for consideration</header><text display-inline="yes-display-inline">In determining the amount of a civil penalty assessed or refund of money ordered pursuant to subsection (a), the Federal Maritime Commission shall take into consideration—</text><subparagraph id="id5355acf0887b4b23bc8d1e378f14bd27" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">the nature, circumstances, extent, and gravity of the violation committed;</text></subparagraph><subparagraph id="id60120a1083f44bc79d6dd99b540f35b1" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">with respect to the violator—</text><clause id="id9f130e4e449f47e09c2be9e0672b565e" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">the degree of culpability;</text></clause><clause id="idc02ca465b35a46948adb98c3601f9d8e" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">any history of prior offenses;</text></clause><clause id="id273251ca9a0e4d3bb62185f54ad5264f" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(iii)</enum><text display-inline="yes-display-inline">the ability to pay; and</text></clause><clause id="id063af4c3ede745f0abb0a6c0abf2d26c" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(iv)</enum><text display-inline="yes-display-inline">such other matters as justice may require; and</text></clause></subparagraph><subparagraph id="idc1705ec9017f4fb1a3ce6cae1580437b" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">the amount of any refund of money ordered pursuant to subsection (a)(1)(B).</text></subparagraph></paragraph><paragraph id="id55c5bb89cc034d8b9a25f0c5aeebb04a" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Commensurate reduction in civil penalty</header><subparagraph id="ida47e49e39ad04ef98e27617ae57702c5" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">In any case in which the Federal Maritime Commission orders a refund of money pursuant to subsection (a)(1)(B) in addition to assessing a civil penalty pursuant to subsection (a)(1)(A), the amount of the civil penalty assessed shall be decreased by any additional amounts included in the refund of money in excess of the actual injury (as defined in section 41305(a)).</text></subparagraph><subparagraph id="id362199f44c784cd58ce63d54b2a4f575" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><header display-inline="yes-display-inline">Treatment of refunds</header><text display-inline="yes-display-inline">A refund of money ordered pursuant to subsection (a)(1)(B) shall be—</text><clause id="id610c08b160374a429721679325513878" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">considered to be compensation paid to the applicable claimant; and</text></clause><clause id="id8515cfe8fe3d48159e34571f77382392" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">deducted from the total amount of damages awarded to that claimant in a civil action against the violator relating to the applicable violation.</text></clause></subparagraph></paragraph></subsection><after-quoted-block display="yes">;</after-quoted-block></quoted-block></subparagraph><subparagraph id="id77e687c4a1c047a4b6c24adb4d80d161" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">in subsection (c), by striking <quote>may not be imposed</quote> and inserting <quote>or refund of money under subparagraph (A) or (B), respectively, of subsection (a)(1) may not be imposed</quote>;</text></subparagraph><subparagraph id="idacbca05d77564edead9df43c5e981d9b" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">in subsection (e), by inserting <quote>or order a refund of money</quote> after <quote>penalty</quote>;</text></subparagraph><subparagraph id="id77aec7e614324f08b2bd3cdf1f3d00c2" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(D)</enum><text display-inline="yes-display-inline">in subsection (f), by inserting <quote>, or that is ordered to refund money,</quote> after <quote>assessed</quote>; and</text></subparagraph><subparagraph id="id7eef99f4bc484c858f6bfa1c97d956b8" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(E)</enum><text display-inline="yes-display-inline">in subsection (g), in the first sentence, by inserting <quote>or a refund required under this section</quote> after <quote>penalty</quote>. </text></subparagraph></paragraph></subsection></section><section id="id546b4233-1150-4db5-8f6e-cb486fd0b1e7" changed="not-changed" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>9.</enum><header display-inline="yes-display-inline">Data collection</header><subsection id="idBAFCFE57DD134489AC88BE7FA295ACEF" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header display-inline="yes-display-inline">In General</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/46/411">Chapter 411</external-xref> of title 46, United States Code, is amended by adding at the end the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="id951dc3cc-69df-4eb0-a127-bdb69d3573c9" changed="not-changed"><section id="ideb4abc0b-6ab5-4569-a0c7-2f056e3c2df4" changed="not-changed" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>41110.</enum><header display-inline="yes-display-inline">Data collection</header><subsection id="id45148af22dc8426d80e0b16d6afaca20" changed="not-changed" commented="no" display-inline="no-display-inline"><enum/><text display-inline="yes-display-inline">The Federal Maritime Commission shall publish on its website a calendar quarterly report that describes the total import and export tonnage and the total loaded and empty 20-foot equivalent units per vessel (making port in the United States, including any territory or possession of the United States) operated by each ocean common carrier covered under this chapter. Ocean common carriers under this chapter shall provide to the Commission all necessary information, as determined by the Commission, for completion of this report.</text></subsection></section><after-quoted-block display="yes">.</after-quoted-block></quoted-block></subsection><subsection id="id1DB1865DCE6B4ABBB52A05F02342748F" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header display-inline="yes-display-inline">Rule of construction</header><text display-inline="yes-display-inline">Nothing in this section, and the amendment made by this section, shall be construed to compel the public disclosure of any confidential or proprietary data, in accordance with section 552(b)(4) of title 5, United States Code.