BILL</legis-type><official-title>To promote peace and democracy in Ethiopia, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one" changed="deleted" reported-display-style="strikethrough" committee-id="SSFR00"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Ethiopia Peace and Democracy Promotion Act of 2021</short-title></quote>.</text></section><section id="id6D2CDB6DD40B4C64AD5B763057BA6828" changed="deleted" reported-display-style="strikethrough" committee-id="SSFR00"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="id9C6A37E1515A4A1D8CEB109CC170C451"><enum>(1)</enum><header>Appropriate congressional committees</header><text>The term <term>appropriate congressional committees</term> means the Committee on Foreign Relations of the Senate and the Committee on Foreign Affairs of the House of Representatives.</text></paragraph><paragraph id="id625EC486EB10443AA4A8BBF14E196394"><enum>(2)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of State.</text></paragraph></section><section id="id2B47D9DAC5AC4388B674339E92158E83" changed="deleted" reported-display-style="strikethrough" committee-id="SSFR00"><enum>3.</enum><header>Findings</header><text display-inline="no-display-inline">Congress makes the following findings:</text><paragraph id="ideeb6fa6ab7ce47d19e4f4ce22616a0fd"><enum>(1)</enum><text>The United States and the Federal Democratic Republic of Ethiopia share an important relationship and more than a century of diplomatic relations.</text></paragraph><paragraph id="idf0b87e5b8f544e2bb851dfdbc4545c38"><enum>(2)</enum><text>Ethiopia is the second most populous country in Africa and plays a key role in advancing security and stability across sub-Saharan Africa, including as a top contributor of uniformed personnel to United Nations peacekeeping missions and as host country to the African Union.</text></paragraph><paragraph id="id88fc7fa578fb444a83eb2bc7b7891df1"><enum>(3)</enum><text>Amid proliferating popular protests in 2018, against decades of authoritarian rule, Ethiopia’s governing Ethiopian People’s Revolutionary Democratic Front (EPRDF) selected Abiy Ahmed as Prime Minister, who upon taking office embarked on a program of political and economic reform that was soon encumbered by widespread inter-communal conflict, political assassinations, and democratic backsliding.</text></paragraph><paragraph id="idb983ff83e2a64108ae3167dafc611746"><enum>(4)</enum><text>Tensions between Prime Minister Abiy Ahmed and the leadership of the Tigray People’s Liberation Front (TPLF), who, until 2019, were EPRDF coalition partners, deteriorated significantly throughout 2019–2020, with the EPRDF’s transformation into the Prosperity Party (PP), the Federal Government of Ethiopia’s postponement of the 2020 elections, and the TPLF’s decision to hold elections in Tigray Regional State of Ethiopia despite Federal objections, all serving as major catalysts.</text></paragraph><paragraph id="id0bced3f1fec54a9eb5de9ae6d3c8ad80"><enum>(5)</enum><text>In the early hours of November 4, 2020, Prime Minister Abiy ordered a military offensive in response to an attack by the TPLF on the Northern Command of the Ethiopian National Defense Forces (ENDF), which TPLF officials have asserted was an act of self-defense in the face of an imminent invasion by Federal forces.</text></paragraph><paragraph id="idf2b6c89696e5488d8b3880d57662f273"><enum>(6)</enum><text>Throughout November 2020, hostilities between the ENDF and forces loyal to the TPLF evolved into a large-scale armed conflict that also involved the Eritrean Defense Forces (EDF) and Amhara regional forces and militia fighting in support of the Federal Government.</text></paragraph><paragraph id="idccb42f514d84429b95e11944e7bae998"><enum>(7)</enum><text>Despite repeated calls from the United States and its international partners for a full and verifiable Eritrean withdrawal from Ethiopia, which date back to November 2020, Eritrean forces remain in Ethiopia.</text></paragraph><paragraph id="idcc493bb1a5d64472955bd87307706cae"><enum>(8)</enum><text>Fighting between TPLF aligned forces and the ENDF and its allies persists in parts of Tigray, and has spread to Amhara and Afar, and is estimated to have resulted in the deaths of tens of thousands of individuals, prompted more than 61,000 Ethiopians to seek refuge in Sudan, and internally displaced over 2,000,000.</text></paragraph><paragraph id="id6b90d6c9cb6549a18dc29d9ae2b3c8c5"><enum>(9)</enum><text>The war has disrupted harvests, livelihoods, markets, and banking, and critical public infrastructure was systematically looted and destroyed during the course of the conflict, including health centers and schools, with the majority of the reports implicating the ENDF, the EDF, and allied militia. Supply chains and food were allegedly looted by ENDF, EDF, and allied militia, which collectively contributed to conditions that have resulted in 400,000–900,000 Ethiopians living in famine-like conditions and a further 1,800,000 close to that threshold, according to an analysis issued in June 2021. </text></paragraph><paragraph id="id4d78e5bdce5a4f6199713451b4060369"><enum>(10)</enum><text>Interruptions in electricity, internet, and telephone services imposed by the Federal Government of Ethiopia continue to hamper humanitarian relief efforts and enable impunity from armed actors on all sides of the conflict by restricting the flow of information about human rights and humanitarian conditions in the region.</text></paragraph><paragraph id="idecf0943d0d064cc2b353330cc19d7d6a"><enum>(11)</enum><text>Despite repeated assurances from the Federal Government of Ethiopia that it would allow unfettered humanitarian access to Tigray, it continues to impose wide-ranging bureaucratic obstacles that impede the relief efforts of international humanitarian organizations, and encourage and deploy hostile rhetoric toward international humanitarian organizations that endanger the safety and security of their staff on the ground.</text></paragraph><paragraph id="ide5e9e01c022f47ecb4e408c8d9fa7f53"><enum>(12)</enum><text>Twenty-three aid workers have been killed in the course of the conflict in northern Ethiopia, including an aid worker employed by a United States Agency for International Development implementing partner, who was reportedly executed by Ethiopian and Eritrean forces in May 2021, and 3 Doctors Without Borders employees in June 2021, by unknown armed actors. </text></paragraph><paragraph id="idc2996fb183bc47909139007a6915e96a"><enum>(13)</enum><text>Parties to the conflict in northern Ethiopia have been accused of extra-judicial killings, rape, and ethnic cleansing that may amount to war crimes, crimes against humanity, and genocide.</text></paragraph><paragraph id="id5609187495014b7a93f9fb5d404f8237"><enum>(14)</enum><text>Two Eritrean refugee camps in Tigray, Shimelba and Hitsats, were attacked and destroyed by armed actors in November 2020 through January 2021, and refugees subjected to killings, abductions, and forced returns.</text></paragraph><paragraph id="id19ae35ffbdb0417a961f10937a5a53a4"><enum>(15)</enum><text>As of October 31, 2021, total United States Government humanitarian assistance in fiscal years 2020 and 2021 for the northern Ethiopia crisis response totaled $617,387,662, making it the single largest donor of humanitarian aid to the humanitarian crisis in northern Ethiopia since the conflict began.</text></paragraph><paragraph id="id2a7f69c49f154a1684d72cc5d2a39dc1"><enum>(16)</enum><text>In July 2021, TPLF aligned forces launched military operations into some occupied portions neighboring Amhara and Afar regions, displacing hundreds of thousands of Amhara and Afar civilians, and giving rise to allegations of serious abuses by Tigrayan forces against civilians in those two regions, as well as against Eritrean refugees residing in the Mai Aini and Adi Harush camps.</text></paragraph><paragraph id="idbaa896fce23349d2ab8e98b24168682f"><enum>(17)</enum><text>The TPLF’s July 2021 offensive was followed by reports of escalating abuses against Tigrayan civilians in various parts of Ethiopia and the alleged killing of Tigrayans in Humera, all of which occur within a context of incendiary and ethnicized public statements from Ethiopian officials and media platforms. </text></paragraph><paragraph id="idca230ee7687f4c2bbd89a9575f94604b"><enum>(18)</enum><text>The Federal Government of Ethiopia responded to TPLF offensives in July through August 2021 by pursuing mass military mobilization, including the mobilization of regional special forces and ethnic militia from various parts of the country, in an effort to thwart and roll back TPLF operations.</text></paragraph><paragraph id="id3679d627686541bc824632ca5a9b93bd"><enum>(19)</enum><text>In August 2021, officials from the TPLF and Oromo Liberation Army (OLA), a rebel group engaged in armed struggle primarily in the Oromia region, publicly confirmed they had entered an alliance designed to coordinate their military operations against the Federal Government of Ethiopia, developments which occurred against the backdrop of TPLF advances in Amhara region and increased OLA activity in Oromia.</text></paragraph><paragraph id="id640e2ca4cac9452496e3cbb17d1aa875"><enum>(20)</enum><text>In September 2021, the Federal Government of Ethiopia announced it was expelling seven senior United Nations officials, and in October 2021 commenced an air offensive on the Tigrayan capital, Mekele, which has further exacerbated the inability of international aid organizations to deliver food. </text></paragraph><paragraph id="id628c01ce73284097b4526518861326f5"><enum>(21)</enum><text>In October, state-owned Ethiopia Television reported that Prime Minister Abiy stated that, <quote>[i]f we make sure that this thing called wheat [food aid] does not enter Ethiopia, 70 per cent of Ethiopia's problems will be solved,</quote> implying that he may stop the delivery of international food aid altogether. </text></paragraph><paragraph id="id79b17aad745a4b42914497ba37f6ef7b"><enum>(22)</enum><text>In October 2021, a United Nations Humanitarian Air Services flight that had been cleared by Federal authorities to land in Mekelle to deliver food aid was forced to abort landing due to air raids, threatening the lives of 11 United Nations and non-governmental staff on board.</text></paragraph><paragraph id="idb23b37a9ba844e0fae0d800211a4c001"><enum>(23)</enum><text>In the wake of military advances by the Tigray Defense Forces in late October 2021, Prime Minister Abiy urged citizens to take up arms to defend themselves, and on November 2, 2021, Ethiopia declared a 6-month state of emergency.</text></paragraph><paragraph id="id490afeb830624a949ecbcafe105874b7"><enum>(24)</enum><text>On November 3, 2021, the Office of the High Commissioner for Human Rights released the Joint Investigation into Alleged Violations of International Human Rights, Humanitarian and Refugee Law Committed by all Parties to the Conflict in the Tigray Region of the Federal Democratic Republic of Ethiopia, which found that <quote>attacks on civilians and civilian objects, as well as indiscriminate attacks by ENDF, EDF, and TSF Tigray Special Forces] in violation of international humanitarian law … may amount to war crimes,</quote> and that <quote>these groups and affiliated militia committed acts in violation of international human rights law and international humanitarian law</quote>. </text></paragraph><paragraph id="id75d13c81af3e47a68fa5acfd30c71889"><enum>(25)</enum><text>The escalating conflict between the Federal Government of Ethiopia and its allies and the TPLF and OLA occurs in the context of a broader deterioration of political conditions across the country, including persistent inter-communal violence, expanding repression against journalists, opposition parties, and dissident voices, and highly contentious national elections conducted in June to July 2021 that did not meet internationally accepted standards.