which was read twice and referred to the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Federal Funding Accountability and Transparency Act of 2006, to require the budget justifications and appropriation requests of agencies be made publicly available.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H9F313BE2828641CDBC6E00BA61445091"><section section-type="section-one" id="H8EF83EFB87A74857BE8DC060673AFDB2"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Congressional Budget Justification Transparency Act of 2021</short-title></quote>.</text></section><section section-type="subsequent-section" id="H809ABA694AC44CCDB585EB45355068F0"><enum>2.</enum><header>Public availability of budget justifications and appropriation requests</header><subsection id="H895E7988C47746CE9E4B3AC22ACBF3ED"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 3 of the Federal Funding Accountability and Transparency Act of 2006 (<external-xref legal-doc="usc" parsable-cite="usc/31/6101">31 U.S.C. 6101</external-xref> note) is amended to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H649F69F772254A53B29069EB3C53DD0D"><section id="HBE8A7325104E4884A8535F903BE897FE"><enum>3.</enum><header>Full disclosure of Federal funds</header><subsection id="HC6C7B0CCFBE64113A31DA199AD98F044"><enum>(a)</enum><header>In general</header><text>Not less frequently than monthly when practicable, and in any event not less frequently than quarterly, the Secretary (in consultation with the Director and, with respect to information described in subsection (b)(2), the head of the applicable agency (as defined in subsection (b)(1))) shall ensure that updated information with respect to the information described in subsection (b) is posted on the website established under section 2.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="HA1287D0D32DB42B6BC5C4F80C2753B67"><enum>(b)</enum><header display-inline="yes-display-inline">Information To be posted</header><paragraph commented="no" display-inline="no-display-inline" id="HBA15F1314AB241328DA8967C19FB2DA5"><enum>(1)</enum><header display-inline="yes-display-inline">Funds</header><text display-inline="yes-display-inline">For any funds made available to or expended by a Federal agency or component of a Federal agency, the information to be posted shall include—</text><subparagraph commented="no" display-inline="no-display-inline" id="HB5F4EED8115D43FFA72EF51A3C31C33C"><enum>(A)</enum><text display-inline="yes-display-inline">for each appropriations account, including an expired or unexpired appropriations account, the amount—</text><clause commented="no" display-inline="no-display-inline" id="H1692E6582DEE4676AE1841F0522C544D"><enum>(i)</enum><text display-inline="yes-display-inline">of budget authority appropriated;</text></clause><clause commented="no" display-inline="no-display-inline" id="H90EC6D15156F4C81993EBB0940E81674"><enum>(ii)</enum><text display-inline="yes-display-inline">that is obligated;</text></clause><clause commented="no" display-inline="no-display-inline" id="HEE8F907AB4824DB1B5477A85C2D09294"><enum>(iii)</enum><text display-inline="yes-display-inline">of unobligated balances; and</text></clause><clause commented="no" display-inline="no-display-inline" id="HE0DC9143FFDF49B0AFFB2CD83FDDA2D2"><enum>(iv)</enum><text display-inline="yes-display-inline">of any other budgetary resources;</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H970A2E89F5954E2DB14AD0C8D16355E2"><enum>(B)</enum><text display-inline="yes-display-inline">from which accounts and in what amount—</text><clause commented="no" display-inline="no-display-inline" id="HCC4170D8AB5E47A69DDCB8CC4716BE6D"><enum>(i)</enum><text display-inline="yes-display-inline">appropriations are obligated for each program activity; and</text></clause><clause commented="no" display-inline="no-display-inline" id="HDA20272BB46F40E081FA50A4E45502BD"><enum>(ii)</enum><text display-inline="yes-display-inline">outlays are made for each program activity;</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HF55A43CD1FD045BD9F381EAFF33585B3"><enum>(C)</enum><text display-inline="yes-display-inline">from which accounts and in what amount—</text><clause commented="no" display-inline="no-display-inline" id="H8D54A38F1111405ABB47611E6296D440"><enum>(i)</enum><text display-inline="yes-display-inline">appropriations are obligated for each object class; and</text></clause><clause commented="no" display-inline="no-display-inline" id="H5AD6A58E77534314B14233E028FBF3E4"><enum>(ii)</enum><text display-inline="yes-display-inline">outlays are made for each object class; and</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H48F33A6BDA5E40F9AA9927D55635B5A1"><enum>(D)</enum><text display-inline="yes-display-inline">for each program activity, the amount—</text><clause commented="no" display-inline="no-display-inline" id="H3F49F3FBE0E74B49A6566EC0DB7B6EED"><enum>(i)</enum><text display-inline="yes-display-inline">obligated for each object class; and</text></clause><clause commented="no" display-inline="no-display-inline" id="HCA8A1D000F1E49A495E617CB06F2B45B"><enum>(ii)</enum><text display-inline="yes-display-inline">of outlays made for each object class.