<section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Public Engagement Opportunity on Public Land Exploration Act of 2021</short-title></quote> or the <quote><short-title>PEOPLE Act of 2021</short-title></quote>.</text></section> <section id="idCF7A88DA53154EE1ABCEF04A201987D3"><enum>2.</enum><header>Transparency and landowner protections</header> <subsection id="idc76f807534124dfca8f603ad937ab679"><enum>(a)</enum><header>Requirements for inclusion of land identified in expressions of interest in lease sales</header><text>Section 17(b) of the Mineral Leasing Act (<external-xref legal-doc="usc" parsable-cite="usc/30/226">30 U.S.C. 226(b)</external-xref>) is amended by adding at the end the following:</text>

<paragraph id="ida94eae1bbc79460194b8f68dcd1e395a"><enum>(4)</enum><header>Requirements for inclusion of land identified in expressions of interest in lease sales</header>
<subparagraph id="id6b8d6e0451fe4a2c839924ba89bf08fc"><enum>(A)</enum><header>In general</header><text>A member of the public may submit to the Secretary an expression of interest that identifies land for consideration for inclusion by the Secretary in a lease sale under this section.</text></subparagraph> <subparagraph id="idc26584a98fdc48f4aed02d899837ab31"><enum>(B)</enum><header>Inclusion of land in lease sale</header><text>Subject to the requirements of this section, the Secretary may include in a lease sale under this section the land identified under an expression of interest received by the Secretary.</text></subparagraph>
<subparagraph id="id4bc264ee419b4bc0aea77fb5335a315d"><enum>(C)</enum><header>Notification</header><text>On receipt of an expression of interest, the Secretary shall notify by certified mail, electronic mail, and electronic posting on the website of the relevant leasing or land management agency—</text> <clause commented="no" id="id7E21203B6B9A495188412D7F7A1979C8"><enum>(i)</enum><text>any owners of surface rights on land identified under the expression of interest;</text></clause>
<clause commented="no" id="id8AADCF76E48B449B8C8A38D467C779FD"><enum>(ii)</enum><text>any holders of recreational or special use permits on the land; </text></clause> <clause commented="no" id="idCA20F2FB65064FC7A4581517D79CBD87"><enum>(iii)</enum><text>any holders of grazing rights on the land; </text></clause>
<clause id="id9262ed22c51a4053ac00a0bd17023510"><enum>(iv)</enum><text>any owner of a water right the water of which originates on or flows over the land;</text></clause> <clause id="id47ca12e1b6b24133a9d468309066ed3c"><enum>(v)</enum><text>any owner of a water conveyance structure, such as a ditch, on the land; and</text></clause>
<clause id="id3e8b88006f834b3d838be3f42d896241"><enum>(vi)</enum><text>the local government with jurisdiction over the area in which the land is located. </text></clause></subparagraph> <subparagraph id="idE25B0068CC3247F2A4E5FEE3813F4B6A"><enum>(D)</enum><header>Transparency</header> <clause id="id2002380293574AB2825C7AA8AA0FA519"><enum>(i)</enum><header>In general</header><text>The Secretary shall require that each bid for a lease described in subparagraph (B) include—</text>
<subclause id="id99AD32F4710B4CB8A7296C4CAE91321A"><enum>(I)</enum><text>the name of the person or entity submitting the bid, including the name of all subsidiaries, affiliates, and entities controlled by, or under common control with, the person or entity; </text></subclause> <subclause id="id57014C527A83424F8B7926D9F9421AA0"><enum>(II)</enum><text>if an agent is submitting the bid on behalf of a person or entity, the name of the person or entity on behalf of which the agent is acting, including all subsidiaries, affiliates, and entities controlled by, or under common control with, the person or entity; and</text></subclause>
<subclause commented="no" id="idD8BE3F92E7B84EEA900708E05BCA228E"><enum>(III)</enum><text>if the person or entity submitting the bid is the person or entity that submitted the applicable expression of interest, or if an agent is submitting the bid on behalf of the person or entity that submitted the applicable expression of interest, a disclosure of that fact. </text></subclause></clause> <clause id="id2d27e67a53b84fff8743185a5f48b344"><enum>(ii)</enum><header>Publication</header><text>The Secretary shall publish on the website of the relevant leasing or land management agency each name disclosed in a bid under clause (i).</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection>