</text></paragraph><paragraph id="id9efa8a8b052a4d428f3850cd9359fae2"><enum>(26)</enum><text>Ethiopia’s crisis is nested within a complex regional environment, the most important dimensions of which are three-way tensions between Ethiopia, Egypt, and Sudan over the Grand Ethiopian Renaissance Dam border tensions between Sudan and Ethiopia over Al Fashaga, Eritrea’s muscular regional engagement, and increasing geopolitical competition in the Horn of Africa that involves the Gulf, Turkey, Iran, Russia, and the People’s Republic of China. </text></paragraph><paragraph id="idc0b294806b744b9198a79c0668ef096b"><enum>(27)</enum><text>Working in conjunction with its international partners, the United States has consistently called for a political solution to the crisis, unfettered humanitarian access, an end to human rights violations, full accountability for all atrocities committed during the course of hostilities, and a broader all-inclusive national dialogue, and has taken a number of actions to encourage and incentivize a peaceful resolution to the conflict in Ethiopia, including reductions in development and security assistance, visa sanctions, and high-level diplomatic engagement.</text></paragraph><paragraph id="id2763e22b01fe4e62af8902ee16e8cc5e"><enum>(28)</enum><text>On September 17, 2021, President Joseph R. Biden signed Executive Order No. 14046 <quote>Imposing Sanctions on Certain Persons With Respect to the Humanitarian and Human Rights Crisis in Ethiopia,</quote> which authorizes the United States to target parties responsible for or complicit in actions or policies that prolong the conflict in northern Ethiopia, and those that commit human rights abuses, or obstruct humanitarian access and a ceasefire with respect to the conflict. </text></paragraph><paragraph id="id0fe9f34396994c6f9168f1aed3983ad4"><enum>(29)</enum><text>The Federal Government of Ethiopia has rejected all offers to facilitate a diplomatic solution to the conflict, including those extended by African Union Chairman Cyril Ramaphosa in November 2020, and Intergovernmental Authorities on Development (IGAD) Chairman Abdalla Hamdok in August 2021, to mediate talks with the TPLF.</text></paragraph></section><section id="iddd1a2ae7698644158c9ccb8a179a1074" changed="deleted" reported-display-style="strikethrough" committee-id="SSFR00"><enum>4.</enum><header>Statement of policy</header><text display-inline="no-display-inline">It is the policy of the United States to support a peaceful, democratic unified Ethiopia, and to use all diplomatic, development, and legal tools to support an end to the conflict that began in northern Ethiopia, an end to violence throughout Ethiopia, the promotion of an all-inclusive national dialogue, and the advancement of the human, civil, and political rights of all Ethiopians. </text></section><section id="id95868a0fc6104c03b128d3559ca8d0bd" changed="deleted" reported-display-style="strikethrough" committee-id="SSFR00"><enum>5.</enum><header>Support for democracy and human rights in Ethiopia</header><subsection id="id513ce1ba4ade442c8fba1d5909c8bbac"><enum>(a)</enum><header>In general</header><text>The Secretary, in consultation with the Administrator of the United States Agency for International Development, shall develop and implement a strategy for supporting democracy and human rights in Ethiopia that includes a description and justification of—</text><paragraph id="id2738c9047429445b82c0b2c0c21920cf"><enum>(1)</enum><text>plans to support civil society efforts related to expanding citizen participation and political space;</text></paragraph><paragraph id="idb030d5b2414d4828b424c22cbb686ff0"><enum>(2)</enum><text>plans to support all-inclusive national dialogue in Ethiopia;</text></paragraph><paragraph id="id9a538169c45741cc9f4b4fdc5c1c225d"><enum>(3)</enum><text>plans to support justice and accountability mechanisms for abuses and atrocities committed in the course of the conflict;</text></paragraph><paragraph id="idaa298c23cec74d189907d2af4a59e967"><enum>(4)</enum><text>plans to combat hate speech and disinformation in Ethiopia;</text></paragraph><paragraph id="id6d25ec68cd7249acbdb8db841c2c030c"><enum>(5)</enum><text>current and planned democracy and governance support to government institutions in Ethiopia; and</text></paragraph><paragraph id="id756235acd6734bf3bd119ff5794a0c7c" commented="no"><enum>(6)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="idE6B51FD05A9545ACB343D14BB41DEE8F"><enum>(A)</enum><text>results of the most recent impact evaluation of these activities; and</text></subparagraph><subparagraph id="idbbd9d4c7d3124b118a632f39d701179e" commented="no" indent="up1"><enum>(B)</enum><text>plans for applying lessons learned from such evaluations.</text></subparagraph></paragraph></subsection><subsection id="idfac5eecb114b4085a88625f51ccdfbca"><enum>(b)</enum><header>Report to Congress</header><text>Not less than 180 days after the date of the enactment of this Act, the Secretary shall submit the strategy required in subsection (a) to the appropriate congressional committees.</text></subsection></section><section id="ided948a764de2471dbb573231fcded6a0" changed="deleted" reported-display-style="strikethrough" committee-id="SSFR00"><enum>6.</enum><header>Support for conflict resolution, mitigation and management, and reconciliation</header><subsection id="idffbe1ac9acf84343af8db31e6ace8368"><enum>(a)</enum><header>Conflict resolution</header><text>The President is authorized to provide financial, technical, and diplomatic support for—</text><paragraph id="id3ad35c5abcd242e99bc3f021b1f88e9c"><enum>(1)</enum><text>efforts by the African Union or other credible entities engaged in efforts to help bring about a peaceful resolution to the conflict in northern Ethiopia; and</text></paragraph><paragraph id="id08e59df263a844f99e32e5c779f6733f"><enum>(2)</enum><text>efforts by civil society, especially those from marginalized communities, women, and youth, to participate and engage in peacebuilding, mediation, and community reconciliation.</text></paragraph></subsection><subsection id="id0b01741507e04dc488b9169bb3c01202"><enum>(b)</enum><header>Conflict mitigation and reconciliation</header><text>The Administrator of the United States Agency for International Development shall develop and implement a strategy, coordinated with the Secretary as relevant, to support conflict mitigation and management, and reconciliation and trauma healing for conflict affected groups in Ethiopia that includes—</text><paragraph id="id56b0851699e7443589e43af5cca8a6e9"><enum>(1)</enum><text>an analysis of the drivers of conflict in Ethiopia;</text></paragraph><paragraph id="id8ef485a9999848d1a14d52bbef9628f1"><enum>(2)</enum><text>a comprehensive plan to mitigate and manage conflict;</text></paragraph><paragraph id="id48baecfbb5e64d428c938bcfd2891e71"><enum>(3)</enum><text>an emphasis on community-led grass roots reconciliation;</text></paragraph><paragraph id="idb24d97e370414c25963386bdf0e4736a"><enum>(4)</enum><text>specific steps the Agency will take to ensure the participation of traditionally marginalized communities and ethnic groups, women, and youth;</text></paragraph><paragraph id="id2e251cb8e9ff4c16a85d4c8d1e3c0d7b"><enum>(5)</enum><text>plans to ensure that all assistance programs that are directly aimed at benefitting the Ethiopian people or building the capacity of civil society to incorporate, to the extent practicable, community-based conflict mitigation and management, violence prevention, peacebuilding interventions, reconciliation activities, psychosocial support, and trauma healing;</text></paragraph><paragraph id="id505ed392e7ec43e78bcb2d47978532bf"><enum>(6)</enum><text>a clear statement of—</text><subparagraph id="id3d45093e973c40d9aaa874be96f50a96"><enum>(A)</enum><text>the goals and expected outcomes of the strategy; and</text></subparagraph><subparagraph id="id1bebae1d608d4f2eb6c2426f4a05bd2e"><enum>(B)</enum><text>the means through which progress towards those goals will be met including through regular rigorous evaluations; and</text></subparagraph></paragraph><paragraph id="idb721aa1615d947ebb31692a563f37068"><enum>(7)</enum><text>plans for updating and revising the current Country Development Cooperation Strategy to include elements of the strategy required under this subsection.</text></paragraph></subsection><subsection id="id3383f9a88f514f99a2c9300e081d13c9"><enum>(c)</enum><header>Submission</header><text>The strategy required under subsection (b) shall be submitted to the appropriate congressional committees not later than 90 days after the date of the enactment of this Act.</text></subsection></section><section id="id516e7c626d9a4b79a26acf7b159a8fc8" changed="deleted" reported-display-style="strikethrough" committee-id="SSFR00"><enum>7.</enum><header>Actions in support of peace and stability in Ethiopia</header><subsection id="id43a283402c044f999363f8b508eb708f"><enum>(a)</enum><header>Sanctions for actions undermining transition to democracy</header><paragraph id="ide2ff0a3603e6458293dd59aab16f6e55"><enum>(1)</enum><header>In general</header><text>The President shall impose the sanctions described in paragraph (2) with respect to any foreign person that the President determines—</text><subparagraph id="id4e23d82084f04299aac971d8dae51b75"><enum>(A)</enum><text>undermines efforts with respect to a peaceful negotiated settlement to end hostilities in northern Ethiopia;</text></subparagraph><subparagraph id="idced350e22eba4449a18e7d36711b31af"><enum>(B)</enum><text>through business dealings with senior leadership of the Government of Ethiopia or the Government of Eritrea, the Tigray People’s Liberation Front, or other parties to the conflict in and around northern Ethiopia, derives significant financial benefit or political power from policies or actions, including electoral fraud, human rights abuses, or corruption, that contribute to the conflict or impede a transition to democracy in Ethiopia; </text></subparagraph><subparagraph id="id62B92BAB110F49498F755749EA307AB6"><enum>(C)</enum><text>provides to any party involved in hostilities in Ethiopia—</text><clause id="idd2acb85a48f3408c9eef7e0b8c59a7d0"><enum>(i)</enum><text>weapon systems, such as firearms, unmanned aerial systems, helicopters, munitions used by such unmanned aerial systems or helicopters, battle tanks, armored combat vehicles, or munitions for such tanks and vehicles, missiles or missile systems; armed vehicles; or</text></clause><clause id="idd7617584c67c45f2ab3625fe0d5216c2"><enum>(ii)</enum><text>support for such systems, such as ammunition, spare parts, pilots or other operators; or</text></clause></subparagraph><subparagraph id="id3ea62a130fbf42bb96dfde25ae4c9918"><enum>(D)</enum><text>knowingly facilitates or finances the sale, operation, or transfer of weapons to any party involved in hostilities in Ethiopia.</text></subparagraph></paragraph><paragraph id="id0e49901fa319486dbf8c68a14594a4e1"><enum>(2)</enum><header>Sanctions described</header><text>The sanctions to be imposed under paragraph (1) with respect to a foreign person are the following:</text><subparagraph id="id2010736e22864744b7474416cb4ab178"><enum>(A)</enum><header>Property blocking</header><text>The exercise of all powers granted to the President by the International Emergency Economic Powers Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701 et seq.