which was referred to the <committee-name committee-id="HSM00">Committee on Small Business</committee-name></action-desc></action><action display="yes"><action-date date="20220928">September 28, 2022</action-date><action-desc>Reported without recommendation with amendments, referred to the House Calendar, and ordered to be printed</action-desc><action-instruction>Omit the part struck through and insert the part printed in italic</action-instruction></action><legis-type>RESOLUTION</legis-type><official-title display="yes">Of inquiry directing the Secretary of the Treasury to transmit certain documents to the House of Representatives relating to the role of the Department of the Treasury in the Paycheck Protection Program of the Small Business Administration.</official-title></form><resolution-body style="traditional" id="H78184CA1AED94A07B78AE1668486B470"><section display-inline="yes-display-inline" section-type="undesignated-section" id="H6D508FB15183418BBE1418035890930B"><enum/><text display-inline="yes-display-inline">That the Secretary of the Treasury is directed to transmit to the House of Representatives, not later than 14 days after the date of the adoption of this resolution, copies of any document, memorandum, correspondence, and other communication or any portion of any such communication in the possession of the Secretary that refers or relates to the role of the Department of the Treasury <deleted-phrase reported-display-style="strikethrough" committee-id="HSM00">with respect to the loan programs established under paragraphs (36) and (37) of section 7(a) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(a)(36)</external-xref>) (commonly known as the <quote>Paycheck Protection Program</quote>), including</deleted-phrase>—</text><paragraph id="H4A26252BD6AD4A54846E5A48BE068676"><enum>(1)</enum><text display-inline="yes-display-inline"><added-phrase reported-display-style="italic" committee-id="HSM00">with respect to the loan programs established under paragraphs (36) and (37) of section 7(a) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(a)(36)</external-xref>) (commonly known as the <quote>Paycheck Protection Program</quote>),</added-phrase> all such communications between the Department of the Treasury and the Small Business Administration relating to the Paycheck Protection Program;</text></paragraph><paragraph id="HB336CDB7B6794308B6488A4B939110E5"><enum>(2)</enum><text display-inline="yes-display-inline"><added-phrase reported-display-style="italic" committee-id="HSM00">with respect to the loan programs established under paragraphs (36) and (37) of section 7(a) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(a)(36)</external-xref>) (commonly known as the <quote>Paycheck Protection Program</quote>),</added-phrase> all such documents and communications relating to the obligation of the Secretary of the Treasury to testify before the Small Business Committee of the House of Representatives as required by section 321(b) of the Economic Aid to Hard-Hit Small Businesses, Nonprofits, and Venues Act (<external-xref legal-doc="usc" parsable-cite="usc/15/639b">15 U.S.C. 639b(b)</external-xref>); <deleted-phrase reported-display-style="strikethrough" committee-id="HSM00">and</deleted-phrase></text></paragraph><paragraph id="H6882E68239A64DFF96088354479220DF"><enum>(3)</enum><text display-inline="yes-display-inline"><added-phrase reported-display-style="italic" committee-id="HSM00">with respect to the loan programs established under paragraphs (36) and (37) of section 7(a) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(a)(36)</external-xref>) (commonly known as the <quote>Paycheck Protection Program</quote>),</added-phrase> all such documents and communications relating to the role of the Secretary of the Treasury in administering the Paycheck Protection Program<deleted-phrase reported-display-style="strikethrough" committee-id="HSM00">.</deleted-phrase><added-phrase reported-display-style="italic" committee-id="HSM00">;</added-phrase></text></paragraph><paragraph id="HEA671473A99446D8AEBABA3FA023F864" reported-display-style="italic" changed="added" committee-id="HSM00"><enum>(4)</enum><text display-inline="yes-display-inline">with respect to loans made under section 7(b) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(b)</external-xref>) in response to COVID–19, from grants under section 1110(e) of the CARES Act (<external-xref legal-doc="usc" parsable-cite="usc/15/9009">15 U.S.C. 9009(e)</external-xref>), from grants under section 331 of the Economic Aid to Hard-Hit Small Businesses, Nonprofits, and Venues Act (<external-xref legal-doc="usc" parsable-cite="usc/15/9009b">15 U.S.C. 9009b</external-xref>), and from grants under section 5003 of the American Rescue Plan Act of 2021, all documents and communications relating to the amount of funds from such loans or grants that have been recovered from any individual or entity that fraudulently obtained such a loan or grant; and</text></paragraph><paragraph id="HF7EB70A1C691462D92C10E688C014952" reported-display-style="italic" changed="added" committee-id="HSM00"><enum>(5)</enum><text display-inline="yes-display-inline">with respect to actions taken by the Department of the Treasury on and after January 21, 2021, to assist small business concerns (as defined under section 3 of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/632">15 U.S.C. 632</external-xref>)) with addressing government regulations, and all such communications between the Secretary of the Treasury and the Administrator of the Small Business Administration relating to any guidance the Administration offered Treasury in targeting regulatory assistance to small business concerns.</text></paragraph></section></resolution-body><official-title-amendment>Amend the title so as to read: <quote>Resolution of inquiry directing the Secretary of the Treasury to transmit certain documents to the House of Representatives relating to the role of the Department of the Treasury in the Paycheck Protection Program of the Small Business Administration and with respect to regulatory assistance for small business concerns.</quote>.</official-title-amendment><endorsement display="yes"><action-date date="20220928">September 28, 2022</action-date><action-desc>Reported without recommendation with amendments, referred to the House Calendar, and ordered to be printed</action-desc></endorsement></resolution>