<subsection id="iddf7a75d16f194a209fb24e501a6e89bb"><enum>(b)</enum><header>Notice requirements</header><text>Section 17(f) of the Mineral Leasing Act (<external-xref legal-doc="usc" parsable-cite="usc/30/226">30 U.S.C. 226(f)</external-xref>) is amended—</text> <paragraph id="idFBCEAE765F38416D929524023BFEB44B"><enum>(1)</enum><text>in the sixth sentence, by striking <quote>The requirements</quote> and inserting the following:</text>

<paragraph id="id6E66DD7AFE4B42F7899C30D42BED2489"><enum>(6)</enum><header>Applicability of other notice requirements</header><text>The requirements</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph> <paragraph id="idA21472F6FA1146A885CE65BC6D3A9678"><enum>(2)</enum><text>in the fifth sentence, by striking <quote>Such maps</quote> and inserting the following:</text>

<paragraph id="id4286CCC9696A4EB29BDB9A1B22C975EC"><enum>(2)</enum><header>Required inclusions</header>
<subparagraph id="id79E3BFACB94C483EACAEB72688C4B78F"><enum>(A)</enum><header>In general</header><text>A notice required under paragraph (1)</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph> <paragraph id="id8B6FF19DA1744397A521C37576859AA9"><enum>(5)</enum><text>by striking <quote>(f) At least</quote> and all that follows through <quote>land management agencies.</quote> and inserting the following:</text>

<subsection id="id4391c363bf814abba836ab5c500bc146"><enum>(f)</enum><header>Notice requirements</header>
<paragraph id="id1C1571C1926E4038B6EA9D6D8DD4CD3D"><enum>(1)</enum><header>In general</header><text>Not later than 90 days before offering land for lease under this section, and not later than 30 days before approving an application for permit to drill under the provisions of a lease issued under this section, modifying the terms of any lease issued under this section, or granting a waiver, exception, or modification of any stipulation of a lease issued under this section, the Secretary shall—</text> <subparagraph id="idB165A4ED4237485298BD74145D0B28F2"><enum>(A)</enum><text>post notice in the appropriate local offices, and on the electronic websites, of the leasing and land management agencies offering the land for lease; </text></subparagraph>
<subparagraph id="idE0F23F3F42E849BCA950EB0C2B8CB6CA"><enum>(B)</enum><text>notify by certified mail and electronic mail any—</text> <clause commented="no" id="idb6a7df2bcdaa4617b8c30905cc50d7b0"><enum>(i)</enum><text>owners of surface rights on the land covered by the lease;</text></clause>
<clause id="idaa7f6493c9f142609636b7a114f2a4fb"><enum>(ii)</enum><text>holders of special recreation permits for commercial use, competitive events, or other organized activities on the land covered by the lease; </text></clause> <clause id="id4006535adb7747dd985f4caa78befbf3"><enum>(iii)</enum><text>holders of grazing rights on the land covered by the lease; </text></clause>
<clause id="ida91acac04dac46ef83a4b732a9011fe9"><enum>(iv)</enum><text>owner of a water right the water of which originates on or flows over the land;</text></clause> <clause id="id09ed7582c20e44548cf334042d6829bb"><enum>(v)</enum><text>owner of a water conveyance structure, such as a ditch, on the land; and</text></clause>
<clause id="ida356c7f533f6490cbc4422dbefe83d52"><enum>(vi)</enum><text>as applicable, members of the public who have submitted to the Secretary a request to receive notice regarding proposed actions of the Secretary applicable to—</text> <subclause id="id8F022C4EF84545E5B913037013BDDA36"><enum>(I)</enum><text>a geographic area; or</text></subclause>
<subclause id="idF6513FF017EF4876A412DC7F648E22FA"><enum>(II)</enum><text>a resource.</text></subclause></clause></subparagraph></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> <paragraph id="id4BB9CBD4615346F5BBDE0CB1C71749E7"><enum>(6)</enum><text>by inserting after paragraph (2) (as so designated) the following:</text>

<paragraph id="id4014d9b9ed774dacaf997b5cd0f87825"><enum>(3)</enum><header>Additional requirements</header>
<subparagraph id="id880eafe210e842db88e69cd395016747"><enum>(A)</enum><header>In general</header><text>Before determining the parcels to be included in a lease sale under this section, the Secretary shall provide a scoping period of not less than 30 days during which the Secretary shall provide public notice and an opportunity for comment regarding all parcels that may be included in the lease sale.</text></subparagraph> <subparagraph id="id2f4e9d6510b7451288670d1fc0d8e1c8"><enum>(B)</enum><header>Environmental analysis</header> <clause id="id278906D47FB342D6912AFD9319696C9F"><enum>(i)</enum><header>Public notice and comment</header><text>Before conducting a lease sale under this section, the Secretary, in complying with the <act-name parsable-cite="NEPA69">National Environmental Policy Act of 1969</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>), shall ensure that the public has the period of time required under that Act to comment on any environmental analysis carried out with respect to the lease sale.</text></clause>
