<congress>One Hundred Seventeenth Congress of the United States of America</congress><session display="yes">2d Session</session><enrolled-dateline display="yes">Begun and held at the City of Washington on Monday, the third day of January, two thousand and twenty two</enrolled-dateline><legis-num display="yes">S. 3059</legis-num><current-chamber display="no">IN THE SENATE OF THE UNITED STATES</current-chamber><legis-type display="yes">AN ACT</legis-type><official-title display="yes">To amend the Ethics in Government Act of 1978 to provide for a periodic transaction reporting requirement for Federal judicial officers and the online publication of financial disclosure reports of Federal judicial officers, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause"><section id="H94F34CF2FD85440D88C2D48CBA4A3A1C" section-type="section-one" commented="no" display-inline="no-display-inline"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Courthouse Ethics and Transparency Act</short-title></quote>.</text></section><section id="H2EBDA77B591441BD88CAFEC66F777DC5" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Periodic transaction reports and online publication of financial disclosure reports of Federal judges</header><subsection id="HBA80CBECC9A54B8B85A349CA73676F88" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header display-inline="yes-display-inline">Periodic transaction reporting requirement for Federal judges</header><paragraph id="HD05B845A87C44F48B7B9FBB0CAE31319" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 103(l) of the Ethics in Government Act of 1978 (5 U.S.C. App.) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idAD492B9148884F0E9DBB3459D73A3F51"><paragraph id="HFCEB2DC11FE24D98A948C7852863CC6E" commented="no" display-inline="no-display-inline"><enum>(11)</enum><text display-inline="yes-display-inline">Each judicial officer.</text></paragraph><paragraph id="id98272CEABA2C470CBBB0A92D0A6F5FD5" commented="no" display-inline="no-display-inline"><enum>(12)</enum><text display-inline="yes-display-inline">Each bankruptcy judge appointed under section 152 of title 28, United States Code.</text></paragraph><paragraph id="id8F9E5EDD39384C4597B9766B4970C114" commented="no" display-inline="no-display-inline"><enum>(13)</enum><text display-inline="yes-display-inline">Each United States magistrate judge appointed under section 631 of title 28, United States Code.</text></paragraph><after-quoted-block display="yes">.</after-quoted-block></quoted-block></paragraph><paragraph id="HCC298B5E97C341719517090A365FBBAE" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Effective date</header><text display-inline="yes-display-inline">The amendment made by paragraph (1) shall apply to applicable transactions occurring on or after the date that is 90 days after the date of enactment of this Act.</text></paragraph></subsection><subsection id="H1329A051873C498BA61F7282374A7EEA" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header display-inline="yes-display-inline">Online publication of financial disclosure reports of Federal judges</header><text display-inline="yes-display-inline">Section 105 of the Ethics in Government Act of 1978 (5 U.S.C. App.) is amended—</text><paragraph id="HE97DFAA966DC4B78B9310405D21E11BF" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating subsections (c) and (d) as subsections (d) and (e), respectively; and</text></paragraph><paragraph id="H1C9A5F4E5DA145719A23A5E33D4E10CD" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">by inserting after subsection (b) the following: </text><quoted-block style="OLC" display-inline="no-display-inline" id="H979C1B6FC8464D09ABC00CEE550D22D8"><subsection id="H92D51E8FFADA48A9810FFE4685BAE1D2" commented="no" display-inline="no-display-inline"><enum>(c)</enum><header display-inline="yes-display-inline">Online publication of financial disclosure reports of Federal judges</header><paragraph id="H45E4E85F5F2743C3A3FE2AADDE8FF0E7" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">Establishment of database</header><text display-inline="yes-display-inline">Subject to paragraph (4), not later than 180 days after the date of enactment of the <short-title></short-title><short-title></short-title><short-title>Courthouse Ethics and Transparency Act</short-title>, the Administrative Office of the United States Courts shall establish a searchable internet database to enable public access to any report required to be filed under this title by a judicial officer, bankruptcy judge, or magistrate judge.