</external-xref>) to the extent necessary to block and prohibit all transactions in all property and interests in property of the foreign person if such property and interests in property are in the United States, come within the United States, or are or come within the possession or control of a United States person.</text></subparagraph><subparagraph id="id93ce80b1dfdf45fabf9a81fac1b23c67"><enum>(B)</enum><header>Aliens inadmissible for visas, admission, or parole</header><clause id="id55121a3a530f4dde9db9c191bffc0b94"><enum>(i)</enum><header>Visas, admission, or parole</header><text>An alien described in paragraph (1) is—</text><subclause id="id798aac7feca442918bd6ac991eec639b"><enum>(I)</enum><text>inadmissible to the United States;</text></subclause><subclause id="id5825897612ef4bc3ab09b4be3496b1fe"><enum>(II)</enum><text>ineligible to receive a visa or other documentation to enter the United States; and</text></subclause><subclause id="id462c9c2bfb33431581d16f3b92d9678b"><enum>(III)</enum><text>otherwise ineligible to be admitted or paroled into the United States or to receive any other benefit under the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101 et seq.</external-xref>).</text></subclause></clause><clause id="id7fc5da73637e46ca854baf8661194839"><enum>(ii)</enum><header>Current visas revoked</header><subclause id="id1ead95a06fa84876932fd0090b4fb9d1"><enum>(I)</enum><header>In general</header><text>The visa or other entry documentation of an alien described in paragraph (1) shall be revoked, regardless of when such visa or other entry documentation is or was issued.</text></subclause><subclause id="idc7a5f12e796640568497520d58443fae"><enum>(II)</enum><header>Immediate effect</header><text>A revocation under subclause (I) shall—</text><item id="id3403f1d43a564a90a7de03b7524caeee"><enum>(aa)</enum><text>take effect immediately; and</text></item><item id="idb30bbdfd0b6f488584ef35bfb20e89a1"><enum>(bb)</enum><text>automatically cancel any other valid visa or entry documentation that is in the alien's possession.</text></item></subclause></clause></subparagraph></paragraph><paragraph id="idBCEE5369C6354AB4BB616722AA4DE3EC"><enum>(3)</enum><header>Exceptions</header><subparagraph id="id5334642c4a29499882d7663c9165e789"><enum>(A)</enum><header>Exception relating to importation of goods</header><clause id="id09f8082aec8a48749725af7439d7c358"><enum>(i)</enum><header>In general</header><text>The authority or a requirement to impose sanctions under this section shall not include the authority or a requirement to impose sanctions on the importation of goods.</text></clause><clause id="id5e27a4c9fe454c7eafbac0e39e411058"><enum>(ii)</enum><header>Good defined</header><text>In this subparagraph, the term <term>good</term> means any article, natural or manmade substance, material, supply, or manufactured product, including inspection and test equipment, and excluding technical data.</text></clause></subparagraph><subparagraph id="id2ecac7381a1a443b9ba1f31fab67d195"><enum>(B)</enum><header>Exception to comply with United Nations headquarters agreement and law enforcement objectives</header><text>Sanctions under paragraph (2)(B) shall not apply to an alien if admitting the alien into the United States—</text><clause id="idD45E766257E649EEAB6371E728C76E70"><enum>(i)</enum><text> is necessary to permit the United States to comply with the Agreement regarding the Headquarters of the United Nations, signed at Lake Success on June 26, 1947, and entered into force November 21, 1947, between the United Nations and the United States, or other applicable international obligations of the United States; or</text></clause><clause id="idDF2D6371685F4D7D806A2FA8781EA911"><enum>(ii)</enum><text>would further important law enforcement objectives.</text></clause></subparagraph></paragraph><paragraph id="ide9083fd2ba6145d3b0a480035c7a259c"><enum>(4)</enum><header>Implementation; penalties</header><subparagraph id="id6266f110fe414ef19a9f4950df893b14"><enum>(A)</enum><header>Implementation</header><text>The President may exercise all authorities provided under sections 203 and 205 of the International Emergency Economic Powers Act (50 U.S.C. 1702 and 1704) to carry out this subsection.</text></subparagraph><subparagraph id="id4586bd9e345c4619bb6cd55034a81626"><enum>(B)</enum><header>Penalties relating to property blocking</header><text>A person that violates, attempts to violate, conspires to violate, or causes a violation of subparagraph (A) of paragraph (2) or any regulation, license, or order issued to carry out either such subparagraph shall be subject to the penalties set forth in subsections (b) and (c) of section 206 of the International Emergency Economic Powers Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1705">50 U.S.C. 1705</external-xref>) to the same extent as a person that commits an unlawful act described in subsection (a) of that section.</text></subparagraph></paragraph><paragraph id="id747D0A7B0E284D9886CADB3918B3EEEB"><enum>(5)</enum><header>Definitions</header><text>In this subsection:</text><subparagraph id="id2deb1ea2ef51410085de7717c0fc975f"><enum>(A)</enum><header>Admission; admitted; alien</header><text>The terms <term>admission</term>, <term>admitted</term>, and <term>alien</term> have the meanings given those terms in section 101 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101</external-xref>). </text></subparagraph><subparagraph id="ide0d80141ccef43ee97696811f10542b1"><enum>(B)</enum><header>Foreign person</header><text>The term <term>foreign person</term> means a person that is not a United States person. </text></subparagraph><subparagraph id="idad26a0731f6148c59c61349d9db752a5"><enum>(C)</enum><header>Knowingly</header><text>The term <term>knowingly</term>, with respect to conduct, a circumstance, or a result, means that a person has actual knowledge, or should have known, of the conduct, the circumstance, or the result. </text></subparagraph><subparagraph id="ide7e2590abab944b182b1ef8f7649d1e3"><enum>(D)</enum><header>United states person</header><text>The term <term>United States person</term> means—</text><clause id="idb98a2e7a6ac14cb1bc49865080dd0af0"><enum>(i)</enum><text>a United States citizen, an alien lawfully admitted for permanent residence to the United States, or any other individual subject to the jurisdiction of the United States; or</text></clause><clause id="id1c7cfb7bf2e64464af61b8f0cb979bd0"><enum>(ii)</enum><text>an entity organized under the laws of the United States or of any jurisdiction within the United States, including a foreign branch of such entity. </text></clause></subparagraph></paragraph></subsection><subsection id="idfe9155811e50404384d86a490583e7f5"><enum>(b)</enum><header>Limitations on export of defense and dual-Use items to Ethiopia and Eritrea</header><paragraph id="id96ff0045dd8f40d4a07909b4c92e995f"><enum>(1)</enum><header>Dual-use items</header><text>A license shall be required under section 1754(c)(1)(A) of the Export Control Reform Act of 2018 (<external-xref legal-doc="usc" parsable-cite="usc/50/4813">50 U.S.C. 4813(c)(1)(A)</external-xref>) for the export, reexport, or in-country transfer to Ethiopia or Eritrea of items described in clause (ii) of that section.</text></paragraph><paragraph id="idddb41da593ca413ba977d014ec7960aa"><enum>(2)</enum><header>Defense items</header><text>No license may be issued for the export to Ethiopia or Eritrea of any item on the United States Munitions List under section 38(a)(1) of the Arms Export Control Act (<external-xref legal-doc="usc" parsable-cite="usc/22/2778">22 U.S.C. 2778(a)(1)</external-xref>) on January 1, 2016.</text></paragraph></subsection><subsection id="ide27d1c713c574c32b985afcc53262b9b"><enum>(c)</enum><header>Prohibition and suspension of certain assistance to Ethiopia</header><paragraph id="id0144ead3fe324a2c8912dc1cfd9f8fd1"><enum>(1)</enum><header>Support by United States International Development Finance Corporation</header><text>The United States International Development Finance Corporation may not provide support under title II of the Better Utilization of Investments Leading to Development Act of 2018 (<external-xref legal-doc="usc" parsable-cite="usc/22/9621">22 U.S.C. 9621 et seq.</external-xref>) for projects in Ethiopia.</text></paragraph><paragraph id="idbb8d14e85d27421a91f60956a518c47e"><enum>(2)</enum><header>Termination</header><text>The prohibition under paragraph (1) shall not apply on or after the date that is 30 days after the Secretary of State determines and certifies to the appropriate congressional committees that the Government of Ethiopia and its proxies and allies have—</text><subparagraph id="idf41fb502b67b4b71bb88b3c8e6503c10"><enum>(A)</enum><text>ceased all offensive military operations in northern Ethiopia;</text></subparagraph><subparagraph id="idad9a98c6ec244e69a355d944c0e09dca"><enum>(B)</enum><text>taken steps toward a genuine political dialogue to achieve an end to the conflict;</text></subparagraph><subparagraph id="id6c430f301f32482495c015b2553bba16"><enum>(C)</enum><text>implemented measures to better protect human rights and ensure adherence to international humanitarian law and international human rights law;</text></subparagraph><subparagraph id="id8d9dced618e3454e8a3b5f12b612a238"><enum>(D)</enum><text>continuously allowed unfettered humanitarian access; and</text></subparagraph><subparagraph id="id5540f9ada4124331aac0a90472ef40a3"><enum>(E)</enum><text>cooperated with independent investigations of credible allegations of war crimes, crimes against humanity, and other human rights abuses carried out in the course of hostilities.</text></subparagraph></paragraph></subsection><subsection id="idd341348c49474c0d91d4d0abd711deb3"><enum>(d)</enum><header>Multilateral sanctions</header><text>The Secretary, in consultation with the Secretary of the Treasury and the Secretary of Commerce, as appropriate, should engage with members of the United Nations Security Council, the North Atlantic Treaty Organization, the European Union, the African Union, and any other relevant actors to achieve a coordinated imposition of multilateral sanctions and export controls on persons described in subsection (a)(1).</text></subsection></section><section id="id620c0da07d1b482d9369d595c7f81623" changed="deleted" reported-display-style="strikethrough" committee-id="SSFR00"><enum>8.</enum><header>Security assistance</header><subsection id="idf36b777057184a68a4198d19b4cb8b9e"><enum>(a)</enum><header>Suspension of assistance</header><text>All security assistance being provided to the Government of Ethiopia by the United States Government shall immediately be suspended until such time as the Secretary reports to the appropriate congressional committees that hostilities in northern Ethiopia and related conflicts have ended, and the parties to the conflict are engaged in good faith efforts to reach a comprehensive peace agreement.</text></subsection><subsection id="id5488ae394e65408daf97894895bf1a8c"><enum>(b)</enum><header>Report</header><text>Not later than 15 days after the date of the enactment of this Act, the Secretary shall provide to the appropriate congressional committees a comprehensive list of all assistance halted in compliance with subsection (a) as of the date of the enactment of this Act.</text></subsection></section><section id="id51c39292286d49119d8dcb2828d49c1a" commented="no" changed="deleted" reported-display-style="strikethrough" committee-id="SSFR00"><enum>9.