Required disclosure by business entities engaged in customer service communications of physical location.</toc-entry><toc-entry level="section" idref="H33B38D440D7A4A42BE34BF2245EEAEF4">Sec. 202. Enforcement.</toc-entry></toc></subsection></section><section id="H7434B943C92A4B20AD7624662695CD74"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="H039DF5553B8B42E98100ECE1C4E378E8"><enum>(1)</enum><header>Agency</header><text>The term <term>agency</term> means a Federal or State executive agency or a military department.</text></paragraph><paragraph id="H448BA7BCCBF240C986663AC89CCB9A6F"><enum>(2)</enum><header>Business entity</header><text>The term <term>business entity</term> means any organization, corporation, trust, partnership, sole proprietorship, unincorporated association, or venture established to make a profit, in whole or in part, by purposefully availing itself of the privilege of conducting commerce in the United States.</text></paragraph><paragraph commented="no" id="HD5E777C5AE87444A9F11668ADB9FBAB8"><enum>(3)</enum><header>Call center</header><text display-inline="yes-display-inline">The term <term>call center</term> means a facility or other operation whereby employees receive incoming telephone calls, emails, or other electronic communication for the purpose of providing customer assistance or other service.</text></paragraph><paragraph id="HA3A750937B3B475DABD7D2DD8EF99252"><enum>(4)</enum><header>Consumer</header><text>The term <term>consumer</term> means any individual within the territorial jurisdiction of the United States who purchases, transacts, or contracts for the purchase or transaction of any goods, merchandise, or services, not for resale in the ordinary course of the individual's trade or business, but for the individual's use or that of a member of the individual’s household.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id56DF208403B341DD9B941893F6217D49"><enum>(5)</enum><header display-inline="yes-display-inline">Contracting call center work overseas</header><text display-inline="yes-display-inline">The term <term>contracting call center work overseas</term> means transferring the work of a call center, or of one or more facilities or operating units within a call center comprising at least 30 percent of the total volume of the call center or operating unit when measured against the previous 12-month average call volume of operations or substantially similar operations, through a contract or other agreement to another entity who will perform that work outside of the United States.</text></paragraph><paragraph id="H489EEA63FEA144E9BB0D38B50CA37C28"><enum>(6)</enum><header>Customer service communication</header><text>The term <term>customer service communication</term> means any telecommunication or wire communication between a consumer and a business entity in furtherance of commerce.</text></paragraph><paragraph id="HE856809A50304CD6AC4C4DE48A5610D0"><enum>(7)</enum><header>Employer</header><text display-inline="yes-display-inline">The term <term>employer</term> means any business enterprise that employs in a call center—</text><subparagraph id="HFF566EA716C744ACB73113F8C809C156"><enum>(A)</enum><text>50 or more employees, excluding part-time employees; or</text></subparagraph><subparagraph id="H4EDC397A4E9045DA9524CDCC043AB31A"><enum>(B)</enum><text>50 or more employees who in the aggregate work at least 1,500 hours per week (exclusive of hours of overtime).</text></subparagraph></paragraph><paragraph id="HD8FF9769CA984A7B896235A52893041F"><enum>(8)</enum><header>Part-time employee</header><text>The term <term>part-time employee</term> means an employee who is employed for an average of fewer than 20 hours per week or who has been employed for fewer than 6 of the 12 months preceding the date on which notice is required.</text></paragraph><paragraph commented="no" id="HEA3D8413CB4144C5B38C75D5C9561F92"><enum>(9)</enum><header>Relocating and relocation</header><text display-inline="yes-display-inline">The terms <term>relocating</term> and <term>relocation</term> refer to the closure of a call center, or the cessation of operations of a call center, or one or more facilities or operating units within a call center comprising at least 30 percent of the total volume of the call center or operating unit, when measured against the previous 12-month average call volume of operations or substantially similar operations, and the transferring of the operations of the call center (or facilities or operating units) to another location outside of the United States.</text></paragraph><paragraph id="H79448918D45B498FB6B49D08F88F49C0"><enum>(10)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Labor.</text></paragraph><paragraph id="HB12BB407EAD744A08F89CB173621723F"><enum>(11)</enum><header>Telecommunication</header><text>The term <term>telecommunication</term> means the transmission, between or among points specified by the communicator, of information of the communicator's choosing, without change in the form or content of the information as sent and received.