which was read twice and referred to the <committee-name committee-id="SSGA00" added-display-style="italic" deleted-display-style="strikethrough">Committee on Homeland Security and Governmental Affairs</committee-name></action-desc></action><action stage="Reported-in-Senate"><action-date>May 10, 2021</action-date><action-desc>Reported by <sponsor name-id="S380">Mr. Peters</sponsor>, with an amendment</action-desc><action-instruction>Strike out all after the enacting clause and insert the part printed in italic</action-instruction></action><legis-type>A BILL</legis-type><official-title>To direct the Administrator of the Federal Emergency Management Agency to develop guidance for firefighters and other emergency response personnel on best practices to protect them from exposure to PFAS and to limit and prevent the release of PFAS into the environment, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause"><section commented="no" display-inline="no-display-inline" section-type="section-one" id="S1" changed="deleted" reported-display-style="strikethrough" committee-id="SSGA00"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Protecting Firefighters from Adverse Substances Act </short-title></quote> or the <quote><short-title>PFAS Act</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="id50B539A4333C4A8AA186AFD76A1BDD2A" changed="deleted" reported-display-style="strikethrough" committee-id="SSGA00"><enum>2.</enum><header display-inline="yes-display-inline">Guidance on how to prevent exposure to and release of PFAS</header><subsection commented="no" display-inline="no-display-inline" id="id5C76F57E724941DD8E720EABF09D1707"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of this Act, the Administrator of the Federal Emergency Management Agency, in consultation with the Administrator of the United States Fire Administration, the Administrator of the Environmental Protection Agency, the Director of the National Institute for Occupational Safety and Health, and the heads of any other relevant agencies, shall—</text><paragraph commented="no" display-inline="no-display-inline" id="id1caa790ae9f84a3586f1c2969715c790"><enum>(1)</enum><text display-inline="yes-display-inline">develop and publish guidance for firefighters and other emergency response personnel on training, education programs, and best practices to—</text><subparagraph commented="no" display-inline="no-display-inline" id="id760c87313de04fc6a903f42dcb7b7c7e"><enum>(A)</enum><text display-inline="yes-display-inline">reduce the exposure to per- and polyfluoroalkyl substances (commonly referred to as <quote>PFAS</quote>) from firefighting foam and personal protective equipment; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idaef6b299c69a4565a0a741036903a3ab"><enum>(B)</enum><text display-inline="yes-display-inline">limit or prevent the release of PFAS from firefighting foam into the environment;</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idB69A52A3AB4D4CF48D4A9C061D737CF4"><enum>(2)</enum><text display-inline="yes-display-inline">develop and issue guidance to firefighters and other emergency response personnel on alternative foams, personal protective equipment, and other firefighting tools and equipment that do not contain PFAS; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idDCBB98079BE149C4865863AE754D1990"><enum>(3)</enum><text display-inline="yes-display-inline">create an online public repository, which shall be updated on a regular basis, on tools and best practices for firefighters and other emergency response personnel to reduce, limit, and prevent the release of and exposure to PFAS.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id21F716522935403C9383B0DDC9BDA853"><enum>(b)</enum><header display-inline="yes-display-inline">Required consultation</header><text display-inline="yes-display-inline">In developing the guidance required under subsection (a), the Administrator of the Federal Emergency Management Agency shall consult with appropriate interested entities, including—</text><paragraph commented="no" display-inline="no-display-inline" id="id9835b36bc7b443d4acc651befc3fcd42"><enum>(1)</enum><text display-inline="yes-display-inline">firefighters and other emergency response personnel, including national fire service and emergency response organizations;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1d97c6b1f6d14fd7b5312c36b2fb97b9"><enum>(2)</enum><text display-inline="yes-display-inline">impacted communities dealing with PFAS contamination;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idb68484621e1d44f6807efe89a141fb17"><enum>(3)</enum><text display-inline="yes-display-inline">scientists, including public and occupational health and safety experts, who are studying PFAS and PFAS alternatives in firefighting foam;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idC5067514D1C349ED9DD819BB0C4508F8"><enum>(4)</enum><text display-inline="yes-display-inline">voluntary standards organizations engaged in developing standards for firefighter and firefighting equipment;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id160B1C548C8543388514F814922F2E2E"><enum>(5)</enum><text display-inline="yes-display-inline">State fire training academies;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idE758854DFAE14AA4BBAB275C2E7D9A92"><enum>(6)</enum><text display-inline="yes-display-inline">State fire marshals;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0b197313e3e94f2e84e52bf4a0998056"><enum>(7)</enum><text display-inline="yes-display-inline">manufacturers of firefighting tools and equipment; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0B485F8EE851441B83436B3FC034C4C6"><enum>(8)</enum><text display-inline="yes-display-inline">any other relevant entities, as determined by the Administrator of the Federal Emergency Management Agency and the Administrator of the United States Fire Administration.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id7BEF14F29FC34E5DA423BC76227D54CE"><enum>(c)</enum><header display-inline="yes-display-inline">Review of guidance</header><text display-inline="yes-display-inline">Not later than 3 years after the date on which the guidance required under subsection (a) is issued, and not less frequently than once every 2 years thereafter, the Administrator of the Federal Emergency Management Agency, in consultation with the Administrator of the United States Fire Administration, the Administrator of the Environmental Protection Agency, and the Director of the National Institute for Occupational Safety and Health, shall review the guidance and, as appropriate, issue updates to the guidance.