which was read twice and referred to the <committee-name committee-id="SSFR00">Committee on Foreign Relations</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To codify in statute the establishment of the Office of Global Women's Issues and the Women’s Global Development and Prosperity Initiative, and for other purposes.</official-title></form><legis-body><section id="idF0FFF348416C4E0DB4CA91595D09D069" section-type="section-one"><enum>1.</enum><header>Office of Global Women's Issues and the Women's Global Development and Prosperity Initiative</header><text display-inline="no-display-inline">Chapter 1 of part I of the Foreign Assistance Act of 1961 (<external-xref legal-doc="usc" parsable-cite="usc/22/2151">22 U.S.C. 2151 et seq.</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idFF538F1683484B6584973DB18F3EC12B"><section section-type="subsequent-section" id="idD5FB5C3A7361450BA9CDA1552ED6699C"><enum>138.</enum><header>Office of Global Women's Issues and the Women's Global Development and Prosperity Initiative</header><subsection id="idc2f5c06a6f044d4ba1d27a732a1d55d7"><enum>(a)</enum><header>In general</header><text>The Secretary of State shall establish, in the Office of the Secretary of State, the Office of Global Women’s Issues (referred to in this section as the <quote>Office</quote>).</text></subsection><subsection id="idbf6f3b5d9d794bf7b0d26f1ea6b44c91"><enum>(b)</enum><header>Purpose; duties</header><paragraph id="id0B5DF9098FB244F080B66B76E96591B3"><enum>(1)</enum><header>Purpose</header><text>The purpose of the Office is to advance equal opportunity for women and the status of women and girls in United States foreign policy.</text></paragraph><paragraph id="id33D9BF5AF6344F6E8015122BBDC91C46"><enum>(2)</enum><header>Duties</header><text>In carrying out the purpose described in paragraph (1), the Office—</text><subparagraph id="id83c139c58a834d5581646da55b72e53f"><enum>(A)</enum><clause commented="no" display-inline="yes-display-inline" id="id77822FB4D1084261B9E30792A027AE4F"><enum>(i)</enum><text>shall advise the Secretary of State and provide input on all activities, policies, programs, and funding relating to equal opportunity for women and the advancement of women and girls internationally to all bureaus and offices of the Department of State; and </text></clause><clause id="id97120B7542104D96937C6462D97754C9" indent="up1"><enum>(ii)</enum><text>may, as appropriate, provide to the international programs of other Federal agencies input on all activities, policies, programs, and funding relating to equal opportunity for women and the advancement of women and girls internationally;</text></clause></subparagraph><subparagraph id="id0445a970ed424130b05e67c7cf809e51"><enum>(B)</enum><clause commented="no" display-inline="yes-display-inline" id="id37B26AB41AEA48A1975CB78C8207A2A9"><enum>(i)</enum><text>shall work to ensure that efforts to advance equal opportunity for women and men and women’s and girls’ empowerment are fully integrated into the programs, structures, processes, and capacities of all bureaus and offices of the Department of State; and </text></clause><clause id="id2877289A401B45FEBAA9C572D5AB20D8" indent="up1"><enum>(ii)</enum><text>may, as appropriate, work to ensure that efforts to advance equal opportunity for women and men and women’s and girls’ empowerment are fully integrated into the international programs of other Federal agencies;</text></clause></subparagraph><subparagraph id="idfd2ccf2c3580448cb5730c27433f5d90"><enum>(C)</enum><text>shall implement the Women’s Global Development and Prosperity Initiative, in accordance with subsection (c); and</text></subparagraph><subparagraph id="id40786292214d4998adb23f424c108944"><enum>(D)</enum><text>may not engage in any activities not described in subparagraphs (A) through (C).</text></subparagraph></paragraph></subsection><subsection id="idb2733341489c4a5387af786519527eee"><enum>(c)</enum><header>Women’s Global Development and Prosperity Initiative</header><paragraph id="id8FCBDF58738A4672A31DE78D9195508B"><enum>(1)</enum><header>Establishment</header><text>The Secretary of State shall establish the Women’s Global Development and Prosperity Initiative (referred to in this subsection as the <quote>Initiative</quote>) to carry out the activities described in paragraphs (2) through (4).</text></paragraph><paragraph id="id559ea553a8f24a69962de37faa8d7442"><enum>(2)</enum><header>Women prospering in the workforce</header><text>The Initiative shall advance women in the workforce by improving their access to quality vocational education and skills training, which will enable them to secure jobs in their local economies.</text></paragraph><paragraph id="iddcdf8aea6e154768ab6727b748ce03d3"><enum>(3)</enum><header>Women succeeding as entrepreneurs</header><text>The Initiative shall promote women’s entrepreneurship and increasing access to capital, financial services, markets, technical assistance, and mentorship.