which was read twice and referred to the <committee-name committee-id="SSEG00">Committee on Energy and Natural Resources</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Public Utility Regulatory Policies Act of 1978 to require States to consider measures to promote greater electrification of the transportation sector, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Responsibly and Equitably Change How Auto-charging Rates Get Evaluated Act</short-title></quote> or the <quote><short-title>RECHARGE Act</short-title></quote>.</text></section><section section-type="subsequent-section" id="id82E9520E55DA47EEB9852D17EF67F5DF"><enum>2.</enum><header>Consideration of measures to promote greater electrification of the transportation sector</header><subsection id="id626EC76A026B45609B9FBC812F5E4436"><enum>(a)</enum><header>In general</header><text>Section 111(d) of the Public Utility Regulatory Policies Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/16/2621">16 U.S.C. 2621(d)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idF7457E33832449E0BCA77E205977B219"><paragraph id="id5401D189D9E4438E9CA8B7D0B6D29298"><enum>(20)</enum><header>Electric vehicle charging programs</header><text>Each State shall consider measures to promote greater electrification of the transportation sector, including the establishment of rates that—</text><subparagraph id="id92C9C6712E0F4A058EB2ED12D9475A4B"><enum>(A)</enum><text>promote affordable and equitable electric vehicle charging options for residential, commercial, and public electric vehicle charging infrastructure;</text></subparagraph><subparagraph id="idB817A4397D92463682F2AA21AEA571C7"><enum>(B)</enum><text>improve the customer experience associated with electric vehicle charging, including by reducing charging times for light-, medium-, and heavy-duty vehicles;</text></subparagraph><subparagraph id="id5C8CFF53D7DC4AD3936E78D6963769A5"><enum>(C)</enum><text>accelerate both third-party investment and investments by electric utilities in electric vehicle charging stations for light-, medium-, and heavy-duty vehicles; and</text></subparagraph><subparagraph id="idB60C42EDA3D84E879D0A36AC39C4F129"><enum>(D)</enum><text>appropriately recover the marginal costs of delivering electricity to electric vehicles and electric vehicle charging infrastructure.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id04F69CFC2DDC4942882A5AD9AF0CBB74" commented="no"><enum>(b)</enum><header>Compliance</header><paragraph id="id2BD3C263957D4C91BDAB04B52BB2B981" commented="no"><enum>(1)</enum><header>Time limitation</header><text>Section 112(b) of the Public Utility Regulatory Policies Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/16/2622">16 U.S.C. 2622(b)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id86d41640e96f43b394d40012bbf3bb20"><paragraph id="idb3867e3ca7e142e4885d041541400ba2" commented="no"><enum>(7)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="idd253109728804a0a97741ab717264125"><enum>(A)</enum><text>Not later than 1 year after the date of enactment of this paragraph, each State regulatory authority (with respect to each electric utility for which the State has ratemaking authority) and each nonregulated utility shall commence consideration under section 111, or set a hearing date for consideration, with respect to the standard established by paragraph (20) of section 111(d).</text></subparagraph><subparagraph commented="no" id="idF9B32456405440ACAEF42FE5E3E3ED79" indent="up1"><enum>(B)</enum><text>Not later than 2 years after the date of enactment of this paragraph, each State regulatory authority (with respect to each electric utility for which the State has ratemaking authority), and each nonregulated electric utility shall complete the consideration and make the determination under section 111 with respect to the standard established by paragraph (20) of section 111(d).</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="idD0B4F79EDAF346D3AB455D3618F61F5D" commented="no"><enum>(2)</enum><header>Failure to comply</header><text>Section 112(c) of the Public Utility Regulatory Policies Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/16/2622">16 U.S.C. 2622(c)</external-xref>) is amended by adding at the end the following: <quote>In the case of the standard established by paragraph (20) of section 111(d), the reference contained in this subsection to the date of enactment of this Act shall be deemed to be a reference to the date of enactment of that paragraph.</quote>.</text></paragraph><paragraph id="idA8DFA859763946F2AEB2B8BC86912D08" commented="no"><enum>(3)</enum><header>Prior State actions</header><subparagraph id="id9918714A59364A719A83A5CF474B5F49" commented="no"><enum>(A)</enum><header>In general</header><text>Section 112 of the Public Utility Regulatory Policies Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/16/2622">16 U.S.C. 2622</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id140eefc1c7e24953846c425bb26d7962"><subsection id="id0d21decf53da41e0b3acf5392f682d9f" commented="no"><enum>(g)</enum><header>Prior State actions</header><text>Subsections (b) and (c) shall not apply to the standard established by paragraph (20) of section 111(d) in the case of any electric utility in a State if, before the date of enactment of this subsection—</text><paragraph id="id2e5744fe6a6e4277be5bb7c1a40443a2" commented="no"><enum>(1)</enum><text>the State has implemented for the electric utility the standard (or a comparable standard);</text></paragraph><paragraph id="idba1147dc2cbf46c5a3dc610add16276a" commented="no"><enum>(2)</enum><text>the State regulatory authority for the State or the relevant nonregulated electric utility has conducted a proceeding to consider implementation of the standard (or a comparable standard) for the electric utility; or</text></paragraph><paragraph id="id6982c89729334717a424314e639615ee" commented="no"><enum>(3)</enum><text>the State legislature has voted on the implementation of the standard (or a comparable standard) for the electric utility during the 3-year period ending on that date of enactment.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph><subparagraph id="id28F65622D3EE42239FB465EA74BD4B89" commented="no"><enum>(B)</enum><header>Cross-reference</header><text>Section 124 of the Public Utility Regulatory Policies Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/16/2634">16 U.S.C. 2634</external-xref>) is amended—</text><clause id="id705D330EE49D4F70B3A0BAC346F4939F" commented="no"><enum>(i)</enum><text>by striking <quote>this subsection</quote> each place it appears and inserting <quote>this section</quote>; and</text></clause><clause id="id95DDF27319CB427B831446F82203D4E9" commented="no"><enum>(ii)</enum><text>by adding at the end the following: <quote>In the case of the standard established by paragraph (20) of section 111(d), the reference contained in this section to the date of enactment of this Act shall be deemed to be a reference to the date of enactment of that paragraph.</quote>.</text></clause></subparagraph></paragraph></subsection></section></legis-body></bill>