</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HE2B0328B5A9348438399951FA850E97D"><enum>(2)</enum><header>Budget justifications</header><subparagraph commented="no" display-inline="no-display-inline" id="HD6A14EBA87C545BCBB2E9D25A6555D14"><enum>(A)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this paragraph—</text><clause commented="no" display-inline="no-display-inline" id="id9BA7058950234F0F8612B0F7A285A36D"><enum>(i)</enum><text display-inline="yes-display-inline">the term <term>agency</term> has the meaning given that term in section 101 of title 31, United States Code; </text></clause><clause commented="no" display-inline="no-display-inline" id="id8B88F53BB0554810BF1A6E8B5EFD31E4"><enum>(ii)</enum><text display-inline="yes-display-inline">the term <term>budget justification materials</term> means the annual budget justification materials of an agency that are submitted, in conjunction with the budget of the United States Government submitted under section 1105(a) of title 31, United States Code; and</text></clause><clause display-inline="no-display-inline" commented="no" id="idC7A88BCAF8524F25A0581EA5AB010717"><enum>(iii)</enum><text>the term <term>open Government data asset</term> has the meaning given that term in section 3502 of title 44, United States Code). </text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HB7584D51EC8844C6AA3FB95451B42E76"><enum>(B)</enum><header>Information</header><text display-inline="yes-display-inline">The information to be posted— </text><clause commented="no" display-inline="no-display-inline" id="idF3BF7B3F48B844F6B1E1059CAC890A04"><enum>(i)</enum><text display-inline="yes-display-inline">shall include any budget justification materials—</text><subclause id="H3028261056C940A6B06DC8862AB04155"><enum>(I)</enum><text display-inline="yes-display-inline"> for the second fiscal year beginning after the date of enactment of this paragraph, and each fiscal year thereafter; and</text></subclause><subclause id="H9A8CC054AC0E4324A06D69773633BDE5"><enum>(II)</enum><text>to the extent practicable, that were released for any fiscal year before the date of enactment of this paragraph; and</text></subclause></clause><clause id="id9EB8595A84934B289A78C47A41D19777"><enum>(ii)</enum><text>shall not include any portion of the budget justification materials the disclosure of which is prohibited by law, that contains classified information, or that is exempt from disclosure under paragraph (1) of section 552(b) of title 5, United States Code.</text></clause></subparagraph><subparagraph id="HC98820599FF14B55B77041B53526001B"><enum>(C)</enum><header>Format</header><text>Budget justification materials shall be posted under subparagraph (B)—</text><clause id="H5E933FDEB7F4490C857642438ED32B49"><enum>(i)</enum><text display-inline="yes-display-inline">as an open Government data asset;</text></clause><clause id="HE1B52A79512B404FBF8D049855AB3944"><enum>(ii)</enum><text>in a manner that enables users to download individual reports, download all reports in bulk, and download in bulk the results of a search, to the extent practicable; and</text></clause><clause id="H4D5E79477C1F46AF90E8B4F48DE703C3"><enum>(iii)</enum><text>in a structured data format, to the extent practicable.</text></clause></subparagraph><subparagraph id="HF0020CB02E374B3198B4CAD3724A2D15"><enum>(D)</enum><header>Deadline</header><text>The budget justification materials required to be posted under subparagraph (B)(i) shall be posted not later than 2 weeks after the date on which the budget justification materials are first submitted to Congress.</text></subparagraph><subparagraph id="H792255BC2B1645F09664F87955D60E6A"><enum>(E)</enum><header>Rule of construction</header><text>Nothing in this paragraph shall be construed to authorize an agency to destroy any budget justification materials relating to a fiscal year before the fiscal year described in subparagraph (B)(i).</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" display-inline="no-display-inline" id="H009F48CE63F04D0681D43C3751D02670"><enum>(b)</enum><header display-inline="yes-display-inline">Information regarding agency budget justifications</header><text display-inline="yes-display-inline">Section 1105 of title 31, United States Code, is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H283FC9C2501445C3AD1A556189F9D09F"><subsection commented="no" display-inline="no-display-inline" id="HE20156F794D04308BC7730D2441180DD"><enum>(i)</enum><paragraph commented="no" display-inline="yes-display-inline" id="H6A66ABD52711477BB4F8EAAA89C07B25"><enum>(1)</enum><text display-inline="yes-display-inline">The Director of the Office of Management and Budget