</text></paragraph><paragraph id="H975BA2E673F7453C9471682725E7BDEE"><enum>(12)</enum><header>Wire communication and communication by wire</header><text>The term <term>wire communication</term> or <term>communication by wire</term> means the transmission of writing, signs, signals, pictures, and sounds of all kinds by aid of wire, cable, or other like connection between the points of origin and reception of such transmission, including all instrumentalities, facilities, apparatus, and services (among other things, the receipt, forwarding, and delivery of communications) incidental to such transmission.</text></paragraph></section><title id="id6AEED605970E49DD855CB14C0D6F4301" style="OLC"><enum>I</enum><header>Consequences for relocating or contracting out call center work overseas</header><section id="H43FBC1F4A81E48E4993CC7BDBE3EF6E8"><enum>101.</enum><header>List of call centers relocating or contracting call center work overseas and ineligibility for grants or guaranteed loans</header><subsection id="H662080460A2843949105F081B6754CB8"><enum>(a)</enum><header>List</header><paragraph id="HA18E935C032644E2B3540F7DB735C739"><enum>(1)</enum><header>Notice requirement</header><subparagraph id="H4EAA22D53C484BC1BDBFC24CD5237145"><enum>(A)</enum><header>In general</header><text>Not fewer than 120 days before relocating a call center outside of the United States, or contracting call center work overseas, an employer shall notify the Secretary of such relocation or contracting.</text></subparagraph><subparagraph id="H0156364A6DD743ACBB8CF01E1208DDE3"><enum>(B)</enum><header>Penalty</header><text>A person who violates subparagraph (A) shall be subject to a civil penalty not to exceed $10,000 for each day of violation.</text></subparagraph></paragraph><paragraph commented="no" id="H8A1D58DE93E94788B89F242B35F254B4"><enum>(2)</enum><header>Establishment and maintenance of list</header><subparagraph commented="no" id="idD2EAD54A175A484A8A0ADEA96A8C2BB6"><enum>(A)</enum><header>In general</header><text>The Secretary shall establish, maintain, and make available to the public a list of all employers who relocate a call center or contract call center work overseas, as described in paragraph (1)(A).</text></subparagraph><subparagraph commented="no" id="idE2511EA2F2AC48D0BB59A6054CB5EF56"><enum>(B)</enum><header>Term</header><text>Each employer included in the list required by subparagraph (A) shall remain on the list for a period not to exceed 5 years after each instance of relocating a call center or contracting call center work overseas.</text></subparagraph><subparagraph commented="no" id="idC26FCCC71A6F47FF9FC45475DBE9B1D3"><enum>(C)</enum><header>Removal</header><text>The Secretary may remove an employer from the list required by subparagraph (A) if the Secretary determines that—</text><clause commented="no" id="idDB645405B7124795B5B87FEEBDD8033B"><enum>(i)</enum><subclause commented="no" display-inline="yes-display-inline" id="id4EFB5F1A27C8455B9786E60C8F1C43F7"><enum>(I)</enum><text>the employer has relocated a call center from a location outside of the United States to a location in the United States; and</text></subclause><subclause commented="no" id="id028A298CC813430C9789E62B4C72BCF2" indent="up1"><enum>(II)</enum><text>the new call center in the United States employs a number of employees equal to or greater than the number of employees who worked at the original call center that was relocated to a location outside of the United States; or</text></subclause></clause><clause commented="no" id="id00F0D7094B76459D9C44990E3B079B7A"><enum>(ii)</enum><text>in the case of an employer who contracted call center work overseas, the employer demonstrates that the contract or agreement has been amended to require that all employees performing call center work under the contract or agreement will be located in the United States.</text></clause></subparagraph></paragraph></subsection><subsection id="HCD3DD3B97CA241D2B13572C0D78CA2EB"><enum>(b)</enum><header>Ineligibility for grants or guaranteed loans</header><paragraph id="H93D277E2740F4FFE88EF916BA1C4E60A"><enum>(1)</enum><header>Ineligibility</header><text display-inline="yes-display-inline">Except as provided in paragraph (2) and notwithstanding any other provision of law, an employer who appears on the list required by subsection (a)(2)(A) shall be ineligible for any direct or indirect Federal grants or Federal guaranteed loans for 5 years after the date such employer was added to the list.