which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Public Health Service Act to ensure the provision of high-quality service through the Suicide Prevention Lifeline, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H6C6E859B2AE7411C8D47B7F73CAC9B31"><section section-type="section-one" id="H32DBFC569E764C35A43E481C8DEC9D36"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Suicide Prevention Lifeline Improvement Act of 2021</short-title></quote>.</text></section><section commented="no" section-type="subsequent-section" id="H75B4F6FB1569485D879578F6E8D8F3CD"><enum>2.</enum><header>Suicide Prevention Lifeline</header><subsection id="HB258F39713C54940AE343CF4877DBCC4"><enum>(a)</enum><header>Plan</header><text display-inline="yes-display-inline">Section 520E–3 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/290bb-36c">42 U.S.C. 290bb–36c</external-xref>) is amended—</text><paragraph id="H7012BB1EE31F4CD1B78861F7C2FBB2DC"><enum>(1)</enum><text>by redesignating subsection (c) as subsection (e); and</text></paragraph><paragraph id="H50EFD103CFEE40949E5DAD97E447E08C"><enum>(2)</enum><text>by inserting after subsection (b) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H1FC6003835E841FD9F36BACC7BDC4CF6"><subsection id="H80BBD95853F14E38A316B7332D213F01"><enum>(c)</enum><header>Plan</header><paragraph id="HDFF0B22B5586438797DCC4F3B82A6122"><enum>(1)</enum><header>In general</header><text>For purposes of maintaining the suicide prevention hotline under subsection (b)(2), the Secretary shall develop and implement a plan to ensure the provision of high-quality service.</text></paragraph><paragraph id="HD6666ED47E3D401CBA933F16108E5C9D"><enum>(2)</enum><header>Contents</header><text>The plan required by paragraph (1) shall include the following:</text><subparagraph id="H0A78023FFEBA4EB48A3CE7AFC158520C"><enum>(A)</enum><text>Quality assurance provisions, including—</text><clause id="H2D5A01E378374E4984FC3C7C6D2CE341"><enum>(i)</enum><text>clearly defined and measurable performance indicators and objectives to improve the responsiveness and performance of the hotline, including at backup call centers; and</text></clause><clause id="H9F04C2472079413EA0BFD1C1471E0C78"><enum>(ii)</enum><text>quantifiable timeframes to track the progress of the hotline in meeting such performance indicators and objectives.</text></clause></subparagraph><subparagraph id="HFD9AB3597818406095544BB3A2CFD0F7"><enum>(B)</enum><text>Standards that crisis centers and backup centers must meet—</text><clause id="H9895444E9AD34A92B2DAFF0243217C7C"><enum>(i)</enum><text>to participate in the network under subsection (b)(1); and</text></clause><clause id="H3C9E0A353A6B4134968B15161CBDD674"><enum>(ii)</enum><text display-inline="yes-display-inline">to ensure that each telephone call, online chat message, and other communication received by the hotline, including at backup call centers, is answered in a timely manner by a person, consistent with the guidance established by the American Association of Suicidology or other guidance determined by the Secretary to be appropriate.</text></clause></subparagraph><subparagraph id="HB50EF6843F8E49A28706207E8431E1DD"><enum>(C)</enum><text display-inline="yes-display-inline">Guidelines for crisis centers and backup centers to implement evidence-based practices including with respect to followup and referral to other health and social services resources.</text></subparagraph><subparagraph id="H4DA8BE83A13B4FF3B492051774775390"><enum>(D)</enum><text>Guidelines to ensure that resources are available and distributed to individuals using the hotline who are not personally in a time of crisis but know of someone who is.</text></subparagraph><subparagraph id="HA0DCDC3F4D3A4CCC98579301EB3A58C8"><enum>(E)</enum><text>Guidelines to carry out periodic testing of the hotline, including at crisis centers and backup centers, during each fiscal year to identify and correct any problems in a timely manner.</text></subparagraph><subparagraph id="H43D9C21E4AD24A97BB0EEAFBC18775BB"><enum>(F)</enum><text display-inline="yes-display-inline">Guidelines to operate in consultation with the State department of health, local governments, Indian tribes, and tribal organizations.</text></subparagraph></paragraph><paragraph id="HEEC9A2D00EA64838BBE295970A0762EE"><enum>(3)</enum><header>Initial plan; updates</header><text>The Secretary shall—</text><subparagraph id="H2D7C9806C41D4B75ABE31F6581F8C03F"><enum>(A)</enum><text display-inline="yes-display-inline">not later than 6 months after the date of enactment of the <short-title>Suicide Prevention Lifeline Improvement Act of 2021</short-title>, complete development of the initial version of the plan required by paragraph (1), begin implementation of such plan, and make such plan publicly available; and</text></subparagraph><subparagraph id="H41BE95D4AA9644D9BD35DA0AF007D88A"><enum>(B)</enum><text>periodically thereafter, update such plan and make the updated plan publicly available.