</text></subsection><subsection id="id98e9f1d8-0c13-4884-8141-1e4769f7ced6" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(c)</enum><header display-inline="yes-display-inline">Clerical amendment</header><text display-inline="yes-display-inline">The analysis for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/46/411">chapter 411</external-xref> of title 46, United States Code, is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idba5267a7-2f5e-4e9b-9f41-19e33f4dbf50" changed="not-changed"><toc changed="not-changed"><toc-entry bold="off" level="section" changed="not-changed">41110. Data collection.</toc-entry></toc><after-quoted-block display="yes">.</after-quoted-block></quoted-block></subsection></section><section id="id3bcfce3e-9ac4-4a82-b28f-8fb061eba6d2" commented="no" changed="not-changed" display-inline="no-display-inline" section-type="subsequent-section"><enum>10.</enum><header display-inline="yes-display-inline">Charge complaints</header><subsection id="id99709336-4d00-4057-af9d-a7ae3af26fb0" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/46/413">Chapter 413</external-xref> of title 46, United States Code, is amended by adding at the end the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="id9482c568-e65b-4a95-9096-a77eb8b123b5" changed="not-changed"><section id="id76cb5695-fb8c-4f7c-83be-7533fee86113" changed="not-changed" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>41310.</enum><header display-inline="yes-display-inline">Charge complaints</header><subsection id="idf68cbd34-55ff-4190-b7a4-41ae777dc8de" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">A person may submit to the Federal Maritime Commission, and the Commission shall accept, information concerning complaints about charges assessed by a common carrier. The information submitted to the Commission shall include the bill of lading numbers and invoices, and may include any other relevant information. </text></subsection><subsection id="id1849fb83-61ba-4446-9e66-854e88dab199" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header display-inline="yes-display-inline">Investigation</header><text display-inline="yes-display-inline">Upon receipt of a submission under subsection (a), with respect to a charge assessed by a common carrier, the Commission shall promptly investigate the charge with regard to compliance with section 41104(a) and section 41102. The common carrier shall—</text><paragraph id="id2071d3cf-cf88-4bc6-8bdc-48ad9fc700f0" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">be provided an opportunity to submit additional information related to the charge in question; and</text></paragraph><paragraph id="idf7ff6fa7-4492-4155-9b47-1b7ac07e6cc8" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">bear the burden of establishing the reasonableness of any demurrage or detention charges pursuant to section 545.5 of title 46, Code of Federal Regulations (or successor regulations).</text></paragraph></subsection><subsection id="idc05e8176-c492-479e-a0a5-bd23cefb5a01" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(c)</enum><header display-inline="yes-display-inline">Refund</header><text display-inline="yes-display-inline">Upon receipt of submissions under subsection (a), if the Commission determines that a charge does not comply with section 41104(a) or 41102, the Commission shall promptly order the refund of charges paid.</text></subsection><subsection id="id7E2CD4347F9F4147944F3F7EFF38E56F" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(d)</enum><header display-inline="yes-display-inline">Penalties</header><text display-inline="yes-display-inline">In the event of a finding that a charge does not comply with section 41104(a) or 41102 after submission under subsection (a), a civil penalty under section 41107 shall be applied to the common carrier making such charge.</text></subsection><subsection id="idee1ebc7a01b44633a48b1be0f142682e" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(e)</enum><header display-inline="yes-display-inline">Considerations</header><text display-inline="yes-display-inline">If the common carrier assessing the charge is acting in the capacity of a non-vessel-operating common carrier, the Commission shall, while conducting an investigation under subsection (b), consider—</text><paragraph id="id4bd88dadbff74f5b8be1f912289e7918" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">whether the non-vessel-operating common carrier is responsible for the noncompliant assessment of the charge, in whole or in part; and</text></paragraph><paragraph id="idc05ba4c689c7488bbea03f3592630d64" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">whether another party is ultimately responsible in whole or in part and potentially subject to action under subsections (c) and (d).</text></paragraph></subsection></section><after-quoted-block display="yes">. </after-quoted-block></quoted-block></subsection><subsection id="id46fa268f-b03c-4d69-b912-0caff44d243e" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header display-inline="yes-display-inline">Clerical amendment</header><text display-inline="yes-display-inline">The analysis for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/46/413">chapter 413</external-xref> of title 46, United States Code, is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idd3868199-9013-4b72-aa76-279df2a6952b" changed="not-changed"><toc changed="not-changed"><toc-entry bold="off" level="section" changed="not-changed">41310. and</text></subparagraph><subparagraph id="idb771000aa389433fb4e492d7d05f82bf" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">not greater than 45 feet.</text></subparagraph></paragraph><paragraph id="id04cdef769aed4815a0afae1196806daa" commented="no" changed="not-changed" display-inline="no-display-inline"><enum>(3)</enum><header display-inline="yes-display-inline">Out of service percentage</header><text display-inline="yes-display-inline">The term <term>out of service percentage</term> means the proportion of the chassis fleet for any defined geographical area that is out of service at any one time.