display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Countering the Chinese Government and Communist Party's Political Influence Operations Act</short-title></quote>.</text></section><section id="idf15861d518b9455b946337618d396f98"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="id931388035662436faab1710f0a75c1f6"><enum>(1)</enum><header>Appropriate congressional committees</header><text>The term <term>appropriate congressional committees</term> means—</text><subparagraph id="id26ff3f8c7bc1461e9695f6719d76ef1a"><enum>(A)</enum><text>the <committee-name committee-id="SSAP00">Committee on Appropriations of the Senate</committee-name>;</text></subparagraph><subparagraph id="id91EA8625032E431E8A3EE988A9CC80E6"><enum>(B)</enum><text>the <committee-name committee-id="SSAS00">Committee on Armed Services of the Senate</committee-name>;</text></subparagraph><subparagraph id="id0964571EE0D745ADAECF0EB3B2AC8904"><enum>(C)</enum><text>the <committee-name committee-id="SSFR00">Committee on Foreign Relations of the Senate</committee-name>;</text></subparagraph><subparagraph id="id8557667670644538AA7CC1D8A0E5DADB"><enum>(D)</enum><text>the <committee-name committee-id="SSHR00">Committee on Health, Education, id="id3522473AED9341E7BCE5D824C0F92F73"><enum>(M)</enum><text>the <committee-name committee-id="">Permanent Select Committee on Intelligence of the House of Representatives</committee-name>; and</text></subparagraph><subparagraph id="idB3DBF135B3D04A00BF82421E2FD771F9"><enum>(N)</enum><text>the <committee-name committee-id="">Committee on Financial Services of the House of Representatives</committee-name>.</text></subparagraph></paragraph><paragraph id="id3f13ba02fef641cfbc7c7714f2d980e0"><enum>(2)</enum><header>Political influence operations</header><text>The term <term>political influence operations</term> means the coordinated and often concealed application of disinformation, press manipulation, economic coercion, targeted investments, corruption, or academic censorship, which are often intended—</text><subparagraph id="idABD86C72D8414C19A1C6E51A402FDE27"><enum>(A)</enum><text>to coerce and corrupt United States interests, values, institutions, or individuals; and</text></subparagraph><subparagraph id="id6299FC08899C4BB0B5820C1CE486D2DE"><enum>(B)</enum><text>to foster attitudes, behavior, decisions, or outcomes in the United States that support the interests of the Government of the People’s Republic of China or the Chinese Communist Party.</text></subparagraph></paragraph></section><section id="idd576b6c06ba34a709dc2a241e49ad4ee"><enum>3.</enum><header>Statement of policy</header><subsection id="id0149db36ee324168b356b964207338b1"><enum>(a)</enum><header>Findings</header><text>Congress finds the following:</text><paragraph id="idfbdb042e43d54845aff83095cc51be5e"><enum>(1)</enum><text>The Government of the People’s Republic of China and the Chinese Communist Party employ a wide range of political, informational, and economic measures to influence, coerce, intimidate, and undermine the United States interests and the interests of United States partners and allies.</text></paragraph><paragraph id="id6d67c3fedfdc4a02ba205a58727a0bd6"><enum>(2)</enum><text>The December 2017 National Security Strategy of the United States of America states, <quote>Although the United States seeks to continue to cooperate with China, China is using economic inducements and penalties, influence operations, and implied military threats to persuade other states to heed its political and security agenda.</quote></text></paragraph><paragraph id="idd76721b3ab154c21a737a37de3cdf0d3"><enum>(3)</enum><text>Given the economic strength of the People’s Republic of China and the growing apparatus being used to spread its influence globally, efforts to promote its authoritarian ideal pose significant and consequential long-term challenges to United States interests and values.</text></paragraph><paragraph id="idbd85bd16b2a340aba1461572e6823928"><enum>(4)</enum><text>The Government of the People’s Republic of China and the Chinese Communist Party use overt and covert means to target the political and economic elite, the media and public opinion, civil society and academia, and members of the Chinese diaspora.