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H6EBE6A0A6B1743E9B5915034BC4CBF49"><enum>(b)</enum><header>Transmission of data to CDC</header><text display-inline="yes-display-inline">Section 520E–3 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/290bb-36c">42 U.S.C. 290bb–36c</external-xref>) is amended by inserting after subsection (c) of such section, as added by subsection (a) of this section, the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H7BB6A60A78DC4CA8A3B5923099B8872B"><subsection id="HA28319D5E706434A93CBD6F98121C7A2"><enum>(d)</enum><header>Transmission of data to CDC</header><text display-inline="yes-display-inline">The Secretary shall formalize and strengthen agreements between the National Suicide Prevention Lifeline program and the Centers for Disease Control and Prevention to transmit any necessary epidemiological data from the program to the Centers for Disease Control and Prevention, including local call center data, to assist the Centers in suicide prevention efforts.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H8A0F2F0FAA6E44878EB3972FA603F9D5"><enum>(c)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">Subsection (e) of section 520E–3 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/290bb-36c">42 U.S.C. 290bb–36c</external-xref>) is amended to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H7FC29179F4414ECC82152369A4832EB4"><subsection id="HB11E4305041E4484A07200BFE5B5F435"><enum>(e)</enum><header>Authorization of appropriations</header><paragraph id="H03C77429594445039364FA7B01BD68B1"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">To carry out this section, there are authorized to be appropriated $113,600,000 for each of fiscal years 2022 through 2024.</text></paragraph><paragraph id="HC50555D22E264910A6D9BD58B6950DF6"><enum>(2)</enum><header>Allocation</header><text display-inline="yes-display-inline">Of the amount authorized to be appropriated by paragraph (1) for each of fiscal years 2022 through 2024, at least 80 percent shall be made available to crisis centers.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="H63B3AEA01D40463CB0E6C78453334AD3"><enum>3.</enum><header>Pilot program on innovative technologies</header><subsection id="H17EF117DE3154725AF6190F1B25CA0A9"><enum>(a)</enum><header>Pilot program</header><paragraph id="HAB144EF73D574192B7A62382A70CC335"><enum>(1)</enum><header>In general</header><text>The Secretary of Health and Human Services, acting through the Assistant Secretary for Mental Health and Substance Use, shall carry out a pilot program to research, analyze, and employ various technologies and platforms of communication (including social media platforms, texting platforms, and email platforms) for suicide prevention in addition to the telephone and online chat service provided by the Suicide Prevention Lifeline.</text></paragraph><paragraph id="HA65623A05F824BBCB5730E4C85A6E1A2"><enum>(2)</enum><header>Authorization of appropriations</header><text>To carry out paragraph (1), there is authorized to be appropriated $5,000,000 for the period of fiscal years 2022 and 2023.</text></paragraph></subsection><subsection id="HA5FB522710EB4B06A8E61949CC02FDA4"><enum>(b)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 2 years after the date on which the pilot program under subsection (a) commences, the Secretary of Health and Human Services, acting through the Assistant Secretary for Mental Health and Substance Use, shall submit to Congress a report on the pilot program. With respect to each platform of communication employed pursuant to the pilot program, the report shall include—</text><paragraph id="HE9F8DDB9E1204AA49FDB1DA72C4610A9"><enum>(1)</enum><text>a full description of the program;</text></paragraph><paragraph id="HFC804B8C5F3A4A6594C942CCD82B3D9F"><enum>(2)</enum><text>the number of individuals served by the program;</text></paragraph><paragraph id="H1926FFB02E1C48AC9C78FEA7BC46ECF5"><enum>(3)</enum><text>the average wait time for each individual to receive a response;</text></paragraph><paragraph id="H21D2D06A4701409493604C6F54393326"><enum>(4)</enum><text>the cost of the program, including the cost per individual served; and</text></paragraph><paragraph id="H1DB4C9A347EC46C7B2F0F84CC67D0A6F"><enum>(5)</enum><text>any other information the Secretary determines appropriate.</text></paragraph></subsection></section><section id="HFEDBF123358E43848D7ABD54F46D076E"><enum>4.