which was read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To repeal section 230 of the Communications Act of 1934.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Repeal of section 230</header><subsection id="idDFBF119ACAE744E1B9CD05B4A5F9F87E"><enum>(a)</enum><header>In general</header><text>Section 230 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/230">47 U.S.C. 230</external-xref>) is repealed.</text></subsection><subsection id="idC30680D64DF24156AF41A2AD302C5EAB"><enum>(b)</enum><header>Conforming amendments</header><paragraph id="id77BE040EDFE14AA39B95ABF81AC8FA76"><enum>(1)</enum><header>Communications Act of 1934</header><text>The Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/151">47 U.S.C. 151 et seq.</external-xref>) is amended—</text><subparagraph id="id1A9E9722945242D79D1E6E5B517E225E"><enum>(A)</enum><text>in section 223(h) (<external-xref legal-doc="usc" parsable-cite="usc/47/223">47 U.S.C. 223(h)</external-xref>), by striking paragraph (2) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idFB5CD7DCD2B94978A6B88FFFFB40D03C"><paragraph id="idCEADD8C2A2644A24BAC474E86B5C98FD"><enum>(2)</enum><text>The term <term>interactive computer service</term> means any information service, system, or access software provider that provides or enables computer access by multiple users to a computer server, including specifically a service or system that provides access to the Internet and such systems operated or services offered by libraries or educational institutions.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="id891A2B862C3C43CB9E61FF3E15E03AFB"><enum>(B)</enum><text>in section 231(b)(4) (<external-xref legal-doc="usc" parsable-cite="usc/47/231">47 U.S.C. 231(b)(4)</external-xref>), by striking <quote>or section 230</quote>.</text></subparagraph></paragraph><paragraph id="idD92573B3EAD04BB4AE3A86C898C4DC09"><enum>(2)</enum><header>Trademark Act of 1946</header><text>Section 45 of the Act entitled <quote>An Act to provide for the registration and protection of trademarks used in commerce, to carry out the provisions of certain international conventions, and for other purposes</quote>, approved July 5, 1946 (commonly known as the <quote>Trademark Act of 1946</quote>) (<external-xref legal-doc="usc" parsable-cite="usc/15/1127">15 U.S.C. 1127</external-xref>), is amended by striking the definition relating to the term <quote>Internet</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idCB53F2E464FC45728E4F408703A4173B"><subsection id="id48CF6BE8D263479F9B612021564E577E"><enum/><text>The term <term>Internet</term> means the international computer network of both Federal and non-Federal interoperable packet switched data networks.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="id231F3B19D59F4FE0A52A8C7F2C3F61D6"><enum>(3)</enum><header>Title 17, United States Code</header><text>Section 1401 of title 17, United States Code, is amended by striking subsection (g).</text></paragraph><paragraph id="id5B631F197CE34D6C866AE657A55507F9"><enum>(4)</enum><header>Title 18, United States Code</header><text>Part I of title 18, United States Code, is amended—</text><subparagraph id="idE0FBAFEE61F043F3B1BC3739F905AFD2"><enum>(A)</enum><text>in section 2257(h)(2)(B)(v), by striking <quote>, except that deletion of a particular communication or material made by another person in a manner consistent with section 230(c) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/230">47 U.S.C. 230(c)</external-xref>) shall not constitute such selection or alteration of the content of the communication</quote>; and</text></subparagraph><subparagraph id="id32E25A22E4DE46DEB56B7C26E8AB478A"><enum>(B)</enum><text>in section 2421A—</text><clause id="idC472BE86D827429DBACFC524722AEBEC"><enum>(i)</enum><text>in subsection (a), by striking <quote>(as such term is defined in defined in section 230(f) the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/230">47 U.S.C. 230(f)</external-xref>))</quote> and inserting <quote>(as that term is defined in section 223 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/223">47 U.S.C. 223</external-xref>))</quote>; and</text></clause><clause id="id8136BCECE1344578B0D53E9A2C251A0F"><enum>(ii)</enum><text>in subsection (b), by striking <quote>(as such term is defined in defined in section 230(f) the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/230">47 U.S.C. 230(f)</external-xref>))</quote> and inserting <quote>(as that term is defined in section 223 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/223">47 U.S.C. 223</external-xref>))</quote>.