</text></paragraph><paragraph id="id8b3bd13305654603ac1d76a9a7468288"><enum>(5)</enum><text>The Government of the People’s Republic of China and the Chinese Communist Party employ an array of government entities, friendship and exchange organizations, private entities and businesspeople, and government-funded foundations, think tanks, educational and other projects to carry out political influence operations, which is often referred to as <quote>United Front work.</quote></text></paragraph><paragraph id="id78032b856f2447fb95fa6d30f4a0e316"><enum>(6)</enum><text>According to the U.S.-China Economic and Security Review Commission, <quote>China uses what it calls <quote>United Front</quote> work to co-opt and neutralize sources of potential opposition to the policies and authority of its ruling Chinese Communist Party… To carry out its influence activities abroad, the [United Front Work Department] directs <quote>overseas Chinese work,</quote> which seeks to co-opt ethnic Chinese individuals and communities living outside China, while a number of other key affiliated organizations guided by China’s broader United Front strategy conduct influence operations targeting foreign actors and states.</quote></text></paragraph><paragraph id="id888bedf183c944cfa4e8ce33a2a2dcb9"><enum>(7)</enum><text>These political influence operations violate national sovereignty, and as such, are fundamentally different from traditional efforts by countries to shape international policy debates and improve their public image through public diplomacy and strategic communications campaigns.</text></paragraph><paragraph id="idf7df70d610084359abcf853b4493b61b"><enum>(8)</enum><text>The aims of the political influence operations of the Government of the People’s Republic of China and the Chinese Communist Party are—</text><subparagraph id="idE99FD7A2BD504EA1A642C62607BA61C0"><enum>(A)</enum><text>to protect the political security of the Chinese Communist Party, or its ability to exercise an absolute monopoly on political power within the People’s Republic of China and to increasingly to dominate international politics regarding issues that the Chinese Communist Party deems important;</text></subparagraph><subparagraph id="idA68D1026CD4D4792B17EEE3ED6ABCDF6"><enum>(B)</enum><text>to domestically and globally promote the idea that the Chinese Communist Party’s political and economic model is superior to that of democracies;</text></subparagraph><subparagraph id="id146119DA34B54F7DB051D8133AB1DF6E"><enum>(C)</enum><text>to spread its governance model to other countries and to undermine democracy and free-market economies;</text></subparagraph><subparagraph id="id1E9E439A4DC148EA82325A7E3C684B87"><enum>(D)</enum><text>to promote the interests of the regime globally;</text></subparagraph><subparagraph id="id3174EC3FB7094EC98A9A5DEE84C9E8FA"><enum>(E)</enum><text>to weaken American alliances and partnerships by creating new divisions between them, or by exacerbating existing ones; and</text></subparagraph><subparagraph id="id59206c7f86c44f64b4c5226f3bb62519"><enum>(F)</enum><text>to foment domestic social and political divisions, and to exacerbate existing ones, within democratic countries, including by undermining popular confidence in democracy and its essential institutions.</text></subparagraph></paragraph><paragraph id="ide27c4bcdb2ca4d12ad4c9d1c9ade96af"><enum>(9)</enum><text>The political influence operations of the Government of the People’s Republic of China and the Chinese Communist Party take advantage of the open and democratic nature of the United States, including—</text><subparagraph id="id5B672C46FFDF4DFA8E662459398C582A"><enum>(A)</enum><text>constitutional protections for free speech and a free press; and</text></subparagraph><subparagraph id="id6DC808035AFF44078D6EEDC6E3547ED9"><enum>(B)</enum><text>the desire of some companies or institutions to attract Chinese investment, gain access to Chinese markets, or attain greater global influence.</text></subparagraph></paragraph></subsection><subsection id="id8ff98b344469475b89b2845af8ec184b"><enum>(b)</enum><header>Sense of Congress</header><text>It is the sense of Congress that—</text><paragraph id="idDE01A20DF0BE4C838C16D15ED889CCD8"><enum>(1)</enum><text>the political influence operations of the Government of the People’s Republic of China and the Chinese Communist Party are not <quote>soft power</quote> intended to persuade, but <quote>sharp power</quote> intended—</text><subparagraph id="idE2EE253675C94B6C9973C1F5138836C5"><enum>(A)</enum><text>to penetrate or corrupt democratic countries and undermine democratic institutions and freedoms;</text></subparagraph><subparagraph