</enum><header>HHS study and report</header><text display-inline="no-display-inline">Not later than 2 years after the Secretary of Health and Human Services begins implementation of the plan required by section 520E–3(c) of the Public Health Service Act, as added by section 2(a)(2) of this Act, the Secretary shall—</text><paragraph id="H825B069894E44D6284D84CC109160E87"><enum>(1)</enum><text>complete a study on—</text><subparagraph id="H4E707CBE43F846819026544BF1F54278"><enum>(A)</enum><text>the implementation of such plan, including the progress towards meeting the objectives identified pursuant to paragraph (2)(A)(i) of such section 520E–3(c) by the timeframes identified pursuant to paragraph (2)(A)(ii) of such section 520E–3(c); and</text></subparagraph><subparagraph id="HFE4C496CC62344F49BFFE9F1C4844CC5"><enum>(B)</enum><text display-inline="yes-display-inline">in consultation with the Director of the Centers for Disease Control and Prevention, options to expand data gathering from calls to the Suicide Prevention Lifeline in order to better track aspects of usage such as repeat calls, consistent with applicable Federal and State privacy laws; and</text></subparagraph></paragraph><paragraph id="H7C278666D41B4572916C9AC8F99B63CC"><enum>(2)</enum><text>submit a report to Congress on the results of such study, including recommendations on whether additional legislation or appropriations are needed.</text></paragraph></section><section id="H99702CB433154E86866C434E975E70F9"><enum>5.</enum><header>GAO study and report</header><subsection id="H2DB2D8BC9EAF481B995C2D3743F01AF2"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 2 years after the Secretary of Health and Human Services begins implementation of the plan required by section 520E–3(c) of the Public Health Service Act, as added by section 2(a)(2) of this Act, the Comptroller General of the United States shall—</text><paragraph id="H33140E94FA5C4DF49FCD4FE5856F94C6"><enum>(1)</enum><text display-inline="yes-display-inline">complete a study on the Suicide Prevention Lifeline; and</text></paragraph><paragraph id="HBC237BFF3F1945BA9A52E60A179BF0A9"><enum>(2)</enum><text>submit a report to Congress on the results of such study.</text></paragraph></subsection><subsection id="H688FE0664C5E4647A84DCCE75F58EFA4"><enum>(b)</enum><header>Issues To be studied</header><text display-inline="yes-display-inline">The study required by subsection (a) shall address—</text><paragraph id="H64748AF7E2854C8492966E61DDFC70C1"><enum>(1)</enum><text>the feasibility of geolocating callers to direct calls to the nearest crisis center;</text></paragraph><paragraph id="HCE6FE16DB27648ED9D66EC4D933C9A76"><enum>(2)</enum><text display-inline="yes-display-inline">operation shortcomings of the Suicide Prevention Lifeline;</text></paragraph><paragraph id="HEE7B93F3D15B4C8E8DB7135BE61466B8"><enum>(3)</enum><text>geographic coverage of each crisis call center;</text></paragraph><paragraph id="H266EF43B3F354B5F8B07C964051B3200"><enum>(4)</enum><text>the call answer rate of each crisis call center;</text></paragraph><paragraph id="HF629C40BF3324104B1B163286A7A2137"><enum>(5)</enum><text>the call wait time of each crisis call center;</text></paragraph><paragraph id="HAA228E0B393E49D3B4DFF4BB2525BAFB"><enum>(6)</enum><text>the hours of operation of each crisis call center;</text></paragraph><paragraph id="H1E91164CFA004C2FB1FBBD8AAF2B79E4"><enum>(7)</enum><text>funding avenues of each crisis call center;</text></paragraph><paragraph id="HFFAABE3289A0414A853C6AA186A23948"><enum>(8)</enum><text display-inline="yes-display-inline">the implementation of the plan under section 520E–3(c) of the Public Health Service Act, as added by section 2(a) of this Act, including the progress towards meeting the objectives identified pursuant to paragraph (2)(A)(i) of such section 520E–3(c) by the timeframes identified pursuant to paragraph (2)(A)(ii) of such section 520E–3(c); and</text></paragraph><paragraph id="HA0ED966BEDB14CE9B5B8C9882C3B799B"><enum>(9)</enum><text>service to individuals requesting a foreign language speaker, including—</text><subparagraph id="H5811D3D576E8480B915DEC5F18B20257"><enum>(A)</enum><text>the number of calls or chats the Lifeline receives from individuals speaking a foreign language;</text></subparagraph><subparagraph id="HAF35511C8F7E48E183F13CC72B140AAA"><enum>(B)</enum><text>the capacity of the Lifeline to handle these calls or chats; and</text></subparagraph><subparagraph id="H215520F6A0EC42A99C7E68E3A3EAEC20"><enum>(C)</enum><text>the number of crisis centers with the capacity to serve foreign language speakers, in house.</text></subparagraph></paragraph></subsection><subsection id="H46F794E26F6448ECAA9D8251C07F8449"><enum>(c)</enum><header>Recommendations</header><text>The report required by subsection (a) shall include recommendations for improving the Suicide Prevention Lifeline, including recommendations for legislative and administrative actions.</text></subsection></section><section id="H5F86341ABB034095A36BED34AB68340C"><enum>6.</enum><header>Definition</header><text display-inline="no-display-inline">In this Act, the term <term>Suicide Prevention Lifeline</term> means the suicide prevention hotline maintained pursuant to section 520E–3 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/290bb-36c">42 U.S.C. 290bb–36c</external-xref>).</text></section></legis-body></bill>
