<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>1st Session</session><legis-num>S. 2171</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20210622">June 22, 2021</action-date><action-desc><sponsor name-id="S382">Mr. Sasse</sponsor> introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To prohibit Presidential appointees from subsequently acting on behalf of the Government of the People’s Republic of China, the Chinese Communist Party, and Chinese military companies. </official-title></form><legis-body><section id="idB5A4FE50EB164E338402F07C6F75A524" section-type="section-one"><enum>1.</enum><header>Post-employment limitations on Presidential appointees with respect to the Government of the People’s Republic of China, the Chinese Communist Party, and Chinese military companies</header><text display-inline="no-display-inline">Section 207 of title 18, United States Code, is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id6CDCA8579C1D461994B7EE004353D8EC"><subsection id="id8E624B8AE6E54D6C80A8A5DB9BDC1000"><enum>(m)</enum><header>Restrictions on Presidential appointees with respect to the Government of the People’s Republic of China, the Chinese Communist Party, and Chinese military companies</header><paragraph id="id9316705D209242B79C35B7751B347098"><enum>(1)</enum><header>In general</header><text>In addition to the other restrictions set forth in this section, any person who serves in a position pursuant to an appointment made by the President and who knowingly, at any time after the termination of his or her service in the position—</text><subparagraph id="id7b81a1625fec4d499249a46cbe627e59"><enum>(A)</enum><text>represents an entity described in paragraph (2) before any officer or employee of any department or agency of the United States with the intent to influence a decision of such officer or employee in carrying out his or her official duties; or</text></subparagraph><subparagraph id="idefef3d80747c402d8b563c9ad456f240"><enum>(B)</enum><text>aids or advises an entity described in paragraph (2) with the intent to influence a decision of any officer or employee of any department or agency of the United States, in carrying out his or her official duties, </text></subparagraph><continuation-text continuation-text-level="paragraph">shall be punished as provided in section 216 of this title.</continuation-text></paragraph><paragraph id="id15E0DC0B9237474499E13A7F03A51501"><enum>(2)</enum><header>Entities</header><text>An entity described in this paragraph is any of the following:</text><subparagraph id="id7ed237fa8cef41519956023e5df42b38"><enum>(A)</enum><text>The Government of the People’s Republic of China.</text></subparagraph><subparagraph id="id0effce18c3204b6a8a32f083bfc50b91"><enum>(B)</enum><text>The Chinese Communist Party.</text></subparagraph><subparagraph id="idd0c737d07db6497193559419a3105c1f"><enum>(C)</enum><text>Any entity identified under section 1237(b) of the Strom Thurmond National Defense Authorization Act for Fiscal Year 1999 (<external-xref legal-doc="public-law" parsable-cite="pl/105/261">Public Law 105–261</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701</external-xref> note).</text></subparagraph><subparagraph id="id0972368f1a6c4fa2aa8a947f9f3af19d"><enum>(D)</enum><text>Any entity identified under section 1260H of the William M. (Mac) Thornberry National Defense Authorization Act for Fiscal Year 2021 (<external-xref legal-doc="public-law" parsable-cite="pl/116/283">Public Law 116–283</external-xref>).</text></subparagraph><subparagraph id="id478FCBF794CD4DABACE2831A5480C234"><enum>(E)</enum><text>An entity based in the People's Republic of China that is included on the entity list maintained by the Bureau of Industry and Security of the Department of Commerce and set forth in Supplement No. 4 to part 744 of title 15, Code of Federal Regulations.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
