which was read twice and referred to the <committee-name committee-id="SSEV00">Committee on Environment and Public Works</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the National Environmental Policy Act of 1969 to provide for legal reform, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="id84D07B244B6E48579E02C0D31686D409"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>NEPA Legal Reform Act</short-title></quote>.</text></section><section section-type="subsequent-section" id="S1"><enum>2.</enum><header>Legal reforms under NEPA</header><subsection id="idCFAA7C4CC9D249A780ED77E81065B0E7"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Title I of the National Environmental Policy Act of 1969 is amended—</text><paragraph id="id70BE52AEB39A44228C15AD2F05BC107A"><enum>(1)</enum><text>by redesignating section 105 (<external-xref legal-doc="usc" parsable-cite="usc/42/4335">42 U.S.C. 4335</external-xref>) as section 106; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id56D9C5F5D1184981A4285A141E279056"><enum>(2)</enum><text>by inserting after section 104 (<external-xref legal-doc="usc" parsable-cite="usc/42/4334">42 U.S.C. 4334</external-xref>) the following: </text><quoted-block style="OLC" display-inline="no-display-inline" id="id6F9288C601A442B2A4744FD8A27AAA46"><section id="id6E524A34D37243838C9A84449BA41D2C"><enum>105.</enum><header>Legal reform</header><subsection id="id044ADACE96254208BF3332485D9F085D"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="id9B260A2635D547DCBB6AB7991AA866ED"><enum>(1)</enum><header>Federal agency</header><text>The term <term>Federal agency</term> includes a State that has assumed responsibility under section 327 of title 23, United States Code.</text></paragraph><paragraph id="id2683BA676DF44668ABAAAC6E87272EEF"><enum>(2)</enum><header>Head of a Federal agency</header><text>The term <term>head of a Federal agency</term> includes the governor or head of an applicable State agency of a State that has assumed responsibility under section 327 of title 23, United States Code.</text></paragraph><paragraph id="id8A4524F3DC004CADB226B55019BA89DE"><enum>(3)</enum><header>NEPA process</header><subparagraph id="idA50C95A3CDB04790A9316242A702DB9A"><enum>(A)</enum><header>In general</header><text>The term <term>NEPA process</term> means the entirety of every process, analysis, or other measure, including an environmental impact statement, required to be carried out by a Federal agency under this title before the agency undertakes a proposed action.</text></subparagraph><subparagraph id="idF8E844F12F044FC986E0CA939495FFDA"><enum>(B)</enum><header>Period</header><text>For purposes of subparagraph (A), the NEPA process—</text><clause id="id823C4B406D4D4CDF8B82CFD43541812A"><enum>(i)</enum><text>begins on the date on which the head of a Federal agency receives an application for a proposed action from a project sponsor; and</text></clause><clause id="idB91AA88EEF504B8EA9D0D14893B641D0"><enum>(ii)</enum><text>ends on the date on which the Federal agency issues, with respect to the proposed action—</text><subclause id="id72007C4F71004120974B99A6DF197150"><enum>(I)</enum><text>a record of decision, including, if necessary, a revised record of decision;</text></subclause><subclause id="id384C819019DC434885E5314EC4EE310D"><enum>(II)</enum><text>a finding of no significant impact; or</text></subclause><subclause id="idA5AC6EE605ED4D6AB14FB78D84476EC8"><enum>(III)</enum><text>a categorical exclusion under this title. </text></subclause></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idBC7CEEB6351944709D97646700ECFF0C"><enum>(4)</enum><header display-inline="yes-display-inline">Project sponsor</header><text display-inline="yes-display-inline">The term <term>project sponsor</term> means a Federal agency or other entity, including a private or public-private entity, that seeks approval of a proposed action. </text></paragraph></subsection><subsection id="id2778CF37F82B4CEC932BAAA961A2EE7C"><enum>(b)</enum><header>Judicial review</header><paragraph commented="no" id="id751E0141ACE143FEAAB37E7D32C38CDA"><enum>(1)</enum><header>Standing</header><text>Notwithstanding any other provision of law, a plaintiff may only bring a claim arising under Federal law seeking judicial review of a portion of the NEPA process if the plaintiff pleads facts that allege that the plaintiff has personally suffered, or will likely personally suffer, a direct, tangible harm as a result of the portion of the NEPA process for which the plaintiff is seeking review.