<clause id="idE98F35446D7B46FDBD2C45736AB6EA8B"><enum>(ii)</enum><header>Requirement</header><text>The period for public comment under clause (i) shall be not less than 30 days.</text></clause></subparagraph> <subparagraph id="idf5a1759bae6d473ba265dca45c0e1255"><enum>(C)</enum><header>Requirement to conduct NEPA analysis</header> <clause id="idB69AF585CF504E2492D8AEDB44240F7D"><enum>(i)</enum><header>In general</header><text>Before conducting a lease sale under this section, the Secretary shall conduct an analysis under the <act-name parsable-cite="NEPA69">National Environmental Policy Act of 1969</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>) unless the Secretary determines that—</text>
<subclause id="id13e06037b2ca40b9a0d4369258df6411"><enum>(I)</enum><text>the proposed action is adequately covered by relevant existing analyses under that Act, such as an environmental impact statement or environmental assessment (including supporting data and records);</text></subclause> <subclause id="id0bb27b93d0f9452399eae9ebe05f390b"><enum>(II)</enum><text>the proposed action is in conformance with the relevant land use plan; and</text></subclause>
<subclause id="idfc892c52403a465d958b9a94498c98d2"><enum>(III)</enum><text>there are no new circumstances, new information, or unanticipated or unanalyzed environmental impacts that warrant new or supplemental analysis.</text></subclause></clause> <clause id="id83068fdb8ae747288a789cae6d21ca21" commented="no"><enum>(ii)</enum><header>Public notice and comment</header><text>Before making a determination under clause (i) that an analysis under the <act-name parsable-cite="NEPA69">National Environmental Policy Act of 1969</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>) is not required with respect to a lease sale under this section, the Secretary shall provide a period of public comment for that determination of not less than 30 days.</text></clause></subparagraph>
<subparagraph id="id9cbba7bf68c548f6bd59835fa2f1d135"><enum>(D)</enum><header>NEPA analysis requirements</header>
<clause id="idDA4153CEA2FA4B40B91748E6573C9368"><enum>(i)</enum><header>In general</header><text>Any analysis prepared pursuant to the <act-name parsable-cite="NEPA69">National Environmental Policy Act of 1969</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>) for a lease sale under this section shall address all parcels being considered for sale.</text></clause> <clause id="ide3959344eda44aeaaf07b02e994b65b8"><enum>(ii)</enum><header>Restriction</header><text>No parcel may be included in a lease sale under this section—</text>
<subclause id="ideda933a6ca7e44e7aa5732d8f2cdc4cc"><enum>(I)</enum><text>without compliance with—</text> <item id="id66B59646C03A4722A1315F9F2FAC0458"><enum>(aa)</enum><text>the public notice and comment requirements of this subsection; and </text></item>
<item id="id919672577E8D4739A70ED41C7EF2586F"><enum>(bb)</enum><text>the <act-name parsable-cite="NEPA69">National Environmental Policy Act of 1969</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>); and</text></item></subclause> <subclause id="id9b97976eec274ca8828b11a2a6391c76"><enum>(II)</enum><text>unless the parcel is specifically identified and considered in the analysis for that specific lease sale carried out in compliance with the <act-name parsable-cite="NEPA69">National Environmental Policy Act of 1969</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>).</text></subclause></clause></subparagraph>
<subparagraph id="id7acceba202d74e98aab8eab9d84dc463"><enum>(E)</enum><header>Surface management by another Federal agency</header><text>With respect to a parcel the surface of which is managed by another Federal agency, the parcel may not be included in a lease sale under this section without the consent of that Federal agency for that specific lease sale.</text></subparagraph> <subparagraph id="id80058fa77a5c4a8390f1bde00b9951d4"><enum>(F)</enum><header>Protests</header> <clause id="idFEB753EC214947968955B8920BF04534"><enum>(i)</enum><header>In general</header><text>Any party may file a protest regarding the inclusion of a parcel in a lease sale under this section. </text></clause>
