which was read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require the Federal Railroad Administration and the Federal Highway Administration to provide recommendations for reducing the number of very rural highway-rail grade crossing collisions, to authorize a public outreach and educational program to reduce such collisions, and to authorize grants to improve grade crossing safety.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="id9A0087D9CE9E4F8B9D9FFB5E471264FA"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Right Track Act</short-title></quote>.</text></section><section section-type="subsequent-section" id="id38F77C98CB9E4BE0AA11C4CD56E71786"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text><paragraph id="id0501a4d53bff45c0955c36aae4905552"><enum>(1)</enum><text>Collisions at nonsignalized highway-rail grade crossings continue to lead to fatalities in very rural areas.</text></paragraph><paragraph id="id81498370cd8140929997e3a44bd03822"><enum>(2)</enum><text>In States with extensive rail infrastructure, additional information for protecting grade crossings would be valuable to the general public, State and local governments, and rail operators.</text></paragraph></section><section id="id4f3ec9a7666d46bc9f6efb65e2eeed14"><enum>3.</enum><header>Recommendations</header><subsection id="id8E2C78D9C304407088B7AF3B67C6ADF7"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Administrator of the Federal Railroad Administration and the Administrator of the Federal Highway Administration, after consultation with railroads, technology developers, manufacturers, relevant State and local agencies, institutions of higher education, and law enforcement agencies, shall jointly provide recommendations for reducing the number of collisions at highway-rail grade crossings in counties with 10 or fewer residents per square mile (according to the most recent decennial census) to—</text><paragraph id="idE568F382C7444C67B2FFBBB5E753A374"><enum>(1)</enum><text>the <committee-name committee-id="SSAP00">Committee on Appropriations of the Senate</committee-name>;</text></paragraph><paragraph id="id3F762736071F4366BA7F50390F773141"><enum>(2)</enum><text>the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation of the Senate</committee-name>; </text></paragraph><paragraph id="idB839AFE566A145F9B2CEE2B5476F2C28"><enum>(3)</enum><text>the <committee-name committee-id="">Committee on Appropriations of the House of Representatives</committee-name>;</text></paragraph><paragraph id="id306111DADEB7457387C7C26E82745BEC"><enum>(4)</enum><text>the <committee-name committee-id="">Committee on Transportation and Infrastructure of the House of Representatives</committee-name>;</text></paragraph><paragraph id="idCA79604D80E74AD588989924C256B19A"><enum>(5)</enum><text>stakeholders involved in consultations under this subsection; and</text></paragraph><paragraph id="id849558C187B5458982A612206582D7D5"><enum>(6)</enum><text>the general public.</text></paragraph></subsection><subsection id="id5ee392e224044d7ab33426942f30cf32"><enum>(b)</enum><header>Use of recommendations</header><text>The Administrators shall use the recommendations referred to in subsection (a) to provide technical assistance to States seeking to make rail safety infrastructure improvements.</text></subsection></section><section id="id604164d794b54a61948ba33d09ff5d15"><enum>4.</enum><header>Public outreach and education</header><text display-inline="no-display-inline">The Administrator of the Federal Railroad Administration and the Administrator of the Federal Highway Administration shall jointly conduct a public outreach and educational initiative, in cooperation with Operation Lifesaver, to reduce collisions at public highway-rail grade crossings in counties with 10 or fewer residents per square mile that includes multimedia resources, including resources that are not available online.</text></section><section id="id08198f915fe4488a9cc22b872c64d3b9"><enum>5.</enum><header>Grade crossing safety improvement grants</header><subsection id="id6DC6D2336629427190F796799AAD3941"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">The Secretary of Transportation shall use amounts set aside pursuant to subsection (c) for grants to eligible recipients (as described in section 22907(b) of title 49, United States Code) to improve grade crossing safety in counties with 10 or fewer residents per square mile. The Secretary shall prioritize the projects receiving grants under this subsection in accordance with the criteria set forth in section 22907(e) of title 49, United States Code.</text></subsection><subsection id="id7935B1169CDB416C86A6EA22C86B40BC"><enum>(b)</enum><header>Priority</header><text>In selecting grant recipients under subsection (a), the Secretary shall prioritize projects based on the application of the hazard indices and accident prediction formulae described in the Federal Highway Administration’s Highway-Rail Crossing Handbook </text></subsection><subsection id="idE80B6B0E076F4AA3A45CEA6C9DED1916"><enum>(c)</enum><header>Funding</header><text>During each of the fiscal years 2022 through 2026, $10,000,000 of the amounts appropriated for grants under section 22907 of title 49, United States Code, shall be set aside for grants authorized under subsection (a). The set aside required under this subsection shall not overlap with the rural set aside required under subsection (g) of such section 22907. </text></subsection><subsection id="id8D5ABCEE85CD45FB9E8391465DCA4214"><enum>(d)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 3 years after the date of the enactment of this Act, the Secretary of Transportation shall submit a report to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation of the Senate</committee-name> and the <committee-name committee-id="">Committee on Transportation and Infrastructure of the House of Representatives</committee-name> that describes the implementation of this section.</text></subsection></section></legis-body></bill>
