 STATES</current-chamber><legis-type display="yes">AN ACT</legis-type><official-title display="yes">To address behavioral health and well-being among health care professionals.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause" style="OLC"><section id="H3310201694914C8281CDDC96DF056A19" section-type="section-one" commented="no" display-inline="no-display-inline"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Protecting Medicare and American Farmers from Sequester Cuts Act</short-title></quote>.</text></section><section id="H11B2D7897E284965BB26119C0FF5850B" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Adjustments to Medicare sequestration reductions</header><subsection id="H99B5AD16731440F6BE4E843CECF606CD" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header display-inline="yes-display-inline">Extension of temporary suspension through March 2022</header><paragraph id="HC4CFD6218FD94428A260BE5E0133FF87" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 3709(a) of division A of the CARES Act (<external-xref legal-doc="usc" parsable-cite="usc/2/901a">2 U.S.C. 901a</external-xref> note) is amended—</text><subparagraph id="HAA906006A01840CAA8CD3AD110C439D2" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">in the subsection header by inserting <quote><header-in-text level="subsection" style="OLC">and adjustment</header-in-text></quote> after <quote><header-in-text level="subsection" style="OLC">suspension</header-in-text></quote>; and</text></subparagraph><subparagraph id="HC4ED73DB4E5C4C92AA4D0F8322C705D4" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">by striking <quote>December 31, 2021</quote> and inserting <quote>March 31, 2022</quote>.</text></subparagraph></paragraph><paragraph id="H7CAD2FCC06464BDFB14F4520841292B8" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Effective date</header><text display-inline="yes-display-inline">The amendments made by paragraph (1) shall take effect as if enacted as part of the CARES Act (<external-xref legal-doc="public-law" parsable-cite="pl/116/136">Public Law 116–136</external-xref>).</text></paragraph></subsection><subsection id="H5AA5A883B1D54D13BA8F5883EAE5924D" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header display-inline="yes-display-inline">Adjustments to Medicare program sequestration reduction with respect to fiscal years 2022 and 2030</header><text display-inline="yes-display-inline">Section 251A(6) of the Balanced Budget and Emergency Deficit Control Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/2/901a">2 U.S.C. 901a(6)</external-xref>) is amended—</text><paragraph id="H581CDE26D1EA44A1868981E380A731DD" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating subparagraph (C) as subparagraph (E); and</text></paragraph><paragraph id="HC68A06E065E64582897622011288529A" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">by inserting after subparagraph (B) the following new subparagraphs:</text><quoted-block style="OLC" id="H39810F72B9934BBC8F2488DDB0245712" display-inline="no-display-inline"><subparagraph id="HE2223AFAC59C453F94179C8264398595" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">Notwithstanding the 2 percent limit specified in subparagraph (A) for payments for the Medicare programs specified in section 256(d), the sequestration order of the President under such subparagraph for fiscal year 2022 shall be applied to such payments so that with respect to the period beginning on April 1, 2022, and ending on June 30, 2022, the payment reduction shall be 1.0 percent.</text></subparagraph><subparagraph id="HF98C26BDFBE949AB94678F9BB4F00E9A" commented="no" display-inline="no-display-inline"><enum>(D)</enum><text display-inline="yes-display-inline">Notwithstanding the 2 percent limit specified in subparagraph (A) for payments for the Medicare programs specified in section 256(d), the sequestration order of the President under such subparagraph for fiscal year 2030 shall be applied to such payments so that—</text><clause id="H33D3AEB764214F5A8E6C21A373446195" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">with respect to the first 6 months in which such order is effective for such fiscal year, the payment reduction shall be 2.25 percent; and</text></clause><clause id="HCD3E3527AC224431BF41BE4DD5EAE3E9" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">with respect to the second 6 months in which such order is so effective for such fiscal year, the payment reduction shall be 3 percent. </text></clause></subparagraph><after-quoted-block display="yes">.</after-quoted-block></quoted-block></paragraph></subsection></section><section id="H0174612F18254C229F318183A63A87A5" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>3.