</enum><header>Assistance to the government of the Federal Democratic Republic of Ethiopia provided through international financial institutions</header><subsection id="id7090288a75864baea148eac350245c27" commented="no"><enum>(a)</enum><header>Restrictions</header><text>The Secretary of the Treasury shall instruct the United States Executive Directors of the international financial institutions—</text><paragraph id="idbf372d00b35044059106c83ddf2d79ff" commented="no"><enum>(1)</enum><text>to use the voice and vote of the United States in those institutions to oppose any loan or extension of financial or technical assistance to the Governments of Ethiopia and Eritrea; and</text></paragraph><paragraph id="id3637c8293ede4334a6137122b9c9b509" commented="no"><enum>(2)</enum><text>to work with other key donor countries to develop a coordinated policy with respect to lending to the Governments of Ethiopia and Eritrea aimed at advancing human rights and promoting peace.</text></paragraph></subsection><subsection id="id6340e92f698a4375aa70b26d6842a224" commented="no"><enum>(b)</enum><header>Exception for humanitarian purposes</header><text>The restrictions under paragraphs (1) and (2) of subsection (a) shall not apply with respect to loans or financial or technical assistance provided for humanitarian purposes, including efforts to prevent, detect, and respond to the COVID–19 pandemic, or any other infectious disease threat that is declared by the World Health Organization to be a Public Health Emergency of International Concern.</text></subsection><subsection id="id2a3200956162460e88493a3ce8dc9f00" commented="no"><enum>(c)</enum><header>Waiver for projects that directly support basic human needs</header><text>The Secretary of the Treasury may waive the application of the restriction under subsection (a)(1) only if the Secretary of the Treasury submits to the appropriate congressional committees a written determination, arrived at with the concurrence of the Secretary of State, that the waiver is being exercised to support projects that directly support basic, life-saving human needs.</text></subsection><subsection id="idb7e3fedba5cd4e42ae1aa1f89e6aa232" commented="no"><enum>(d)</enum><header>Termination</header><text>Subsection (a)(1) shall not apply on or after the date that is 30 days after the Secretary of State determines and certifies to the appropriate congressional committees that the Government of Ethiopia and its proxies and allies have—</text><paragraph id="idd9ebfe7e565e468b9c7977334e1a52d0"><enum>(1)</enum><text>ceased all offensive military operations in northern Ethiopia and conflict in surrounding areas of Ethiopia;</text></paragraph><paragraph id="id6e5ee58f8d2448adbdd84379bf170596" commented="no"><enum>(2)</enum><text>taken steps toward a genuine political dialogue to achieve an end to the conflict;</text></paragraph><paragraph id="id9c5c84bc42fb41de99fe567b1ae0cfe1" commented="no"><enum>(3)</enum><text>implemented measures to better protect human rights and ensure adherence to international humanitarian law and international human rights law;</text></paragraph><paragraph id="ida0ddf1be48bc40bab1a9e386a090d275" commented="no"><enum>(4)</enum><text>continuously allowed unfettered humanitarian access; and</text></paragraph><paragraph id="id4a3651f3f44c42d39a40d8e2e9fe9654" commented="no"><enum>(5)</enum><text>cooperated with independent investigations of credible allegations of war crimes, crimes against humanity and other human rights abuses carried out in the course of hostilities.</text></paragraph></subsection><subsection id="idc0838f9443f249e3b5485f315f0c76f5" commented="no"><enum>(e)</enum><header>Briefing</header><text>Not later than 60 days after the date of the enactment of this Act and every 120 days thereafter until the restrictions in subsection (a)(1) are terminated pursuant to subsection (d), the Secretary of the Treasury, in conjunction with the Secretary and the Administrator of the United States Agency for International Development, or their designees, shall brief the appropriate congressional committees on the efforts of the United States Executive Directors of the international financial institutions pursuant to subsection (a).</text></subsection></section><section id="id7d2eaa0b3cb24f4a91347c218341f79b" commented="no" changed="deleted" reported-display-style="strikethrough" committee-id="SSFR00"><enum>10.</enum><header>Support for accountability</header><subsection id="id498753d8aebc40f59510bf678932e9d5" commented="no"><enum>(a)</enum><header>In General</header><text>The President is authorized to provide financial, technical, and diplomatic support for efforts to pursue accountability for war crimes and crimes against humanity, including any preliminary activities necessary to preserve evidence of crimes in Ethiopia, with the goal of promoting accountability for war crimes, crimes against humanity, or other violations of international human rights law and international humanitarian law that have taken place in the course of hostilities in northern Ethiopia or other areas of Ethiopia.</text></subsection><subsection id="id017062a16bf64283ad665ac627422454" commented="no"><enum>(b)</enum><header>Provision of information</header><text>The President is authorized to share information possessed by the United States Government with organizations engaged in a credible investigation meant to lead to the prosecution of any individual credibly accused of war crimes, crimes against humanity, or other violations of international human rights law or international humanitarian law in accordance with this section.</text></subsection></section><section id="id08422a815a2c45738087e4448d51201c" commented="no" changed="deleted" reported-display-style="strikethrough" committee-id="SSFR00"><enum>11.</enum><header>Arms-related, financial, and other reporting requirements</header><subsection id="id76144b4c21e94c69b4f44444b94b88d8" commented="no"><enum>(a)</enum><header>Report on certain activities and finances of senior officials of the governments of ethiopia and eritrea and armed opposition groups</header><text>Not later than 180 days after the date of the enactment of this Act, and annually thereafter until the date that is 2 years after the end of hostilities in the Tigray region, the Secretary shall submit to the appropriate congressional committees a report that—</text><paragraph id="id252f4866d47448a6b5973b61771f4896" commented="no"><enum>(1)</enum><text>describes the actions and involvement of any senior officials of the Governments of Ethiopia and Eritrea and any senior leaders in the party to the conflict in northern Ethiopia and related conflicts—</text><subparagraph id="id81cb84835d27458cbdd85a2ac4149768" commented="no"><enum>(A)</enum><text>facilitating or financing the sale or transfers of arms or weapons to any party to the hostilities in Ethiopia, including the Government of Ethiopia, the Government of Eritrea, opposition groups, militias, or other armed groups active in the conflict in Ethiopia;</text></subparagraph><subparagraph id="id96cd89185785487cbd3f58eb5ebaba85" commented="no"><enum>(B)</enum><text>directing, carrying out, or ordering violations of human rights including the systemic use of rape and sexual and gender based violence;</text></subparagraph><subparagraph id="iddde7b9d814c8497394e670bb7bd3adc9" commented="no"><enum>(C)</enum><text>directing, carrying out, or ordering the use or recruitment of children by armed groups or armed forces; and</text></subparagraph><subparagraph id="idf745c284fa98414baeec2aa19dd6eaea" commented="no"><enum>(D)</enum><text>directing, carrying out, or ordering significant acts of corruption;</text></subparagraph></paragraph><paragraph id="id13d438efdefc463fb514ce6ba8805dab" commented="no"><enum>(2)</enum><text>identifies Ethiopian, Eritrean, and other foreign financial institutions in which senior officials of the Governments of Ethiopia and Eritrea whose actions are described in paragraph (1), and senior leaders of parties to the conflict in northern Ethiopia and related conflicts in the Federal Democratic Republic of Ethiopia whose actions are described in paragraph (1), hold significant assets, and provides an assessment of the value of such assets; and</text></paragraph><paragraph id="id60c1028737b44aae8681461d495c920d" commented="no"><enum>(3)</enum><text>identifies Ethiopian, Eritrean, and foreign financial institutions that knowingly facilitate or finance the sale or transfer of weapons, arms, or non-lethal equipment intended or altered by a third party for military use to any party to the hostilities in Ethiopia.</text></paragraph></subsection><subsection id="ide77e5ea4569f41d5b4ec0ab43130c5ac" commented="no"><enum>(b)</enum><header>Form</header><text>The report required under subsection (a) shall be submitted in unclassified form, but may contain a classified annex.</text></subsection><subsection id="id018eed6349d24873abe3a2445d372f61"><enum>(c)</enum><header>Report on progress on accountability in Ethiopia</header><text>Not later than 180 days after the date of the enactment of this Act, and every 180 days thereafter, the Secretary of State shall submit to Congress a report on progress towards holding individuals in Ethiopia and Eritrea accountable for human rights violations, war crimes, and crimes against humanity. </text></subsection></section></legis-body><legis-body display-enacting-clause="no-display-enacting-clause"><section id="id717f5bff-39c2-4f7c-adac-72395f21e028" section-type="section-one" changed="added" reported-display-style="italic" committee-id="SSFR00"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Ethiopia Peace and Stabilization Act of 2022</short-title></quote>.</text></section><section id="id8e87ff32-da25-40f8-bd7c-d10949e8de7e" changed="added" reported-display-style="italic" committee-id="SSFR00"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="id4fb7c454-2ff2-4e33-a7f7-9ebe85893386"><enum>(1)</enum><header>Appropriate congressional committees</header><text>The term <term>appropriate congressional committees</term> means the Committee on Foreign Relations of the Senate and the Committee on Foreign Affairs of the House of Representatives.</text></paragraph><paragraph id="idBADDECC769CC4BBFAC69D20A673961C0"><enum>(2)</enum><header>Civil conflict</header><text>The term <term>civil conflict</term> means the civil conflict that began in Ethiopia’s Tigray region in November 2020, and has since spread to other parts of the country.</text></paragraph><paragraph id="idA4C8110CCC204E0D90B2BEF5DEE1ADB1"><enum>(3)</enum><header>Parties to the conflict</header><text>The term <term>parties to the conflict</term> means the state authorities and armed parties directly participating in the civil conflict in Ethiopia, including the Governments of Ethiopia and Eritrea, Tigray People’s Liberation Front (TPLF), Ethiopian National Defense Forces (ENDF), Tigray Defense Forces (TDF), Eritrean Defence Forces (EDF), Ethiopian regional forces, organized ethnic militia, and any other entity which the President determines to be among the parties to the conflict for purposes of this Act. </text></paragraph><paragraph id="id54ce7f89-764a-4970-bd4c-5dc51257d4d9"><enum>(4)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of State.