which was read twice and referred to the <committee-name committee-id="SLIA00">Committee on Indian Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To provide for the conveyance of certain property to the Tanana Tribal Council located in Tanana, Alaska, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H5C748D9781314864A64EDB4359FF3D70"><section section-type="section-one" id="H5702D8A2FC4A4D15853446DC7C080D46"><enum>1.</enum><header>Conveyance of property to the Tanana Tribal Council</header><subsection commented="no" display-inline="no-display-inline" id="H46BFE6EE26854AACBDACAAFECA199183"><enum>(a)</enum><header display-inline="yes-display-inline">Conveyance of property</header><paragraph commented="no" display-inline="no-display-inline" id="H53963BFF49AE4B648CC84280B3BA5B8B"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">As soon as practicable, but not later than 180 days, after the date of enactment of this Act, the Secretary of Health and Human Services (referred to in this Act as the <term>Secretary</term>) shall convey to the Tanana Tribal Council located in Tanana, Alaska (referred to in this section as the <term>Council</term>), all right, title, and interest of the United States in and to the property described in subsection (b) for use in connection with health and social services programs.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H99DC55D5144342A9B68B5618443A449C"><enum>(2)</enum><header display-inline="yes-display-inline">Conditions</header><text display-inline="yes-display-inline">The conveyance of the property under paragraph (1)—</text><subparagraph commented="no" display-inline="no-display-inline" id="H07C25602C4B948BD8E2B5163BA54BA75"><enum>(A)</enum><text display-inline="yes-display-inline">shall be made by warranty deed; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H216B9BCFB79C4F20BA29577E50C2E613"><enum>(B)</enum><text display-inline="yes-display-inline">shall not—</text><clause commented="no" display-inline="no-display-inline" id="HA159E5AABEF14977A5B36FAF42366307"><enum>(i)</enum><text display-inline="yes-display-inline">require any consideration from the Council for the property;</text></clause><clause commented="no" display-inline="no-display-inline" id="HE23A982D0AE94DE684CF1BAC954446F0"><enum>(ii)</enum><text display-inline="yes-display-inline">impose any obligation, term, or condition on the Council; or</text></clause><clause commented="no" display-inline="no-display-inline" id="H7B6FA9FD5E324FDBB6034842F9E60D6E"><enum>(iii)</enum><text display-inline="yes-display-inline">allow for any reversionary interest of the United States in the property.</text></clause></subparagraph></paragraph><paragraph id="HC91F6AABD9C940129A5F15B1F7E5004E"><enum>(3)</enum><header>Effect on any quitclaim deed</header><text>The conveyance by the Secretary of title by warranty deed under paragraph (1) shall, on the effective date of the conveyance, supersede and render of no future effect any quitclaim deed to the property described in subsection (b) executed by the Secretary and the Council. </text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H666C0F6B913B47B59A540353ED621243"><enum>(b)</enum><header display-inline="yes-display-inline">Property described</header><text display-inline="yes-display-inline">The property, including all land, improvements, and appurtenances, described in this subsection is the property included in U.S. Survey No. 5958 in the village of Tanana, Alaska, within surveyed lot 12, T. 4 N., R. 22 W., Fairbanks Meridian, Alaska, containing 11.25 acres.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="HF65AF6193D6A48B48C9D6FDF21B75651"><enum>(c)</enum><header display-inline="yes-display-inline">Environmental liability</header><paragraph commented="no" display-inline="no-display-inline" id="H5DCF88352342482EA7D4AB15FCF9964E"><enum>(1)</enum><header display-inline="yes-display-inline">Liability</header><subparagraph commented="no" display-inline="no-display-inline" id="HC3C8A538361145C68BF11069F7A9A8F6"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, the Council shall not be liable for any soil, surface water, groundwater, or other contamination resulting from the disposal, release, or presence of any environmental contamination on any portion of the property described in subsection (b) on or before the date on which the property is conveyed to the Council.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H379D45C57E594B73B75640D658E6ED5F"><enum>(B)</enum><header display-inline="yes-display-inline">Environmental contamination</header><text display-inline="yes-display-inline">An environmental contamination described in subparagraph (A) includes any oil or petroleum products, hazardous substances, hazardous materials, hazardous waste, pollutants, toxic substances, solid waste, or any other environmental contamination or hazard as defined in any Federal or State of Alaska law.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H066EDCC8F3324DD3B7E09FCA43D1DBEC"><enum>(2)</enum><header display-inline="yes-display-inline">Easement</header><text display-inline="yes-display-inline">The Secretary shall be accorded any easement or access to the property conveyed under this section as may be reasonably necessary to satisfy any retained obligation or liability of the Secretary.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H1D03BA2A3562429290FE164CD12010F1"><enum>(3)</enum><header display-inline="yes-display-inline">Notice of hazardous substance activity and warranty</header><text display-inline="yes-display-inline">In carrying out this section, the Secretary shall comply with subparagraphs (A) and (B) of section 120(h)(3) of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9620">42 U.S.C. 9620(h)(3)</external-xref>).</text></paragraph></subsection></section></legis-body></bill>
