which was read twice and referred to the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To establish the National Deepfake and Digital Provenance Task Force, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Deepfake Task Force Act</short-title></quote>.</text></section><section id="id96d01c536ae64e8bb65ded198c13c8f5"><enum>2.</enum><header>National deepfake and digital provenance task force</header><subsection id="id8c6e94e08ef047acae149039a91bac12"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="id8edeb36e67034d79ac6528fde376720a"><enum>(1)</enum><header>Digital content forgery</header><text>The term <term>digital content forgery</term> means the use of emerging technologies, including artificial intelligence and machine learning techniques, to fabricate or manipulate audio, visual, or text content with the intent to mislead.</text></paragraph><paragraph id="id54A3CD8D480E4C219A4AC484FC47EFC0"><enum>(2)</enum><header>Digital content provenance</header><text>The term <term>digital content provenance</term> means the verifiable chronology of the origin and history of a piece of digital content, such as an image, video, audio recording, or electronic document.</text></paragraph><paragraph id="id4C9BA82E8B444821BF39D3567E46CE5E"><enum>(3)</enum><header>Eligible entity</header><text>The term <term>eligible entity</term> means—</text><subparagraph id="id8C64FF4AB5A64D4CAB72BC91A82ADF5B"><enum>(A)</enum><text>a private sector or nonprofit organization; or</text></subparagraph><subparagraph id="id5261BC5E27E94049B5FBF07FAAF46B41" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text>an institution of higher education.</text></subparagraph></paragraph><paragraph id="idB8701CC6A87D4EEEA0DA14EBDA05C40A"><enum>(4)</enum><header>Institution of higher education</header><text>The term <term>institution of higher education</term> has the meaning given the term in section 101 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001</external-xref>).</text></paragraph><paragraph id="id30BA6029CE524B11B34EA2FDD60E8470"><enum>(5)</enum><header>Relevant congressional committees</header><text>The term <term>relevant congressional committees</term> means—</text><subparagraph id="id0D9746BA30DC4E828DCAC17950FF54ED"><enum>(A)</enum><text>the Committee on Homeland Security and Governmental Affairs of the Senate; and</text></subparagraph><subparagraph id="id6BF7921A0AE743A4B07725BDB5EDDE88"><enum>(B)</enum><text>the Committee on Homeland Security and the Committee on Oversight and Reform of the House of Representatives.</text></subparagraph></paragraph><paragraph id="idb3d124ce0b184176bff1a0469dd36cf0"><enum>(6)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Homeland Security.</text></paragraph><paragraph id="id95A9382B6B084761B150A0FAF8CC2492"><enum>(7)</enum><header>Task Force</header><text>The term <term>Task Force</term> means the National Deepfake and Provenance Task Force established under subsection (b)(1).</text></paragraph></subsection><subsection id="idb4a92a16ea43460fa8e7985af1416bbe"><enum>(b)</enum><header>Establishment of task force</header><paragraph id="id152caf296e12426fa7b97747c0bddcb0"><enum>(1)</enum><header>Establishment</header><text>The Secretary, in coordination with the Director of the Office of Science and Technology Policy, shall establish a task force, to be known as <quote>the National Deepfake Provenance Task Force</quote>, to—</text><subparagraph id="idab4aa55359824ddea41626e3aad5cee9"><enum>(A)</enum><text>investigate the feasibility of, and obstacles to, developing and deploying standards and technologies for determining digital content provenance;</text></subparagraph><subparagraph id="idc2c4fe73d9c148819ae3653ecb31454c"><enum>(B)</enum><text>propose policy changes to reduce the proliferation and impact of digital content forgeries, such as the adoption of digital content provenance and technology standards; and</text></subparagraph><subparagraph id="ida198083dd8d745938137c3bd07c6daba"><enum>(C)</enum><text>serve as a formal mechanism for interagency coordination and information sharing to facilitate the creation and implementation of a national strategy to address the growing threats posed by digital content forgeries.</text></subparagraph></paragraph><paragraph id="id0507c72aa46f420286aad548598d590c"><enum>(2)</enum><header>Membership</header><subparagraph id="idCE92A87C2F85481D9511BBA08053D676"><enum>(A)</enum><header>Co-chairpersons</header><text>The following shall serve as co-chairpersons of the Task Force:</text><clause id="id75FF6EA06D5348B59A6CDAA085662050"><enum>(i)</enum><text>The Secretary or a designee of the Secretary.