<clause id="id7804167AE084405A8CD81FFD0E519271"><enum>(ii)</enum><header>Deadline; method of filing</header><text>A protest under clause (i)—</text> <subclause id="idED032E62C12A4ABC96A29F4832B898E7"><enum>(I)</enum><text>shall be filed by the date that is not later than 45 days after the date on which the Secretary gives notice of the lease sale under paragraph (1); and </text></subclause>
<subclause id="id99C7E8B067D24E70B3B9FD3724D28527"><enum>(II)</enum><text>may be filed by electronic mail.</text></subclause></clause></subparagraph></paragraph> <paragraph id="id5f4a325fba634a5788f7ef091b0d694d"><enum>(4)</enum><header>Local governments</header><text>Before taking any action for which notice or opportunity for comment is required under this subsection, the Secretary shall provide to local governments with jurisdiction over the area in which land covered by a proposed action is located notice and an opportunity for comment that meets or exceeds the requirements for notice and opportunity for comment under this subsection.</text></paragraph>
<paragraph id="id0cbfb6c774124b16800a83e304d88388"><enum>(5)</enum><header>Indian tribes</header>
<subparagraph id="id01a90e6fff7d4349a51b869c2861dfe6"><enum>(A)</enum><header>Definitions</header><text>In this paragraph:</text> <clause id="id60502f7f79b8471f9ca410630a58ca92"><enum>(i)</enum><header>Cultural site</header><text>The term <term>cultural site</term> means—</text>
<subclause id="id6ea3621b92a04fb2a9b3a97ff0972f1e"><enum>(I)</enum><text>a sacred site;</text></subclause> <subclause id="id683a357c21c84b6da4be4399bc41febd"><enum>(II)</enum><text>a historic property (as defined in section 800.16 of title 36, Code of Federal Regulations (as in effect on the date of enactment of the <short-title>PEOPLE Act of 2021</short-title>)); and</text></subclause>
<subclause id="id04ed9e8ece784c848e485a02a61a55bc"><enum>(III)</enum><text>a landform or landscape that—</text> <item id="iddd9cf21e0e3b4e51ab3787779f75a7d0"><enum>(aa)</enum><text>is the site of important customs, practices, objects, places, or ceremonies of Indian Tribes;</text></item>
<item id="ide43bac921a434e0083de200f0ec86b58"><enum>(bb)</enum><text>is important to an Indian Tribe for the undertaking of religious, cultural, spiritual, or traditional practices;</text></item> <item id="idde49ea65031d411c9dd9ca08586c4179"><enum>(cc)</enum><text>is connected through features or ceremonies to other sites or a larger sacred landscape; or</text></item>
<item id="id530980c7dcc9455d9f4821ccdde9a9a5"><enum>(dd)</enum><text>contains important traditional food or material gathering areas.</text></item></subclause></clause> <clause id="id497f86e6b4944aef9fe2615df6d2e38a"><enum>(ii)</enum><header>Former reservation</header><text>The term <term>former reservation</term> means land that is within the exterior boundaries of any previous reservation that was established by treaty, Executive order, or Secretarial order for an Indian Tribe.</text></clause>
<clause id="idd4c4abe9b3ab4942bd881dade6b139ab"><enum>(iii)</enum><header>Indian Tribe</header><text>The term <term>Indian Tribe</term> means an Indian tribe included on the list published by the Secretary under section 104 of the Federally Recognized Indian Tribe List Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/25/5131">25 U.S.C. 5131</external-xref>).</text></clause> <clause id="id999ca2cd816842478047f6675dee15f2"><enum>(iv)</enum><header>Interested Indian Tribe</header><text>The term <term>interested Indian Tribe</term>, with respect to land under consideration for inclusion by the Secretary in a lease sale under this section, means an Indian Tribe with—</text>
<subclause id="idda2f85f478e14e6a85a6004f5d74ce98"><enum>(I)</enum><text>historic, prehistoric, cultural, or religious connection to a cultural site located on the land;</text></subclause> <subclause id="id307eb2e51d2b4f719105061930f12911"><enum>(II)</enum><text>a former reservation located on the land; or</text></subclause>
<subclause id="id36a12d256bd64ffeb63e7a4e4079e24e"><enum>(III)</enum><text>treaty rights or other reserved rights that can be exercised on the land.</text></subclause></clause> <clause id="idf50daafa8454461a85b4377aa7198962"><enum>(v)</enum><header>Sacred site</header><text>The term <term>sacred site</term> means a specific, discrete, narrowly delineated site on land subject to leasing under this section that is identified by an Indian Tribe as sacred by virtue of the established religious significance of the site to, or ceremonial use of the site by, an Indian Tribe. </text></clause></subparagraph>
