which was read twice and referred to the <committee-name committee-id="SSEG00">Committee on Energy and Natural Resources</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To direct the Secretary of Agriculture to transfer certain National Forest System land to the State of South Dakota, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Gilt Edge Mine Conveyance Act</short-title></quote>.</text></section><section id="id037cb70aa8cd43f8b78afe3ffac4792e"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="id0fa2b4f1537049dc954789a35e17969d"><enum>(1)</enum><header>Federal land</header><text>The term <term>Federal land</term> means all right, title, and interest of the United States in and to approximately 266 acres of National Forest System land within the Gilt Edge Mine Superfund Boundary, as generally depicted on the map. </text></paragraph><paragraph id="id739dba1b1a074d5381efe5f0b6afced3"><enum>(2)</enum><header>Map</header><text>The term <term>map</term> means the map entitled <quote>Gilt Edge Mine Conveyance Act</quote> and dated August 20, 2020. </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id89affa52579342e0ad9b6942be082354"><enum>(3)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Agriculture, acting through the Chief of the Forest Service. </text></paragraph><paragraph id="idb84e2d70556049f5b032a84412e0ae1b"><enum>(4)</enum><header>State</header><text>The term <term>State</term> means State of South Dakota. </text></paragraph></section><section id="id119954a96cab499ebb9b9b10c217eb0d"><enum>3.</enum><header>Land conveyance</header><subsection id="id3a65a6b2033c4969ab970b74d070434e"><enum>(a)</enum><header>In general</header><text>Subject to the terms and conditions described in this Act, if the State submits to the Secretary an offer to acquire the Federal land for the market value, as determined by the appraisal under subsection (c), the Secretary shall convey the Federal land to the State. </text></subsection><subsection id="id2824c1e4cb004c968e21b730ca398fe7"><enum>(b)</enum><header>Terms and conditions</header><text>The conveyance under subsection (a) shall be— </text><paragraph id="id2a6ec86357384e2ca7891f2302a613ee"><enum>(1)</enum><text>subject to valid existing rights;</text></paragraph><paragraph id="ida23e8dc35c0b407492eda1c267c41b0f"><enum>(2)</enum><text>made by quitclaim deed; and</text></paragraph><paragraph id="idfe8cbad49a1446bc9047dee83f6f3a13"><enum>(3)</enum><text>subject to any other terms and conditions as the Secretary considers appropriate to protect the interests of the United States. </text></paragraph></subsection><subsection id="idfd30067ada5b44ae9375e7e2c930a231"><enum>(c)</enum><header>Appraisal</header><paragraph id="id916780d38544477db6f911f1985a44dc"><enum>(1)</enum><header>In general</header><text>Before submitting an offer under subsection (a), the State shall complete an appraisal to determine the market value of the Federal land. </text></paragraph><paragraph id="id7d6f44aff804468f8cd1cffc1b1ad861"><enum>(2)</enum><header>Standards</header><text>The appraisal under paragraph (1) shall be conducted in accordance with— </text><subparagraph id="id043f7498483847eebc3ede376ec32b04"><enum>(A)</enum><text>the Uniform Appraisal Standards for Federal Land Acquisitions; and </text></subparagraph><subparagraph id="id05b74beef6d84446afab81b573c5c2cb"><enum>(B)</enum><text>the Uniform Standards of Professional Appraisal Practice. </text></subparagraph></paragraph></subsection><subsection id="id2e78c508dd6c406db764386624983b23"><enum>(d)</enum><header>Map</header><paragraph id="id24074a2c980b4538985c369cb5301d91"><enum>(1)</enum><header>Availability of map</header><text>The map shall be kept on file and available for public inspection in the appropriate office of the Forest Service. </text></paragraph><paragraph id="id774db3107cbb40e69eccfbbfcf6dee53"><enum>(2)</enum><header>Correction of errors</header><text>The Secretary may correct any errors in the map. </text></paragraph></subsection><subsection id="id9e30cacf7b4242d29355442dc803155d"><enum>(e)</enum><header>Consideration</header><text>As consideration for the conveyance under subsection (a), the State shall pay to the Secretary an amount equal to the market value of the Federal land, as determined by the appraisal under subsection (c). </text></subsection><subsection id="id7d0b0ec37678499395cacd1c9802b2d5"><enum>(f)</enum><header>Survey</header><text>The State shall prepare a survey that is satisfactory to the Secretary of the exact acreage and legal description of the Federal land to be conveyed under subsection (a).</text></subsection><subsection id="idba9552025bd74fbb9157d4bd30bae22c"><enum>(g)</enum><header>Costs of conveyance</header><text>As a condition on the conveyance under subsection (a), the State shall pay all costs associated with the conveyance, including the cost of— </text><paragraph id="id9153b4d5bcb346ee9e10faa48ea0ef09"><enum>(1)</enum><text>the appraisal under subsection (c); and</text></paragraph><paragraph id="ide1ee9e34972d449e93650e0cee337fc9"><enum>(2)</enum><text>the survey under subsection (f).</text></paragraph></subsection><subsection id="idf467e41a5f5a4d5d9fcb61c91ca5d309"><enum>(h)</enum><header>Proceeds from the sale of land</header><text>Any proceeds received by the Secretary from the conveyance under subsection (a) shall be— </text><paragraph id="id035f1c2cc3524e11bafc68834981a09f"><enum>(1)</enum><text>deposited in the fund established under <external-xref legal-doc="public-law" parsable-cite="pl/90/171">Public Law 90–171</external-xref> (commonly known as the <quote>Sisk Act</quote>) (<external-xref legal-doc="usc" parsable-cite="usc/16/484a">16 U.S.C. 484a</external-xref>); and </text></paragraph><paragraph id="idd531136ab01c4ad6850a4fae6a1938b6"><enum>(2)</enum><text>available to the Secretary until expended, without further appropriation, for the maintenance and improvement of land or administration facilities in the Black Hills National Forest in the State.</text></paragraph></subsection><subsection id="idda76bd5ce53241198052d01efe2d7112"><enum>(i)</enum><header>Environmental conditions</header><text>Notwithstanding section 120(h)(3)(A) of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9620">42 U.S.C. 9620(h)(3)(A)</external-xref>), the Secretary shall not be required to provide any covenant or warranty for the Federal land conveyed to the State under this Act. </text></subsection></section></legis-body></bill>