</text></paragraph><paragraph id="ideba7649584a14b65b2a9ff4c73435973"><enum>(5)</enum><header>Senior official</header><text>The term <quote>senior official</quote> means—</text><subparagraph id="id061e70708d0440d082b309c7d4699115" commented="no"><enum>(A)</enum><text>the head of state or head of party;</text></subparagraph><subparagraph id="id7cb06087b4564ea3a394aedb5a973210"><enum>(B)</enum><text>the head of government;</text></subparagraph><subparagraph id="id1672892ebfe74bd89ba3bb4b006da57b"><enum>(C)</enum><text>a member of the cabinet or official exercising minister-level authority;</text></subparagraph><subparagraph id="ida170a8308c6b4a2295ffa27ab24f700e"><enum>(D)</enum><text>any other high ranking official in the defense, security, or foreign affairs apparatus of the government; or</text></subparagraph><subparagraph id="id9ccce3a2633e46c8a5d72b4eb125539d"><enum>(E)</enum><text>any other office which the President determines to be a senior official for purposes of this Act. </text></subparagraph></paragraph></section><section id="id174938d1-de51-405b-995e-36c92494f4d1" changed="added" reported-display-style="italic" committee-id="SSFR00"><enum>3.</enum><header>Sense of Congress</header><text display-inline="no-display-inline">It is the sense of Congress that—</text><paragraph id="idaf9d4efadbb84f008411101ce4d6c1ec"><enum>(1)</enum><text>Ethiopia’s civil conflict directly threatens the unity of and undermines democracy in Ethiopia and threatens stability in the Horn of Africa;</text></paragraph><paragraph id="id343446cf3b5a45049933c930a4070f5a"><enum>(2)</enum><text>northern Ethiopia has suffered from a prolonged blockade that has prevented the flow of humanitarian assistance, medical supplies, and fuel and created an unprecedented humanitarian crisis; </text></paragraph><paragraph id="id8d51e2529d6c483ea6478f3165057f47"><enum>(3)</enum><text>all parties to the civil conflict should immediately end hostilities and allow unfettered access to deliver humanitarian aid, negotiate a ceasefire, and begin negotiations towards a sustainable peace agreement;</text></paragraph><paragraph id="ide14d8efb95634d9d89a45e3b4a516c49"><enum>(4)</enum><text>the Government of Eritrea must immediately and completely withdraw its military forces from Ethiopia;</text></paragraph><paragraph id="idca6c70247d634ba39f81fea99e87f603"><enum>(5)</enum><text>external actors must cease the sale and provision of all arms and materiel to all parties to the conflict;</text></paragraph><paragraph id="id76cb2b19f6d24b90a9d56feb832450af"><enum>(6)</enum><text>the United States and the international community should prioritize delivering humanitarian aid to all areas in need of assistance, with an urgent focus on the provision of emergency food aid to communities that are currently facing famine conditions or food insecurity; </text></paragraph><paragraph id="id0ca72bcd4e9a4e2faf958357f9e811c9"><enum>(7)</enum><text>the United States should provide assistance for a peaceful negotiated settlement to the civil conflict, including assistance for stabilization, mitigation, reconciliation, and democracy strengthening;</text></paragraph><paragraph id="id34863f4b3c5f4df8b2695ce60bd43f9f"><enum>(8)</enum><text>the United States should impose restrictions on security and other related assistance;</text></paragraph><paragraph id="idc9a443195e5e46519964b338773315a5"><enum>(9)</enum><text>all allegations of human rights abuses, war crimes, and crimes against humanity must be thoroughly investigated by a neutral credible body, and perpetrators must be held accountable; and</text></paragraph><paragraph id="id4e0facc3eef946dba1e31257f214c6c7"><enum>(10)</enum><text>the United States and international community should seek to hold accountable governments, organizations, and individuals, including those in the diaspora who have—</text><subparagraph id="id6ab303fbc27e444bbfe3e09259065197"><enum>(A)</enum><text>incited the civil conflict and related violence in Ethiopia; and</text></subparagraph><subparagraph id="id94c9c5f0a3e14922a7622b1bfd962ddc"><enum>(B)</enum><text>spread disinformation as part or on behalf of a foreign government, political party, ethnic group, or organization to further the civil conflict or incite anti-American sentiment in Ethiopia. </text></subparagraph></paragraph></section><section id="ideffd5c70-9295-4921-8180-591db39b9556" changed="added" reported-display-style="italic" committee-id="SSFR00"><enum>4.</enum><header>Statement of policy</header><text display-inline="no-display-inline">It is the policy of the United States to support a peaceful, democratic, and unified Ethiopia by—</text><paragraph id="id5C34259C905A41F3AF54132607C2A380"><enum>(1)</enum><text>using all diplomatic, development, and legal tools to support a sustainable peace agreement;</text></paragraph><paragraph id="id31b03a9102bc4be98eeae5793869f69e"><enum>(2)</enum><text>supporting a credible, inclusive political process to unify the country that is convened by a mutually agreed upon party, individual, or group and that—</text><subparagraph id="id9a84bb7c107445d38442b93022c99f7d"><enum>(A)</enum><text>acknowledges the political nature of conflict;</text></subparagraph><subparagraph id="id5b26dd7c961b4ed2aa72b18727ca47ad"><enum>(B)</enum><text>seeks a political solution to support the resolution of grievances; and</text></subparagraph><subparagraph id="idc98bfd4eb45941c18a4628be7d5acdcd"><enum>(C)</enum><text>charts a democratic and peaceful path forward for the country;</text></subparagraph></paragraph><paragraph id="id4fa28f0d18ef4e87b9d0552f4ebc553c"><enum>(3)</enum><text>advancing the human, civil, and political rights of all Ethiopians regardless of ethnicity, religion, gender, or geographic area of origin; and</text></paragraph><paragraph id="id1103a7501b894614a2d04474d3faa8fb"><enum>(4)</enum><text>countering malign foreign influence and disinformation exacerbating the civil conflict and intercommunal violence.</text></paragraph></section><section id="ida12134e0-21c3-418d-9263-ce913cfd58e4" changed="added" reported-display-style="italic" committee-id="SSFR00"><enum>5.</enum><header>Support for democracy and human rights in Ethiopia</header><subsection id="id44687ee7536346c08e56325e28824fdb"><enum>(a)</enum><header>Sense of Congress</header><text>It is the sense of Congress that the United States must—</text><paragraph id="id0b90b4c7b489431aa435bcc3a0739bf8"><enum>(1)</enum><text>use all diplomatic levers at its disposal to secure the release of all political prisoners, including opposition leaders, supporters, journalists, and activists detained on the basis of their political activity or views, their ethnicity, or their reporting;</text></paragraph><paragraph id="idbb9e0546c885438c8795335ac84899a9"><enum>(2)</enum><text>ensure the Government of Ethiopia respects the rights of all Ethiopians to free expression and political participation, without discrimination based on ethnicity, ideology, or political affiliation; and</text></paragraph><paragraph id="idfbebba871c5645e0bd010b246f99ab3b"><enum>(3)</enum><text>support a credible mechanism that addresses grievances and charts a democratic and peaceful path forward for the country, and which includes representatives of all political parties, including those who have been detained as political prisoners, civil society organizations, and representatives of ethnic communities.</text></paragraph></subsection><subsection id="idcdac8bf512a441249d7a09abaaed70a2"><enum>(b)</enum><header>Strategy</header><paragraph id="idd9e8554d6ce541fd815b036681e48815"><enum>(1)</enum><header>In general</header><text>The Secretary, in consultation with the Administrator of the United States Agency for International Development, shall develop and implement a strategy for supporting democracy and the rule of law and adherence to international humanitarian law and relevant international human rights treaties in Ethiopia that includes a description and justification of—</text><subparagraph id="id559b682ba94b4231abca9ff89d55150c"><enum>(A)</enum><text>plans to support civil society efforts related to expanding citizen participation and political space;</text></subparagraph><subparagraph id="id0615f4d949a647bdbafc1f7fb916963b"><enum>(B)</enum><text>plans to support a credible, comprehensive political process to unify Ethiopia, which includes broad representation from civil society, political parties, ethnic communities, and religious groups;</text></subparagraph><subparagraph id="idae6519f9274440778beb23f19ac0786a"><enum>(C)</enum><text>plans to support respect for the rule of law, including justice and accountability mechanisms for abuses and atrocities committed in the course of the civil conflict;</text></subparagraph><subparagraph id="id9e110214fca945ac826412dbb51e848c"><enum>(D)</enum><text>plans to combat hate speech and disinformation in Ethiopia;</text></subparagraph><subparagraph id="id01aac860b49a42f78f32b13bb227ad6d"><enum>(E)</enum><text>current and planned democracy and governance support to Ethiopia’s government institutions, including independent institutions like the National Electoral Board of Ethiopia (NEBE);</text></subparagraph><subparagraph id="id174cd0ca6b704ea98f085ead27b65a62"><enum>(F)</enum><text>plans for evaluating current and planned democracy and governance support and application of lessons learned; and</text></subparagraph><subparagraph id="id66f7739ce7cc4bb4b1c5db97ecb1d657"><enum>(G)</enum><text>mechanisms for holding accountable individuals who impede democratic processes, perpetrate gross violations of human rights, or are credibly implicated in public corruption. </text></subparagraph></paragraph><paragraph id="id37bed5cd-70c5-421f-a813-8194604b22f9"><enum>(2)</enum><header>Report to Congress</header><text>Not less than 90 days after the date of the enactment of this Act, the Secretary shall submit the strategy required under paragraph (1) to the appropriate congressional committees.</text></paragraph></subsection><subsection id="id915adfb0871a4878939c657d216bf5a5"><enum>(c)</enum><header>Quarterly reports</header><paragraph id="id2695B9F186D646EAA4F311A899E45D77"><enum>(1)</enum><header>In general</header><text>Not later than 30 days after the date of the enactment of this Act, and every 90 days thereafter, the Secretary of State, after consultation with the heads of other Federal departments and agencies represented on the Atrocity Early Warning Task Force and with representatives of human rights organizations, shall submit to the appropriate congressional committees a report that includes a determination with respect to whether actions in Ethiopia by parties to the conflict constitute—</text><subparagraph id="id639fa97ff9f14b11bc1fac38bf3d2868"><enum>(A)</enum><text>genocide;</text></subparagraph><subparagraph id="id7e2cb6543c994c129fef1deebf67e939"><enum>(B)</enum><text>crimes against humanity; or</text></subparagraph><subparagraph id="id2014a4b39d4e4c4f90859b1a54ec8e24"><enum>(C)</enum><text>war crimes.</text></subparagraph></paragraph><paragraph id="id87aa4f95428e4747b3e8b3eda5d632bf"><enum>(2)</enum><header>Form</header><text>Each report required by paragraph (1) shall—</text><subparagraph id="id95f4d6d9737c4a639a7d96362ae53ac2"><enum>(A)</enum><text>clearly identify individuals or groups about which the determination in such paragraph is made; and</text></subparagraph><subparagraph id="id19d995231c0b4edeaf710a380a03d0a4"><enum>(B)</enum><text>be submitted in unclassified form, but may include a classified annex that is provided separately.</text></subparagraph></paragraph><paragraph id="idb34a058ee7a74b0fb3cee335578060cf"><enum>(3)</enum><header>Public availability</header><text>The Secretary shall make each report submitted under paragraph (1) available to the public on an internet website of the Department of State. </text></paragraph></subsection></section><section id="idef89b3ab-2163-42c2-a950-88127e3f94e3" changed="added" reported-display-style="italic" committee-id="SSFR00"><enum>6.