</enum><header display-inline="yes-display-inline">Extension of support for physicians and other professionals in adjusting to Medicare payment changes</header><subsection id="HDFBE01D0B2D34C0C904A4D8740895813" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 1848 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395w-4">42 U.S.C. 1395w–4</external-xref>) is amended—</text><paragraph id="H014E007D233646E3915EFA2813C44E94" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (c)(2)(B)(iv)(V), by striking <quote>2021</quote> and inserting <quote>2021 or 2022</quote>; and </text></paragraph><paragraph id="HF3E6F1D1178B4FA48D86E0E55AACE6F6" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (t)—</text><subparagraph id="H85F5F46871B7402094E0F73BA2DEEEF5" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">in the subsection header, by striking <quote><header-in-text level="subsection" style="OLC">2021</header-in-text></quote> and inserting <quote><header-in-text level="subsection" style="OLC">2021 and 2022</header-in-text></quote>;</text></subparagraph><subparagraph id="HB973AB183A8C479AABB24AA27D97455C" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">in paragraph (1)—</text><clause id="HBCC21D62A39E4B7B8F4856D0F8077C6C" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">by striking <quote>during 2021</quote> and inserting <quote>during 2021 and 2022</quote>; and</text></clause><clause id="H8DBB9EDC516D4BFBA49F0168606C3CA2" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">by striking <quote>for such services furnished on or after January 1, 2021, and before January 1, 2022, by 3.75 percent.</quote> and inserting </text><quoted-block style="OLC" id="H22564E6857DB42B0B224A64EF8831D54" display-inline="yes-display-inline"><text>for—</text><subparagraph id="HD220828D8F3A4509AA81F1550A82FBD3" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">such services furnished on or after January 1, 2021, and before January 1, 2022, by 3.75 percent; and</text></subparagraph><subparagraph id="HD4EFA02ACADA4906A01CBE58233C6F63" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">such services furnished on or after January 1, 2022, and before January 1, 2023, by 3.0 percent.</text></subparagraph><after-quoted-block display="yes">; and</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="HBB39CF52BD084DAC9078DE31329525D0" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">in paragraph (2)(C)—</text><clause id="H9336F46602684F7D9FF986E3735AC570" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">in the subparagraph header, by striking <quote><header-in-text level="subparagraph" style="OLC">2021</header-in-text></quote> and inserting <quote><header-in-text level="subparagraph" style="OLC">2021 and 2022</header-in-text></quote>;</text></clause><clause id="H0F3671DCA703438C98DBC8139D3283D5" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">by inserting <quote>for services furnished in 2021 or 2022</quote> after <quote>under this subsection</quote>; and</text></clause><clause id="HCB042B7A8FA04ABCB92EAD43365DF2C9" commented="no" display-inline="no-display-inline"><enum>(iii)</enum><text display-inline="yes-display-inline">by inserting <quote>or 2022, respectively</quote> before the period at the end.</text></clause></subparagraph></paragraph></subsection><subsection id="H03C00321638D421CA2E389AA04F4486E" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header display-inline="yes-display-inline">Report</header><text display-inline="yes-display-inline">Section 101(c) of division N of the Consolidated Appropriations Act, 2021 (<external-xref legal-doc="public-law" parsable-cite="pl/116/260">Public Law 116–260</external-xref>) is amended—</text><paragraph id="H8CA37797F08E4ED29528A82B4E77FCBA" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">in the first sentence—</text><subparagraph id="H75527784B64D4F07884616DE1F0AD409" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">by striking <quote>April 1, 2022</quote> and inserting <quote>each of April 1, 2022, and April 1, 2023</quote>; and</text></subparagraph><subparagraph id="H0748A5E1B80C454DB3B230FCEAE9F99B" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">by inserting <quote>with respect to 2021 or 2022, as applicable</quote> after <quote>under such section</quote>. </text></subparagraph></paragraph></subsection></section><section id="H3F1D24B7D9974AD3AA33511651389D36" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>4.</enum><header display-inline="yes-display-inline">Preserving patient access to critical clinical lab services</header><subsection id="HA42B107495224656890C4064A331761F" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header display-inline="yes-display-inline">Revised phase-in of reductions from private payor rate implementation</header><text display-inline="yes-display-inline">Section 1834A(b)(3) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395m-1">42 U.S.C. 1395m–1(b)(3)</external-xref>) is amended—</text><paragraph id="H13F001765CED47E5912733BCED653A38" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">in subparagraph (A), by striking <quote>through 2024</quote> and inserting <quote>through 2025</quote>; and</text></subparagraph><subparagraph id="HDE71A267E0F94C6F823A00ACA09AE68C" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">by striking <quote>March 31, 2022</quote> and inserting <quote>March 31, 2023</quote>. </text></subparagraph></paragraph></subsection></section><section id="H71500DB3603E428386339C209D048D48" section-type="subsequent-section" commented="no" display-inline="no-display-inline"><enum>5.</enum><header display-inline="yes-display-inline">Delay to the implementation of the radiation oncology model under the Medicare program</header><text display-inline="no-display-inline">Section 133 of Division CC of the Consolidated Appropriations Act, 2021 (<external-xref legal-doc="public-law" parsable-cite="pl/116/260">Public Law 116–260</external-xref>) is amended by striking <quote>January 1, 2022</quote> and inserting <quote>January 1, 2023</quote>.