id="idAC5B63B197604B93A4FBA3953E8EDDA9"><enum>(B)</enum><text>to foster attitudes, behavior, laws, and policies favorable to the Government of the People’s Republic of China’s interest through disinformation, coercion, corruption, and other means;</text></subparagraph><subparagraph id="id9426C51870F1418A86CCEA1840629475"><enum>(C)</enum><text>to widen the scope of Chinese authoritarian influence around the world, including—</text><clause id="id0495A7B3D53B457EB45220E80229A4CA"><enum>(i)</enum><text>to suppress political opposition to the Chinese Communist Party; and</text></clause><clause id="id60A2040516D24C5B8E455F289F646612"><enum>(ii)</enum><text>to violate the internationally recognized human and civil rights of both Chinese and foreign citizens living in countries around the world; and</text></clause></subparagraph><subparagraph id="id078b86a8c0c94f84be14afda3ac07b75"><enum>(D)</enum><text>to undermine the strength of American alliances around the world; and</text></subparagraph></paragraph><paragraph id="id27070E1930264441A15BE38C32CE41DE"><enum>(2)</enum><text>the people of the United States need reliable and current information—</text><subparagraph id="id4B5B2E2921234974AF9B4B4716DF6586"><enum>(A)</enum><text>to identify the key institutions, individuals, entities, and ministries that carry out such operations; and</text></subparagraph><subparagraph id="id926F1F0D6016451CB6F68769884CC772"><enum>(B)</enum><text>to distinguish between malign political influence operations intended to undermine core American freedoms and democratic institutions, as opposed to legitimate cultural, educational, business, and people-to-people exchanges that may benefit the United States and China.</text></subparagraph></paragraph></subsection><subsection id="id1c5d9f1e03d442128c6bbdbd769b3ab4"><enum>(c)</enum><header>Statement of policy</header><text>It is the policy of the United States—</text><paragraph id="id61b708556de749fda7d6e6b7f0726ec0"><enum>(1)</enum><text>to clearly differentiate between the Chinese people and culture and the Government of the People’s Republic of China and the Chinese Communist Party in official statements, media messaging, and policy;</text></paragraph><paragraph id="id140a7a3cbc4e490ea62bf7380798165b"><enum>(2)</enum><text>to clearly differentiate between legal, internationally accepted public diplomacy and strategic communications campaigns and illicit activities to undermine democratic institutions or freedoms;</text></paragraph><paragraph id="id829EB8BB263F4E3E93BBC488EEDFCBBD"><enum>(3)</enum><text>to protect United States citizens and legal residents from malign or coercive political influence operations;</text></paragraph><paragraph id="id2f21060d6a8c45efa62737ed7379d446"><enum>(4)</enum><text>to enhance cooperation and coordination with the United Kingdom, Australia, Canada, New Zealand, Japan, Taiwan, Singapore, and the members of the European Union, whose governments and institutions have faced acute pressure from the political influence operations of the Government of the People’s Republic of China and the Chinese Communist Party, and with other allies throughout the world;</text></paragraph><paragraph id="id6D81FC32468F4992956CE09D733192B6"><enum>(5)</enum><text>to create strategies to ensure that countries in Africa, the Western Hemisphere, Southeast Asia, and elsewhere are aware of the People’s Republic of China’s <quote>sharp power</quote> tactics, including the Chinese Communist Party’s party-to-party training program, which is designed to instill admiration and emulation of Beijing’s governance model and weaken democracy in these regions, and provide needed capacity to counter them effectively; </text></paragraph><paragraph id="id45d0f526cfe7431aa7238416e7dd939d"><enum>(6)</enum><text>to implement more advanced transparency requirements concerning collaboration with Chinese actors for media agencies, universities, think tanks, and government officials;</text></paragraph><paragraph id="id619BA439666C458D83E5DB7380825F44"><enum>(7)</enum><text>to use various forums to raise awareness about—</text><subparagraph id="id1613A6D78E72436B815F9EEEDB2FCCD3"><enum>(A)</enum><text>the goals and methods of the political influence operations of the Government of the People’s Republic of China and the Chinese Communist Party; and</text></subparagraph><subparagraph id="idC907C71B3E9A4C5B82C6C76D92894052"><enum>(B)</enum><text>common patterns and approaches used by Chinese intelligence agencies or related actors;</text></subparagraph></paragraph><paragraph id="id85830428a51b4c5da8e9cece11149d22"><enum>(8)</enum><text>to require greater transparency for Confucius Institutes, think tanks, academic programs, and nongovernmental organizations funded primarily by the Government of the People’s Republic of China and the Chinese Communist Party, or by individuals or public or private organizations with a demonstrable affiliation with the Government of the People’s Republic of China and the Chinese Communist Party that are operating in the United States to register through the Foreign Agents Registration Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/22/611">22 U.S.C. 611 et seq.