<subparagraph id="idC254B25CBF474E97AFCF995C3878A0E9"><enum>(B)</enum><header>Notice and opportunity for comment; formal consultation</header><text>Before taking any action for which notice or opportunity for comment is required under this subsection, the Secretary shall—</text> <clause id="idaca6a0e6385a48c29e576ad41dfb345f"><enum>(i)</enum><text>provide any interested Indian Tribe notice and an opportunity for comment that meets or exceeds the requirements for notice and opportunity for comment under this subsection; and</text></clause>
<clause id="id52e8df78f3ba4b30b3598e833448e185"><enum>(ii)</enum><text>at the request of any interested Indian Tribe, initiate formal consultation with the interested Indian Tribe regarding the proposed action.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> <subsection id="id150df4f0832d4fbcbd6f6474ff4d6eeb"><enum>(c)</enum><header>Surface estate owner protection</header><text>Section 17 of the Mineral Leasing Act (<external-xref legal-doc="usc" parsable-cite="usc/30/226">30 U.S.C. 226</external-xref>) is amended by adding at the end the following:</text>

<subsection id="id94b1f635ee764a96a8ae93148611a51c"><enum>(q)</enum><header>Surface estate owner protection</header>
<paragraph id="id9E104DAFFBD14BAFA759626F662585C8"><enum>(1)</enum><header>Definition of covered land</header><text>In this subsection, the term <term>covered land</term> means land subject to a lease under this section—</text> <subparagraph id="id19A425A56C0F491180C5BD87123C8AEB"><enum>(A)</enum><text>the title to the oil and gas resources of which is held by the United States; but </text></subparagraph>
<subparagraph id="id6FA5A6195E664B158A43AA2F27A51838"><enum>(B)</enum><text>the title to the surface estate of which is not held by the United States.</text></subparagraph></paragraph> <paragraph id="id54803c10c6ab46e4981971ffdfe319a8"><enum>(2)</enum><header>Post-lease surface use agreement</header> <subparagraph id="id1a454e1ad2ef4b13aca2fd3e9a3a05d5"><enum>(A)</enum><header>In general</header><text>Except as provided in paragraph (3), the Secretary shall not authorize any operator to conduct exploration and drilling operations on covered land until the operator files with the Secretary a document, signed by the operator and the 1 or more surface estate owners, demonstrating that the operator has secured a written surface use agreement between the operator and the 1 or more surface estate owners that meets the requirements of subparagraph (B).</text></subparagraph>
<subparagraph id="id5f60048f940e43f6893c14d72775d407"><enum>(B)</enum><header>Contents</header><text>The surface use agreement under subparagraph (A) shall provide for—</text> <clause id="idc08836e85fa543a1b0c76fc6e138ea91"><enum>(i)</enum><text>the use by the operator of only such portion of the surface estate as is reasonably necessary for exploration and drilling operations based on site-specific conditions;</text></clause>
<clause id="id12a66d05ec7445f181e332b9ca8683d3"><enum>(ii)</enum><text>the accommodation of the surface estate owner to the maximum extent practicable, including the location, use, timing, and type of exploration and drilling operations, consistent with the right of the operator to develop the oil and gas estate;</text></clause> <clause id="idc367a084e268478ea7bd13cad29be131"><enum>(iii)</enum><text>placement, specifications, maintenance, and design of well pads, gathering pipelines, and roads to be constructed for oil and gas operations, to the extent known;</text></clause>
<clause id="id3591b00ad62342aca5187066724b14cf"><enum>(iv)</enum><text>terms of ingress and egress on the surface of the land for oil and gas operations;</text></clause> <clause id="id1600a4a1e70943bba15889d6b9b978f0"><enum>(v)</enum><text>construction, maintenance, and placement of all pits and equipment used or planned for oil and gas operations, to the extent known;</text></clause>
<clause id="id43c7979904fd4f0cbb0d1701994fcadf"><enum>(vi)</enum><text>use and impoundment of water on the surface of the land;</text></clause> <clause id="id0fe61b78306245f2a792f74aeb101f8c"><enum>(vii)</enum><text>removal and restoration of plant life;</text></clause>
<clause id="id34953e3229b3415a86bff6d9c5118074"><enum>(viii)</enum><text>surface water drainage changes;</text></clause> <clause id="idd1415ce327c14d03a3f794c53a4d1d31"><enum>(ix)</enum><text>actions to limit and effectively control precipitation runoff and erosion;</text></clause>
