<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>1st Session</session><legis-num>S. 3182</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20211104">November 4, 2021</action-date><action-desc><sponsor name-id="S277">Mr. Carper</sponsor> (for himself, <cosponsor name-id="S349">Mr. Portman</cosponsor>, and <cosponsor name-id="S384">Mr. Tillis</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To improve the Office of Refugee Resettlement shelter grant process.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Safe Shelters Act of 2021</short-title></quote>.</text></section><section id="idE8B576DCA19F41E7B25DFCBB6AABD791"><enum>2.</enum><header>Office of Refugee Resettlement shelter grant process</header><subsection id="id7B61E9B6F91D4B35BC1A7520B2C21155"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section: </text><paragraph id="idD3453CC7A867451AA4EEF3DD523B6B1C"><enum>(1)</enum><header>Adverse action</header><text>The term <term>adverse action</term> means an adverse criminal or regulatory action taken by the Federal Government or a State or local government with respect to contracting with a government entity or to the care of children, including—</text><subparagraph id="idF63F59758672441291165950E6E30D16"><enum>(A)</enum><text>the suspension or revocation of an operating license; and</text></subparagraph><subparagraph id="idEEA5C5866A304EA7AD698FA273844A1A"><enum>(B)</enum><text>any ongoing or pending investigation by the Federal Government or a State or local government.</text></subparagraph></paragraph><paragraph id="idD389D0F7D2264569ACED08E27F990561"><enum>(2)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Health and Human Services.</text></paragraph><paragraph id="idAF1F3D77404145C89A579778ABE7ED66" commented="no" display-inline="no-display-inline"><enum>(3)</enum><header>Unaccompanied alien child</header><text>The term <term>unaccompanied alien child</term> has the meaning given the term in section 462(g) of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/279">6 U.S.C. 279(g)</external-xref>).</text></paragraph></subsection><subsection id="id4AF802CD86DF4C61BF145683190AF5E6"><enum>(b)</enum><header>Disclosure and licensure</header><text>With respect to Office of Refugee Resettlement grants to open or fund shelter facilities for unaccompanied alien children, the Secretary shall require each applicant—</text><paragraph id="idD84CCF2EF5D64C43A717BFF9C014F948"><enum>(1)</enum><text>to disclose in the grant application any adverse action taken against the applicant during the 5-year period immediately preceding the date on which the application is submitted; and</text></paragraph><paragraph id="idD13D2C325C894AF79657205FAF695E60"><enum>(2)</enum><text>to be licensed to operate such a facility in the applicable State as of such date.</text></paragraph></subsection><subsection id="id047A53E70874447F95B8F6AD6DC9443C"><enum>(c)</enum><header>Information sharing</header><text>In considering an application for a grant referred to in subsection (b), the Secretary shall seek to collaborate with the appropriate regulatory agencies of the State in which the applicant intends to operate to conduct a review of State databases for information on adverse actions taken against the applicant.</text></subsection></section></legis-body></bill>
