which was read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To adjust certain ownership and other requirements for passenger vessels, and for other purposes. </official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Open America's Ports Act</short-title></quote>.</text></section><section id="id2EF4D9CE38744535A79ACF33CC869852"><enum>2.</enum><header>Repeal of PVSA and adjustment of Jones Act requirements for passenger vessels</header><subsection id="id58275383D06E4D368FF246471A1F8B00"><enum>(a)</enum><header>Repeal of PVSA domestic requirements</header><text>Section 55103 of title 46, United States Code (commonly referred to as the <quote><short-title>Passenger Vessel Services Act of 1886</short-title></quote>), is repealed.</text></subsection><subsection id="id2F5C31FA213F4AD8A24D0A6D2184BBD1"><enum>(b)</enum><header>Adjustment of Jones Act requirements</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/46/121">Chapter 121</external-xref> of title 46, United States Code, is amended—</text><paragraph id="id79DF057E5AC547D09DA82AC17780C943"><enum>(1)</enum><text>in section 12103, by adding at the end the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="id705AF4994F7E48C49D791DACA416CA23"><subsection id="id617ADEA363E547C583FF70566E66714D"><enum>(d)</enum><header>Nonapplicability</header><text>The requirements of this section shall not apply to any vessel that transports passengers between ports or places in the United States to which the coastwise laws apply, either directly or via a foreign port.</text></subsection><after-quoted-block>; </after-quoted-block></quoted-block></paragraph><paragraph id="id07346F637D424173B51975442378BDCE"><enum>(2)</enum><text>in section 12112(a)—</text><subparagraph id="idD3400BE8E8BB4F05AEAECC3B5C168784"><enum>(A)</enum><text>in paragraph (1), by inserting <quote>except in the case of a vessel described in subparagraph (C) of paragraph (2),</quote> before <quote>satisfies</quote>; and</text></subparagraph><subparagraph id="id03D74BCB45FA47688929F72BE87CCCAE"><enum>(B)</enum><text>in paragraph (2)—</text><clause id="idC551D94DC41F4FD797A0B8A1B1845304"><enum>(i)</enum><text>in subparagraph (A), by striking <quote>or</quote> after the semicolon;</text></clause><clause id="id1D686BAB0931454284B7FC86E7054986"><enum>(ii)</enum><text>in subparagraph (B)(iii), by striking <quote>; and</quote> and inserting <quote>; or</quote>; and</text></clause><clause id="idF82A8EDAF3174A34B920A88E5FF44EA8"><enum>(iii)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idDECA893B4CA74F13A700957449A5380A"><subparagraph id="id0099A650AEC740468A6A586DE4216AA8" indent="up1"><enum>(C)</enum><text>transports passengers between ports or places in the United States to which the coastwise laws apply, either directly or via a foreign port; and</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph></paragraph><paragraph id="id8D7C388840A14A47B07B3B7261B25DE7"><enum>(3)</enum><text>in section 12121(b), by striking <quote>55102, and 55103</quote> and inserting <quote>and 55102</quote>.</text></paragraph></subsection><subsection id="id7609E443BC7D436BAAEE016229E8E05D"><enum>(c)</enum><header>Adjustment of citizenship and Navy Reserve requirements</header><text>Section 8103(k) of title 46, United States Code, is amended to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id6426A303C7744DA0A46DC67043509404"><subsection id="id9695657A855F4CE3AC0578CDB90B5CFA"><enum>(k)</enum><header>Exemption for passenger vessels</header><text>Subsections (a) and (b) shall not apply to any vessel that transports passengers between ports or places in the United States to which the coastwise laws apply, either directly or via a foreign port.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id464A23D1279745E081218F6A3D96305A"><enum>(d)</enum><header>Conforming amendments</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/46/551">Chapter 551</external-xref> of title 46, United States Code, is amended—</text><paragraph id="idDDEA308318DF412287E0670436F3D4DF"><enum>(1)</enum><text>by repealing section 55104; and</text></paragraph><paragraph id="idC4F11D2659AA43CE85ECC7DAFAEA9540"><enum>(2)</enum><text>in section 55121—</text><subparagraph id="id615633CAB2C64D19B878F1225884EE4D"><enum>(A)</enum><text>in the section heading, by striking <quote><header-in-text level="section" style="USC">and passengers</header-in-text></quote>;</text></subparagraph><subparagraph id="id542771CBE00D41E8A22CA3805FBC20CD"><enum>(B)</enum><text>by striking subsection (a);</text></subparagraph><subparagraph id="id17E0295E13C744DEB53C2A1290BC1E69"><enum>(C)</enum><text>by striking <quote>(b)</quote> and all that follows through <quote><header-in-text level="section" style="USC">States.—</header-in-text></quote>; and</text></subparagraph><subparagraph id="id67C1BBE53BF8438488DEE0322E53733B"><enum>(D)</enum><text>by striking <quote>sections 55102 and 55103 of this title do</quote> and inserting <quote>section 55102 of this title does</quote>. </text></subparagraph></paragraph></subsection></section><section id="idD5930ED877694765A92122EAF7E01520"><enum>3.</enum><header>Rule of construction</header><text display-inline="no-display-inline">Nothing in the amendments made by this Act shall be construed to exempt a vessel that transports passengers between ports or places in the United States to which the coastwise laws apply, either directly or via a foreign port, from any applicable law of the United States except as explicitly provided in such amendments. </text></section></legis-body></bill>
