which was read twice and referred to the <committee-name committee-id="SSEG00">Committee on Energy and Natural Resources</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To establish a process for the Board on Geographic Names to review and revise offensive names of Federal land units, to create an advisory committee to recommend Federal land unit names to be reviewed by the Board, and for other purposes. </official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H8F8C2712791A4B2881605DF6BE952269"><section section-type="section-one" id="H4FF369BB5E214FBE92E6C68E6BE5D435"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Reconciliation in Place Names Act</short-title></quote>.</text></section><section id="HF253665B8BE840E288E945934A85B3B4"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds that—</text><paragraph id="HFF018DD026E344B6959D081CC1BC84AF"><enum>(1)</enum><text>the United States contains geographic features named—</text><subparagraph id="H4D9B66C349A542658EF32DE516F8227A"><enum>(A)</enum><text>with derogatory terms that include racial and sexual slurs and stereotypes targeting Native Americans, African Americans, and others;</text></subparagraph><subparagraph id="H865D65F77F2C473BA7AD2B6E8C870022"><enum>(B)</enum><text>in honor of individuals who—</text><clause id="H86D39321F24E47A59952616F68B60452"><enum>(i)</enum><text>held racially repugnant views;</text></clause><clause id="H3AA41553569D4C8894CDA86D1AADEE51"><enum>(ii)</enum><text>committed atrocities against Native Americans; or</text></clause><clause id="HBAAFD55661664DB6B4F1644D388BAF5E"><enum>(iii)</enum><text>supported or effectuated discriminatory policies; and</text></clause></subparagraph><subparagraph id="H6182B6FA0EE4463D8CF988518E0639CD"><enum>(C)</enum><text>to recognize individuals who carried out injustices against racial minorities;</text></subparagraph></paragraph><paragraph id="HA26869B6596D4CFBA5A71120AFAE5A7C"><enum>(2)</enum><text>place names that include racial or sexual slurs, or honor individuals who held racially repugnant views, committed atrocities against Native Americans, or carried out injustices against racial minorities—</text><subparagraph id="HE0BA4688E58940D2AF835A7F2BE89D98"><enum>(A)</enum><text>perpetuate prejudice;</text></subparagraph><subparagraph id="H2FFE0CB4E29A45D4AC18C4E145B12216"><enum>(B)</enum><text>disparage racial minorities; and</text></subparagraph><subparagraph id="H938770BAEE994CE58CE444439A81DCC4"><enum>(C)</enum><text>honor individuals who committed or supported atrocities;</text></subparagraph></paragraph><paragraph id="H251940CDB48A491C874B40B3CAD4CD00"><enum>(3)</enum><text>no geographic feature in the United States should have a name that—</text><subparagraph id="H28D6AF2CBC504CE1B3A7401945765D4E"><enum>(A)</enum><text>perpetuates prejudice;</text></subparagraph><subparagraph id="HC8EA3D1200D44279A0E49ECE862F34CB"><enum>(B)</enum><text>disparages racial minorities; or</text></subparagraph><subparagraph id="HC8708E8D0C9F4BE081537B9A554C2AAA"><enum>(C)</enum><text>honors individuals who committed or supported atrocities against racial minorities;</text></subparagraph></paragraph><paragraph id="H84EBF44022544C518C356FBF5C2883AB"><enum>(4)</enum><text>place names in the United States should—</text><subparagraph id="H5F0FA1979F224F238A725211D895533E"><enum>(A)</enum><text>be equitable and just;</text></subparagraph><subparagraph id="H450623DB013248C6AB7EB7E364623C0D"><enum>(B)</enum><text>honor the cultural diversity of the United States; and</text></subparagraph><subparagraph id="H0923E5371DEE4464BCCE3596D32CFF3C"><enum>(C)</enum><text>advance dignity for all people in the United States;</text></subparagraph></paragraph><paragraph id="HE4A8872720434B4D9DB74B01D16DEACD"><enum>(5)</enum><text>the Board on Geographic Names is responsible for naming geographic features in the United States;</text></paragraph><paragraph id="H655199CD669D4947AF4F47345997DC3E"><enum>(6)</enum><text>the policies of the Board on Geographic Names—</text><subparagraph id="HA4D28B3BA19046E6A3946819C44D4B53"><enum>(A)</enum><text>authorize changing the names of geographic features determined to be offensive; and</text></subparagraph><subparagraph id="H018D1D4D7A804D859853782A5B211A59"><enum>(B)</enum><text>prohibit the use of terms considered to be