which was read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To establish the Office of Technologists within the Federal Trade Commission.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H98400276CF8A4739A7D5FEBB68AA2643"><section section-type="section-one" id="H0F06CE188FC44FF08F38497FC58E7532"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Federal Trade Commission Technologists Act of 2021</short-title></quote>.</text></section><section id="H32511BEB7DAF4C17908DF444912A4E23"><enum>2.</enum><header>Establishment of the Office of Technologists</header><subsection id="H459EBE38AD34486A9ED9E209C327C6C7"><enum>(a)</enum><header>Office of Technologists</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of this section, the Commission shall establish within the Commission the Office of Technologists (in this section referred to as the <quote>Office</quote>) to advise the Commission on technology matters, including the Commission’s use of technology, technical aspects of law enforcement actions, and technology policy recommendations.</text></subsection><subsection id="H0D5CB4E3364042FBAF66C0ABF915B121"><enum>(b)</enum><header>Personnel</header><paragraph id="id5E7C201CA2C940B5945AB8F853D07C24"><enum>(1)</enum><header>In general</header><text>The Commission shall appoint to positions in the Office—</text><subparagraph id="id30469605F5944723AE24E3A9F01DB0CA"><enum>(A)</enum><text>not less than 25 technologists; and</text></subparagraph><subparagraph id="idA1B3761908E64B9FB846263E62FAC674"><enum>(B)</enum><text>other necessary employees.</text></subparagraph></paragraph><paragraph id="idDE8DC841E001428DA64E149EB7C8A4D8"><enum>(2)</enum><header>Direct hire authority</header><text>The Commission may make appointments of technologists under paragraph (1) without regard to the provisions of subchapter I of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/33">chapter 33</external-xref> of title 5, United States Code.</text></paragraph><paragraph id="idB8C86A57626942E4BE4EFE4584545B10"><enum>(3)</enum><header>Calculation of number of technologists</header><text>For purposes of paragraph (1)(A), the number of individuals appointed to a position as a technologist shall be determined on a full-time equivalent basis, except that an appointment of an individual to a position as a technologist on a term or temporary basis shall be counted as an appointment to a full-time position, without regard to the number of hours in the administrative workweek of the individual.</text></paragraph><paragraph id="id0920D760076E412AABE2FE219F124A71"><enum>(4)</enum><header>Compensation</header><subparagraph id="idC8031CFAFA95470DA3BEB239F4B7543C"><enum>(A)</enum><header>Rate of pay</header><text>Subject to subparagraph (B), in order to recruit and retain qualified technologists, the Commission may fix the rate of pay, including compensation for night and overtime work and other premium pay, of any technologist appointed under paragraph (1), as the Commission considers necessary for the interest of the Federal Government and just to the individuals employed.</text></subparagraph><subparagraph id="id07B078D12BEC43E0BC83BE866A5E5784"><enum>(B)</enum><header>Maximum</header><text>The total amount payable to a technologist appointed under paragraph (1), including compensation for night and overtime work and other premium pay, during any pay period may not exceed the rate of basic pay payable for a position at level II of the Executive Schedule under section 5313 of title 5, United States Code.</text></subparagraph><subparagraph id="id4C76FE9458AA4DCB934B3B7837469666"><enum>(C)</enum><header>Time off</header><text>With respect to a technologist appointed under paragraph (1) who is not eligible for overtime or other premium pay, the Commission may grant such technologist compensatory time off from duty for overtime work performed.</text></subparagraph></paragraph></subsection><subsection id="H65B5D6AD906F4AB09F164A70ECFA744A"><enum>(c)</enum><header>Definitions</header><text>In this section:</text><paragraph id="idBDA53C8275D54C9BACBCABA7BEE09917"><enum>(1)</enum><header>Commission</header><text>The term <term>Commission</term> means the Federal Trade Commission.</text></paragraph><paragraph id="idB1B3B6558FBE4001834C1BDD178885D0"><enum>(2)</enum><header>Technologist</header><text>The term <term>technologist</term> means an individual with training and expertise regarding the state of the art in information technology, including product development, supply chain management, data privacy and analytics, algorithms, information security, network security, the manufacturing of hardware, software development, computer science, or other related fields.</text></paragraph></subsection><subsection id="H41ED61E3A1BF472FAAC95A18B34318D1"><enum>(d)</enum><header>Authorization of appropriation</header><text>There is authorized to be appropriated such sums as necessary to carry out the requirements of this section.</text></subsection></section></legis-body></bill>