</text></paragraph><paragraph id="idd5a23813c48241e9aff52e141bf76224" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(4)</enum><header display-inline="yes-display-inline">Street dwell time</header><text display-inline="yes-display-inline">The term <term>street dwell time</term>, with respect to a piece of equipment, means the quantity of time during which the piece of equipment is in use outside of the terminal. </text></paragraph></subsection><subsection id="id0e6e4cba975444bc8d3b14777adc0e8a" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header display-inline="yes-display-inline">Authority to collect data</header><paragraph id="id4b72775e008d4369a5b27c4653b98715" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Each port, marine terminal operator, and chassis owner or provider with a fleet of over 50 chassis that supply chassis for a fee shall submit to the Director such data as the Director determines to be necessary for the implementation of this section, subject to subchapter III of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/44/35">chapter 35</external-xref> of title 44, United States Code.</text></paragraph><paragraph id="id205cf73eda0241bea918d0ac047f481d" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Approval by OMB</header><text display-inline="yes-display-inline">Subject to the availability of appropriations, not later than 60 days after the date of enactment of this Act, the Director of the Office of Management and Budget shall approve an information collection for purposes of this section.</text></paragraph></subsection><subsection id="id4f45997fc85948a3a98d9eebffd26416" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(c)</enum><header display-inline="yes-display-inline">Publication</header><text display-inline="yes-display-inline">Subject to the availability of appropriations, not later than 240 days after the date of enactment of this Act, and not less frequently than monthly thereafter, the Director shall publish statistics relating to the dwell time of equipment used in intermodal transportation at the top 25 ports, including inland ports, by 20-foot equivalent unit, including—</text><paragraph id="idda5158ac413c40b5aca4233c9a31686a" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">total street dwell time, from all causes, of marine containers and marine container chassis; and</text></paragraph><paragraph id="id8b313ac2d28041139a63aa33fa2f4ab4" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">the average out of service percentage, which shall not be identifiable with any particular port, marine terminal operator, or chassis provider.</text></paragraph></subsection><subsection id="id4d7895868f1f4f7481569cd691629a5e" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(d)</enum><header display-inline="yes-display-inline">Factors</header><text display-inline="yes-display-inline">Subject to the availability of appropriations, to the maximum extent practicable, the Director shall publish the statistics described in subsection (c) on a local, regional, and national basis.</text></subsection><subsection id="id4f90ec39e8134078a3758352860bb2ca" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(e)</enum><header display-inline="yes-display-inline">Sunset</header><text display-inline="yes-display-inline">The authority under this section shall expire December 31, 2026. </text></subsection></section><section id="id869349a9e14049258de175fab8d3f95d" commented="no" changed="not-changed" display-inline="no-display-inline" section-type="subsequent-section"><enum>17.</enum><header display-inline="yes-display-inline">Federal maritime commission activities</header><subsection id="id28a885ab316d4a8c92985224d3944f4f" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header display-inline="yes-display-inline">Public submissions to commission</header><text display-inline="yes-display-inline">The Federal Maritime Commission shall—</text><paragraph id="id1fa439e971c74c6d94203c6279fe205d" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">establish on the public website of the Commission a webpage that allows for the submission of comments, complaints, concerns, reports of noncompliance, requests for investigation, and requests for alternative dispute resolution; and</text></paragraph><paragraph id="id0d2b337971b4466ba147610123654f5e" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">direct each submission under the link established under paragraph (1) to the appropriate component office of the Commission.</text></paragraph></subsection><subsection id="id92273034cb66438c83c42f6b588faee5" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header display-inline="yes-display-inline">Authorization of Office of Consumer Affairs and Dispute Resolution Services</header><text display-inline="yes-display-inline">The Commission shall maintain an Office of Consumer Affairs and Dispute Resolution Services to provide nonadjudicative ombuds assistance, mediation, facilitation, and arbitration to resolve challenges and disputes involving cargo shipments, household good shipments, and cruises subject to the jurisdiction of the Commission.</text></subsection><subsection id="id0538e8a79c35496bbc95a18048b26b22" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(c)</enum><header display-inline="yes-display-inline">Enhancing capacity for investigations</header><paragraph id="id33147ad4020f4453aa83655947a8fcae" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Pursuant to section 41302 of title 46, United States Code, not later than 18 months after the date of enactment of this Act, the Chairperson of the Commission shall staff within the Bureau of Enforcement, the Bureau of Certification and Licensing, the Office of the Managing Director, the Office of Consumer Affairs and Dispute Resolution Services, and the Bureau of Trade Analysis not fewer than 7 total positions to assist in investigations and oversight, in addition to the positions within the Bureau of Enforcement, the Bureau of Certification and Licensing, the Office of the Managing Director, the Office of Consumer Affairs and Dispute Resolution Services, and the Bureau of Trade Analysis on that date of enactment.