<clause id="id6df3a7cb277447ce8e53b92f6063a894"><enum>(x)</enum><text>control and management of noise, weeds, dust, traffic, trespass, litter, and interference with the use of the surface estate owner;</text></clause> <clause id="id24a9e486432349de837c9f5fc8b3ad86"><enum>(xi)</enum><text>operator indemnification for injury to persons caused by the operator or a subcontractor or agent of the operator;</text></clause>
<clause id="id532a4af99d0a4c87b69a0b5602236764"><enum>(xii)</enum><text>the reclamation of the site to a condition capable of supporting the uses that the land was capable of supporting prior to exploration and drilling operations; and</text></clause> <clause id="idbd80e42e57664a00bcd2d6afc9196708"><enum>(xiii)</enum><text>compensation for damages resulting from exploration and drilling operations, including—</text>
<subclause id="id0552f224e39844269e8383b423a70eab"><enum>(I)</enum><text>loss of income and increased costs incurred;</text></subclause> <subclause id="id7E110F621C9F4A29BDB79884DF7C2714"><enum>(II)</enum><text>groundwater contamination and negative impacts to air quality;</text></subclause>
<subclause id="idd8e6218621f34beda7198f621e91da85"><enum>(III)</enum><text>damage to, or destruction of, personal property, including crops, forage, and livestock; and</text></subclause> <subclause id="id197eac1256334ef0804794235edd397e"><enum>(IV)</enum><text>failure to reclaim the site in accordance with clause (xii).</text></subclause></clause></subparagraph>
<subparagraph id="id14afa270f97b4a60a3d7657a7af0536d"><enum>(C)</enum><header>Procedure</header>
<clause id="id95752a82988748b2b75dbc62dedfa9db"><enum>(i)</enum><header>Notice of intent to enter into agreement</header><text>An operator shall notify the 1 or more surface estate owners of the desire of the operator to conclude an agreement under this paragraph by certified mail or electronic mail. </text></clause> <clause id="id0991850896724F6FA19A45540D3EE37F"><enum>(ii)</enum><header>Arbitration</header> <subclause id="id388F037022D34C8EB3F29855AAEC7777"><enum>(I)</enum><header>In general</header><text>If the surface estate owner and the operator do not reach an agreement under clause (i) by the date that is 90 days after the date on which the operator provides notice under that clause, the operator may submit the matter to third-party arbitration.</text></subclause>
<subclause id="id2DB365405D2543CDBBABF922A1F8ABA0"><enum>(II)</enum><header>Deadline for arbitration</header><text>An arbitration under subclause (I) shall be concluded within a period of 90 days. </text></subclause> <subclause id="id5566526A045A4C88B13F44D05CEE8B4E"><enum>(III)</enum><header>Cost</header><text>The cost of an arbitration under subclause (I) shall be the responsibility of the operator.</text></subclause>
<subclause id="idf660d320bb0c4e6da26acbbc00dc7e30"><enum>(IV)</enum><header>List of arbitrators</header><text>The Secretary shall make publicly available a list of persons who are qualified to arbitrate disputes under this clause.</text></subclause> <subclause id="id11b2a6584b24489b8982292c54ad7249"><enum>(V)</enum><header>Qualifications of arbitrators</header><text>In order to arbitrate a dispute under this clause, an arbitrator shall meet the minimum qualification criteria of the American Arbitration Association, including—</text>
<item id="id54f8d1764192484689f3a1d3416e7d05"><enum>(aa)</enum><text>a minimum of 10 years of senior-level business or professional experience or legal practice;</text></item> <item id="id0b99ba5ae2a9478da2a437d22a90d179"><enum>(bb)</enum><text>an educational degree or professional licenses appropriate to the oil and gas industry;</text></item>
<item id="idc044cedadc6043b982ea6a1ba4b55579"><enum>(cc)</enum><text>training or experience in arbitration or other forms of dispute resolution; and</text></item> <item id="id039a230bef3e4df6b171031e95df62a9"><enum>(dd)</enum><text>membership in relevant professional associations.</text></item></subclause>
<subclause id="ide35da3ae6160448ab8e23ee05028ac9b"><enum>(VI)</enum><header>Referral</header><text>Referral of a matter for arbitration by an operator to an arbitrator identified by the Secretary pursuant to subclause (IV) shall be sufficient to constitute compliance with subclause (V).</text></subclause></clause></subparagraph></paragraph> <paragraph id="id7baed643788147b3a3ef139a14c56d42"><enum>(3)</enum><header>Authorized exploration and drilling operations</header> <subparagraph id="id3aac9ddbf9ab40fd91e8ff5861ef9d7f"><enum>(A)</enum><header>Authorization without surface use agreement</header> <clause id="idCAF9D0CBA6E140308999B0F84EF01B0D"><enum>(i)</enum><header>In general</header><text>The Secretary may authorize an operator to conduct exploration and drilling operations on covered land without first securing a surface use agreement in accordance with paragraph (2), if—</text>
