which was read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To provide for improvements to aircraft hangars, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Hangars Accelerate National Growth And Regional Stability Act</short-title></quote> or the <quote><short-title>HANGARS Act</short-title></quote>.</text></section><section id="idf0cba871253c4a12811c8bb1523de87e"><enum>2.</enum><header>Hangar development program for general aviation airports</header><subsection id="id15c6ce3e25404a69ba091c34d0bc1e2a"><enum>(a)</enum><header>Program</header><paragraph id="id2A8A0A3EA59D41EA958689C4C80F2CBD"><enum>(1)</enum><header>In general</header><text>The Secretary of Transportation (in this section referred to as the <quote>Secretary</quote>) shall establish a program under which the Secretary shall award grants to eligible entities for an eligible project at the airport.</text></paragraph><paragraph id="idA2DC948F539D47459EFBAF4AED40EB71"><enum>(2)</enum><header>Application</header><text>An eligible entity seeking a grant under the program under this section shall submit an application to the Secretary at such time, in such manner, and containing such information as the Secretary may require. </text></paragraph></subsection><subsection id="id15a83ae26bb8469cba83b61d6f5265c5"><enum>(b)</enum><header>Eligible entities</header><text>In this section, the term <term>eligible entity</term> means a sponsor of a—</text><paragraph id="idD446E65479424251969E86F423DFC84D"><enum>(1)</enum><text>public-use airport that is not a primary airport (as such terms are defined in section 47102 of title 49, United States Code); or</text></paragraph><paragraph id="idD08FE390068A4E42B448E5BA6174C026"><enum>(2)</enum><text>general aviation airport (as defined in such section 47102).</text></paragraph></subsection><subsection id="id57258e6d2ddf4becbf611c231caaac67"><enum>(c)</enum><header>Eligible projects</header><paragraph id="id4C9818E0C4BE417090E3759A0DADBE94"><enum>(1)</enum><header>In general</header><text>In this section, the term <term>eligible project</term> means a project to construct, repair, or improve an aircraft hangar facility.</text></paragraph><paragraph id="id8423F9D9B8B0475A96CADFD5100B59B1"><enum>(2)</enum><header>Planning and acquisition costs</header><subparagraph id="id773C8D9472C34264AE043C05542C9C04"><enum>(A)</enum><header>In general</header><text>Subject to subparagraph (B), an eligible project may include costs incurred—</text><clause id="id2544d9dde2324f81be1a4913589269d9"><enum>(i)</enum><text>to prepare a plan or specifications, including carrying out a field investigation, for the eligible project; and</text></clause><clause id="id3e4fc6b2f47448f983282ee03c4da5b5"><enum>(ii)</enum><text>to acquire land and install utilities connected to the development of the eligible project.</text></clause></subparagraph><subparagraph id="id6367DA4112754874AE265C21CBB18E61"><enum>(B)</enum><header>Limitation</header><text>Not more than 10 percent of the amount of a grant awarded under this section may be used for the costs described in subparagraph (A).</text></subparagraph></paragraph></subsection><subsection id="id38576ccd74b7453786e7bc42300f67a4"><enum>(d)</enum><header>Federal share</header><text>The Federal share of the costs of an eligible project carried out with a grant under this section is 95 percent.</text></subsection><subsection id="ide63aceff666446dca52f5c9f162cc14e"><enum>(e)</enum><header>Priority consideration</header><text>In awarding grants under the program under this section, the Secretary shall give priority consideration to eligible projects—</text><paragraph id="id6c0a5ce416ca4f9d96f5d144e70fb3d9"><enum>(1)</enum><text>that will be completed within 2 years of the grant award;</text></paragraph><paragraph id="id8d3acd2e72ab4b12b81900989093a0a6"><enum>(2)</enum><text>that leverage private sector investments to build or improve facilities at the airport; and</text></paragraph><paragraph id="id4E6A3AF0BEA04181BE2E5C42E0896DA9"><enum>(3)</enum><text>that—</text><subparagraph id="id32052D9CA3504EA89A81105190044C5C"><enum>(A)</enum><text>achieve a complete development objective;</text></subparagraph><subparagraph id="idF6BF303102014D4D9B8A857EDD7BA05D"><enum>(B)</enum><text>are located on a statewide aviation master plan; or</text></subparagraph><subparagraph id="id0E8D24B7B9CB420C8AC657CC878BC449"><enum>(C)</enum><text>are located on an airport's master plan.</text></subparagraph></paragraph></subsection><subsection id="id810E449F0B4A49C1B725B84F4663C779"><enum>(f)</enum><header>Requirements</header><text>For any grant awarded under this section, the Secretary shall ensure that the eligible project is—</text><paragraph id="id7B8F7AECEAC24DE78C04DC61574144B8"><enum>(1)</enum><text>owned and operated by the sponsor of the eligible airport;</text></paragraph><paragraph id="id9CBE6C3231FB4AC5BD83240AB0C97076"><enum>(2)</enum><text>used on a non-exclusive basis; and</text></paragraph><paragraph id="idA841B0734F3F4931856218DE29D9A40B"><enum>(3)</enum><text>made available and used for public aeronautical purposes, including aircraft storage and maintenance.</text></paragraph></subsection><subsection id="id9CB4F13DE5784D3FB56068EFF5320BD8"><enum>(g)</enum><header>Grant limit</header><text>For grants awarded under this section, not more than $5,000,000 may be made available to a single eligible project.</text></subsection><subsection id="id1be79564e8694879afa492a6ea6befc3"><enum>(h)</enum><header>Administration</header><text>Of the amounts made available under subsection (i), the Secretary may retain up to 3 percent for personnel, contracting, and other costs to administer and oversee grants made under this section.