</text></paragraph><paragraph id="id3778627a34164538bd05761e686a353e" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Duties</header><text display-inline="yes-display-inline">The additional staff appointed under paragraph (1) shall provide support—</text><subparagraph id="id120f4af8504f46dc9e62f881e2633f19" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">to Area Representatives of the Bureau of Enforcement;</text></subparagraph><subparagraph id="idcc15d51d263343d7b422b01b211a4eab" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">to attorneys of the Bureau of Enforcement in enforcing the laws and regulations subject to the jurisdiction of the Commission;</text></subparagraph><subparagraph id="idbd52e195548f48b8a69138638c963540" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">for the alternative dispute resolution services of the Commission; or</text></subparagraph><subparagraph id="id41d01ff75b56494a8bfd39fb701e88a4" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(D)</enum><text display-inline="yes-display-inline">for the review of agreements and activities subject to the authority of the Commission.</text></subparagraph></paragraph></subsection></section><section id="id7d04e3e19fba4372ac773ec72e979832" commented="no" changed="not-changed" display-inline="no-display-inline" section-type="subsequent-section"><enum>18.</enum><header display-inline="yes-display-inline">Temporary emergency authority</header><subsection id="id1223829056ce48ffa94e3968f999bfee" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">In this section: </text><paragraph id="id6d055a6b600e4bc78763f5918916d6fd" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">Common carrier</header><text display-inline="yes-display-inline">The term <term>common carrier</term> has the meaning given the term in section 40102 of title 46, United States Code.</text></paragraph><paragraph id="id00b5d6f1bf6c4cb3ae27ace260a323c8" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Motor carrier</header><text display-inline="yes-display-inline">The term <term>motor carrier</term> has the meaning given the term in section 13102 of title 49, United States Code.</text></paragraph><paragraph id="id38fd12a7d1fe4c43af9c933bee59142f" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(3)</enum><header display-inline="yes-display-inline">Rail carrier</header><text display-inline="yes-display-inline">The term <term>rail carrier</term> has the meaning given the term in section 10102 of title 49, United States Code.</text></paragraph><paragraph id="id86edd95246234c6faacd0d6f76f3476f" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(4)</enum><header display-inline="yes-display-inline">Shipper</header><text display-inline="yes-display-inline">The term <term>shipper</term> has the meaning given the term in section 40102 of title 46, United States Code.</text></paragraph></subsection><subsection id="idc7288f9e621845408f667fe7a4b814c5" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header display-inline="yes-display-inline">Public input on information sharing</header><paragraph id="ida89d939f019143a18efb37465279dcee" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 60 days after the date of enactment of this Act, the Federal Maritime Commission shall issue a request for information, seeking public comment regarding—</text><subparagraph id="id15ad45d1c82b4f9a89c06d00259c4e49" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">whether congestion of the carriage of goods has created an emergency situation of a magnitude such that there exists a substantial, adverse effect on the competitiveness and reliability of the international ocean transportation supply system;</text></subparagraph><subparagraph id="id8d39cc8635be4f2ca68e86cc0674f490" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">whether an emergency order under this section would alleviate such an emergency situation; and</text></subparagraph><subparagraph id="id8508e1af97ac424e9c63ab91604da5f3" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">the appropriate scope of such an emergency order, if applicable.</text></subparagraph></paragraph><paragraph id="id33b7648a6c944828aa14964a180241f7" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Consultation</header><text display-inline="yes-display-inline">During the public comment period under paragraph (1), the Commission may consult, as the Commission determines to be appropriate, with—</text><subparagraph id="id47a14a3d9a414d16b71656e45569039d" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">other Federal departments and agencies; and</text></subparagraph><subparagraph id="id2dfebfe5eeec437fb155ead7679cb363" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">persons with expertise relating to maritime and freight operations.</text></subparagraph></paragraph></subsection><subsection id="id4a10ab60dce84e0f9adf3ffc84a4371a" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(c)</enum><header display-inline="yes-display-inline">Authority To require information sharing</header><text display-inline="yes-display-inline">On making a unanimous determination described in subsection (d), the Commission may issue an emergency order requiring any common carrier or marine terminal operator to share directly with relevant shippers, rail carriers, or motor carriers information relating to cargo throughput and availability, in order to ensure the efficient transportation, loading, and unloading of cargo to or from—</text><paragraph id="id0fa8e5a0f9cb4d86bea01d77003b357d" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">any inland destination or point of origin;</text></paragraph><paragraph id="ida0bbb22569c74385bbb83ce35f35d603" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">any vessel; or</text></paragraph><paragraph id="id437d840bcfad4ebf9aa2bcbd418ac697" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(3)</enum><text display-inline="yes-display-inline">any point on a wharf or terminal.