</text></section><section id="H46C66F89C9FA418DB1F9A2AA4D8071A1" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>6.</enum><header display-inline="yes-display-inline">Medicare Improvement Fund</header><text display-inline="no-display-inline">Section 1898(b)(1) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395iii">42 U.S.C. 1395iii(b)(1)</external-xref>) is amended by striking <quote>fiscal year 2021</quote> and all that follows through the period at the end and inserting <quote>fiscal year 2021, $101,000,000.</quote>. </text></section><section commented="no" id="H6B5F95233F724CA99C2EF3B6D18FC4C1" section-type="subsequent-section" display-inline="no-display-inline"><enum>7.</enum><header display-inline="yes-display-inline">PAYGO annual report</header><text display-inline="no-display-inline">For the purposes of the annual report issued pursuant to section 5 of the Statutory Pay-As-You-Go Act of 2010 (<external-xref legal-doc="usc" parsable-cite="usc/2/934">2 U.S.C. 934</external-xref>) after adjournment of the first session of the 117th Congress, and for determining whether a sequestration order is necessary under such section, the debit for the budget year on the 5-year scorecard, if any, and the 10-year scorecard, if any, shall be deducted from such scorecard in 2022 and added to such scorecard in 2023. </text></section><section commented="no" id="H9F1AED6C618C4489B6AD8013E7D2C049" section-type="subsequent-section" display-inline="no-display-inline"><enum>8.</enum><header display-inline="yes-display-inline">Expedited procedures for considering an increase in the debt limit</header><subsection commented="no" id="HEA9D0E2B75334B7EB6E0BF3663A4E8AC" display-inline="no-display-inline"><enum>(a)</enum><header display-inline="yes-display-inline">Definition</header><text display-inline="yes-display-inline">In this section, the term <term>joint resolution</term> means a joint resolution—</text><paragraph commented="no" id="H816AA7AA83E14D409DC254891D9CDA04" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">that is introduced by the Majority Leader of the Senate, or a designee, during the period beginning on the date of enactment of this Act and ending on December 31, 2021;</text></paragraph><paragraph id="H709B04EEC08646FE896C30422AD287E8" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">which does not have a preamble;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H20DDE9A814154DA89F07E6A1B606C145"><enum>(3)</enum><text display-inline="yes-display-inline">the title of which is as follows: <quote>Joint resolution relating to increasing the debt limit.</quote>; and</text></paragraph><paragraph commented="no" id="HFA8FB51BA2C64846B6604B8201172127" display-inline="no-display-inline"><enum>(4)</enum><text display-inline="yes-display-inline">the matter after the resolving clause of which is as follows: <quote>That the limitation under section 3101(b) of title 31, United States Code, as most recently increased by <external-xref legal-doc="public-law" parsable-cite="pl/117/50">Public Law 117–50</external-xref> (<external-xref legal-doc="usc" parsable-cite="usc/31/3101">31 U.S.C. 3101</external-xref> note), is increased by $_________.</quote>, the blank space being appropriately filled in with the dollar amount of the increase.</text></paragraph></subsection><subsection commented="no" id="H1EFF1CB4F1CD46C793229DBD9D58626F" display-inline="no-display-inline"><enum>(b)</enum><header display-inline="yes-display-inline">Expedited consideration in Senate</header><paragraph commented="no" id="H325988E086DF48C09AF1DB7F5B40DFB7" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">Placement on calendar</header><text display-inline="yes-display-inline">Upon introduction in the Senate, the joint resolution shall be placed immediately on the calendar. </text></paragraph><paragraph commented="no" id="H510FEDDA41ED40C086831C5E9E8F1FBF" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Proceeding to consideration</header><subparagraph commented="no" id="H43029C91DCEE4BA5BFEBBDC77E29FC2A" display-inline="no-display-inline"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Notwithstanding rule XXII of the Standing Rules of the Senate, it is in order, not later than January 15, 2022 (even though a previous motion to the same effect has been disagreed to) to move to proceed to the consideration of the joint resolution.</text></subparagraph><subparagraph commented="no" id="HE3E65B87508A44B79B4B2982B838B4C1" display-inline="no-display-inline"><enum>(B)</enum><header display-inline="yes-display-inline">Procedure</header><text display-inline="yes-display-inline">For a motion to proceed to the consideration of the joint resolution—</text><clause commented="no" id="H9619BCEFE2604A1DBE15D807D916C6A0" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">all points of order against the motion are waived;</text></clause><clause commented="no" id="H4523F9FA59554D41ABDBE0E0130656E0" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">the motion is not debatable;</text></clause><clause commented="no" id="H4982670981BC45F6A6C37B00C97C9470" display-inline="no-display-inline"><enum>(iii)</enum><text display-inline="yes-display-inline">the motion is not subject to a motion to postpone;</text></clause><clause commented="no" id="H50BA1581983A4075AC269795D509BD0F" display-inline="no-display-inline"><enum>(iv)</enum><text display-inline="yes-display-inline">a motion to reconsider the vote by which the motion is agreed to or disagreed to shall not be in order; and</text></clause><clause commented="no" id="HF411ED3288D0485E936B2E410EEDF9D1" display-inline="no-display-inline"><enum>(v)</enum><text display-inline="yes-display-inline">if the motion is agreed to, the joint resolution shall remain the unfinished business until disposed of.