</text></clause><clause id="idFA877D61CF8E40FBABDCE6399DDBA338"><enum>(ii)</enum><text>The Director of the Office of Science and Technology Policy or a designee of the Director.</text></clause></subparagraph><subparagraph id="id0dc8aa70dff948d6a01a5c8cc84c84de"><enum>(B)</enum><header>Composition</header><text>The Task Force shall be composed of 12 members, of whom—</text><clause id="id8645ca6212d842068908eaef9709547c"><enum>(i)</enum><text>4 shall be representatives from the Federal Government, including the co-chairpersons of the Task Force;</text></clause><clause id="id4da44852fdd04a8e8726dfba0b2d3477"><enum>(ii)</enum><text>4 shall be representatives from institutions of higher education; and</text></clause><clause id="iddfad39cc97674825820e3345e028a776"><enum>(iii)</enum><text>4 shall be representatives from private or nonprofit organizations.</text></clause></subparagraph><subparagraph id="id8cf3564b0e644915ab0c1743afbd4972"><enum>(C)</enum><header>Appointment</header><text>Not later than 120 days after the date of enactment of this Act, the co-chairpersons of the Task Force shall appoint members to the Task Force in accordance with subparagraph (A) from among technical experts in—</text><clause id="idACD40F74BB094B6C97DEDD5503C21CBE"><enum>(i)</enum><text>artificial intelligence;</text></clause><clause id="idAEC15A041F3D4F98AAE25D95575E2DEC"><enum>(ii)</enum><text>media manipulation;</text></clause><clause id="id5118881562144E16AC2091098D4D9326"><enum>(iii)</enum><text>digital forensics;</text></clause><clause id="id68E968FEFA734822A65E246E5C91954D"><enum>(iv)</enum><text>secure digital content and delivery;</text></clause><clause id="id6AA396D1DE474F6CA88E6FFFBF18ADCA"><enum>(v)</enum><text>cryptography; or</text></clause><clause id="idCA15751BFF324152AD45CA33B0C9BD22"><enum>(vi)</enum><text>related subjects.</text></clause></subparagraph><subparagraph id="idf920f6991a3e42ec916c2bacccf0017e"><enum>(D)</enum><header>Term of appointment</header><text>The term of a member of the Task Force shall end on the date described in subsection (g)(1).</text></subparagraph><subparagraph id="idcf2398917bc64ef7876846acf191d09b"><enum>(E)</enum><header>Vacancy</header><text>Any vacancy occurring in the membership of the Task Force shall be filled in the same manner in which the original appointment was made.</text></subparagraph><subparagraph id="idbb3696023bd74becbfbb39d67e73f89e"><enum>(F)</enum><header>Expenses for non-federal members</header><text>Members of the Task Force described in clauses (ii) and (iii) of subparagraph (B) shall be allowed travel expenses, including per diem in lieu of subsistence, at rates authorized for employees under subchapter I of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/57">chapter 57</external-xref> of title 5, United States Code, while away from their homes or regular places of business in the performance of services for the Task Force.</text></subparagraph></paragraph></subsection><subsection id="id3baf87b0a1784a2f93eb6dd4c3a28aca"><enum>(c)</enum><header>Coordinated plan</header><paragraph id="id8093f30cb2a04f09930e0536672d8c63"><enum>(1)</enum><header>In general</header><text>The Task Force shall develop a coordinated plan to—</text><subparagraph id="id3C35137E4DCC45C7AAB4A2439C772560"><enum>(A)</enum><text>reduce the proliferation and impact of digital content forgeries, including by exploring how the adoption of a digital content provenance standard could assist with reducing the proliferation of digital content forgeries;</text></subparagraph><subparagraph id="id0025CCC4DC37411F82A7E2875BF6FE45"><enum>(B)</enum><text>develop mechanisms for content creators to—</text><clause id="id6BD835EDF7DD4725802F599A6DE60167"><enum>(i)</enum><text>cryptographically certify the authenticity of original media and non-deceptive manipulations; and</text></clause><clause id="id769E7117F42640E594F83F164BE68772"><enum>(ii)</enum><text>enable the public to validate the authenticity of original media and non-deceptive manipulations to establish digital content provenance; and</text></clause></subparagraph><subparagraph id="id4F5ECBDD86354628AF33E1B7CAD5C913"><enum>(C)</enum><text>increase the ability of internet companies, journalists, watchdog organizations, other relevant entities, and members of the public to—</text><clause id="id14C0679A032B4C73826B005CCADD50C4"><enum>(i)</enum><text>meaningfully scrutinize and identify potential digital content forgeries; and</text></clause><clause id="idDD88DDCF8CB74E6D9277FA6FB890C569"><enum>(ii)</enum><text>relay trust and information about digital content provenance to content consumers.