</enum><header>Support for conflict resolution, mitigation and management, and reconciliation</header><subsection id="id33f0f9d3509d47c989c8d384b3f216b4"><enum>(a)</enum><header>Conflict resolution</header><text>The President is authorized to provide financial, technical, and diplomatic support for—</text><paragraph id="ida606199f8bf94f86bbabd95be364dd04"><enum>(1)</enum><text>efforts by the African Union or other credible entities engaged in efforts to help bring about a peaceful resolution to conflict across Ethiopia; and</text></paragraph><paragraph id="id58885f81682d42b6b6b45bac7f0fd6fd"><enum>(2)</enum><text>efforts by civil society, especially those from marginalized communities in all regions of Ethiopia, women, youth, and persons with disabilities, to participate and engage in peacebuilding, mediation, and community reconciliation.</text></paragraph></subsection><subsection id="ida51d5331006045c79ab773ad7df18801"><enum>(b)</enum><header>Conflict mitigation and reconciliation</header><text>The Secretary shall ensure the development and implementation of a coordinated strategy, developed by the Administrator of the United States Agency for International Development in coordination with relevant bureaus of the Department of State, to support conflict mitigation and management, reconciliation, and trauma healing for conflict affected groups in Ethiopia that includes—</text><paragraph id="idde486977fec3438684509fe747a73a28"><enum>(1)</enum><text>an analysis of the drivers of conflict in Ethiopia;</text></paragraph><paragraph id="iddca2a4f797ff44468046404ed965994b"><enum>(2)</enum><text>a comprehensive plan to support efforts to mitigate and manage conflict with an emphasis on community-led grassroots reconciliation;</text></paragraph><paragraph id="idf535b60751c84a80a29baaa1f24e4e81"><enum>(3)</enum><text>plans to support grass roots local mechanisms for dispute resolution and sustainable mechanisms to address grievances at the community level;</text></paragraph><paragraph id="idef0aa1975a324b08b4114f71c7cba1c1"><enum>(4)</enum><text>specific steps the Department of State and the United States Agency for International Development will take to ensure the participation of traditionally marginalized communities and ethnic groups, women, and youth;</text></paragraph><paragraph id="id881d82ea34044287abe25869b4040bdb"><enum>(5)</enum><text>plans to ensure that all assistance programs that aim to benefit the Ethiopian people or build the capacity of civil society incorporate, to the extent practicable, community-based conflict mitigation and management, violence prevention, peacebuilding interventions, reconciliation activities, psychosocial support, and trauma healing;</text></paragraph><paragraph id="id4ff89130b1e54945a51fba5f31d1821e"><enum>(6)</enum><text>plans to ensure that all assistance programs that are directly aimed at benefitting the Ethiopian people are implemented based on need and do not discriminate on the basis of ethnic, regional, or political affiliations;</text></paragraph><paragraph id="id84b70bbf66d644a4a6ddff3afa023547"><enum>(7)</enum><text>a clear statement of—</text><subparagraph id="idd16624b6b55e41c5aca2ddc5096823a0"><enum>(A)</enum><text>the goals and expected outcomes of the strategy; and</text></subparagraph><subparagraph id="id6f251055ccfe4a998e2221f2ec44d279"><enum>(B)</enum><text>the means through which progress towards the strategy’s goals will be measured, including through regular evaluations; and</text></subparagraph></paragraph><paragraph id="id07ae2ee8b8f8459f83848f3541618fc7"><enum>(8)</enum><text>plans for updating and revising the current Country Development Cooperation Strategy to include elements of the strategy required under this subsection.</text></paragraph></subsection><subsection id="id20f7f9bf1f51424880f7e98de8dd25df"><enum>(c)</enum><header>Submission</header><text>The Secretary shall submit the strategy required under subsection (b) to the appropriate congressional committees not later than 90 days after the date of the enactment of this Act.</text></subsection></section><section id="ida487c01e-de71-45e2-a341-e1dc6b59c3a9" changed="added" reported-display-style="italic" committee-id="SSFR00"><enum>7.</enum><header>Actions in support of peace and stability in Ethiopia</header><subsection id="id50c7363c-f3df-4c1a-8187-b6f266d67ca9"><enum>(a)</enum><header>Sanctions for actions undermining transition to democracy</header><paragraph id="id262bb1e048d24b4997bbfa008b638ba9"><enum>(1)</enum><header>In general</header><text>Beginning 180 days after the date of the enactment of this Act, the President shall impose the sanctions described in paragraph (2) concerning any foreign person that the President determines—</text><subparagraph id="idc18307c2843944149d071ca58572942b"><enum>(A)</enum><text>has knowingly engaged in significant acts which have materially undermined or which are intended to undermine officially authorized efforts to negotiate a settlement to end the civil conflict;</text></subparagraph><subparagraph id="id04d680ea24d1435baee28af5ed3d01e3"><enum>(B)</enum><text>has directly and materially contributed to an escalation of the civil conflict;</text></subparagraph><subparagraph id="idf1d931d3e93c4832a5ab55c6c03f4372"><enum>(C)</enum><text>deliberately impedes the delivery of humanitarian assistance to any area of the country; or</text></subparagraph><subparagraph id="idebc3a3bd0f5b4cb1af8df828bec6e7af"><enum>(D)</enum><text>through business dealings with senior leadership of the Government of Ethiopia or the Tigray People’s Liberation Front or other parties to the conflict, has knowingly derived significant financial or political benefit from the conflict or efforts made to impede a transition to democracy in Ethiopia through actions including directing or knowingly engaging in or facilitating—</text><clause id="id1762ded0151c48fd8b499cd7c0c7f758"><enum>(i)</enum><text>electoral fraud;</text></clause><clause id="id228273e68f424c4b8b4d6cb4141c0ec6"><enum>(ii)</enum><text>serious human rights abuses; or</text></clause><clause id="id87f46b76d4214856837e065d1974b409"><enum>(iii)</enum><text>acts of public corruption.</text></clause></subparagraph></paragraph><paragraph id="idf1f4d45b-ea10-46c7-be89-0d95e768a674"><enum>(2)</enum><header>Sanctions described</header><text>The sanctions that the President shall impose under paragraph (1) concerning a foreign person are the following:</text><subparagraph id="id36b0589b-d2d5-410e-ab26-f78f5ce4928d"><enum>(A)</enum><header>Property blocking</header><text>The exercise of all powers granted to the President by the International Emergency Economic Powers Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701 et seq.</external-xref>) to the extent necessary to block and prohibit all transactions in all property and interests in property of the foreign person if such property and interests in property are in the United States, come within the United States, or come within the possession or control of a United States person.</text></subparagraph><subparagraph id="id3b8b9cc4-3a16-49d8-ac63-911f79ff3130"><enum>(B)</enum><header>Aliens inadmissible for visas, admission, or parole</header><clause id="id6addcee5-11c5-4d1a-bc0b-b3b28498e4c5"><enum>(i)</enum><header>Visas, admission, or parole</header><text>An alien described in paragraph (1) is—</text><subclause id="idd1303a45-ec9f-45fd-bf74-cc6396c89e2d"><enum>(I)</enum><text>inadmissible to the United States;</text></subclause><subclause id="id176872eb-2046-474f-a6a0-d487a3e176e1"><enum>(II)</enum><text>ineligible to receive a visa or other documentation to enter the United States; and</text></subclause><subclause id="ide5593870-47d7-4943-b7f2-8d9e8d4da0a9"><enum>(III)</enum><text>otherwise ineligible to be admitted or paroled into the United States or to receive any other benefit under the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101 et seq.</external-xref>).</text></subclause></clause><clause id="idfa7148d7-dce8-4451-a75d-ab2377c4599d"><enum>(ii)</enum><header>Current visas revoked</header><subclause id="id67e93099-6ede-4426-96fd-e470c87f3474"><enum>(I)</enum><header>In general</header><text>The United States shall revoke the visa or other entry documentation of an alien described in paragraph (1), regardless of when such visa or other entry documentation is or was issued.</text></subclause><subclause id="idae14fba8-e6d4-4325-bd10-a76eeb22b930"><enum>(II)</enum><header>Immediate effect</header><text>A revocation under subclause (I) shall—</text><item id="idb2ce9821-556f-491d-afd3-bffce77d743c"><enum>(aa)</enum><text>take effect immediately; and</text></item><item id="id87dfdc82-b09a-4daa-a085-256d7528a32f"><enum>(bb)</enum><text>automatically cancel any other valid visa or entry documentation that is in the alien's possession.</text></item></subclause></clause></subparagraph></paragraph><paragraph id="idc3b9e5f9-27cc-40d5-bebc-0fbed1a4f84b"><enum>(3)</enum><header>Exceptions</header><subparagraph id="id5443f1055cba47a4b8c996abe18aef74"><enum>(A)</enum><header>Exception for intelligence activities</header><text>Sanctions under this section shall not apply to any activity subject to the reporting requirements under title V of the National Security Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/50/3091">50 U.S.C. 3091 et seq.</external-xref>) or any authorized intelligence activities of the United States.</text></subparagraph><subparagraph id="id8bf9f3b49e1b4fa9b275d53f449440f1"><enum>(B)</enum><header>Exception to comply with international obligations and for law enforcement activities</header><text>Sanctions under paragraph (2)(B) shall not apply with respect to an alien if admitting or paroling the alien into the United States is necessary—</text><clause id="id51300089a0b94ac1a9594b635520ae41"><enum>(i)</enum><text>to permit the United States to comply with the Agreement regarding the Headquarters of the United Nations, signed at Lake Success June 26, 1947, and entered into force November 21, 1947, between the United Nations and the United States, or other applicable international obligations; or</text></clause><clause id="idd25c99ead924469081db475f965c90cf"><enum>(ii)</enum><text>to carry out or assist law enforcement activity in the United States.</text></clause></subparagraph><subparagraph id="id83d3cd50980d4f33a5635e1e635450b6"><enum>(C)</enum><header>Exception relating to importation of goods</header><clause id="id3bf6978e393b480485622aa992f0c29e"><enum>(i)</enum><header>In general</header><text>The authorities and requirements to impose sanctions authorized under this subtitle shall not include the authority or a requirement to impose sanctions on the importation of goods.</text></clause><clause id="idde553dfce6f041b787928dfce9f6a6c9"><enum>(ii)</enum><header>Good defined</header><text>In this paragraph, the term <term>good</term> means any article, natural or manmade substance, material, supply or manufactured product, including inspection and test equipment, and excluding technical data.</text></clause></subparagraph></paragraph><paragraph id="ida0e13f77-aa62-409f-8bb6-e586ddb907cc"><enum>(4)</enum><header>Implementation; penalties</header><subparagraph id="id8e243b07-1705-4f57-8b8f-19dc1b45f302"><enum>(A)</enum><header>Implementation</header><text>The President may exercise all authorities provided under sections 203 and 205 of the International Emergency Economic Powers Act (50 U.S.C. 1702 and 1704) to carry out this subsection.