derogatory or offensive in geographic place names;</text></subparagraph></paragraph><paragraph id="H9A2ED78B5BBD4807A5DA28F86E919775"><enum>(7)</enum><text>the renaming process of the Board on Geographic Names—</text><subparagraph id="H5D877180032049A4A64E07EE4C16DA13"><enum>(A)</enum><text>is time consuming;</text></subparagraph><subparagraph id="H7B7D500E3BA14A6FA4E565D4C4801C83"><enum>(B)</enum><text>lacks transparency and public involvement; and</text></subparagraph><subparagraph id="H571E2AAE2C0C423CB339E2E031F0F55C"><enum>(C)</enum><text>fails to address the scope and breadth of inappropriate place names;</text></subparagraph></paragraph><paragraph id="HFF1610495B0E4841913663FEBA002287"><enum>(8)</enum><text>the extent of inappropriate or offensive place names in the United States requires a systematic, public process in which offensive and inappropriate place names are reviewed and replaced; and</text></paragraph><paragraph id="H9D81139FE4154AF0B853E4C92A9B84D1"><enum>(9)</enum><text>the process described in paragraph (8) offers an opportunity for reconciliation for—</text><subparagraph id="HAC3A14BF889F49E4AB04322D79D0F5A6"><enum>(A)</enum><text>people of the United States who suffer from prejudice and racial violence; and</text></subparagraph><subparagraph id="HFC6CAA3D353C4E9796BAF64D48D8C318"><enum>(B)</enum><text>all people of the United States in whose name the acts were committed.</text></subparagraph></paragraph></section><section id="H86936DCD522B4EF4A8D25008883A7D3E"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="H449C96A865CF4A03A19373CE134CDA1A"><enum>(1)</enum><header>Board</header><text>The term <term>Board</term> means the Board on Geographic Names established by section 2 of the Act of July 25, 1947 (<external-xref legal-doc="usc" parsable-cite="usc/43/364a">43 U.S.C. 364a</external-xref>).</text></paragraph><paragraph id="H3E05EE73109F435A97DFD7962E4E1A4A"><enum>(2)</enum><header>Committee</header><text>The term <term>Committee</term> means the Advisory Committee on Reconciliation in Place Names established by section 4(a).</text></paragraph><paragraph id="H987E9308543441EB9602D4F897C66A10"><enum>(3)</enum><header>Federal land unit</header><text>The term <term>Federal land unit</term> includes—</text><subparagraph id="HD179722325174B62BC1452A265144A98"><enum>(A)</enum><text>National Forest System land;</text></subparagraph><subparagraph id="H1F7BAAD2675E46B5B345D6272AB36008"><enum>(B)</enum><text>a unit of the National Park System;</text></subparagraph><subparagraph id="HCF185C0CF3654D1AB44AEEADD623F710"><enum>(C)</enum><text>a component of the National Wilderness Preservation System;</text></subparagraph><subparagraph id="H9900BD6DF53C41BAB2412A66E4426E26"><enum>(D)</enum><text>any part of the National Landscape Conservation System; and</text></subparagraph><subparagraph id="H2BC5FD283C874805A5229F1F3A349F6C"><enum>(E)</enum><text>a unit of the National Wildlife Refuge System.</text></subparagraph></paragraph><paragraph id="H8D72D7D0F251460D942927C32E33498F"><enum>(4)</enum><header>Indian Tribe</header><text>The term <term>Indian Tribe</term> has the meaning given the term in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>).</text></paragraph><paragraph id="HE3E5FF9626D3438E8371347D0E4001EA"><enum>(5)</enum><header>Offensive place name</header><text>The term <term>offensive place name</term> means a domestic geographic place name or Federal land unit that—</text><subparagraph id="HD14836F7508C48ADBF0CBBCE3C6CAEDE"><enum>(A)</enum><text>recognizes an individual who—</text><clause id="H2769E9C7965D491F93A83BEE384D803B"><enum>(i)</enum><subclause commented="no" display-inline="yes-display-inline" id="HC4FCFE806864466992B7E598DB7136A9"><enum>(I)</enum><text>held racially repugnant views;</text></subclause><subclause id="H26E130402F35475DA04F910D590415DC" indent="up1"><enum>(II)</enum><text>committed atrocities against Native Americans; or</text></subclause><subclause id="H08AD14F2E1B54F94BD1F52DABBE783EC" indent="up1"><enum>(III)</enum><text>supported or effectuated discriminatory policies; or</text></subclause></clause><clause id="HE2F4AD33D65F47C398F1BA026BDAE49E"><enum>(ii)</enum><text>carried out other injustices against racial minorities;</text></clause></subparagraph><subparagraph id="H7D681F27C5CA4BBB8EB51F9C06E66446"><enum>(B)</enum><text>contains a racial or sexual slur;</text></subparagraph><subparagraph id="H1B45B19942574DD6BA07E7CEC8D14C15"><enum>(C)</enum><text>perpetuates racial, ethnic, or gender-based stereotypes; or</text></subparagraph><subparagraph id="H52579719837F4912931B899C19E36E05"><enum>(D)</enum><text>is derogatory or otherwise offensive.