</text></paragraph><paragraph id="idF97D993DA2D04A6CA701F8C39C50B666"><enum>(2)</enum><header>Statute of limitations</header><subparagraph id="id683842531FCD4412B326F75E42645736"><enum>(A)</enum><header>In general</header><text>Notwithstanding any other provision of law and except as provided in subparagraph (B)(ii), a claim arising under Federal law seeking judicial review of any portion of the NEPA process shall be barred unless it is filed not later than the earlier of—</text><clause id="idF5C64ADEEF924BE9AC933164A8A38F3F"><enum>(i)</enum><text>150 days after the final agency action under the NEPA process has been taken; and</text></clause><clause id="id46B2023880444E71B97E122A09E4705A"><enum>(ii)</enum><text>if applicable, an earlier date after which judicial review is barred that is specified in the Federal law pursuant to which the judicial review is allowed.</text></clause></subparagraph><subparagraph id="idA444F47C64F4416EB8EDC6AB13B5CD5E"><enum>(B)</enum><header>New information</header><clause id="id3C836BBD6D084F13B18F790AA60E4A54"><enum>(i)</enum><header>Consideration</header><text>A Federal agency shall consider for the purpose of a supplemental environmental impact statement new information received after the close of a comment period if the information satisfies the requirements for a supplemental environmental impact statement under the regulations of the Federal agency.</text></clause><clause id="idE2AFE0885BCA48D48758E6B6530E5740"><enum>(ii)</enum><header>Statute of limitations based on new information</header><text>If a supplemental environmental impact statement is required under the regulations of a Federal agency, a claim for judicial review of the supplemental environmental impact statement shall be barred unless it is filed not later than the earlier of—</text><subclause id="idCA98153C98B24EE49A0F539AAF029446"><enum>(I)</enum><text>150 days after the publication of a notice in the Federal Register that the supplemental environmental impact statement is final; and</text></subclause><subclause id="id767DAA5CBA3D4D4991795BC1D241D8A4"><enum>(II)</enum><text>if applicable, an earlier date after which judicial review is barred that is specified in the Federal law pursuant to which the judicial review is allowed.</text></subclause></clause></subparagraph><subparagraph id="id737F53C13565448CA05F47F19F1BACD6"><enum>(C)</enum><header>Savings clause</header><text>Nothing in this paragraph creates a right to judicial review.</text></subparagraph></paragraph><paragraph id="idF1FE2B9D356C4F789722D54AAAB2586B"><enum>(3)</enum><header>Remedies</header><subparagraph id="idCBA24AA691364B588713AB13E63DCD13"><enum>(A)</enum><header>Preliminary injunctions and temporary restraining orders</header><clause id="id03ACE36FDF4D4AA7A76F38F4BA082A9D"><enum>(i)</enum><header>In general</header><text>Subject to clause (ii), in a motion for a temporary restraining order or preliminary injunction against a Federal agency or project sponsor in a claim arising under Federal law seeking judicial review of any portion of the NEPA process, the plaintiff shall establish by clear and convincing evidence that—</text><subclause id="id8CBD4C53C72C4C0A9B6CF2B0834A421B"><enum>(I)</enum><text>the plaintiff is likely to succeed on the merits;</text></subclause><subclause id="id32ABA136D67D4ABB8A82656135985B7D"><enum>(II)</enum><text>the plaintiff is likely to suffer irreparable harm in the absence of the temporary restraining order or preliminary injunction, as applicable;</text></subclause><subclause id="id14C41C7811A5465B92620BE791BAD26D"><enum>(III)</enum><text>the balance of equities is tipped in the favor of the plaintiff; and</text></subclause><subclause id="id54E5833AD95241888F9056F64CB0CA17"><enum>(IV)</enum><text>the temporary restraining order or preliminary injunction is in the public interest.</text></subclause></clause><clause id="id566D4424FE7C491D9405E8F48161A107"><enum>(ii)</enum><header>Additional requirements</header><text>A court may not grant a motion described in clause (i) unless the court—</text><subclause id="id6C939A7916F64CF091E465CCE0EA0367"><enum>(I)</enum><text>makes a finding of extraordinary circumstances that warrant the granting of the motion;</text></subclause><subclause id="id6E723316F1D9426C86260C4510F84A93"><enum>(II)</enum><text>considers the potential effects on public health, safety, and the environment, and the potential for significant negative effects on jobs resulting from granting the motion; and</text></subclause><subclause id="idB60ED5096C664C2BA4E697BC4EFE6CD0"><enum>(III)</enum><text>notwithstanding any other provision of law, applies the requirements of Rule 65(c) of the Federal Rules of Civil Procedure.