and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To improve fairness in political speech, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Preserving Political Speech Online Act</short-title></quote>.</text></section><section id="id0826E6A9C4C0454599CE426F3CA50380"><enum>2.</enum><header>Fairness in political advertising</header><subsection id="id416CC3C7BE6D46FDB5D79787AED832E3"><enum>(a)</enum><header>In general</header><text>Not later than 120 days after the date of enactment of this section, the Commission shall initiate a rulemaking proceeding in accordance with section 553 of title 5, United States Code, to require any online platform or third party advertiser that displays, hosts, or otherwise allows the advertisement of a legally qualified candidate in an election for Federal office to abide by the following rules of fair access and equal opportunity:</text><paragraph id="id27AD9F726D30412B909BAAFDD25317B6"><enum>(1)</enum><text>Any online platform or third party advertiser who permits a legally qualified candidate in an election for Federal office to display or otherwise post an advertisement on such online platform or through such third party advertiser shall afford equal advertisement opportunities to any other legally qualified candidate for such office in such election.</text></paragraph><paragraph id="id5A06AC8C36504F95BEBAAFEB15B60E19"><enum>(2)</enum><text>Any online platform or third party advertiser shall charge comparable rates to each legally qualified candidate for any advertising service described in paragraph (1).</text></paragraph><paragraph id="id4B316C5FBA03443BAD01533216967434"><enum>(3)</enum><text>Any online platform or third party advertiser shall have no power of censorship over the content of any advertisement described in this subsection.</text></paragraph></subsection><subsection id="idE749FF1FC3DD4CC393A69F9B57ADFA8F"><enum>(b)</enum><header>Transparency requirement</header><text>An online platform shall maintain, and make available online for public inspection in a machine readable format, a complete record of any purchase of an advertising service by a legally qualified candidate on such online platform within 24 hours of such purchase.</text></subsection><subsection id="idCFDC534295144EA7AFB9BE86999A51B9"><enum>(c)</enum><header>Enforcement by the Commission</header><paragraph id="idff76b6ee6cf44f968e8fd694f969fcf0"><enum>(1)</enum><header>Unfair or deceptive acts or practices</header><text>A violation of subsection (a) or (b) or a rule promulgated thereunder shall be treated as a violation of a rule defining an unfair or a deceptive act or practice under section 18(a)(1)(B) of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/57a">15 U.S.C. 57a(a)(1)(B)</external-xref>).</text></paragraph><paragraph id="id00bcc8ec4f7a41e1af47903ca2043a32" commented="no"><enum>(2)</enum><header>Powers of the Commission</header><subparagraph id="id7c31f4efe2344b6e9202606ca24ed08c" commented="no"><enum>(A)</enum><header>In general</header><text>The Commission shall enforce this section in the same manner, by the same means, and with the same jurisdiction, powers, and duties as though all applicable terms and provisions of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/41">15 U.S.C. 41 et seq.</external-xref>) were incorporated into and made a part of this section.</text></subparagraph><subparagraph id="id7e025e97f40f4376ba337eb297ea4dc3" commented="no"><enum>(B)</enum><header>Privileges and immunities</header><text>Any person who violates subsection (a) or (b) or a rule promulgated thereunder shall be subject to the penalties and entitled to the privileges and immunities provided in the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/41">15 U.S.C. 41 et seq.</external-xref>).</text></subparagraph><subparagraph id="idbe59549474374cdc85619cb4373c078f" commented="no"><enum>(C)</enum><header>Authority preserved</header><text>Nothing in this section shall be construed to limit the authority of the Federal Trade Commission under any other provision of law.</text></subparagraph></paragraph></subsection><subsection id="idD749A695A17948989E9AB7BB25AC97F2"><enum>(d)</enum><header>Definitions</header><text>In this section:</text><paragraph id="id84A32A6AF550437695CC31806506482D"><enum>(1)</enum><header>Commission</header><text>The term <term>Commission</term> means the Federal Trade Commission.</text></paragraph><paragraph id="idF0B301C389144B2B9FBAE8E000F018EF" commented="no"><enum>(2)</enum><header>Election</header><text>The term <term>election</term> has the meaning given that term in section 301 of the Federal Election Campaign Act of 1971 (<external-xref legal-doc="usc" parsable-cite="usc/52/30101">52 U.S.C. 30101</external-xref>).</text></paragraph><paragraph id="id7232E3A61F614255B41BE11279CEEF2F" commented="no"><enum>(3)</enum><header>Federal office</header><text>The term <term>Federal office</term> has the meaning given that term in section 301 of the Federal Election Campaign Act of 1971 (<external-xref legal-doc="usc" parsable-cite="usc/52/30101">52 U.S.C. 30101</external-xref>).