</text></subparagraph></paragraph><paragraph id="H029BDDA806504FC599C46C11C878C413"><enum>(6)</enum><header>Tribal organization</header><text>The term <term>Tribal organization</term> has the meaning given the term in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>).</text></paragraph><paragraph id="H32105CDA1BC344368872A123CA883540"><enum>(7)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Interior.</text></paragraph></section><section id="HE1FD72DEDE78471EAF120D3C00C06894"><enum>4.</enum><header>Advisory committee</header><subsection id="H470A6B321B0041FB86E383CFCB224CA7"><enum>(a)</enum><header>Establishment</header><text>Not later than 180 days after the date of enactment of this Act, the Secretary shall establish an advisory committee, to be known as the <quote>Advisory Committee on Reconciliation in Place Names</quote>.</text></subsection><subsection id="H15DB6C5CEA904022861EB5A2090CDB06"><enum>(b)</enum><header>Purpose</header><text>The purpose of the Committee is to advise the Board with respect to renaming geographic features with offensive place names.</text></subsection><subsection id="H60E6CAA9E0C64ECA99119A6E6B72C995"><enum>(c)</enum><header>Membership</header><text>The Committee shall be composed of 17 members, to be appointed by the Secretary, of whom, to the extent practicable—</text><paragraph id="H4AFDB202F6DA40DD963280C2942863EC"><enum>(1)</enum><text>4 members shall be members of an Indian Tribe;</text></paragraph><paragraph id="H8990AA438FD948F6B817DB2C9C48B575"><enum>(2)</enum><text>1 member shall represent a Tribal organization;</text></paragraph><paragraph id="HA11C0BEB0445405899498D03A7264573"><enum>(3)</enum><text>1 member shall represent a Native Hawaiian organization;</text></paragraph><paragraph id="H271E7AF4587B4C84942806DB8DBB2199"><enum>(4)</enum><text>4 members shall have a background in civil rights or race relations;</text></paragraph><paragraph id="HBEEA2B23BA114A02B915B20EAF3E8A03"><enum>(5)</enum><text>4 members shall have expertise in—</text><subparagraph id="HDA07F53CC9CF460D8FBEB193FED6E24C"><enum>(A)</enum><text>anthropology;</text></subparagraph><subparagraph id="H315C86B3ADC04B85B94FD2D11EFA78D9"><enum>(B)</enum><text>cultural studies, ethnic studies, or indigenous studies;</text></subparagraph><subparagraph id="HC54BF762A888406F93E385B4B2AA940D"><enum>(C)</enum><text>geography; or</text></subparagraph><subparagraph id="H088701F2E0B54B479674B0F625D66CF5"><enum>(D)</enum><text>history; and</text></subparagraph></paragraph><paragraph id="H32D9B544B6914A8F9253F78B88E22B7D"><enum>(6)</enum><text>3 members shall represent the general public.</text></paragraph></subsection><subsection id="H316D54163212423E9951B4D5653CCD4F"><enum>(d)</enum><header>Consultation with Indian Tribes</header><text>Before making an appointment under paragraph (1), (2), or (4) of subsection (c), the Secretary shall consult with Indian Tribes regarding the appointment.</text></subsection><subsection id="HACED0B100B9F4008B97FEE06F4DBCA0E"><enum>(e)</enum><header>Duties</header><text>The Committee shall—</text><paragraph id="H86304148FD3C42DEBA1ECBE7C1097A69"><enum>(1)</enum><text>establish a process to solicit and review proposals to rename geographic features and Federal land units with offensive place names;</text></paragraph><paragraph id="HBF89A8DF4ADA478C9DB59ED3B6BED39A"><enum>(2)</enum><text>solicit proposals to rename geographic features and Federal land units with offensive place names from—</text><subparagraph id="H7CEBB88E6B11474A8655EA2D6FFDFAC2"><enum>(A)</enum><text>Indian Tribes;</text></subparagraph><subparagraph id="H3918E80678E044F09164749443E359FA"><enum>(B)</enum><text>appropriate State and local governments; and</text></subparagraph><subparagraph id="H7136EB222DFF44ACA07421D9239E7F78"><enum>(C)</enum><text>members of the public;</text></subparagraph></paragraph><paragraph id="H3DF15AA130CF47E5B911F3C68C99D733"><enum>(3)</enum><text>provide an opportunity for public comment on name change proposals;</text></paragraph><paragraph id="H056EE25E0C0542FB98BAEDFE492D8A6A"><enum>(4)</enum><text>make recommendations to the Board to rename geographic features with offensive place names, including proposed new names; and</text></paragraph><paragraph id="H6275D08284BD463FB3D58068AAD24742"><enum>(5)</enum><text>make recommendations to Congress to rename Federal land units with offensive place names, including proposed new names.