</text></clause></subparagraph></paragraph><paragraph id="id6d251a88f01a46d09fce2f968f195c96"><enum>(2)</enum><header>Contents</header><text>The plan required under paragraph (1) shall include the following:</text><subparagraph id="idb857402400fb4be291979123396f1126"><enum>(A)</enum><text>A Government-wide research and development agenda to—</text><clause id="idEA7AFFB3D4604070AA9F412A02C00B25"><enum>(i)</enum><text>improve technologies and systems to detect digital content forgeries; and</text></clause><clause id="idC734CFA34A1C4CBAABDE8DB2DEB28080"><enum>(ii)</enum><text>relay information about digital content provenance to content consumers.</text></clause></subparagraph><subparagraph id="ide88281f56d1146c8bc6bd4483a4ed1ad"><enum>(B)</enum><text>An assessment of the feasibility of, and obstacles to, the deployment of technologies and systems to capture, preserve, and display digital content provenance.</text></subparagraph><subparagraph id="id54B84EE6305347AEB94FEEA5C6BB7CE1"><enum>(C)</enum><text>An assessment of the feasibility of, and challenges in, distinguishing between—</text><clause id="idDBA3E4F0F120447FA7CDC2EE9378CE42"><enum>(i)</enum><text>benign or helpful alterations to digital content; and</text></clause><clause id="idDFA3DA0A802E42AEA966A70BCE190103"><enum>(ii)</enum><text>intentionally deceptive or obfuscating alterations to digital content.</text></clause></subparagraph><subparagraph id="idfea323eb134e483495ad0d6f1b1fdf25"><enum>(D)</enum><text>A discussion of best practices, including any necessary standards, for the adoption and effective use of technologies and systems to determine digital content provenance and detect digital content forgeries.</text></subparagraph><subparagraph id="id1b86e3b039cd435e96c2d7acb31b441f"><enum>(E)</enum><text>Conceptual proposals for necessary research projects and experiments to further develop successful technology to ascertain digital content provenance.</text></subparagraph><subparagraph id="id958f0c82402a4471baf2651b620bb8a6"><enum>(F)</enum><text>Proposed policy changes, including changes in law, to—</text><clause id="id98d53b5f3dc74788b142f1dfeaa32ee1"><enum>(i)</enum><text>incentivize the adoption of technologies, systems, open standards, or other means to detect digital content forgeries and determine digital content provenance; and</text></clause><clause id="id4da394bd620444bda8a62b3339f07a21"><enum>(ii)</enum><text>reduce the incidence, proliferation, and impact of digital content forgeries.</text></clause></subparagraph><subparagraph id="idb503e01667ec4967a5d24143cda9a9a9"><enum>(G)</enum><text>Recommendations for models for public-private partnerships to fight disinformation and reduce digital content forgeries, including partnerships that support and collaborate on—</text><clause id="idF695BE11D23B46E4BC5A477AC242F2BE"><enum>(i)</enum><text>industry practices and standards for determining digital content provenance;</text></clause><clause id="id803B09F1D2AB4954BBD0E17FF600A89C"><enum>(ii)</enum><text>digital literacy education campaigns and user-friendly detection tools for the public to reduce the proliferation and impact of disinformation and digital content forgeries;</text></clause><clause id="id079e1ba229d74f0da09ee956ccf83cae"><enum>(iii)</enum><text>industry practices and standards for documenting relevant research and progress in machine learning; and</text></clause><clause id="id1c845dbc1b694c5ca6706955a900f600"><enum>(iv)</enum><text>the means and methods for identifying and addressing the technical and financial infrastructure that supports the proliferation of digital content forgeries, such as inauthentic social media accounts and bank accounts.</text></clause></subparagraph><subparagraph id="id175e1dc9118f4b0da34515124252f3d1"><enum>(H)</enum><text>An assessment of privacy and civil liberties requirements associated with efforts to deploy technologies and systems to determine digital content provenance or reduce the proliferation of digital content forgeries, including statutory or other proposed policy changes.