</text></clause></subparagraph></paragraph><paragraph id="id52E10BF6D9DE4F1FBF59189CE8ED961F"><enum>(5)</enum><header>Controlled Substances Act</header><text>Section 401(h)(3)(A)(iii)(II) of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/841">21 U.S.C. 841(h)(3)(A)(iii)(II)</external-xref>) is amended by striking <quote>, except that deletion of a particular communication or material made by another person in a manner consistent with section 230(c) of the Communications Act of 1934 shall not constitute such selection or alteration of the content of the communication</quote>.</text></paragraph><paragraph id="id8B6B397560A24701B6275E4F7983B1F8"><enum>(6)</enum><header>Webb-Kenyon Act</header><text>Section 3(b)(1) of the Act entitled <quote>An Act divesting intoxicating liquors of their interstate character in certain cases</quote>, approved March 1, 1913 (commonly known as the <quote>Webb-Kenyon Act</quote>) (<external-xref legal-doc="usc" parsable-cite="usc/27/122b">27 U.S.C. 122b(b)(1)</external-xref>), is amended by striking <quote>(as defined in section 230(f) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/230">47 U.S.C. 230(f)</external-xref>)</quote> and inserting <quote>(as defined in section 223 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/223">47 U.S.C. 223</external-xref>))</quote>.</text></paragraph><paragraph commented="no" id="id8086C14A2A0F4539859D37C05F3446C2"><enum>(7)</enum><header>Title 28, United States Code</header><text>Section 4102 of title 28, United States Code, is amended—</text><subparagraph commented="no" id="idACF1493AA868406AA704C3935B45C89E"><enum>(A)</enum><text>by striking subsection (c); and</text></subparagraph><subparagraph commented="no" id="idE1177D242A3549A6B164E77F59E8DC9C"><enum>(B)</enum><text>in subsection (e)—</text><clause commented="no" id="id4BD1F29FE3C942768BFF31EBE69C3E2F"><enum>(i)</enum><text>by striking <quote>construed to</quote> and all that follows through <quote>affect</quote> and inserting <quote>construed to affect</quote>; and</text></clause><clause commented="no" id="id81571581270549DD96E2BFE042EE18AB"><enum>(ii)</enum><text>by striking <quote>defamation; or</quote> and all that follows and inserting <quote>defamation.</quote>.</text></clause></subparagraph></paragraph><paragraph commented="no" id="idCEE7AE9867FA47F2A60B3EC2DBB93535"><enum>(8)</enum><header>Title 31, United States Code</header><text>Section 5362(6) of title 31, United States Code, is amended by striking <quote>section 230(f) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/230">47 U.S.C. 230(f)</external-xref>)</quote> and inserting <quote>section 223 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/223">47 U.S.C. 223</external-xref>)</quote>.</text></paragraph><paragraph commented="no" id="idF2CD2CE7D6884E47B22D4E89C3BBF548"><enum>(9)</enum><header>National Telecommunications and Information Administration Organization Act</header><text>Section 157 of the National Telecommunications and Information Administration Organization Act (<external-xref legal-doc="usc" parsable-cite="usc/47/941">47 U.S.C. 941</external-xref>) is amended—</text><subparagraph commented="no" id="id0303ACEFB40A402094000D1DFB3ADE49"><enum>(A)</enum><text>by striking subsection (e); and</text></subparagraph><subparagraph commented="no" id="id37AB28A36D954D7CAD1A8F7E5322C249"><enum>(B)</enum><text>by redesignating subsections (f) through (j) as subsections (e) through (i), respectively.</text></subparagraph></paragraph></subsection><subsection id="id9620A2016AE34F1C8750AF529FEA9F89"><enum>(c)</enum><header>Effective date</header><text>The amendments made by this section shall take effect on January 1, 2024.</text></subsection></section></legis-body></bill>