</external-xref>) or a comparable mechanism;</text></paragraph><paragraph id="id652b69453ff448db85d2f454260a7c63"><enum>(9)</enum><text>to seek ways to increase Chinese language proficiency among mid-career professionals that do not rely on funding linked to the Government of the People’s Republic of China;</text></paragraph><paragraph id="idbbb46b451d794373860cd4902b3b8fe0"><enum>(10)</enum><text>to ensure that existing tools are sufficiently screening for the risk of Chinese influence operations; and</text></paragraph><paragraph id="id14EA458E18D441848115048708E29CB7"><enum>(11)</enum><text>to create more flexible tools, as needed, with the goals of—</text><subparagraph id="id855B96FFB29E4C9791512CDCF06F7C2F"><enum>(A)</enum><text>screening investments from the Government of the People’s Republic of China or sources backed by such government to protect against the takeover of United States companies by Chinese state-owned or state-driven entities; and</text></subparagraph><subparagraph id="id2DDD102A30A244E7BF0B0D34F9CC1D25"><enum>(B)</enum><text>protecting institutions or business sectors critically important to United States national security and the viability of democratic institutions.</text></subparagraph></paragraph></subsection></section><section id="id155b872a6b554e19800695d2e3eef047"><enum>4.</enum><header>Strategy to counter “sharp power” political influence operations and To protect United States citizens</header><subsection id="iddbad9a7ba13c435b9b137f85e6597867"><enum>(a)</enum><header>In general</header><text>The Secretary of State and the Secretary of Homeland Security, in coordination with all relevant Federal agencies, shall develop a long-term strategy—</text><paragraph id="id08d3a02adcca48309367e3ea5b7fd5f0"><enum>(1)</enum><text>to carry out the policy set forth in section 3(c);</text></paragraph><paragraph id="idcb2eea8234444c6a9dae90af8f0277ca"><enum>(2)</enum><text>to effectively counter the <quote>sharp power</quote> political influence operations of the Chinese Communist Party globally and in the United States;</text></paragraph><paragraph id="id07ba1d3a5ae541cea0f39619ef3fd454"><enum>(3)</enum><text>to ensure that United States citizens, particularly Chinese Americans and members of the Chinese, Uyghur, Mongolian, Korean, Taiwanese, and Tibetan diaspora who are often the victims and primary targets of malign political influence operations, are protected;</text></paragraph><paragraph id="id72CC45A2573E4E0A9B8BD4EEAA571994"><enum>(4)</enum><text>to ensure that—</text><subparagraph id="id9FC3D4F863FE476DB657E17533AE5C72"><enum>(A)</enum><text>the United States Government strategy to protect the communities described in paragraph (3) is clearly communicated by relevant Federal officials; and</text></subparagraph><subparagraph id="id6CC8CC78C4BE41E29462AAD557178956"><enum>(B)</enum><text>secure outlets are created for reporting on intimidation and surveillance;</text></subparagraph></paragraph><paragraph id="idada23962fd2c4edc81ffa32223c17afa"><enum>(5)</enum><text>to ensure that Chinese nationals who are legally studying, living, or working temporarily in the United States know that intimidation or surveillance by the Government of the People’s Republic of China and the Chinese Communist Party is an unacceptable invasion of their rights while they reside in the United States;</text></paragraph><paragraph id="id69E04825660D4F31B5BDEBDFB781E84E"><enum>(6)</enum><text>to provide secure outlets for reporting on intimidation and surveillance; and</text></paragraph><paragraph id="idDF7BF547EA6D4C5DB062639ED9AAA791"><enum>(7)</enum><text>to identify new tools or authorities necessary to implement this strategy.