</text></subparagraph><subparagraph id="id04e0dd06603244c9adf459c5d68a5693"><enum>(I)</enum><text>A determination of metrics to define the success of—</text><clause id="ida3939139a6c244fd859fde5c592a8a9e"><enum>(i)</enum><text>technologies or systems to detect digital content forgeries;</text></clause><clause id="id106a8d1cdc3a489a9cc3eae7627ae3be"><enum>(ii)</enum><text>technologies or systems to determine digital content provenance; and</text></clause><clause id="id6fbf888db5064913b24ce2fac6a1a2a5"><enum>(iii)</enum><text>other efforts to reduce the incidence, proliferation, and impact of digital content forgeries.</text></clause></subparagraph></paragraph></subsection><subsection id="id27b269a5cef2445d81f231c28edf833b"><enum>(d)</enum><header>Consultations</header><text>In carrying out subsection (c), the Task Force shall consult with the following:</text><paragraph id="id532f3a2402f94c94b154f471575cec12"><enum>(1)</enum><text>The Director of the National Science Foundation.</text></paragraph><paragraph id="idb2950f2ad0314e1cb2458a0a86086c96"><enum>(2)</enum><text>The National Academies of Sciences, Engineering, and Medicine.</text></paragraph><paragraph id="id9269d9ce7b9c46f3a64fa8aeadff0ff7"><enum>(3)</enum><text>The Director of the National Institute of Standards and Technology.</text></paragraph><paragraph id="id5c5eecaf9e61425292af935798502262"><enum>(4)</enum><text>The Director of the Defense Advanced Research Projects Agency.</text></paragraph><paragraph id="idaa4e973f4d1149d297ed9ca33dc4cbe4"><enum>(5)</enum><text>The Director of the Intelligence Advanced Research Projects Activity of the Office of the Director of National Intelligence.</text></paragraph><paragraph id="ide3b031d5e64b42faa0c4548281f52cbc"><enum>(6)</enum><text>The Secretary of Energy.</text></paragraph><paragraph id="id46ae69c514034f4db28be893931f15d8"><enum>(7)</enum><text>The Secretary of Defense.</text></paragraph><paragraph id="idead64e5efc2243bbbdc0f840baea1dcd"><enum>(8)</enum><text>The Attorney General.</text></paragraph><paragraph id="id69a288cc32fc4f2588a2d713552e158a"><enum>(9)</enum><text>The Secretary of State.</text></paragraph><paragraph id="id4571fa1a918441a1981384329b970a05"><enum>(10)</enum><text>The Federal Trade Commission.</text></paragraph><paragraph id="ida8dce8bc3c77477aab77da1b029573b6"><enum>(11)</enum><text>The United States Trade Representative.</text></paragraph><paragraph id="id80d8d0cf6aec41a09d689e04b701ff0b"><enum>(12)</enum><text>Representatives from private industry and nonprofit organizations.</text></paragraph><paragraph id="id981cc5aba4ee461080ebb6cc8d92f870"><enum>(13)</enum><text>Representatives from institutions of higher education.</text></paragraph><paragraph id="idc084f680810342d28fdfc764ced74207"><enum>(14)</enum><text>Such other individuals as the Task Force considers appropriate.</text></paragraph></subsection><subsection id="id5c9f0be73beb4b3c91b5543f6eda543d"><enum>(e)</enum><header>Staff</header><paragraph id="id69A0222ED53F4E98AB4567455FA8A9BC"><enum>(1)</enum><header>In general</header><text>Staff of the Task Force shall be comprised of detailees with expertise in artificial intelligence or related fields from—</text><subparagraph id="id83FD88D1824E4A948A8B6392FCF3636A"><enum>(A)</enum><text>the Department of Homeland Security;</text></subparagraph><subparagraph id="idA667FEFDDFAB40C39C450D393663A255"><enum>(B)</enum><text>the Office of Science and Technology Policy;</text></subparagraph><subparagraph id="idB72415F4403C4BEEA68BDA1B8B4740DC"><enum>(C)</enum><text>the National Institute of Standards and Technology; or</text></subparagraph><subparagraph id="id2EA072A28C2C44B38675B3C283358D99"><enum>(D)</enum><text>any other Federal agency the co-chairpersons of the Task Force consider appropriate with the consent of the head of the Federal agency.</text></subparagraph></paragraph><paragraph id="id42E4150CB57C48BB99B7059FB8F0D3C2"><enum>(2)</enum><header>Other assistance</header><subparagraph id="id00538b10018f4beeb0c9f7d91946d9b5" commented="no"><enum>(A)</enum><header>In general</header><text>The co-chairpersons of the Task Force may enter into an agreement with an eligible entity for the temporary assignment of employees of the eligible entity to the Task Force in accordance with this paragraph.