</text></paragraph></subsection><subsection id="id2e40a99d314441f6836364846da76964" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(d)</enum><header display-inline="yes-display-inline">Description of determination</header><paragraph id="ida860c11b37b44c53a3ea26174aa8d848" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">A determination referred to in subsection (c) is a unanimous determination by the commissioners on the Commission that congestion of carriage of goods has created an emergency situation of a magnitude such that there exists a substantial, adverse effect on the competitiveness and reliability of the international ocean transportation supply system.</text></paragraph><paragraph id="id1706b0e0db2c4917999f5a29cc1d10fc" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Factors for consideration</header><text display-inline="yes-display-inline">In issuing an emergency order pursuant to subsection (c), the Commission shall tailor the emergency order with respect to temporal and geographic scope, taking into consideration the likely burdens on common carriers and marine terminal operators and the likely benefits on congestion relating to the purposes described in section 40101 of title 46, United States Code.</text></paragraph></subsection><subsection id="id7068e38d4e0a4c76a7032af126e25a43" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(e)</enum><header display-inline="yes-display-inline">Petitions for exception</header><paragraph id="id05e6b45c87c4456ba1fe4ef5c4a4999e" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">A common carrier or marine terminal operator subject to an emergency order issued pursuant to this section may submit to the Commission a petition for exception from 1 or more requirements of the emergency order, based on a showing of undue hardship or other condition rendering compliance with such a requirement impracticable.</text></paragraph><paragraph id="id0cac5eec9f3148d6988445a9b37ca8d0" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Determination</header><text display-inline="yes-display-inline">The Commission shall make a determination regarding a petition for exception under paragraph (1) by—</text><subparagraph id="id33d1350918e74e44a547466739c55285" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">majority vote; and</text></subparagraph><subparagraph id="iddd75f18e5ecd4282ae3f85a6ced8fdb6" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">not later than 21 days after the date on which the petition is submitted.</text></subparagraph></paragraph><paragraph id="ida78961b9f4a243439d24abd01e189cae" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(3)</enum><header display-inline="yes-display-inline">Inapplicability pending review</header><text display-inline="yes-display-inline">The requirements of an emergency order that is the subject of a petition for exception under this subsection shall not apply to the petitioner during the period for which the petition is pending.</text></paragraph></subsection><subsection id="ide97251a632a546c2b3fb26aec8a5f2d2" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(f)</enum><header display-inline="yes-display-inline">Limitations</header><paragraph id="id1c742a811869455ab9eb3d9f91da7ec6" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">Term</header><text display-inline="yes-display-inline">An emergency order issued pursuant to this section—</text><subparagraph id="idf0049472bd434a7c8bafcfe48cce86a4" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">shall remain in effect for a period of not longer than 60 days; but</text></subparagraph><subparagraph id="id2c007d53d2534859ae80b34b8d1ed590" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">may be renewed by a unanimous determination of the Commission.</text></subparagraph></paragraph><paragraph id="idcdda08213951482587471e36c1c98605" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Sunset</header><text display-inline="yes-display-inline">The authority provided by this section shall terminate on the date that is 18 months after the date of enactment of this Act.</text></paragraph><paragraph id="idfc3e1b6909c84423bf121a9c7022611a" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(3)</enum><header display-inline="yes-display-inline">Investigative authority unaffected</header><text display-inline="yes-display-inline">Nothing in this section shall affect the investigative authorities of the Commission as described in subpart R of part 502 of title 46, Code of Federal Regulations. </text></paragraph></subsection></section><section id="idf7288d1a3f6c433f84da361cb4bb7b69" changed="not-changed" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>19.</enum><header display-inline="yes-display-inline">Best practices for chassis pools</header><subsection id="id0cb59a1d7d67410083cb2ff82c54986a" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than April 1, 2023, the Federal Maritime Commission shall enter into an agreement with the Transportation Research Board of the National Academies of Sciences, Engineering, and Medicine under which the Transportation Research Board shall carry out a study and develop best practices for on-terminal or near-terminal chassis pools that provide service to marine terminal operators, motor carriers, railroads, and other stakeholders that use the chassis pools, with the goal of optimizing supply chain efficiency and effectiveness.</text></subsection><subsection id="id158023b95dcb4231bfad113368312f78" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header display-inline="yes-display-inline">Requirements</header><text display-inline="yes-display-inline">In developing best practices under subsection (a), the Transportation Research Board shall—</text><paragraph id="ide14244b0d0a64e3987a87d5eba72e67f" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">take into consideration—</text><subparagraph id="idca3c17edcb924c8c9cd3f1b47acb83cb" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">practical obstacles to the implementation of chassis pools; and</text></subparagraph><subparagraph id="id59b48ba62be04d4eb51ade09f86b896f" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">potential solutions to those obstacles; and</text></subparagraph></paragraph><paragraph id="id510011e4c31c49e09683f5eb01086f35" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">address relevant communication practices, information sharing, and knowledge management.