</text></paragraph></subsection><subsection id="H7C41C451403F483BA67C649667FDADF8"><enum>(f)</enum><header>Compensation</header><paragraph id="H11944F6C3A1248ED87BB3FE127FF348C"><enum>(1)</enum><header>In general</header><text>Members of the Committee shall serve without compensation.</text></paragraph><paragraph id="H2E544634E50B483C99D1A285B54C2731"><enum>(2)</enum><header>Travel expenses</header><text>Members of the Committee shall be allowed travel expenses, including per diem in lieu of subsistence, at rates authorized for an employee of an agency under subchapter I of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/57">chapter 57</external-xref> of title 5, United States Code, while away from the home or regular place of business of the member in the performance of the duties of the Committee.</text></paragraph></subsection><subsection id="H27AA98AB80654FBD99D7DF5FFB7BBB1D"><enum>(g)</enum><header>Staff</header><text>The Secretary shall provide the Committee with any staff members and technical assistance that the Secretary, after consultation with the Committee, determines to be appropriate to enable the Committee to carry out the duties of the Committee.</text></subsection><subsection id="HC2B9429ED9354F698FDE3F2C392CD1F2"><enum>(h)</enum><header>Rules</header><text>The Committee may adopt such rules as may be necessary.</text></subsection><subsection id="H7EC8E3BD2D7944EBB3A4FE72B4980005"><enum>(i)</enum><header>Applicable law</header><text>The Committee shall be subject to the Federal Advisory Committee Act (5 U.S.C. App.).</text></subsection><subsection id="H391D6BF887DA4F41A736118C156E26EE"><enum>(j)</enum><header>Duration</header><paragraph id="H79E299579345442AA3109B88A4C2B7B9"><enum>(1)</enum><header>Timeline</header><text>To the extent practicable, not later than 5 years after the date on which the Committee is established, the Committee shall fulfill the duties of the Committee, including the completion of the recommendations required under paragraphs (4) and (5) of subsection (e).</text></paragraph><paragraph id="H978B8429FF804ED792DDDA824625BE03"><enum>(2)</enum><header>Termination</header><text>The Committee shall terminate on the date that is 1 year after the date on which the Board has approved or rejected each Committee recommendation submitted to the Board under subsection (e)(4).</text></paragraph></subsection></section><section id="H729D935EBDC94EFC95A00A63A62CF5D9"><enum>5.</enum><header>Board review</header><subsection id="H5F7C4ABBE080449796DFED86B177977B"><enum>(a)</enum><header>In general</header><text>Not later than 3 years after the date on which the Board receives a recommendation under section 4(e)(4), the Board shall accept or reject the recommendation.</text></subsection><subsection id="H20EF4108F413408E92AE62FED32D93AC"><enum>(b)</enum><header>Process</header><text>The Board shall approve a recommendation of the Committee submitted under section 4(e)(4) unless the Board determines that—</text><paragraph id="H82B22464A761409D9D9A67E665A802BF"><enum>(1)</enum><text>there is a compelling reason and substantial public interest in rejecting the recommendation; or</text></paragraph><paragraph id="HE067A63396CC40AD9DEE9AF248292375"><enum>(2)</enum><text>approving the recommendation would violate Federal law.</text></paragraph></subsection><subsection id="HF34693708A36475794AD83501FC292D3"><enum>(c)</enum><header>Renaming</header><text>If the Board accepts a recommendation by the Committee to rename a geographic feature, the Board shall rename the geographic feature.</text></subsection><subsection id="HFF59428F57BC412AAEABF636444144C8"><enum>(d)</enum><header>Effect</header><text>A Board policy that prevents the Board from considering a name change due to pending legislation shall not apply to Board action on Committee recommendations.</text></subsection></section></legis-body></bill>
