which was read twice and referred to the <committee-name committee-id="SSAF00">Committee on Agriculture, Nutrition, and Forestry</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To reform the Federal sugar program, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Fair Sugar Policy Act of 2021</short-title></quote>.</text></section><section id="idE411D9C0DD0C4F2582CB675350755DBD"><enum>2.</enum><header>Sugar program</header><text display-inline="no-display-inline">Section 156(a) of the Federal Agriculture Improvement and Reform Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/7/7272">7 U.S.C. 7272(a)</external-xref>) is amended—</text><paragraph id="idC3C75CBC29AD4D39B759BB03BA39014F"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (4), by striking <quote>and</quote> at the end; and</text></paragraph><paragraph id="id2771BAD539E649CD8B72FF77726520CB"><enum>(2)</enum><text>in paragraph (5), by striking <quote>2019 through 2023 crop years.</quote> and inserting the following: “2019 and 2020 crop years; and</text><quoted-block style="OLC" display-inline="no-display-inline" id="iddb1c0670ca854783bbe05c6365430d9c"><paragraph id="id43e2ee65959f48d6b6d6dd1951fd71dd"><enum>(6)</enum><text>18.75 cents per pound for raw cane sugar for each of the 2021 through 2025 crop years.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="idCDDCDF5DFF2C482E8EC4C310E1008036"><enum>3.</enum><header>Flexible marketing allotments for sugar repealed</header><text display-inline="no-display-inline">Part VII of subtitle B of title III of the Agricultural Adjustment Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/7/1359aa">7 U.S.C. 1359aa et seq.</external-xref>) is amended to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idEA7BCA254A424E50969BFF498C7E9621"><part id="idb8e5165dd5ee43e7a2268fed8b2dc92d"><enum>VII</enum><header>Administration of Tariff Rate Quotas</header><section id="id01543DC70E7245EDA02ED42B9FA47311"><enum>359a.<?LEXA-Enum 359a.?></enum><header>Tariff rate quotas</header><subsection id="id5EE7EC9F60E147CA94DF8C4358281A24"><enum>(a)</enum><header>In general</header><text>At the beginning of each quota year, the Secretary shall establish the tariff-rate quotas for raw cane sugar and refined sugar at a level that is not less than the minimum level necessary to comply with obligations under international trade agreements that Congress has approved.</text></subsection><subsection id="id1DBA56BA37D24EC4B803133D9501E5F0"><enum>(b)</enum><header>Adjustment</header><paragraph id="id81F1C660ABA4469B839A4534579E7D03"><enum>(1)</enum><header>In general</header><text>Subject to subsection (a), the Secretary shall adjust the tariff-rate quotas for raw cane sugar and refined sugar to provide adequate supplies of sugar at reasonable prices in the domestic market.</text></paragraph><paragraph id="id4CAC045D1B444C6EAF00BE0AFFF400ED"><enum>(2)</enum><header>Ending stocks</header><text>Subject to paragraphs (1) and (3), the Secretary shall establish and adjust tariff-rate quotas so that the ratio of sugar stocks to total sugar use at the end of each quota year shall be approximately 15.5 percent.</text></paragraph><paragraph id="idB51BE3756F834167A7938A531200FF96"><enum>(3)</enum><header>Maintenance of reasonable prices and avoidance of forfeitures</header><subparagraph id="idEEC908E818274DF88E5FEA284715870C"><enum>(A)</enum><header>In general</header><text>The Secretary may establish a different target percentage for the ratio of ending stocks to total use described in paragraph (2) if the Secretary determines the different target percentage is necessary to prevent—</text><clause id="idD110842A6FBB499A94A8D2EC94004566"><enum>(i)</enum><text>unreasonably high prices; or</text></clause><clause id="id86C817FCFBE840298BC8A604B636BFC9"><enum>(ii)</enum><text>forfeitures of sugar pledged as collateral for a loan under section 156 of the Federal Agriculture Improvement and Reform Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/7/7272">7 U.S.C. 7272</external-xref>).</text></clause></subparagraph><subparagraph id="idF74D024E38904C08A002317053A62654"><enum>(B)</enum><header>Announcement</header><text>The Secretary shall publicly announce an establishment of a target percentage under this paragraph.</text></subparagraph></paragraph><paragraph id="id5A86A952B9804296B476CAC901E5D2CD"><enum>(4)</enum><header>Considerations</header><text>In establishing tariff-rate quotas under subsection (a) and making adjustments under this subsection, the Secretary shall consider the impact of the quotas on consumers, workers, businesses (including small businesses), and agricultural producers.</text></paragraph></subsection><subsection id="id49D49B81E2684B3DB7EC961F0F8A3259"><enum>(c)</enum><header>Temporary transfer of quotas</header><paragraph id="idF2C80DC3F9E24304B5E32905484FC993"><enum>(1)</enum><header>In general</header><text>To promote the full use of the tariff-rate quotas for raw cane sugar and refined sugar established or adjusted under subsection (a) or (b), respectively, the Secretary shall promulgate regulations that provide that a country that has been allocated a share of the quotas may temporarily transfer all or part of the share to another country that has also been allocated a share of the quotas.</text></paragraph><paragraph id="id16890B30C2104C1A8A61103ABB420ACB"><enum>(2)</enum><header>Transfers voluntary</header><text>A transfer under this subsection shall be valid only on voluntary agreement between the transferor and the transferee, consistent with procedures established by the Secretary.</text></paragraph><paragraph id="id0A86300C7B514CF89C17124FDA14E66D"><enum>(3)</enum><header>Transfers temporary</header><subparagraph id="idE7BFD81601F04E57BCA466F2D738CFF7"><enum>(A)</enum><header>In general</header><text>A transfer under this subsection shall be valid only for the duration of the quota year during which the transfer is made.</text></subparagraph><subparagraph id="id09DDE3388BDA4680B857B38E5EF1B010"><enum>(B)</enum><header>Following quota year</header><text>No transfer under this subsection shall affect the share of the quota allocated to the transferor or transferee for the following quota year.</text></subparagraph></paragraph></subsection></section></part><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="id7F281BEE096141D4B4668F2EFDB74197"><enum>4.</enum><header>Repeal of feedstock flexibility program for bioenergy producers</header><text display-inline="no-display-inline">Section 9010 of the Farm Security and Rural Investment Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/7/8110">7 U.S.C. 8110</external-xref>) is repealed.</text></section></legis-body></bill>