</text></subparagraph><subparagraph id="id8a360001-0abc-4368-a621-89027402cab4"><enum>(B)</enum><header>Penalties relating to property blocking</header><text>A person that violates, attempts to violate, conspires to violate, or causes a violation of subparagraph (A) of paragraph (2) or any regulation, license, or order issued to carry out either such subparagraph shall be subject to the penalties set forth in subsections (b) and (c) of section 206 of the International Emergency Economic Powers Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1705">50 U.S.C. 1705</external-xref>) to the same extent as a person that commits an unlawful act described in subsection (a) of that section.</text></subparagraph></paragraph><paragraph id="id524eafbc-ab92-4d94-8cf8-ce175780a9ac"><enum>(5)</enum><header>Definitions</header><text>In this subsection:</text><subparagraph id="id52c911ae-e3e7-466b-aa23-6ebc1b6d777a"><enum>(A)</enum><header>Admission; admitted; alien</header><text>The terms <term>admission</term>, <term>admitted</term>, and <term>alien</term> have the meanings given those terms in section 101 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101</external-xref>). </text></subparagraph><subparagraph id="idf2f7dfce50f34929b229cb269d74f35e"><enum>(B)</enum><header>Appropriate committees of Congress</header><text>The term <term>appropriate committees of Congress</term> means the Committee on Foreign Relations of the Senate, the Committee on Banking, Housing, and Urban Affairs of the Senate, the Committee on Foreign Affairs of the House of Representatives, and the Committee on Financial Services of the House of Representatives. </text></subparagraph><subparagraph id="idc9a8fd28-3db8-4e53-aa20-32c4e3f6f6ac"><enum>(C)</enum><header>Foreign person</header><text>The term <term>foreign person</term> means a person that is not a United States person. </text></subparagraph><subparagraph id="idc463d94f-541f-40aa-ae06-f01eb588d390"><enum>(D)</enum><header>Knowingly</header><text>The term <term>knowingly</term>, with respect to conduct, a circumstance, or a result, means that a person has actual knowledge, or should have known, of the conduct, the circumstance, or the result. </text></subparagraph><subparagraph id="id6ea336f4-921b-4553-9f69-01c08378fb73"><enum>(E)</enum><header>United States person</header><text>The term <term>United States person</term> means—</text><clause id="id8ac70a0d-fc72-4595-a5a7-e6484c269401"><enum>(i)</enum><text>a United States citizen, an alien lawfully admitted for permanent residence to the United States, or any other individual subject to the jurisdiction of the United States; or</text></clause><clause id="id4b0e4a84-26e5-4983-8b8f-0e177410c3e8"><enum>(ii)</enum><text>an entity organized under the laws of the United States or of any jurisdiction within the United States, including a foreign branch of such entity. </text></clause></subparagraph></paragraph><paragraph id="idace2fabd5aad4cb1a112fe04beb0812c"><enum>(6)</enum><header>Presidential waiver authority</header><text>The President may waive, on a case-by-case basis and for a period of not more than 180 days, subject to renewal, a requirement under this section to impose or maintain sanctions with respect to a person, only if the President submits to the appropriate committees of Congress—</text><subparagraph id="id695ca7f3021743c3969edcfc751f1e00"><enum>(A)</enum><text>a written determination that the waiver or renewal of a waiver is in the national security interests of the United States; or</text></subparagraph><subparagraph id="id7964a9915ee349a79327cabef2e8a245"><enum>(B)</enum><text>a certification that the person that had engaged in otherwise sanctionable behavior has ceased engaging in such behavior and that there is not a risk that the person could engage in such behavior in the future. </text></subparagraph></paragraph></subsection><subsection id="idfc4704f2-7d2d-43b5-b997-6cb6e437f9be"><enum>(b)</enum><header>Limitations on export of defense and dual-use items to Ethiopia and Eritrea</header><paragraph id="idea678227-5289-4434-a556-460dd64928d6"><enum>(1)</enum><header>Dual-use items</header><text>A license shall be required under section 1754(c)(1)(A) of the Export Control Reform Act of 2018 (<external-xref legal-doc="usc" parsable-cite="usc/50/4813">50 U.S.C. 4813(c)(1)(A)</external-xref>) for the export, re-export, or in-country transfer to Ethiopia or Eritrea of items described in clause (ii) of that section.</text></paragraph><paragraph id="id5ddea59c-1724-4844-95e7-42092719a155"><enum>(2)</enum><header>Defense items</header><text>No license may be issued for the export to Ethiopia or Eritrea of any item on the United States Munitions List under section 38(a)(1) of the Arms Export Control Act (<external-xref legal-doc="usc" parsable-cite="usc/22/2778">22 U.S.C. 2778(a)(1)</external-xref>) on January 1, 2016.</text></paragraph></subsection><subsection id="id707477da-66cb-49d0-8544-b7783b0c8b3a"><enum>(c)</enum><header>Prohibition and suspension of certain assistance to Ethiopia</header><paragraph id="id87da18f4-1b09-40c3-9b87-1ac0a380fc17"><enum>(1)</enum><header>Support by United States International Development Finance Corporation</header><text>The United States International Development Finance Corporation may not provide support under title II of the Better Utilization of Investments Leading to Development Act of 2018 (<external-xref legal-doc="usc" parsable-cite="usc/22/9621">22 U.S.C. 9621 et seq.</external-xref>) for projects in Ethiopia.</text></paragraph><paragraph id="id5093542f-634b-4d67-a3af-455bfe5d5f83"><enum>(2)</enum><header>Termination</header><text>The prohibition under paragraph (1) shall not apply on or after the date that the criteria outlined in section 13 have been met. </text></paragraph><paragraph id="ida20bd2527a7341318e241c54d92e551c"><enum>(3)</enum><header>Presidential waiver authority</header><text>The President may waive, on a case-by-case basis, the prohibition under paragraph (1) if the President submits to the appropriate committees of Congress a written determination that the waiver is in the national security interests of the United States. </text></paragraph></subsection><subsection id="idfb254588-a5fb-44b0-a9fe-db843e6cdfbe"><enum>(d)</enum><header>Multilateral sanctions</header><text>The Secretary, in consultation with the Secretary of the Treasury and the Secretary of Commerce, as appropriate, should engage with members of the United Nations Security Council, the North Atlantic Treaty Organization, the European Union, the African Union, and any other relevant actors to achieve a coordinated imposition of multilateral sanctions and export controls on persons described in subsection (a)(1).</text></subsection></section><section id="id45d9c8c0-a9ed-440d-b27a-e2c9bbcf981b" changed="added" reported-display-style="italic" committee-id="SSFR00"><enum>8.</enum><header>Security assistance</header><subsection id="ida2adf34a72744014971630b5fbee0429"><enum>(a)</enum><header>Suspension of assistance</header><text>The United States shall immediately suspend all security assistance being provided to the Government of Ethiopia.</text></subsection><subsection id="ida45175cf508848a187a5487c64b6f7cf"><enum>(b)</enum><header>Presidential waiver authority</header><text>The President may waive the suspension in subsection (a) if the President submits to the appropriate committees of Congress a written determination that—</text><paragraph id="id4ac717b2705f480c9fd1f936110c09b0"><enum>(1)</enum><text>the waiver or renewal of a waiver is in the national security interests of the United States; and</text></paragraph><paragraph id="id47fe907a70814ed2918f8997bdd06c56"><enum>(2)</enum><text>the Government of Ethiopia and its proxies are taking steps toward a genuine negotiated settlement with the major parties to the conflict.</text></paragraph></subsection><subsection id="id34f6e88ae4304d089f5ea6ad89c06054"><enum>(c)</enum><header>Termination</header><text>The suspension under subsection (a) shall not apply on or after the date that the criteria outlined in section 13 are met.</text></subsection><subsection id="idc5c81457591d40fa95981108af285b8d"><enum>(d)</enum><header>Report</header><text>Not later than 30 days after the date of the enactment of this Act, the Secretary shall provide to the appropriate congressional committees a comprehensive list of all assistance halted in compliance with subsection (a) as of the date of the enactment of this Act.</text></subsection></section><section id="id02efa500-4b61-44a7-9d0d-a5d8b61df4e8" commented="no" changed="added" reported-display-style="italic" committee-id="SSFR00"><enum>9.</enum><header>Assistance to the Government of Ethiopia provided through international financial institutions</header><subsection id="idf1138479-1c4d-4b6f-b118-0c142e5dd8a8" commented="no"><enum>(a)</enum><header>Restrictions</header><text>The Secretary of the Treasury shall instruct the United States Executive Directors of the international financial institutions—</text><paragraph id="id61a41d5f-81be-4658-9bc2-fc28843baa8d" commented="no"><enum>(1)</enum><text>to use the voice and vote of the United States in those institutions to oppose any loan or extension of financial or technical assistance to the Governments of Ethiopia and Eritrea; and</text></paragraph><paragraph id="idacd75703db08440cacd5fb4aba5f69f9"><enum>(2)</enum><text>to work with other key donor countries to develop a coordinated policy for lending to the Governments of Ethiopia and Eritrea aimed at promoting peace and adherence to international humanitarian law and relevant international human rights treaties. </text></paragraph></subsection><subsection id="id17a539f5-c495-4d9e-ba7d-d8d33304ca0e" commented="no"><enum>(b)</enum><header>Exception for humanitarian purposes</header><text>The restrictions under paragraphs (1) and (2) of subsection (a) shall not apply to loans or financial or technical assistance provided for humanitarian purposes. </text></subsection><subsection id="idf29b1ef5-0970-4961-aff3-4c3620fb8ba1" commented="no"><enum>(c)</enum><header>Waiver for projects that directly support basic human needs</header><text>The Secretary of the Treasury may waive the application of the restriction under subsection (a)(1) only if the Secretary of the Treasury submits to the appropriate congressional committees a written determination, arrived at with the concurrence of the Secretary of State, that the waiver supports projects that directly provides basic human needs. </text></subsection><subsection id="id27b8ff06b0764537847c0dd0ef7e066c"><enum>(d)</enum><header>Presidential waiver authority</header><text>The President may waive the application of the restriction under subsection (a)(1), on a case-by-case basis, if the President submits to the appropriate congressional committees a written determination that the waiver is in the national security interests of the United States. </text></subsection><subsection id="idb9ba97f41e4f4f758eb03e17e001cd48"><enum>(e)</enum><header>Termination</header><text>Subsection (a)(1) shall not apply after the criteria outlined in section 13 are met. </text></subsection><subsection id="ida7024057-52e3-4b93-9c2b-5f0e85505eba" commented="no"><enum>(f)</enum><header>Briefing</header><text>Not later than 60 days after the date of the enactment of this Act and every 120 days upon request until the restrictions in subsection (a)(1) are terminated pursuant to subsection (d), the Secretary of the Treasury, in conjunction with the Secretary of State and the Administrator of the United States Agency for International Development, or their designees, shall brief the appropriate congressional committees on the efforts of the United States Executive Directors of the international financial institutions pursuant to subsection (a). </text></subsection></section><section id="id80119730-e1e0-4c27-899e-6ef56fc29856" commented="no" changed="added" reported-display-style="italic" committee-id="SSFR00"><enum>10.