</text></paragraph></subsection><subsection id="id02C912BF534B47C3A04AA9FD2DD73AB1" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(c)</enum><header display-inline="yes-display-inline">Publication</header><text display-inline="yes-display-inline">The Commission shall publish the best practices developed under this section on a publicly available website by not later than April 1, 2024.</text></subsection><subsection id="id30735417396B4E9F8948B3B8482EE732" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(d)</enum><header display-inline="yes-display-inline">Funding</header><text display-inline="yes-display-inline">Subject to appropriations, the Commission may expend such sums as are necessary, but not to exceed $500,000, to carry out this section. </text></subsection></section><section changed="not-changed" commented="no" id="idcd897777816c4f9fa1b728f8ca5778eb" display-inline="no-display-inline" section-type="subsequent-section"><enum>20.</enum><header display-inline="yes-display-inline">Licensing testing</header><subsection id="ideeed3bd8d91a47c88c8a53912132c3f6" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 90 days after the date of enactment of this Act, the Administrator of the Federal Motor Carrier Safety Administration (referred to in this section as the <quote>Administrator</quote>) shall conduct a review of the discretionary waiver authority described in the document issued by the Administrator entitled <quote>Waiver for States Concerning Third Party CDL Skills Test Examiners In Response to the COVID–19 Emergency</quote> and dated August 31, 2021, for safety concerns.</text></subsection><subsection commented="no" id="id88f72c91d7d44e92aa21233fe32bf71a" changed="not-changed" display-inline="no-display-inline"><enum>(b)</enum><header display-inline="yes-display-inline">Permanent waiver</header><text display-inline="yes-display-inline">If the Administrator finds no safety concerns after conducting a review under subsection (a), the Administrator shall—</text><paragraph commented="no" id="idC7AB69C5DA19462F92B8128AF7D50950" changed="not-changed" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">notwithstanding any other provision of law, make the waiver permanent; and</text></paragraph><paragraph commented="no" id="idF2F777709A0D4B0FB537465C06D634CB" changed="not-changed" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">not later than 90 days after completing the review under subsection (a), revise section 384.228 of title 49, Code of Federal Regulations, to provide that the discretionary waiver authority referred to in subsection (a) shall be permanent.</text></paragraph></subsection><subsection commented="no" id="id2F79859964EC44CA9CB805CC371CBB69" changed="not-changed" display-inline="no-display-inline"><enum>(c)</enum><header display-inline="yes-display-inline">Report</header><text display-inline="yes-display-inline">If the Administrator declines to move forward with a rulemaking for revision under subsection (b), the Administrator shall explain the reasons for declining to move forward with the rulemaking in a report to the Committee on Commerce, Science, and Transportation of the Senate and the Committee on Transportation and Infrastructure of the House of Representatives.</text></subsection></section><section id="id459BC1F78503467883F03E7184CAB980" changed="not-changed" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>21.</enum><header display-inline="yes-display-inline">Planning</header><subsection changed="not-changed" id="idB167238894A24C87924502E5C4888CF0" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header display-inline="yes-display-inline">Amendment</header><text display-inline="yes-display-inline">Section 6702(g) of title 49, United States Code, is amended—</text><paragraph id="id9423AFA0773A45BB93D5762819D480DA" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">by striking <quote>Of the amounts</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idF15689CB436F46E1AE5A787090AE3D0D" changed="not-changed"><paragraph id="id804AE3259FC84D2BB0BCC9FE37DE1E3C" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Of the amounts</text></paragraph><after-quoted-block display="yes">; and</after-quoted-block></quoted-block></paragraph><paragraph id="id3B96B020AE5A4C2E9807232178B9A727" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idD862480FE61F411FA93961522DCC4B15" changed="not-changed"><paragraph id="id04C465D2CE7A4B1AA7F0A26CEE0959E5" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Nonapplicability of certain limitations</header><text display-inline="yes-display-inline">Subparagraphs (A) and (B) of subsection (c)(2) shall not apply with respect to amounts made available for planning, preparation, or design under paragraph (1). </text></paragraph><after-quoted-block display="yes">.</after-quoted-block></quoted-block></paragraph></subsection><subsection changed="not-changed" id="idCB58776A6A0648D9B08B7470C3A92209" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header display-inline="yes-display-inline">Emergency designation</header><text display-inline="yes-display-inline">Amounts for which outlays are affected under the amendments made by subsection (a) that were previously designated by the Congress as an emergency requirement pursuant to section 4112(a) of H. Con. Res. 71 (115th Congress), the concurrent resolution on the budget for fiscal year 2018, and to section 251(b) of the Balanced Budget and Emergency Deficit Control Act of 1985 are designated by the Congress as an emergency requirement pursuant to section 4001(a)(1) and section 4001(b) of S. Con. Res. 14 (117th Congress), the concurrent resolution on the budget for fiscal year 2022.</text></subsection></section><section id="idAB134C8C02F84BB98067B9DC3559B94A" changed="not-changed" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>22.