</text></paragraph><paragraph id="ida303f7362bc04726aec5e76c4fdf2428"><enum>(4)</enum><header>Women enabled in the economy</header><text>The Initiative shall identify and reduce the binding constraints in economic and property laws and practices that prevent women’s full and free participation in the global economy and promote foundational legal reforms, including—</text><subparagraph id="id00867669451d4de1a502d9273b5d3d97"><enum>(A)</enum><text>ensuring that women can fully participate in the workforce and engage in economic activities by—</text><clause id="id9619A5AC432845919426D0F34A24ECA0"><enum>(i)</enum><text>ending impunity for violence against women;</text></clause><clause id="idFDA2D19B318A4D8388A0BF3B469B4D49"><enum>(ii)</enum><text>ensuring that women have the authority to sign legal documents, such as contracts and court documents; and </text></clause><clause id="id0E7E0D6B78694523A911A236BB29C798"><enum>(iii)</enum><text>addressing unequal access to courts and administrative bodies for women, whether officially or through lack of proper enforcement;</text></clause></subparagraph><subparagraph id="idb0f179e5909949518cb3efae900e9ed7"><enum>(B)</enum><text>ensuring women’s equal access to credit and capital to start and grow their businesses, savings, and investments, including prohibiting discrimination in access to credit on the basis of sex or marital status;</text></subparagraph><subparagraph id="idf4345fe5506d4b8191e0165e230b93ab"><enum>(C)</enum><text>lifting restrictions on women’s right to own, manage, and make decisions relating to the use of property, including repealing limitations on inheritance and ensuring the ability to transfer, purchase, or lease such property;</text></subparagraph><subparagraph id="id5c569fa5453e4138bd4db3828f0f5e6f"><enum>(D)</enum><text>addressing constraints on women’s freedom of movement, including sex-based restrictions on obtaining passports and identification documents; and</text></subparagraph><subparagraph id="idfb93e4491bb449c7b7ec55264cb9c34c"><enum>(E)</enum><text>promoting the free and equal participation of women in the economy with regard to working hours, occupations, and occupational tasks.</text></subparagraph></paragraph></subsection><subsection id="idabaa0ab47e934eedaa2d8fe8adf4c6c1"><enum>(d)</enum><header>Supervision</header><text>The Office shall be headed by an Ambassador-at-Large for Global Women’s Issues and the Women’s Global Development and Prosperity Initiative (referred to in this section as the <quote>Ambassador</quote>), who shall—</text><paragraph id="id182F0672219242CC96AAF4F90F1EDF53"><enum>(1)</enum><text>be appointed by the President, with the advice and consent of the Senate;</text></paragraph><paragraph id="id70C5E52812DC4E888DF07A1D0B790BA0"><enum>(2)</enum><text>report directly to the Secretary; and </text></paragraph><paragraph id="id2218511C904D4082AEA334A30F303F69"><enum>(3)</enum><text>have the rank and status of Ambassador-at-Large.</text></paragraph></subsection><subsection id="id5206f30496b146a3a435291871320a42"><enum>(e)</enum><header>Coordination</header><text>United States Government efforts to advance women’s economic empowerment globally shall be closely aligned and coordinated with the Initiative.</text></subsection><subsection id="idb3f3ad97fcde4733834615b34266a5ab"><enum>(f)</enum><header>Abortion neutrality</header><paragraph id="id988c21cced6e41f3a1873e1dd5a01afb"><enum>(1)</enum><header>Prohibitions</header><text>The Office, the Initiative, and the Ambassador may not—</text><subparagraph id="id5429a88016fb491aacd97f60ac31c4c2"><enum>(A)</enum><text>lobby other countries, including through multilateral mechanisms and foreign nongovernmental organizations—</text><clause id="id57D605F0272446679A5D5B569B457A3B"><enum>(i)</enum><text>to change domestic laws or policies with respect to abortion; or </text></clause><clause id="id101275B3B82E4059A321038132FE5B38"><enum>(ii)</enum><text>to include abortion as a programmatic requirement of any foreign activities; or</text></clause></subparagraph><subparagraph id="ide8a62cc91a284306862a5176ae7165e0"><enum>(B)</enum><text>provide Federal funding appropriated for foreign assistance to pay for or to promote abortion.</text></subparagraph></paragraph><paragraph id="id9e4ea7be37fb45d7a32c03bffdc8f663"><enum>(2)</enum><header>Limitations on use of funds</header><text>Amounts appropriated for the Office or the Initiative may not be used—</text><subparagraph id="id5b2a667527104277ace2589fbec9856e"><enum>(A)</enum><text>to lobby other countries, including through multilateral mechanisms and foreign nongovernmental organizations—</text><clause id="idFE6AF72144144B71A021687D31A4CA1B"><enum>(i)</enum><text>to change domestic laws or policies with respect to abortion; or </text></clause><clause id="idD1FA4712503C4381A5A47BE7D563B8FE"><enum>(ii)</enum><text>to include abortion as a programmatic requirement of any foreign activities; or</text></clause></subparagraph><subparagraph