</text></paragraph><paragraph id="H018563CDC4044BF4AF8FDCF9C21F8FC0"><enum>(2)</enum><header>Exceptions</header><text>The Secretary, in consultation with the appropriate agency providing a loan or grant, may waive the eligibility restriction provided under paragraph (1) if the employer applying for such loan or grant demonstrates that a lack of such loan or grant would—</text><subparagraph id="H4E6325677B374A3DB2EABD743D795495"><enum>(A)</enum><text>threaten national security;</text></subparagraph><subparagraph id="H4A08525217194970AE2AFEB144A0C66D"><enum>(B)</enum><text>result in substantial job loss in the United States; or</text></subparagraph><subparagraph id="H652A73D9A71B4A82A00461BEF2339D0E"><enum>(C)</enum><text>harm the environment.</text></subparagraph></paragraph></subsection><subsection id="H985D26FA9A6F43868EBECE6E7CC3CE1A"><enum>(c)</enum><header>Preference in Federal contracting for not relocating or contracting call center work overseas</header><text>The head of an agency, when awarding a civilian or defense-related Federal contract, shall give preference to a United States employer that does not appear on the list required by subsection (a)(2)(A).</text></subsection><subsection id="H932A2693D4244E6E895D88EED072B7A9"><enum>(d)</enum><header>Effective date</header><text>This section shall take effect on the date that is 1 year after the date of the enactment of this Act.</text></subsection></section><section id="H2832D1A269B743CCA188E4F2CB624AE1"><enum>102.</enum><header>Rule of construction related to Federal benefits for workers</header><text display-inline="no-display-inline">No provision of this title shall be construed to permit withholding or denial of payments, compensation, or benefits under any provision of Federal law (including Federal unemployment compensation, disability payments, or worker retraining or readjustment funds) to workers employed by employers that relocate operations outside the United States.</text></section><section id="id86068f4640344f85ab2e3bfa10828c98"><enum>103.</enum><header>Report regarding Federal call center work locations</header><text display-inline="no-display-inline">By not later than 1 year after the date of enactment of this Act, the Secretary of Labor shall prepare and submit to Congress a report that documents the location, and amount, of call center work conducted by or for the Federal Government, including—</text><paragraph id="id12830A97FC6B434790AF6ED2CC010E77"><enum>(1)</enum><text>a determination of the amount of such Federal call center work that is conducted by Federal employees, and the amount conducted by Federal contractors; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5531EA92DF2043139271113F26BAFF83"><enum>(2)</enum><text>all locations at which such Federal call center work is being conducted, whether by Federal employees or through Federal contracts.</text></paragraph></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="id3191EA29748049B38BE7411B2E50AC38"><enum>104.</enum><header display-inline="yes-display-inline">Requirement that call center work under a Federal contract be performed inside the United States</header><text display-inline="no-display-inline">The head of an agency, when awarding a civilian or defense-related Federal contract, shall require as a condition of the contract that any call center work performed in connection with the contract or any subcontract under the contract shall be performed inside the United States.</text></section></title><title id="id045FE3FA9D914FABA268D5CE07CAA109" style="OLC"><enum>II</enum><header>Required disclosure of physical locations in customer service communications</header><section id="H84D6E1851117468CAAAE27A7A1B1F511"><enum>201.</enum><header>Required disclosure by business entities engaged in customer service communications of physical location</header><subsection id="H2C04CF7B53AA422E949B5B31D7F68EFA"><enum>(a)</enum><header>In general</header><text>Except as provided in subsection (b), a business entity that either initiates or receives a customer service communication shall require that each of its employees or agents participating in the communication disclose their physical location at the beginning of each customer service communication so initiated or received.</text></subsection><subsection id="H01EDB05F31404834914DF8409C05B343"><enum>(b)</enum><header>Exceptions</header><paragraph id="H929868B1C97A49549106AE4EAD46ACDC"><enum>(1)</enum><header>Business entities located in the United States</header><text>The requirements of subsection (a) shall not apply to a customer service communication involving a business entity if all of the employees or agents of the business entity participating in such communication are physically located in the United States.</text></paragraph><paragraph id="H26B7F753F0E14EC1848CE5543B394143"><enum>(2)</enum><header>Communication initiated by consumer knowingly to foreign entity or address</header><text>The requirements of subsection (a) shall not apply to an employee or agent of a business entity participating in a customer service communication with a consumer if—</text><subparagraph id="H9CF4620A7F944D63A51EB3F6283D1EFF"><enum>(A)</enum><text>the customer service communication was initiated by the consumer;</text></subparagraph><subparagraph id="H5F1C3DD003AA44709F7595EC7618E339"><enum>(B)</enum><text>the employee or agent is physically located outside the United States; and</text></subparagraph><subparagraph id="HEF8F13F65A624082A425D55AD3A51C3C"><enum>(C)</enum><text>the consumer knows or reasonably should know that the employee or agent is physically located outside the United States.