</text></paragraph><paragraph commented="no" id="id48E85EE681F14D1DB2BFCA66CB5B1347"><enum>(4)</enum><header>Legally qualified candidate</header><text>The term <term>legally qualified candidate</term> has the meaning given that term for purposes of section 315 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/315">47 U.S.C. 315</external-xref>).</text></paragraph><paragraph id="id840780D99B49443390A0982F7D2ADE44"><enum>(5)</enum><header>Online platform</header><text>The term <term>online platform</term> means any public-facing website, web application, or digital application, including a social network, video streaming service, advertisement network, or search engine.</text></paragraph><paragraph id="idAAA4554EAE78422083B93EDA50C1F3DC"><enum>(6)</enum><header>Third party advertiser</header><text>The term <term>third party advertiser</term> means any advertisement agency, company, or website developer that distributes or serves advertisements on an affiliated or unaffiliated online platform.</text></paragraph></subsection></section><section id="idA791D5034B90483B9380A09EEC3A3402"><enum>3.</enum><header>Application of Federal Communications Commission equal opportunity requirements to additional licensees</header><text display-inline="no-display-inline">Part I of title III of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/301">47 U.S.C. 301 et seq.</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idF290895D8DC646BEA1E2E4B358DD1CD0"><section id="id4B934DDD9CD04A678E64397042038846"><enum>344.</enum><header>Application of equal opportunity principles to licensees that serve political advertising through other means</header><text display-inline="no-display-inline">Not later than 180 days after the date of enactment of this section, the Commission shall initiate a rulemaking to apply the principles of equal opportunity under sections 312(a)(7) and 315 to any licensee that—</text><paragraph id="id12A5327BD227462F9089A5E03035C4B3"><enum>(1)</enum><text display-inline="yes-display-inline">displays, hosts, or otherwise allows the advertisement of a legally qualified candidate for any public office; and</text></paragraph><paragraph id="id2C146EAC01E14F0390605231F35CC5F3"><enum>(2)</enum><text display-inline="yes-display-inline">is not already subject to those principles under this Act or under a regulation promulgated by the Commission.</text></paragraph></section><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="idCE66DB339BAB4ACF9C0AF2218250F560"><enum>4.</enum><header>Protection for <quote>Good Samaritan</quote> blocking and screening of offensive material</header><text display-inline="no-display-inline">Section 230(c)(2) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/230">47 U.S.C. 230(c)(2)</external-xref>) is amended—</text><paragraph id="idEA3F05B9B39547CF887FE32B11D54E03"><enum>(1)</enum><text>by redesignating subparagraphs (A) and (B) as clauses (i) and (ii), respectively, and adjusting the margins accordingly;</text></paragraph><paragraph id="id0F7EFCCC8B05426C96CB6FA9BA12CB2E"><enum>(2)</enum><text>in clause (i), as so redesignated—</text><subparagraph id="id495DCA6DA63C4E198644A1587991BD28"><enum>(A)</enum><text>by striking <quote>filthy,</quote>; and</text></subparagraph><subparagraph id="id6AEFD695FC4A49AD8D4B9F41B0322C25"><enum>(B)</enum><text>by striking <quote>harassing, or otherwise objectionable, whether or not such material is constitutionally protected</quote> and inserting <quote>harassing or threatening, or promoting illegal activity</quote>;</text></subparagraph></paragraph><paragraph id="id1DF61E6C6C80448CAB1C117D7758A2E3"><enum>(3)</enum><text>in clause (ii), as so redesignated, by striking <quote>paragraph (1)</quote> and inserting <quote>clause (i)</quote>;</text></paragraph><paragraph id="id27768FEFF24549C9A03744CFC11BA8A3"><enum>(4)</enum><text>in the matter preceding clause (i), as so redesignated, by striking <quote>No provider or user</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idACB987B995ED4B8BA6B67F58C574CEB1"><subparagraph id="id2AAD55EA30BF447DAAD5A63C321CEBC9"><enum>(A)</enum><header>In general</header><text>No provider or user</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="id1A22510CC7624F59A3A810A3736527CF"><enum>(5)</enum><text>by adding at the end the following:</text><quoted-block id="idD686A51307FC49FF9262E993881755D7" display-inline="no-display-inline" style="OLC"><subparagraph id="idF70F4845E76541579800238449D8EBCB"><enum>(B)</enum><header>Prohibition of bad faith blocking and screening</header><clause id="id992d211fb86f4237a0f711957b443926"><enum>(i)</enum><header>In general</header><text>For purposes of subparagraph (A)(i), it shall not be considered good faith for a provider of an interactive computer service to block, censor, or screen material on the grounds of race, color, religion, sex, national origin, or political affiliation or speech.</text></clause><clause id="ida9fa7a25cdee457a871172fae560f781" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><header>Exception</header><text>Clause (i) shall not apply to a provider of an interactive computer service that operates services dedicated to a specific set of issues, policies, beliefs, or viewpoints.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