</text></clause></subparagraph></paragraph><paragraph commented="no" id="HC064FE3509A64F99A1D7A6A8FDB8207D" display-inline="no-display-inline"><enum>(3)</enum><header display-inline="yes-display-inline">Floor consideration</header><subparagraph commented="no" id="H9C9CA9DD18B74086B216E36168C0B2C5" display-inline="no-display-inline"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">If the Senate proceeds to consideration of the joint resolution—</text><clause commented="no" id="HA148DBCFE5344E3A93528F87B5FECCFF" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">all points of order against the joint resolution (and against consideration of the joint resolution) are waived;</text></clause><clause commented="no" id="H8A37E346628F48DD870B98088131A8C4" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">debate on the joint resolution, and all debatable motions and appeals in connection therewith, shall be limited to not more than 10 hours, which shall be divided equally between the Chairman and Ranking Member of the Committee on Finance;</text></clause><clause id="HBB0766D63CD1470CA27D20586EB7007C" commented="no" display-inline="no-display-inline"><enum>(iii)</enum><text display-inline="yes-display-inline">an amendment to the joint resolution is not in order; </text></clause><clause commented="no" id="HE970DEB2FCDB4E2EAF00BBFAC2E9884C" display-inline="no-display-inline"><enum>(iv)</enum><text display-inline="yes-display-inline">a motion to postpone or a motion to commit the joint resolution is not in order; and</text></clause><clause commented="no" id="H4FAB5F2E7BC24328BBA8BCB38C1CD99C" display-inline="no-display-inline"><enum>(v)</enum><text display-inline="yes-display-inline">a motion to proceed to the consideration of other business is not in order.</text></clause></subparagraph><subparagraph commented="no" id="H9F33E191AA1B40119BF954214FA2BF77" display-inline="no-display-inline"><enum>(B)</enum><header display-inline="yes-display-inline">Vote on passage</header><text display-inline="yes-display-inline">The vote on passage shall occur immediately following the conclusion of the debate on the joint resolution and a single quorum call if requested in accordance with the rules of the Senate.</text></subparagraph><subparagraph commented="no" id="H3B723A7E221845B994647F4290675FC8" display-inline="no-display-inline"><enum>(C)</enum><header display-inline="yes-display-inline">Rulings of the chair on procedure</header><text display-inline="yes-display-inline">Appeals from the decisions of the Chair relating to the application of this paragraph or the rules of the Senate, as the case may be, to the procedure relating to the joint resolution shall be decided without debate.</text></subparagraph><subparagraph commented="no" id="H0ED25C3833FB4860B50051EAA7B28A0B" display-inline="no-display-inline"><enum>(D)</enum><header display-inline="yes-display-inline">Single measure authorized</header><text display-inline="yes-display-inline">It shall not be in order to consider more than 1 joint resolution under the procedures under this paragraph.</text></subparagraph><subparagraph commented="no" id="H6E0BF2CD3C814B5DBC175654CF547120" display-inline="no-display-inline"><enum>(E)</enum><header display-inline="yes-display-inline">Sunset</header><text display-inline="yes-display-inline">It shall not be in order to consider a joint resolution under the procedures under this paragraph after January 16, 2022.</text></subparagraph></paragraph><paragraph commented="no" id="H106E19F29AE9449BB33C172BBDA95F1B" display-inline="no-display-inline"><enum>(4)</enum><header display-inline="yes-display-inline">Rules of the Senate</header><text display-inline="yes-display-inline">This subsection is enacted by Congress—</text><subparagraph commented="no" id="H9D8B237F9D784A3595672F5955336136" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">as an exercise of the rulemaking power of the Senate, and as such is deemed a part of the rules of the Senate, but applicable only with respect to the procedure to be followed in the Senate in the case of a joint resolution, and supersede other rules only to the extent that they are inconsistent with such rules; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HAD7578427B8044C6AC5042F27481B7CC"><enum>(B)</enum><text display-inline="yes-display-inline">with full recognition of the constitutional right of the Senate to change the rules (so far as relating to the procedure of the Senate) at any time, in the same manner, and to the same extent as in the case of any other rule of the Senate.</text></subparagraph></paragraph></subsection></section></legis-body><attestation><attestation-group><attestor display="no"></attestor><role>Speaker of the House of Representatives</role></attestation-group><attestation-group><attestor display="no"></attestor><role>Vice President of the United States and President of the Senate</role></attestation-group></attestation></bill>
