<congress display="yes">117th CONGRESS</congress><session display="yes">1st Session</session><legis-num display="yes">S. 409</legis-num><current-chamber display="no">IN THE SENATE OF THE UNITED STATES</current-chamber><legis-type display="yes">AN ACT</legis-type><official-title display="yes">To provide for the availability of amounts for customer education initiatives and non-awards expenses of the Commodity Futures Trading Commission Whistleblower Program, and for other purposes. </official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause"><section id="idC8B834717ACE4ED8961DAEC53868324E" section-type="section-one" commented="no" display-inline="no-display-inline"><enum>1.</enum><header display-inline="yes-display-inline">Commodity Futures Trading Commission Whistleblower Program</header><subsection id="id2d68eeb01ea3431faf9827fba761f0e0" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, there is established in the Treasury a separate account (referred to in this section as the <term>account</term>), the amounts in which shall be available for the sole purposes of—</text><paragraph id="id2BE953C0EED54E0892AA45F08C4F9D50" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">carrying out the activities described in section 23(g)(2)(B) of the Commodity Exchange Act (<external-xref legal-doc="usc" parsable-cite="usc/7/26">7 U.S.C. 26(g)(2)(B)</external-xref>) (referred to in this section as <term>customer education initiatives</term>); and </text></paragraph><paragraph id="idF3E4B171456D426E82241D27709BF089" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">funding the administrative, programmatic, and personnel expenses of the Whistleblower Office and the Office of Customer Education and Outreach of the Commodity Futures Trading Commission (referred to in this section as the <term>Commission</term>) in carrying out section 23 of the Commodity Exchange Act (<external-xref legal-doc="usc" parsable-cite="usc/7/26">7 U.S.C. 26</external-xref>) (referred to in this section as <term>non-awards expenses</term>). </text></paragraph></subsection><subsection id="id73E963753F1E4A28BA436D1471787E08" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header display-inline="yes-display-inline">Transfers from Fund into account</header><paragraph id="id4BA4435F6EE54617A2AEF028767D7C6A" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, the Commission shall transfer up to $10,000,000 from the Commodity Futures Trading Commission Customer Protection Fund established under section 23(g)(1) of the Commodity Exchange Act (<external-xref legal-doc="usc" parsable-cite="usc/7/26">7 U.S.C. 26(g)(1)</external-xref>) (referred to in this section as the <term>Fund</term>) into the account.</text></paragraph><paragraph id="id972A95C2305447A0867366E97FAC0AD6" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Availability</header><text display-inline="yes-display-inline">Amounts transferred under paragraph (1) shall be available for obligation without further appropriation and remain available until October 1, 2022. </text></paragraph><paragraph id="idB2D4EAF8FF964102A2FF6CD5D9EACBCA" commented="no" display-inline="no-display-inline"><enum>(3)</enum><header display-inline="yes-display-inline">Remaining amounts</header><text display-inline="yes-display-inline">Amounts remaining in the account that are unobligated on October 1, 2022, shall be returned to the Fund. </text></paragraph></subsection><subsection id="id3E18F21ACD5846B1877DF303B4DF1718" commented="no" display-inline="no-display-inline"><enum>(c)</enum><header display-inline="yes-display-inline">Requirement for obligations</header><text display-inline="yes-display-inline">The Commission may make obligations from the account only when the unobligated balance of the Fund is insufficient to pay non-awards expenses and expenses for customer education initiatives due to awards that the Commission has ordered under section 23(b) of the Commodity Exchange Act (<external-xref legal-doc="usc" parsable-cite="usc/7/26">7 U.S.C. 26(b)</external-xref>).</text></subsection><subsection id="id524DA02BCFF4457B9EF347CAEDAB3317" commented="no" display-inline="no-display-inline"><enum>(d)</enum><header display-inline="yes-display-inline">Reports to Congress</header><text display-inline="yes-display-inline">The Commission shall include in each report required under section 23(g)(5) of the Commodity Exchange Act (<external-xref legal-doc="usc" parsable-cite="usc/7/26">7 U.S.C. 26(g)(5)</external-xref>) the same information with respect to the account as the Commission includes in the report with respect to the Fund, to the extent the information is relevant to the account. </text></subsection></section></legis-body><attestation><attestation-group><attestation-date date="20210528" legis-day="20210527" chamber="Senate">Passed the Senate May 28 (legislative day, May 27), 2021.</attestation-date><attestor display="no"></attestor><role>Secretary</role></attestation-group></attestation><endorsement display="yes"></endorsement></bill>