</text></paragraph></subsection><subsection id="id194534b2787843c69b27704117b63efa"><enum>(b)</enum><header>Report</header><text>Not later than 180 days after the date of the enactment of this Act, and annually thereafter, the Secretary of State, or an appropriate high-ranking official, shall—</text><paragraph id="idA436B0D6E6A6444F86E148826EA922EF"><enum>(1)</enum><text>submit an unclassified report, which may include a classified annex, containing the strategy required under subsection (a) to the appropriate congressional committees; or</text></paragraph><paragraph id="idBB1AA06ED9BE4197B28DFB765A2AC6EB"><enum>(2)</enum><text>describe the strategy required under subsection (a) through unclassified testimony before the <committee-name committee-id="SSFR00">Committee on Foreign Relations of the Senate</committee-name> or the <committee-name committee-id="">Committee on Foreign Affairs of the House of Representatives</committee-name>.</text></paragraph></subsection></section><section id="idf4e3034c1be2461f9176ddf93669d457"><enum>5.</enum><header>Report on the political influence operations of the Government of China and the Communist Party of China</header><subsection id="idcb90a84cd7854d9c8d63dfc402948e98"><enum>(a)</enum><header>In general</header><text>Because it is important for United States policymakers and the American people to be informed about the influence operations described in section 3, not later than 270 days after the date of the enactment of this Act, and annually thereafter, the Secretary of State, in coordination with the Director of National Intelligence, and in consultation with the heads of relevant Federal departments and agencies, shall submit an unclassified report, which may include a classified annex, to the appropriate congressional committees that describes the political influence operations of the Government of the People’s Republic of China and the Chinese Communist Party affecting the United States and select allies and partners, including the United Kingdom, Canada, Australia, New Zealand, Taiwan, and Japan, including efforts—</text><paragraph id="idAF47ED8D5BEC49D8AD12BEDF74881E64"><enum>(1)</enum><text>to exert influence over United States governmental or nongovernmental institutions or individuals, or government officials among United States allies and partners;</text></paragraph><paragraph id="idD1E9DC769FA341F6A8633D4EB5452443"><enum>(2)</enum><text>to coerce or threaten United States citizens or legal permanent residents or their families and associates living in China or elsewhere;</text></paragraph><paragraph id="id0F723C03CCA749B69B268F54E861291C"><enum>(3)</enum><text>to undermine democratic institutions and the freedoms of speech, expression, the press, association, assembly, religion, or academic thought;</text></paragraph><paragraph id="id54DA1B73DBFF46309D80DEA3289992DD"><enum>(4)</enum><text>to otherwise suppress information in public fora, in the United States and abroad; or</text></paragraph><paragraph id="idbdb433b9798347c0aef70cd4d0c8265f"><enum>(5)</enum><text>to develop or obtain property, facilities, infrastructure, business entities, or other assets for use in facilitating the activities described in paragraphs (1) through (4).</text></paragraph></subsection><subsection id="id39fd817f166d4d7f8f56564b2df1595f"><enum>(b)</enum><header>Contents</header><text>The report required under subsection (a) shall include recommendations for the President and Congress relating to—</text><paragraph id="idbfe481c32a504e8ea9df8dc87d9432cf"><enum>(1)</enum><text>the need for additional resources or authorities to counter political influence operations in the United States directed by the Government of the People’s Republic of China and the Chinese Communist Party, including operations carried out in concert with allies;</text></paragraph><paragraph id="id880334acbc5845568312fa99329a0aef"><enum>(2)</enum><text>whether a permanent office to monitor and respond to political influence operations of the Government of the People’s Republic of China and the Chinese Communist Party should be established within the Department of State or within the Office of the Director of National Intelligence; and</text></paragraph><paragraph id="id41ab428353e24acba87e1fee924e90f7"><enum>(3)</enum><text>whether regular public reports on the political influence operations of the Government of the People’s Republic of China and the Chinese Communist Party are needed to inform Congress and the American people of the scale and scope of such operations.</text></paragraph></subsection></section></legis-body></bill>