</enum><header>Support for accountability</header><subsection id="idcc54f420d2224581be14d4dece70811e"><enum>(a)</enum><header>In general</header><text>The President is authorized to provide technical and diplomatic support, including support for activities related to evidence preservation and information sharing, to credible accountability mechanisms with jurisdiction, to promote accountability for war crimes, crimes against humanity, or other violations of international human rights law and international humanitarian law that took place in the 6 months preceding the outbreak of the civil conflict, and have taken place in the course of the civil conflict.</text></subsection><subsection id="id70d5a087a0cc41e5badb18b4dd117e36"><enum>(b)</enum><header>Report on progress on accountability in Ethiopia</header><text>Not later than 180 days after the date of the enactment of this Act, and every 180 days thereafter, the Secretary of State shall submit to Congress a report on progress towards holding individuals in Ethiopia and Eritrea accountable for atrocities, including war crimes and crimes against humanity. </text></subsection></section><section id="id51533351fddc40cab8e62a6fafd1f824" changed="added" reported-display-style="italic" committee-id="SSFR00"><enum>11.</enum><header>Certain activities and finances related to the conflict</header><subsection id="id728455f0f60843fa8e64423d3c3cac2b"><enum>(a)</enum><header>In general</header><text>Not later than 90 days after the date of the enactment of this Act, and every 90 days after that until the end of the civil conflict, the Secretary, in consultation with the Director of National Intelligence and the Secretary of the Treasury, shall provide to the appropriate committees of Congress a report that includes—</text><paragraph id="idb3b1550ce11c4665bb9a7f1d7f472dd8"><enum>(1)</enum><text>a description of the actions and involvement of any senior officials of any party to the civil conflict—</text><subparagraph id="idc576a76ba09b4cdf84bd9225c63c84d8"><enum>(A)</enum><text>facilitating or financing the sale or transfers of arms or weapons to any party to the civil conflict;</text></subparagraph><subparagraph id="ide70ee83e68c84f7aa650c6c39d39af2b"><enum>(B)</enum><text>directing, carrying out, or ordering actions that lead to violations of international humanitarian law, including those involving the systemic use of rape; </text></subparagraph><subparagraph id="id7dbc6a6bdbb54e67b560baea58fa186f"><enum>(C)</enum><text>directing, carrying out, or ordering the use or recruitment of children by armed groups or armed forces; </text></subparagraph><subparagraph id="id657039f4b185455286451eebdd15a4ee"><enum>(D)</enum><text>directing, carrying out, or engaging in significant acts of corruption;</text></subparagraph><subparagraph id="id2AD9ADDE8FBE471DB8F56D3B8C773D3D"><enum>(E)</enum><text>directing, carrying out, or ordering the denial of humanitarian access, including by preventing humanitarian assistance or aid workers from reaching civilian populations;</text></subparagraph><subparagraph id="id29c8a125b79c411faa08a8cf549a39b1"><enum>(F)</enum><text>directing, carrying out, or ordering the killing of aid workers in Ethiopia; and</text></subparagraph><subparagraph id="ida11ab753482948bba1c9f0dff42c6e0a"><enum>(G)</enum><text>directing, carrying out, or ordering the looting or destruction of civilian infrastructure in violation of international humanitarian law, including health facilities and schools; </text></subparagraph></paragraph><paragraph id="idc6223a4a6e4c488b8d3b300fc9599b6a"><enum>(2)</enum><text>a description of Ethiopian and other foreign financial institutions that identifies—</text><subparagraph id="id9da972a7cbef4d24b162e75a1e1d620d"><enum>(A)</enum><text>senior officials of the parties to the conflict whose actions, as identified in paragraph (1) who hold significant assets within a financial institution subject to the jurisdiction of the United States, and an estimated assessment of the value of such assets; and</text></subparagraph><subparagraph id="id8e1526f2720e44f2bb1c275e0d2b5269"><enum>(B)</enum><text>Ethiopian and foreign financial institutions that knowingly facilitate or finance the sale or transfer of weapons, arms, or non-lethal equipment intended or altered by a third party for military use to any party to the civil conflict;</text></subparagraph></paragraph><paragraph id="id636b2026898a45b681a26fef9a3182aa"><enum>(3)</enum><text>a description of the full extent of involvement in the civil conflict by foreign governments, including the Governments of China, Egypt, Eritrea, Iran, Qatar, Russia, Saudi Arabia, Sudan, Turkey, and the United Arab Emirates, and others as appropriate, which shall include—</text><subparagraph id="idef1ff3e0e2db4ce79affb311b60a973c"><enum>(A)</enum><text>a description of which governments have engaged in or supported the conduct of drone and aircraft strikes;</text></subparagraph><subparagraph id="id0a76bf201f614f2c9eff254f587f673b"><enum>(B)</enum><text>a list of the types and estimated amounts of arms and materiel transferred by each government identified under this paragraph, including drone aircraft, to the parties to the conflict or foreign military contractors operating in Ethiopia;</text></subparagraph><subparagraph id="id4fc13d4d9ee94c018bc877182399b308"><enum>(C)</enum><text>an estimate of significant financial support provided by each government identified under this paragraph to the parties to the conflict or foreign military contractors; and</text></subparagraph><subparagraph id="id654b05dd0ee14b79a0a7cd0a435f2a28"><enum>(D)</enum><text>a description of United States diplomatic engagement with the European Union and NATO regarding the support provided by the foreign governments, identified under this paragraph, to the parties to the conflict and foreign military contractors; and</text></subparagraph></paragraph><paragraph id="idbfbd21678c2e4954b30fa188cc134fc8"><enum>(4)</enum><text>a description of the full extent of involvement by Ethiopian diaspora and other non-Ethiopian nationals in military activities in the civil conflict, including—</text><subparagraph id="id01cbc47153f745e5b9de27a7836774b8"><enum>(A)</enum><text>a description of the Ethiopian diaspora and other non-Ethiopian nationals directly participating in the civil conflict either through on the ground fighting or support operations, providing financial or logistical support from abroad, or engaging in activities inciting the parties to the conflict; and</text></subparagraph><subparagraph id="idafadb01b7bd549adb29926fafe71ca19"><enum>(B)</enum><text>an estimate of significant financial support provided by Ethiopian diaspora and other non-Ethiopian nationals to the parties to the conflict.</text></subparagraph></paragraph></subsection><subsection id="id21fe7bed6c004ab287b21ec0c6c95b86"><enum>(b)</enum><header>Form</header><text>The Secretary shall submit the report required under subsection (a) in a classified form.</text></subsection><subsection id="id4c2e0c8a8c654744bd1f7f7e8bc6a824"><enum>(c)</enum><header>Briefing</header><text>Not later than 30 days after the date of the enactment of this Act, and not less than 120 days thereafter upon request until the Secretary determines the requirements are met pursuant to section 13, the Secretary, or the Secretary's designee, shall brief the appropriate committees of Congress on the information described under subsection (a).</text></subsection><subsection id="id0828e18238cc4c3aa3b69630577886e4"><enum>(d)</enum><header>Appropriate committees of Congress defined</header><text>In this section, the term <term>appropriate committees of Congress</term> means—</text><paragraph id="id887DCFE81B434BC2B3DFD1339B6C9A79" commented="no"><enum>(1)</enum><text>the Committee on Foreign Relations and the Select Committee on Intelligence of the Senate; and</text></paragraph><paragraph id="id7827642918b64e9d82730d0855754e2f" commented="no"><enum>(2)</enum><text>the Committee on Foreign Affairs and the Permanent Select Committee on Intelligence of the House of Representatives.</text></paragraph></subsection></section><section id="id888c2f6f6bfe4916968844bc7dae12e5" changed="added" reported-display-style="italic" committee-id="SSFR00"><enum>12.</enum><header>Report on the use of disinformation related to the conflict</header><subsection id="id5d71c9ade58b4797a7d7fe7490126e6d"><enum>(a)</enum><header>Report on the use of online disinformation in the civil conflict</header><text>Not later than 90 days after the date of the enactment of this Act, and every 180 days thereafter, the Secretary of State shall submit to the appropriate congressional committees a report that—</text><paragraph id="ida70ee100c62c46aa874bf52c0645d17d"><enum>(1)</enum><text>describes the use of online disinformation by parties to the conflict to perpetuate the conflict;</text></paragraph><paragraph id="id87a515910cf14a9486f41a7f6f2d6181" commented="no"><enum>(2)</enum><text>describes how funding from state and non-state actors supports use by parties to the conflict of disinformation, in order to further the civil conflict; and</text></paragraph><paragraph id="iddb9f524afa2543ac84569c3409d52ae0"><enum>(3)</enum><text>details any efforts to disrupt the spread of online disinformation related to the civil conflict, including efforts by online and social media providers.</text></paragraph></subsection><subsection id="id7060d42c786b4ae18216cfa763944711"><enum>(b)</enum><header>Form</header><text>The report required under subsection (a) shall be submitted in unclassified form and made publicly available, but may contain a classified annex.</text></subsection></section><section id="id1ef3d18fbccb468aadaf9631c6e00b9b" changed="added" reported-display-style="italic" committee-id="SSFR00"><enum>13.</enum><header>Termination of requirements</header><text display-inline="no-display-inline">Reporting requirements under sections 5(c), 10, and 11, the authorities under section 7, the suspension of security assistance under section 8(a), and the restriction under section 9(a)(1) shall not apply on or after the date that is 30 days after the Secretary determines and certifies to the appropriate congressional committees that the Government of Ethiopia and its proxies have—</text><paragraph id="id8a9c21e9445347318502ed6d3deabeb3"><enum>(1)</enum><text>ceased all offensive military operations in the civil conflict;</text></paragraph><paragraph id="id7c3456694096459a82825627c27dcf04"><enum>(2)</enum><text>taken steps toward a genuine negotiated settlement with the major parties to the conflict;</text></paragraph><paragraph id="id321128369d8d43be9518e19792de5419"><enum>(3)</enum><text>implemented measures to ensure adherence to international humanitarian law and international human rights law;</text></paragraph><paragraph id="id4c73593b89a041ea9344733752c6ceed"><enum>(4)</enum><text>allowed unfettered access for humanitarian relief on a reliable and established basis; and</text></paragraph><paragraph id="id179caaaeb306495a90bb03a0bbdad80d"><enum>(5)</enum><text>cooperated with independent investigations of credible allegations of war crimes, crimes against humanity, and other atrocities carried out in the civil conflict. </text></paragraph></section></legis-body><endorsement><action-date>April 6, 2022</action-date><action-desc>Reported with an