id="id7cdf0597918249898892b5784812e83f" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text>to provide Federal foreign assistance funding to pay for or to promote abortion. </text></subparagraph></paragraph><paragraph id="id4b384f77e85a4366875d30ba4a3b750e"><enum>(3)</enum><header>Construction</header><text>Nothing in this subsection may be construed to prevent—</text><subparagraph id="id88f39866f664419282221f77dfe05e2e"><enum>(A)</enum><text>the funding of activities for the purpose of treating injuries or illnesses caused by legal or illegal abortions; or</text></subparagraph><subparagraph id="id5284f959b2664123822e52a81691bd2b" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text>agencies or officers of the United States from engaging in activities in opposition to policies of coercive abortion or involuntary sterilization.</text></subparagraph></paragraph></subsection><subsection id="id264ee1aafcfc4e658f9a8c31399b9dbe"><enum>(g)</enum><header>Report</header><text>Not later than 180 days after the date of the enactment of this section, and not less frequently than annually thereafter, the Secretary of State shall—</text><paragraph id="id6953DBF800CC48759FEADE0A70E87254"><enum>(1)</enum><text>submit a written report to the <committee-name committee-id="SSAP00">Committee on Appropriations of the Senate</committee-name>, the <committee-name committee-id="SSFR00">Committee on Foreign Relations of the Senate</committee-name>, the <committee-name committee-id="">Committee on Appropriations of the House of Representatives</committee-name>, and the <committee-name committee-id="">Committee on Foreign Affairs of the House of Representatives</committee-name> that describes the implementation of this section, including—</text><subparagraph id="idD20C3176BD0B4CF4A11FA5C4FC46DB70"><enum>(A)</enum><text>measures taken to ensure compliance with subsection (f); and </text></subparagraph><subparagraph id="idf63440af7c6a4e99bd199941fe9488f2"><enum>(B)</enum><text>with respect to funds appropriated pursuant to subsection (h)—</text><clause id="idDD4ECD604F5F4AEC954B35B96E44C6B2"><enum>(i)</enum><text>amounts awarded to prime recipients and subrecipients since the end of the previous reporting period; and </text></clause><clause id="idAE13EBD31F7C4D6F96F34728F12E3466"><enum>(ii)</enum><text>descriptions of each program for which such funds are used; and </text></clause></subparagraph></paragraph><paragraph id="id78519B79742849169A781550A7C6F3EA"><enum>(2)</enum><text>make such report publicly available. </text></paragraph></subsection><subsection id="ida0d09c7a938549c183ec7af0b6460697"><enum>(h)</enum><header>Funding</header><paragraph id="idd3e8513a43cb437b9861246cf6d9411b"><enum>(1)</enum><header>In general</header><text>There shall be reserved to carry out this section, from funds made available for development assistance programs of the United States Agency for International Development, $200,000,000, for each of the fiscal years 2022 through 2026, which shall be—</text><subparagraph id="id9BD9A27683D344F7AF7E7B7AD73365B0"><enum>(A)</enum><text>deposited into the Women’s Global Development and Prosperity Fund (W–GDP);</text></subparagraph><subparagraph id="id28A982D9C760492F9695070AAB1C02F8"><enum>(B)</enum><text>administered by the United States Agency for International Development;</text></subparagraph><subparagraph id="idA71F410379F4469B9D3E5DF44719048E"><enum>(C)</enum><text>expended solely for the purpose, duties, and activities set forth in subsections (b) and (c); and</text></subparagraph><subparagraph id="id5d398ecb422d4c3eac922c8ca8646f7d"><enum>(D)</enum><text>expended, to the greatest extent practicable, in support of removing legal barriers to women’s economic freedom in accordance with the findings of the W–GDP Women’s Economic Freedom Index report published by the Council of Economic Advisers in February 2020.</text></subparagraph></paragraph><paragraph id="idda25473049744978adbf681ddb4846e2"><enum>(2)</enum><header>Requirement</header><text>Notwithstanding paragraph (1), amounts reserved under paragraph (1) for fiscal year 2023, or for any later fiscal year, may not be obligated or expended unless the most recent report submitted pursuant to subsection (g)(1) includes the information required under subparagraphs (A) and (B) of subsection (g)(1). </text></paragraph><paragraph id="id82A1F3D051E34A098B6D7BCDC91A1A6A"><enum>(3)</enum><header>Oversight</header><text>The expenditure of amounts reserved under paragraph (1) shall be jointly overseen by—</text><subparagraph id="id188AE561D2CC48DE8997D5A4E5F1F167"><enum>(A)</enum><text>the United States Agency for International Development;</text></subparagraph><subparagraph id="id29FBDB6890764CD981AF39C5FC331FF6"><enum>(B)</enum><text>the Ambassador; and </text></subparagraph><subparagraph id="id976A71B56A2344E88969BFEE326A50C2"><enum>(C)</enum><text>the Initiative.</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