<subclause id="id6902da84bac54de29a932e554e80d684"><enum>(I)</enum><text>the Secretary makes a determination in writing that—</text> <item id="idEB24132385C84952A702D60C2F73FCB2"><enum>(aa)</enum><text>the operator made a good faith attempt to conclude such an agreement, including by submitting the matter to arbitration in accordance with subclause (I) of paragraph (2)(C)(ii); but</text></item>
<item id="id11EB53A5B02D4A97AE33F5F81AB6519B"><enum>(bb)</enum><text>an agreement was not concluded by the deadline under subclause (I) or (II), as applicable, of that paragraph;</text></item></subclause> <subclause id="id6589ef9a6605438eac2088a2b66cee71"><enum>(II)</enum><text>the operator submits a plan of operations that provides for—</text>
<item id="id5F28772B83C5465CA3EFD7CB607B9658"><enum>(aa)</enum><text>the matters described in paragraph (2)(B); and </text></item> <item id="id436D2568F8664FD8BF62E4B3DB52EA66"><enum>(bb)</enum><text>compliance with all other applicable requirements of Federal and State law; and</text></item></subclause>
<subclause id="id08a32b99cfa64300857fd1bfc92d9c8a"><enum>(III)</enum><text>the operator posts a bond or other financial assurance in the form of a surety bond, trust fund, letter of credit, government security, certificate of deposit, cash, or equivalent in an amount the Secretary determines to be adequate to ensure compensation to the 1 or more surface estate owners for any damages to, or reclamation of, the site.</text></subclause></clause> <clause id="id42E74F6F2F4D4C4892D97D8CE983D4F3"><enum>(ii)</enum><header>Limitation</header><text>Self-bonding shall not be an acceptable form of financial assurance under clause (i)(III). </text></clause></subparagraph>
<subparagraph id="idb5b7d852a6a84d0ea8ba9a2d5fc7a81a"><enum>(B)</enum><header>Surface estate owner participation</header><text>In addition to any participation opportunities provided to members of the public under this section, with respect to a lease issued under this section for covered land, the Secretary shall provide surface estate owners with—</text> <clause commented="no" id="idb3889312cbfe4307bef25b7339022594"><enum>(i)</enum><text>before authorizing an operator to conduct exploration and drilling operations on the covered land, a period of not less than 30 days to comment on the plans of operations of the operator;</text></clause>
<clause id="idf0ed7aea69494422b0ccbf1bae1fbae1"><enum>(ii)</enum><text>an opportunity to participate in bond level determinations and bond release proceedings under subsection (g);</text></clause> <clause id="id73803FF403EC4552B997A215A0BD354A"><enum>(iii)</enum><text>an opportunity to attend any onsite inspection carried out for the purpose of a determination or proceeding under clause (ii);</text></clause>
<clause id="id6cd6b2e404794cd1bbc40c6db3db37be"><enum>(iv)</enum><text>an opportunity to file written objections to a proposed bond release; and</text></clause> <clause id="idd4f16f2f31b74cbba2f56303eaa46ce7"><enum>(v)</enum><text>an opportunity to request and participate in an onsite inspection if the surface estate owner has reason to believe there is a violation of the terms and conditions of the plan of operations of the operator.</text></clause></subparagraph>
<subparagraph id="id2ddc612793444f528eca921a478e4cc3"><enum>(C)</enum><header>Payment of financial guarantee</header>
<clause id="id7063789BBB20431C939DC0FCA5722600"><enum>(i)</enum><header>In general</header><text>The owner of the surface estate of covered land subject to a lease issued under this section may petition the Secretary for payment of all or any portion of a bond or other financial assurance required under subsection (g) as compensation for any damages resulting from exploration and drilling operations pursuant to the lease.</text></clause> <clause commented="no" id="idD7E6D1D17F114FBC8AAAAC13587A5347"><enum>(ii)</enum><header>Form of compensation</header><text>If the Secretary approves the petition under clause (i), the Secretary may use the bond or other financial assurance referred to in that clause to provide compensation to the surface estate owner for the damages described in the petition.</text></clause></subparagraph></paragraph>