</enum><header display-inline="yes-display-inline">Review of potential discrimination against transportation of qualified hazardous materials</header><subsection id="ida0990da6f68f479599df99ae718249b9" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 90 days after the date of enactment of this Act, the Comptroller General of the United States shall initiate a review of whether there have been any systemic decisions by ocean common carriers to discriminate against maritime transport of qualified hazardous materials by unreasonably denying vessel space accommodations, equipment, or other instrumentalities needed to transport such materials. The Comptroller General shall take into account any applicable safety and pollution regulations. </text></subsection><subsection id="id13DCA0F1FDA84DD398D2A6B90DB5E5FD" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header display-inline="yes-display-inline">Consultation</header><text display-inline="yes-display-inline">The Comptroller General of the United States may consult with the Commandant of the Coast Guard and the Chair of the Federal Maritime Commission in conducting the review under this section. </text></subsection><subsection id="idb85044b1de174887993e37b44e3cf298" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(c)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">In this section:</text><paragraph id="idc572a172d148433eb51b8dc3849fcedb" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">Hazardous materials</header><text display-inline="yes-display-inline">The term <term>hazardous materials</term> includes dangerous goods, as defined by the International Maritime Dangerous Goods Code.</text></paragraph><paragraph id="idadbbe3de17414787a39d0e6fae6b432a" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Ocean common carrier</header><text display-inline="yes-display-inline">The term <term>ocean common carrier</term> has the meaning given such term in section 40102 of title 46, United States Code.</text></paragraph><paragraph id="id9b165af354ba449f83ffbe0f0fbc4761" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(3)</enum><header display-inline="yes-display-inline">Qualified hazardous materials</header><text display-inline="yes-display-inline">The term <term>qualified hazardous materials</term> means hazardous materials for which the shipper has certified to the ocean common carrier that such materials have been or will be tendered in accordance with applicable safety laws, including regulations.</text></paragraph><paragraph id="id9069b1dd47ba4c0fbd7c53e3af447865" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(4)</enum><header display-inline="yes-display-inline">Shipper</header><text display-inline="yes-display-inline">The term <term>shipper</term> has the meaning given such term in section 40102 of title 46, United States Code. </text></paragraph></subsection></section><section id="id5BB10C09FFA24D05881A1448354C8EE3" changed="not-changed" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>23.</enum><header display-inline="yes-display-inline">Transportation Worker Identification Credentials</header><subsection id="idFF9D7109ED4B408C9D01BF33C6B76E3A" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header display-inline="yes-display-inline">Definition of direct assistance to a United States port</header><text display-inline="yes-display-inline">In this section:</text><paragraph id="id8A4BB23A007444EEBF0FF07F427EF660" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The term <term>direct assistance to a United States port</term> means the transportation of cargo directly to or from a United States port.</text></paragraph><paragraph id="idD8DADDF29D644F079219B2D6FB25619F" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Exclusions</header><text display-inline="yes-display-inline">The term <term>direct assistance to a United States port</term> does not include—</text><subparagraph id="id7CD04CD5C3DA42888BED5DED258EA48C" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">the transportation of a mixed load of cargo that includes—</text><clause id="id655378564B374B33AE08F3D3294AF184" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">cargo that does not originate from a United States port; or</text></clause><clause id="id6579B936142246EA80F6CD4AD865B1C1" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">a container or cargo that is not bound for a United States port;</text></clause></subparagraph><subparagraph id="id59A209D38ED947458AC14B79684AC5BF" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">any period during which a motor carrier or driver is operating in interstate commerce to transport cargo or provide services not in support of transportation to or from a United States port; or</text></subparagraph><subparagraph id="id9F9CDBEF35024202921F49E276E4588B" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">the period after a motor carrier dispatches the applicable driver or commercial motor vehicle of the motor carrier to another location to begin operation in interstate commerce in a manner that is not in support of transportation to or from a United States port.</text></subparagraph></paragraph></subsection><subsection id="id06171dcaf2ca415995d9a3f74219575f" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header display-inline="yes-display-inline">Transportation Worker Identification Credentials</header><text display-inline="yes-display-inline">The Administrator of the Transportation Security Administration and the Commandant of the Coast Guard shall jointly prioritize and expedite the consideration of applications for a Transportation Worker Identification Credential with respect to applicants that reasonably demonstrate that the purpose of the Transportation Worker Identification Credential is for providing, within the interior of the United States, direct assistance to a United States port. </text></subsection></section><section id="id134248f4884b44b78bbee15f48f4c5b2" changed="not-changed" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>24.