</text></subclause></clause></subparagraph><subparagraph id="idE256AC7D2CDF4E90B2A853E64EA699F8"><enum>(B)</enum><header>Permanent injunctions</header><clause id="id5BF372956C614EED905FCA0D2177B8F5"><enum>(i)</enum><header>In general</header><text>Subject to clause (ii), in a motion for a permanent injunction against a Federal agency or project sponsor a claim arising under Federal law seeking judicial review of any portion of the NEPA process, the plaintiff shall establish by clear and convincing evidence that—</text><subclause id="id2FAC67D7D3C944D6B29448A9ED00A2EE"><enum>(I)</enum><text>the plaintiff has suffered an irreparable injury;</text></subclause><subclause id="id43B0B0C209DD4799BF96CBDF1F331E75"><enum>(II)</enum><text>remedies available at law, including monetary damages, are inadequate to compensate for the injury;</text></subclause><subclause id="idA8800FFEFC244621A374D740CFA94E13"><enum>(III)</enum><text>considering the balance of hardship between the plaintiff and defendant, a remedy in equity is warranted;</text></subclause><subclause id="idB01CF8695E784EC08218D4012C03AED3"><enum>(IV)</enum><text>the public interest is not disserved by a permanent injunction; and</text></subclause><subclause id="id8D3CCD1A180D48B586B0B1B266CC2C31"><enum>(V)</enum><text>if the error or omission of a Federal agency in a statement required under this title is the grounds for which the plaintiff is seeking judicial review, the error or omission is likely to result in specific, irreparable damage to the environment.</text></subclause></clause><clause id="id7FB2748ECFEF4755BC75C85DEBF7505A"><enum>(ii)</enum><header>Additional showing</header><text>A court may not grant a motion described in clause (i) unless—</text><subclause id="id711A895D837E48B1BCA4342F94B642F3"><enum>(I)</enum><text>the court makes a finding that extraordinary circumstances exist that warrant the granting of the motion; and</text></subclause><subclause id="idF67FFD2540E048AAB84E42758299E2E5"><enum>(II)</enum><text>the permanent injunction is—</text><item id="id804E4CDF01C64CE999FD69EEDCD3F680"><enum>(aa)</enum><text>as narrowly tailored as possible to correct the injury; and</text></item><item commented="no" display-inline="no-display-inline" id="idA57546AED01F4E4EB3ADA09EE05154EF"><enum>(bb)</enum><text>the least intrusive means necessary to correct the injury.</text></item></subclause></clause></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id22F272CBDEA54A828E2F9D2489A420AC"><enum>(b)</enum><header>Attorney fees in environmental litigation</header><paragraph id="id5035EEB287E24F1A847A5B84255C1A77"><enum>(1)</enum><header>Administrative procedure</header><text>Section 504(b)(1) of title 5, United States Code, is amended—</text><subparagraph id="id40F69B14FA8C4E85860AD41FDD3D8F52"><enum>(A)</enum><text>in subparagraph (E), by striking <quote>and</quote> at the end;</text></subparagraph><subparagraph id="idBE4F802E305F43BA97C78AF74334D48E"><enum>(B)</enum><text>in subparagraph (F), by striking the period at the end and inserting <quote>; and</quote>; and</text></subparagraph><subparagraph id="id5656DE68B7A547568769DBC003F994EB"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id61d0e6e71ed54a7a9b5c87f6c86a23dd"><subparagraph id="idedc469d4cf444f1cab9c3cfa2c87ae43" indent="up1"><enum>(G)</enum><text><term>special factor</term> does not include knowledge, expertise, or skill in environmental litigation.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="id748316045E894E599EB62AC0232E72BD"><enum>(2)</enum><header>United States as party</header><text display-inline="yes-display-inline">Section 2412(d)(2) of title 28, United States Code, is amended—</text><subparagraph id="id7750C45439174267B52C37E01CECD01D"><enum>(A)</enum><text display-inline="yes-display-inline">in subparagraph (H), by striking <quote>and</quote> at the end;</text></subparagraph><subparagraph id="idB30243EF00984E378E6DF25D05EF39FD"><enum>(B)</enum><text>in subparagraph (I), by striking the period at the end and inserting <quote>; and</quote>; and</text></subparagraph><subparagraph id="id9DE6EF032E1B4F2A9AAEBD8F9408BFF3"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id3230FCCC2EF74D07A2A6A580884F1173"><subparagraph id="id7D5A0256991E4191864C54045257FA3B"><enum>(J)</enum><text><term>special factor</term> does not include knowledge, expertise, or skill in environmental litigation.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection></section></legis-body></bill>