</text></subparagraph></paragraph><paragraph id="H9366D81F376B4B5F9EC654F0264DECF7"><enum>(3)</enum><header>Emergency services</header><text>The requirements of subsection (a) shall not apply to a customer service communication relating to the provision of emergency services (as defined by the Federal Trade Commission).</text></paragraph><paragraph id="HF572E964EF894CEF866D48F37A214EC4"><enum>(4)</enum><header>Business entities and customer service communications excluded by Federal Trade Commission</header><text>The Federal Trade Commission may exclude certain classes or types of business entities or customer service communications from the requirements of subsection (a) if the Commission finds exceptionally compelling circumstances that justify such exclusion.</text></paragraph></subsection><subsection id="HE367324DC6844FCEBED6C7CD2560EEAD"><enum>(c)</enum><header>Transfer to U.S.-Based customer service center</header><text>A business entity that is subject to the requirements of subsection (a) shall, at the request of a customer, transfer the customer to a customer service agent who is physically located in the United States.</text></subsection><subsection id="H8467C2A03A454F7BB040B6ED03E8FE62"><enum>(d)</enum><header>Certification requirement</header><text>Each year, each business entity that participates in a customer service communication shall certify to the Federal Trade Commission that it has complied or failed to comply with the requirements of subsections (a) and (c).</text></subsection><subsection commented="no" display-inline="no-display-inline" id="HB4F3BBD789364C699F34EBA54FF767F5"><enum>(e)</enum><header>Regulations</header><text display-inline="yes-display-inline">Not later than 1 year after the date of the enactment of this Act, the Federal Trade Commission shall promulgate such regulations as may be necessary to carry out the provisions of this section.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="H92AB77AA1C2B4E7B84BFC1DAA24F2F8E"><enum>(f)</enum><header>Effective date</header><text>The requirements of subsection (a) shall apply with respect to customer service communications occurring on or after the date that is 1 year after the date of the enactment of this Act.</text></subsection></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="H33B38D440D7A4A42BE34BF2245EEAEF4"><enum>202.</enum><header>Enforcement</header><subsection commented="no" display-inline="no-display-inline" id="H7ECEC0869C4B4F4C8B619F07B1256C0C"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Any failure to comply with the provisions of section 201 shall be treated as a violation of a regulation under section 18(a)(1)(B) of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/57a">15 U.S.C. 57a(a)(1)(B)</external-xref>) regarding unfair or deceptive acts or practices.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="HA9DF3AA7A3184D7187E33A6D127719DC"><enum>(b)</enum><header>Powers of Federal Trade Commission</header><paragraph commented="no" display-inline="no-display-inline" id="HAF2557A8F68747EB949CFCFEA32F1125"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Federal Trade Commission shall prevent any person from violating section 201 and any regulation promulgated thereunder, in the same manner, by the same means, and with the same jurisdiction, powers, and duties as though all applicable terms and provisions of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/41">15 U.S.C. 41 et seq.</external-xref>) were incorporated into and made a part of this Act.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HC0091EA99F5F45DF877205B298C08BC3"><enum>(2)</enum><header>Penalties</header><text display-inline="yes-display-inline">Any person who violates regulations promulgated under section 201 shall be subject to the penalties and entitled to the privileges and immunities provided in the Federal Trade Commission Act in the same manner, by the same means, and with the same jurisdiction, power, and duties as though all applicable terms and provisions of the Federal Trade Commission Act were incorporated into and made part of this Act.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H5FAFD554CE184118B2FFCA0E9299FC01"><enum>(c)</enum><header>Authority preserved</header><text display-inline="yes-display-inline">Nothing in this section or section 201 shall be construed to limit the authority of the Federal Trade Commission under any other provision of law.</text></subsection></section></title></legis-body></bill>