</text></subsection><subsection id="id9098bdcd1b1841ea839a8ecf574bbaf7"><enum>(i)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to the Secretary $1,000,000,000 for the purpose of carrying out this section. Amounts appropriated under the preceding sentence shall remain available until expended.</text></subsection></section><section id="idCAAFDD458B6F46038F92011D47C255CB"><enum>3.</enum><header>Hangar development program for primary airports</header><subsection id="id8A6DF85801E74F6B8FA2D9650CC891ED"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Title II of the Public Works and Economic Development Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/42/3141">42 U.S.C. 3141 et seq.</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idAD2021EFF0D348B686CA10E3778D3E21"><section id="id18EC5D77EF26475EBE80B3236D0E4B85"><enum>219.</enum><header>Grants for hangar improvement</header><subsection id="idC90F26255D184D8983370608AE5E9DA6"><enum>(a)</enum><header>In general</header><text>On the application of an eligible recipient, the Secretary may make grants to construct, repair, or improve an aircraft hangar facility to further the economic adjustment objectives of this subchapter.</text></subsection><subsection id="id44925FAB5DC1421FB96F0F52517ACF77"><enum>(b)</enum><header>Criteria for grant</header><text>The Secretary may make a grant under this section if the Secretary determines that—</text><paragraph id="id877b3716ce834ebfa8233f049c15fbbb"><enum>(1)</enum><text>the eligible project for which the grant is applied will, directly or indirectly—</text><subparagraph id="id97aff414fe594261a7e890d097b488f5"><enum>(A)</enum><text>improve the opportunities, in the area where the eligible project is or will be located, for the successful establishment or expansion of aircraft maintenance and repair hangar facilities;</text></subparagraph><subparagraph id="id238c3b9dbb174567b3dcbf38355ae986"><enum>(B)</enum><text>leverage private sector investments to build or improve hangar facilities at the airport;</text></subparagraph><subparagraph id="id6f7e1fbb7e084506a0393bc9d946583f"><enum>(C)</enum><text>assist in the creation of additional long-term employment opportunities in the area; or</text></subparagraph><subparagraph id="id76a2950bd9b140b084ceef6044c8974e"><enum>(D)</enum><text>improve the opportunities, in the area where the eligible project is or will be located, for air carriers to establish or increase commercial routes;</text></subparagraph></paragraph><paragraph id="idd57efae0653640caadb73b7c47397e3d"><enum>(2)</enum><text>the area for which the eligible project is to be carried out has a comprehensive economic development strategy and the eligible project is consistent with the strategy; and</text></paragraph><paragraph id="id78611e43a7cc4570ad4df3dc3de4ece4"><enum>(3)</enum><text>the eligible project is located on a statewide aviation master plan or on the airport’s master plan.</text></paragraph></subsection><subsection id="idA742690579E041C7866C4E3438D882E8"><enum>(c)</enum><header>Eligible recipient</header><text>In this section, the term <term>eligible recipient</term> has the meaning given such term in section 3 and includes a primary airport (as defined in section 47102 of title 49, United States Code).</text></subsection><subsection id="idC541C049637E48E1B7A0994EB9E22085"><enum>(d)</enum><header>Eligible project</header><text>In this section, the term <term>eligible project</term> means a project to construct, repair, or improve an aircraft hangar facility at a primary airport (as defined in section 47102 of title 49, United States Code).</text></subsection><subsection id="id9DBB7F88083241A6AD8171AB801E9754"><enum>(e)</enum><header>Federal share</header><text>Notwithstanding section 204, the Federal share of the costs of an eligible project carried out with a grant under this section is 85 percent.</text></subsection><subsection id="id15BAAAC0A31A4187928E6C34E61B27EA"><enum>(f)</enum><header>Notice of Federal interest</header><text>Notwithstanding any other provision of law, any eligible recipient awarded a grant under this section shall record a statement of the Federal Government’s interest in the property improved through the grant in a form acceptable to the Secretary. The Secretary of Transportation shall cooperate with the Secretary as may be needed to facilitate the recording of such statement. </text></subsection><subsection id="id636623439D664903967FD309915A0005"><enum>(g)</enum><header>Administration</header><text>Of the amounts made available under subsection (h), the Secretary may retain up to 1 percent for personnel, contracting, and other costs to administer and oversee grants made under this section. </text></subsection><subsection id="id941E8AC498C04E84BDADBBD68FA466F6"><enum>(h)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to the Secretary $100,000,000 for the purpose of carrying out this section. Amounts appropriated under the preceding sentence shall remain available until expended.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id3D7B43FC04DE43DF81FB916588A7058D"><enum>(b)</enum><header>Conforming amendment</header><text>The table of contents contained in section 1(b) of the Public Works and Economic Development Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/42/3121">42 U.S.C. 3121</external-xref> note) is amended by inserting after the item relating to section 218 the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id3F51D53D27354199B0464D31EBFBE3B8"><toc><toc-entry level="section" bold="off">Sec. 219. Grants for hangar improvement.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section></legis-body></bill>