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id3903253C13D649D88586056241E95915"><enum>(d)</enum><header display-inline="yes-display-inline">Applicability of FACA</header><text display-inline="yes-display-inline">The Federal Advisory Committee Act (5 U.S.C. App.) shall not apply to this Act.</text></subsection></section></legis-body><legis-body display-enacting-clause="no-display-enacting-clause"><section commented="no" display-inline="no-display-inline" section-type="section-one" id="idba446341-7fc4-4c88-bc5f-6de4b33b79b8" changed="added" reported-display-style="italic" committee-id="SSGA00"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Protecting Firefighters from Adverse Substances Act </short-title></quote> or the <quote><short-title>PFAS Act</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="id919f3cb5-4124-4ce7-9091-231fe722a42f" changed="added" reported-display-style="italic" committee-id="SSGA00"><enum>2.</enum><header display-inline="yes-display-inline">Guidance on how to prevent exposure to and release of PFAS</header><subsection commented="no" display-inline="no-display-inline" id="idac3dbd84-be95-4992-b6ea-1c71c7228a56"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of this Act, the Administrator of the Federal Emergency Management Agency, in consultation with the Administrator of the United States Fire Administration, the Administrator of the Environmental Protection Agency, the Director of the National Institute for Occupational Safety and Health, and the heads of any other relevant agencies, shall—</text><paragraph commented="no" display-inline="no-display-inline" id="id2d47bf92-fe35-4dff-b2d0-d0e508d1bce9"><enum>(1)</enum><text display-inline="yes-display-inline">develop and publish guidance for firefighters and other emergency response personnel on training, education programs, and best practices to—</text><subparagraph commented="no" display-inline="no-display-inline" id="idd7b8b0e0-3837-4f7a-9863-994918ee0bc1"><enum>(A)</enum><text display-inline="yes-display-inline">reduce and eliminate exposure to per- and polyfluoroalkyl substances (commonly referred to as <quote>PFAS</quote>) from firefighting foam and personal protective equipment; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id2e6c0b65-7d2e-4489-ba2e-3784b9b268f8"><enum>(B)</enum><text display-inline="yes-display-inline">prevent the release of PFAS from firefighting foam into the environment;</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3d2f402b-21c4-480d-91dd-44c916e4af35"><enum>(2)</enum><text display-inline="yes-display-inline">develop and issue guidance for firefighters and other emergency response personnel on foams and non-foam alternatives, personal protective equipment, and other firefighting tools and equipment that do not contain PFAS; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4a1a96c6-a004-4a5c-b973-d3723d391fc2"><enum>(3)</enum><text display-inline="yes-display-inline">create an online public repository, which shall be updated on a regular basis, on tools and best practices for firefighters and other emergency response personnel to reduce, limit, and prevent the release of and exposure to PFAS.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idf2fc9eaf-fbec-45aa-9728-57bd3d13178a"><enum>(b)</enum><header display-inline="yes-display-inline">Required consultation</header><text display-inline="yes-display-inline">In developing the guidance required under subsection (a), the Administrator of the Federal Emergency Management Agency shall consult with appropriate interested entities, including—</text><paragraph commented="no" display-inline="no-display-inline" id="id38b7bb44-2a66-4b05-ad14-7a067983bd65"><enum>(1)</enum><text display-inline="yes-display-inline">firefighters and other emergency response personnel, including national fire service and emergency response organizations;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ide2080805-84c4-4ad5-b797-60720afd8c3a"><enum>(2)</enum><text display-inline="yes-display-inline">impacted communities dealing with PFAS contamination;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idc319db9f-2bb9-4ac8-ba1a-74f77efb4fce"><enum>(3)</enum><text display-inline="yes-display-inline">scientists, including public and occupational health and safety experts, who are studying PFAS and PFAS alternatives in firefighting foam;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8b0b58f5-045d-4b08-899e-d6cdb0e9d741"><enum>(4)</enum><text display-inline="yes-display-inline">voluntary standards organizations engaged in developing standards for firefighter and firefighting equipment;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idffbf9ed1-5323-4915-9ee9-0c63d35973b6"><enum>(5)</enum><text display-inline="yes-display-inline">State fire training academies;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ided706e3c-b4e9-476f-98ac-67f5038136a5"><enum>(6)</enum><text display-inline="yes-display-inline">State fire marshals;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4586900c-8eee-467b-b0a0-242ebb8181de"><enum>(7)</enum><text display-inline="yes-display-inline">manufacturers of firefighting tools and equipment; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id11142801-e686-4a44-a265-1198c44941c2"><enum>(8)</enum><text display-inline="yes-display-inline">any other relevant entities, as determined by the Administrator of the Federal Emergency Management Agency and the Administrator of the United States Fire Administration.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id9770f77a-cbff-4b7b-906f-c1f2865a245a"><enum>(c)</enum><header display-inline="yes-display-inline">Review of guidance</header><text display-inline="yes-display-inline">Not later than 3 years after the date on which the guidance required under subsection (a) is issued, and not less frequently than once every 2 years thereafter, the Administrator of the Federal Emergency Management Agency, in consultation with the Administrator of the United States Fire Administration, the Administrator of the Environmental Protection Agency, and the Director of the National Institute for Occupational Safety and Health, shall review the guidance and, as appropriate, issue updates to the guidance.</text></subsection><subsection id="id6bf3b00f-8fdd-4506-919d-85dd80f03c93" commented="no" display-inline="no-display-inline"><enum>(d)</enum><header display-inline="yes-display-inline">Applicability of FACA</header><text display-inline="yes-display-inline">The Federal Advisory Committee Act (5 U.S.C.