</enum><header display-inline="yes-display-inline">Use of United States inland ports for storage and transfer of cargo containers</header><subsection id="id344BC13EE8F34319B9F3A4728D8F95B4" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header display-inline="yes-display-inline">Meeting</header><text display-inline="yes-display-inline">Not later than 90 days after the date of enactment of this Act, the Assistant Secretary for Transportation Policy, in consultation with the Administrator of the Maritime Administration and the Chairperson of the Federal Maritime Commission, shall convene a meeting of representatives of entities described in subsection (b) to discuss the feasibility of, and strategies for, identifying Federal and non-Federal land, including inland ports, for the purposes of storage and transfer of cargo containers due to port congestion.</text></subsection><subsection id="id596D7C92E28D44EBB72CBFB2909C7A33" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header display-inline="yes-display-inline">Description of entities</header><text display-inline="yes-display-inline">The entities referred to in subsection (a) are—</text><paragraph id="id6D0A321F83DA4C50B01F3DED18752B31" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">representatives of United States major gateway ports, inland ports, and export terminals;</text></paragraph><paragraph id="id35C3B6F187DF4F7FB860B899E177FFC6" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">ocean carriers;</text></paragraph><paragraph id="idE51B2AE237914561960C8D28C69E3F6E" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(3)</enum><text display-inline="yes-display-inline">railroads;</text></paragraph><paragraph id="idDD1CA9F2790449C09E8EE9E7585FE388" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(4)</enum><text display-inline="yes-display-inline">trucking companies;</text></paragraph><paragraph id="id3d65087e60554f119ce9d104b2862b88" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(5)</enum><text display-inline="yes-display-inline">port workforce, including organized labor; and</text></paragraph><paragraph id="idb44553e70b4c441588f74b21cddb8e1d" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(6)</enum><text display-inline="yes-display-inline">such other stakeholders as the Secretary of Transportation, in consultation with the Chairperson of the Federal Maritime Commission, determines to be appropriate.</text></paragraph></subsection><subsection id="id11738b6d88eb498785b407b1dbcee9fb" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(c)</enum><header display-inline="yes-display-inline">Report to Congress</header><text display-inline="yes-display-inline">As soon as practicable after the date of the meeting convened under subsection (a), the Assistant Secretary for Transportation Policy, in consultation with the Administrator of the Maritime Administration and the Chairperson of the Federal Maritime Commission, shall submit to Congress a report describing—</text><paragraph id="idA351431397444278A3A7A5A634D0F6E1" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">the results of the meeting;</text></paragraph><paragraph id="idB94CA202BEC546AFA3E2822AD8D2410A" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">the feasibility of identifying land or property under the jurisdiction of United States, or ports in the United States, for storage and transfer of cargo containers; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id788F0FC475A34164ACBE1B9EC499B40B" changed="not-changed"><enum>(3)</enum><text display-inline="yes-display-inline">recommendations relating to the meeting, if any.</text></paragraph></subsection><subsection id="idcc071a66df6649e2a33ec15db6aaaa4c" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(d)</enum><header display-inline="yes-display-inline">Savings provision</header><text display-inline="yes-display-inline">No authorization contained in this section may be acted on in a manner that jeopardizes or negatively impacts the national security or defense readiness of the United States.</text></subsection></section><section id="id1EA36DDEA4364C37B3A866E50FD1ACEE" changed="not-changed" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>25.</enum><header display-inline="yes-display-inline">Report on adoption of technology at United States ports</header><text display-inline="no-display-inline">Not later than 1 year after the date of enactment of this Act, the Comptroller General of the United States shall submit to Congress a report describing the adoption of technology at United States ports, as compared to that adoption at foreign ports, including—</text><paragraph id="id26154B2CD33B434E8F58C4AEE0714EBF" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">the technological capabilities of United States ports, as compared to foreign ports;</text></paragraph><paragraph id="id17F00068D2F746A8BEC16AD5F8D5BC00" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">an assessment of whether the adoption of technology at United States ports could lower the costs of cargo handling;</text></paragraph><paragraph id="id79E99FB050F34EF5AE92C6E854B0C5DF" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(3)</enum><text display-inline="yes-display-inline">an assessment of regulatory and other barriers to the adoption of technology at United States ports; and</text></paragraph><paragraph id="idD4FEEDB7C59849148B02B79696059E16" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(4)</enum><text display-inline="yes-display-inline">an assessment of technology and the workforce. </text></paragraph></section><section id="id3e842937e2344d02b82c87385e3ae72e" commented="no" changed="not-changed" display-inline="no-display-inline" section-type="subsequent-section"><enum>26.</enum><header display-inline="yes-display-inline">Authorization of appropriations</header><text display-inline="no-display-inline">Section 46108 of title 46, United States Code, is amended by striking <quote>$29,086,888 for fiscal year 2020 and $29,639,538 for fiscal year 2021</quote> and inserting <quote>$32,869,000 for fiscal year 2022, $38,260,000 for fiscal year 2023, $43,720,000 for fiscal year 2024, and $49,200,000 for fiscal year 2025</quote>.</text></section></legis-body><attestation><attestation-group><attestor display="no"></attestor><role>Speaker of the House of Representatives</role></attestation-group><attestation-group><attestor display="no"></attestor><role>Vice President of the United States and President of the Senate</role></attestation-group></attestation></bill>