</text></subparagraph><subparagraph id="id78aa53097b0d4d379eeb2c92dcb03b8f" commented="no"><enum>(B)</enum><header>Application of ethics rules</header><text>An employee of an eligible entity assigned to the Task Force under subparagraph (A)—</text><clause id="id55fa412a3fa1411d9106c6db7e6876fb" commented="no"><enum>(i)</enum><text>shall be considered a special Government employee for the purpose of Federal law, including—</text><subclause commented="no" id="idD37E0C4ECC2B496995C4CFFF5BE2FD75"><enum>(I)</enum><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/11">chapter 11</external-xref> of title 18, United States Code; and</text></subclause><subclause commented="no" id="id927B55879078428DA76E91334905CFE7"><enum>(II)</enum><text>the Ethics in Government Act of 1978 (5 U.S.C. App.); and</text></subclause></clause><clause id="id5da3d4d654b942c0b7ad0dc4904bd776" commented="no"><enum>(ii)</enum><text>notwithstanding section 202(a) of title 18, United States Code, may be assigned to the Task Force for a period of not more than 2 years.</text></clause></subparagraph><subparagraph id="idcb74ba5238cf473bbe6c040f18f616c7" commented="no"><enum>(C)</enum><header>Financial liability</header><text>An agreement entered into with an eligible entity under subparagraph (A) shall require the eligible entity to be responsible for any costs associated with the assignment of an employee to the Task Force.</text></subparagraph><subparagraph id="id23efbf28ab8646419025f0bbb986a639" commented="no"><enum>(D)</enum><header>Termination</header><text>The co-chairpersons of the Task Force may terminate the assignment of an employee to the Task Force under subparagraph (A) at any time and for any reason.</text></subparagraph></paragraph></subsection><subsection id="id8a6c5cc890ba45928629ce030cc98585"><enum>(f)</enum><header>Task force reports</header><paragraph id="id0fa4957d4a8a4421b6c5a9459f0ed1e9"><enum>(1)</enum><header>Interim report</header><subparagraph id="id382BFA19CDE94F8FB909D61BAC0FDD65"><enum>(A)</enum><header>In general</header><text>Not later than 1 year after the date on which all of the appointments have been made under subsection (b)(2)(C), the Task Force shall submit to the President and the relevant congressional committees an interim report containing the findings, conclusions, and recommendations of the Task Force.</text></subparagraph><subparagraph id="idEDB02812101449DFA2398C30561119E3"><enum>(B)</enum><header>Contents</header><text>The report required under subparagraph (A) shall include specific recommendations for ways to reduce the proliferation and impact of digital content forgeries, including the deployment of technologies and systems to determine digital content provenance.</text></subparagraph></paragraph><paragraph id="id6cfae5b152c14debbea6f3aa6c4ba646"><enum>(2)</enum><header>Final report</header><text>Not later than 180 days after the date of the submission of the interim report under paragraph (1)(A), the Task Force shall submit to the President and the relevant congressional committees a final report containing the findings, conclusions, and recommendations of the Task Force, including the plan developed under subsection (c).</text></paragraph><paragraph id="idE7A654AF3F174DCB950334773A17898F"><enum>(3)</enum><header>Requirements</header><text>With respect to each report submitted under this subsection—</text><subparagraph id="idB741744FBA23485BB9A5D623E05507DB"><enum>(A)</enum><text>the Task Force shall make the report publicly available; and</text></subparagraph><subparagraph id="id596877A9B78540CCAA522F7F4A29F3A4"><enum>(B)</enum><text>the report—</text><clause id="id61CA9E0326274509AAC73B5224073FE0"><enum>(i)</enum><text>shall be produced in an unclassified form; and</text></clause><clause id="idC0B67792F50740AF9740B8F8B08DE66B"><enum>(ii)</enum><text>may include a classified annex.</text></clause></subparagraph></paragraph></subsection><subsection id="id4a0044556f864aca9bc7e576b37f0ecf"><enum>(g)</enum><header>Termination</header><paragraph id="id0437984e005e4933af07cdc389012f1a"><enum>(1)</enum><header>In general</header><text>The Task Force shall terminate on the date that is 90 days after the date on which the Task Force submits the final report under subsection (f)(2).</text></paragraph><paragraph id="id031bc641f46d443791284ba03dce1a96"><enum>(2)</enum><header>Records</header><text>Upon the termination of the Task Force under paragraph (1), each record of the Task Force shall become a record of the National Archives and Records Administration. </text></paragraph></subsection></section></legis-body></bill>