</text></paragraph><paragraph id="H043F6B8778D54139ABB3A3DAFD104B01" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Availability</header><text display-inline="yes-display-inline">Not later than 90 days after the date on which a report is required to be filed under this title by a judicial officer, bankruptcy judge, or magistrate judge, the Administrative Office of the United States Courts shall make the report available on the database established under paragraph (1) in a full-text searchable, sortable, and downloadable format for access by the public. </text></paragraph><paragraph id="HEF4D65D388364EB1B956366262812EB9" commented="no" display-inline="no-display-inline"><enum>(3)</enum><header display-inline="yes-display-inline">Redaction</header><text display-inline="yes-display-inline">Any report made available on the database established under paragraph (1) shall not contain any information that is redacted in accordance with subsection (b)(3).</text></paragraph><paragraph id="id2d908d7256594c3aaf6b5e323676858a" commented="no" display-inline="no-display-inline"><enum>(4)</enum><header display-inline="yes-display-inline">Additional time</header><subparagraph id="idA4E25D1CD5BC4A71A3B48C30726D01EA" commented="no" display-inline="no-display-inline"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Subject to subparagraph (B), the requirements of this subsection may be implemented after the date described in paragraph (1) if the Administrative Office of the United States Courts identifies in writing to the relevant committees of Congress the additional time needed for that implementation.</text></subparagraph><subparagraph id="id1A2B3459514448E0A0ED7BBB4399C016" commented="no" display-inline="no-display-inline"><enum>(B)</enum><header display-inline="yes-display-inline">Publication requirement</header><text display-inline="yes-display-inline">The Administrative Office of the United States Courts shall continue to make the reports described in paragraph (1) available to the public during the period in which the Administrative Office of the United States Courts establishes the database under this subsection.</text></subparagraph></paragraph></subsection><after-quoted-block display="yes">.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="idEA817CF82F8A4836B7BD44587773B261" commented="no" display-inline="no-display-inline"><enum>(c)</enum><header display-inline="yes-display-inline">Technical and conforming amendments</header><paragraph id="H8E8AD21E2FD540A6B848B123F274ECB1" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">Section 103(l) of the Ethics in Government Act of 1978 (5 U.S.C. App.) (as amended by subsection (a)(1)) is amended—</text><subparagraph id="HED732C15685E4460887711123FC3F37B" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">in paragraph (9), by striking <quote>, as defined under section 109(12)</quote>; and</text></subparagraph><subparagraph id="HCE1A7276A5AE4BCCAAA9BA46C08AB3AB" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">in paragraph (10), by striking <quote>, as defined under section 109(13)</quote>. </text></subparagraph></paragraph><paragraph id="H67E0CD152A8543C3B32658312259E110" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">Section 105 of the Ethics in Government Act of 1978 (5 U.S.C. App.) (as amended by subsection (b)) is amended—</text><subparagraph id="H872F86BD4CBA4C4CA15A8F4746D3A588" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">in subsection (a)(1), by striking <quote>be revealing</quote> and inserting <quote>by revealing</quote>; and</text></subparagraph><subparagraph id="H625138B24D424F8AAD4670D7E87CE9EA" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">in subsection (b)—</text><clause id="H23F8C5EF68D84228BB3B623D43C46A13" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">in paragraph (1)—</text><subclause id="H7E76527089854D819479756EAD451DC5" commented="no" display-inline="no-display-inline"><enum>(I)</enum><text display-inline="yes-display-inline">in the first sentence, by striking <quote>be,,</quote> and inserting <quote>be,</quote>; and</text></subclause><subclause id="HD34DE90F07C742F49F88BE785CF6C0BB" commented="no" display-inline="no-display-inline"><enum>(II)</enum><text display-inline="yes-display-inline">in the third sentence, by striking <quote>may be may</quote> and inserting <quote>may be, may</quote>; and</text></subclause></clause><clause id="H99450E10B3FC477AA1084444274EE035" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">in paragraph (3)(A), by striking <quote>described in section 109(8) or 109(10) of this Act</quote> and inserting <quote>who is a judicial officer or a judicial employee</quote>. </text></clause></subparagraph></paragraph><paragraph id="H0A20399885D34711A769952FC15C720B" commented="no" display-inline="no-display-inline"><enum>(3)</enum><text display-inline="yes-display-inline">Section 107(a)(1) of the Ethics in Government Act of 1978 (5 U.S.C.