shall make publicly available on a website, and continuously update, a tabular list for each fiscal year of each agency that submits budget justification materials, which shall include—</text><subparagraph commented="no" display-inline="no-display-inline" id="H77F7B3AC74E947989F234C066B9E6ECD" indent="up1"><enum>(A)</enum><text display-inline="yes-display-inline">the name of the agency;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H8459D59F964D4782A944276280642E53" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">a unique identifier that identifies the agency;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HC30F91E33BE6456D87B2D23DB051A1DD" indent="up1"><enum>(C)</enum><text display-inline="yes-display-inline">to the extent practicable, the date on which the budget justification materials of the agency are first submitted to Congress;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HF674CE07296B4C83A97A62AD4EE11AC8" indent="up1"><enum>(D)</enum><text display-inline="yes-display-inline">the date on which the budget justification materials of the agency are posted online under section 3 of the Federal Funding Accountability and Transparency Act of 2006 (<external-xref legal-doc="usc" parsable-cite="usc/31/6101">31 U.S.C. 6101</external-xref> note);</text></subparagraph><subparagraph id="HCFADEF40A22D41279DBA69CFD694A0A7" indent="up1"><enum>(E)</enum><text>the uniform resource locator where the budget justification materials are published on the website of the agency; and</text></subparagraph><subparagraph id="HC47B8CB4C6A945B8B49A35BE94EEB280" indent="up1"><enum>(F)</enum><text>a single data set that contains the information described in subparagraphs (A) through (E) with respect to the agency for all fiscal years for which budget justifications of the agency are made available under section 3 of the Federal Funding Accountability and Transparency Act of 2006 (<external-xref legal-doc="usc" parsable-cite="usc/31/6101">31 U.S.C. 6101</external-xref> note) in a structured data format.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H86E6BCCA37AF4938B0E00028BC645A81" indent="up1"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H38D619D0173147C38610E791BC8ACCEA"><enum>(A)</enum><text display-inline="yes-display-inline">Each agency that submits budget justification materials shall make the materials available on the website of the agency, in accordance with the policies established by the Director of the Office of Management and Budget under subparagraph (B).</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HC3082649B59146E19D831D35312C08E4" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">Not later than 30 days after the date of enactment of this subsection, the Director of the Office of Management and Budget, in consultation with the Secretary of the Treasury, shall establish policies for agencies relating to making available materials under subparagraph (A), which shall include guidelines for making budget justification materials available in a format aligned with the requirements of section 3(b)(2)(C) of the Federal Funding Accountability and Transparency Act of 2006 (<external-xref legal-doc="usc" parsable-cite="usc/31/6101">31 U.S.C. 6101</external-xref> note) and using a uniform resource locator that is in a consistent format across agencies and is descriptive, memorable, and pronounceable, such as the format of <term>agencyname.gov/budget</term>.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H281D7DC0524648C8A68B38B2BAD7C764" indent="up1"><enum>(C)</enum><text>If the Director of the Office of Management and Budget maintains a public website that contains the budget of the United States Government submitted under subsection (a) and any related materials, such website shall also contain a link to the tabular list required under paragraph (1).</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H1FF96932DD4942D9A95B079EF2583325" indent="up1"><enum>(3)</enum><text display-inline="yes-display-inline">In this subsection, the term <term>budget justification materials</term> has the meaning given that term in section 3 of the Federal Funding Accountability and Transparency Act of 2006 (<external-xref legal-doc="usc" parsable-cite="usc/31/6101">31 U.S.C. 6101</external-xref> note).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="HDF1DB95380D34462B12382F483E3CC8A"><enum>3.</enum><header>Determination of budgetary effects</header><text display-inline="no-display-inline">The budgetary effects of this Act, for the purpose of complying with the Statutory Pay-As-You-Go-Act of 2010, shall be determined by reference to the latest statement titled <quote>Budgetary Effects of PAYGO Legislation</quote> for this Act, submitted for printing in the Congressional Record by the Chairman of the Senate Budget Committee, provided that such statement has been submitted prior to the vote on passage.</text></section></legis-body></bill>