<paragraph id="idadac262736084206b73e36f945f9b124"><enum>(4)</enum><header>Surface estate owner notification</header><text>In addition to any notice provided to members of the public under this section, with respect to a lease of covered land under this section, the Secretary shall notify the 1 or more surface estate owners by certified mail, electronic mail, and electronic posting on the website of the relevant leasing or land management agency—</text> <subparagraph commented="no" id="id46c6bb97cd564808aa9a6aabdce6fe30"><enum>(A)</enum><text>of the lease sale by not later than 90 days before conducting the lease sale;</text></subparagraph>
<subparagraph id="idc331290921534362a53adb8e51c869f2"><enum>(B)</enum><text>of the identity and address of the lessee by not later than 10 business days after the lease is issued;</text></subparagraph> <subparagraph id="idc9ab427206ba4d6c914c264c0cf832e3"><enum>(C)</enum><text>of any subsequent request or decision regarding the lease, including any request or decision to modify the lease, waive a stipulation, or approve a right of way, by not later than 5 business days after the Secretary receives the request or makes the decision; and</text></subparagraph>
<subparagraph id="idb0c0dbab21d14785bc9df71e83ed09eb"><enum>(D)</enum><text>of any issuance of a permit to drill under the lease, by not later than 5 business days after issuance of the permit.</text></subparagraph></paragraph> <paragraph id="ided402bbe0b4d476aa05f4c3e5e87b22e"><enum>(5)</enum><header>Bonds or financial assurances</header> <subparagraph id="id43dff0483ce34200b2ac64009988643b"><enum>(A)</enum><header>In general</header><text>With respect to a lease of covered land under this section, the Secretary shall notify the 1 or more surface estate owners by certified mail, electronic mail, and electronic posting on the website of the relevant leasing or land management agency by not later than 30 days before establishing or releasing a bond or other financial assurance under subsection (g).</text></subparagraph>
<subparagraph id="id2689b1de8cfa46d6bfdfe25925547001"><enum>(B)</enum><header>Objections</header><text>If a surface estate owner objects to the amount of the bond or other financial assurance to be required for a lease of covered land, the Secretary shall respond in writing to the objections of the surface estate owner, including a description of the rationale for the amount.</text></subparagraph> <subparagraph id="id5a74174cc35744d284d7fb0bcbfef9a2"><enum>(C)</enum><header>Release of bond of other financial assurance</header><text>The Secretary may release the bond or other financial assurance required for a lease of covered land only if—</text>
<clause id="id310b274eb624427389d23c60bf6e7698"><enum>(i)</enum><text>the Secretary determines that compensation for damages has been paid in accordance with, as applicable—</text> <subclause id="id0E019A71180C44C3B46112E980595C32"><enum>(I)</enum><text>the terms of the surface use agreement under paragraph (2)(B)(xiii); or</text></subclause>
<subclause id="id2C283FC783114840AC6E7EDA5920D299"><enum>(II)</enum><text>the determination of the Secretary under paragraph (3)(A)(iii);</text></subclause></clause> <clause id="idc4e39be2d1ec4f0c8deb9daa635986b3"><enum>(ii)</enum><text>the surface estate owner and the operator have executed, and submitted to the Secretary, a surface use and compensation agreement providing that the bond or other financial assurance should be released;</text></clause>
<clause id="idb8d24d26a58c45ef98284750bd1f0f84"><enum>(iii)</enum><text>the Secretary determines that—</text> <subclause id="idB7B551C26F3D48DBBE78AC31D4C5F331"><enum>(I)</enum><text>there has been a final resolution of any action for damages; and </text></subclause>
<subclause id="idF2393BF5711E483B95C63766C08F44BA"><enum>(II)</enum><text>any damages awarded pursuant to that action have been paid; or</text></subclause></clause> <clause id="ide45c26875ef640e59a3a4a32d8862913"><enum>(iv)</enum><text>the Secretary determines that—</text>
<subclause id="idD6B1189BADB74A6290C903DFEF9144C6"><enum>(I)</enum><text>all wells on the covered land have been plugged and abandoned; and </text></subclause> <subclause id="id835FC45139D748FA85E3BD7C766EC193"><enum>(II)</enum><text>the operator has not conducted oil and gas operations on the covered land for a period of not less than 6 years.</text></subclause></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section>
