<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>1st Session</session><legis-num>S. 2152</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20210621">June 21, 2021</action-date><action-desc><sponsor name-id="S409">Mr. Luján</sponsor> introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To direct the Federal Communications Commission to promulgate regulations requiring material in the online public inspection file of a covered entity to be made available in a format that is machine-readable.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="HC2DC5F72F51F4B5BA087081FF9726580"><section section-type="section-one" id="H14CF7C82E15944DC86FF758CA8AB89ED"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Fair and Clear Campaign Transparency Act</short-title></quote>.</text></section><section id="HA4E91C499C8E45298AAD4755BAD8C4E5"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text><paragraph id="H79778BDDD2D543179CDB046B80E46E48"><enum>(1)</enum><text>On May 9, 2013, President Barack Obama issued Executive Order 13642 (78 Fed. Reg. 28111 (May 14, 2013)), which made open and machine-readable data the new default for Federal Government information.</text></paragraph><paragraph id="HA087618125A943518A0B1E30A6E16EE7"><enum>(2)</enum><text>Open data principles are essential for transparency and efficiency in government.</text></paragraph><paragraph id="HB245FD1181424B15B2CABAD60B62A838"><enum>(3)</enum><text display-inline="yes-display-inline">In 2012, the Federal Communications Commission required television broadcast stations to post on an online database hosted by the Commission certain materials in the files that those stations are required to maintain and make available for public inspection, including important information about the purchasing of political advertisements. In 2016, the Commission extended the online public inspection file requirement to providers of cable and satellite television service, radio broadcast stations, and providers of satellite radio service.</text></paragraph><paragraph id="HEC19BC14A303480EA4F1D6729E4C746D"><enum>(4)</enum><text>The Commission declined to require those materials to be machine-readable, deciding at the time that it was more important to get the information online faster.</text></paragraph><paragraph id="H4B1BC4F815524EE2AC57B93A5D318FA8"><enum>(5)</enum><text>Machine readability is a critical component of open government and provides interested parties with the necessary access to evaluate data in a more comprehensive way.</text></paragraph></section><section id="H5EB53D8352D74E2CB46ED2DC8835DB1B"><enum>3.</enum><header>Material in online public inspection file required to be in machine-readable format</header><subsection id="H134E02D07B5243149DDECE2D051615E4"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H3DB042ADE5A6408CAF9F3C434E562E47"><enum>(1)</enum><header>Commission</header><text>The term <term>Commission</term> means the Federal Communications Commission.</text></paragraph><paragraph id="HE18C6F9323F74B39B2F2A332623EDBDA"><enum>(2)</enum><header>Covered entity</header><text display-inline="yes-display-inline">The term <term>covered entity</term> means a full-powered television broadcast station, class A television system, AM or FM radio broadcast station, cable operator, direct broadcast satellite service provider, satellite digital audio radio service provider, or any other entity to which an online public inspection file requirement applies.</text></paragraph><paragraph commented="no" id="H123185AC36A24E2C8D7DFB3CF841E2BE"><enum>(3)</enum><header>Machine-readable</header><text>The term <term>machine-readable</term> means, with respect to the format of material in a public inspection file, that the format supports—</text><subparagraph commented="no" id="idCAE37448A6484ADC8F1046C8F17E16C2"><enum>(A)</enum><text>the automated searching for particular text within and among documents;</text></subparagraph><subparagraph commented="no" id="idCFE6DCBD5A484D9D86DA1BCC7D6C9165"><enum>(B)</enum><text>the bulk downloading of data contained in the material;</text></subparagraph><subparagraph commented="no" id="idD67C039F00A3459594A08EC5758EAB6D"><enum>(C)</enum><text>the aggregation, manipulation, sorting, and analysis of the data contained in the material; and</text></subparagraph><subparagraph commented="no" id="id2EA472D860E14207815E3E65E1A853E9"><enum>(D)</enum><text>any other functionality that the Commission considers appropriate.</text></subparagraph></paragraph><paragraph id="HBB300C1C9A6B41798F8C2EAD4D164B63"><enum>(4)</enum><header>Online public inspection file requirement</header><text display-inline="yes-display-inline">The term <term>online public inspection file requirement</term> means a requirement for a covered entity to make material in the public inspection file of the entity available on, or upload the material to, the online public file database hosted by the Commission.</text></paragraph><paragraph id="H5E95C51D26D942B68AC5861DB16F656A"><enum>(5)</enum><header>Political file</header><text>The term <term>political file</term> means, with respect to a covered entity, the file that the entity is required to maintain and make available for public inspection under section 315(e) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/315">47 U.S.C. 315(e)</external-xref>) or under any similar requirement applicable to the entity that is administered by the Commission.</text></paragraph><paragraph id="H02055ACE2A3747FDABB64B9CA51C5CCE"><enum>(6)</enum><header>Public inspection file</header><text>The term <term>public inspection file</term>, with respect to a covered entity—</text><subparagraph id="H4F32000C9C2E4D7CB21C9F5996440D97"><enum>(A)</enum><text display-inline="yes-display-inline">means the file or files that the entity is required to maintain and make available for public inspection under section 25.701, 25.702, 73.3526, 73.3527, or 76.1700 of title 47, Code of Federal Regulations (or any successor regulation), as applicable to the entity, or under any similar requirement applicable to the entity that is administered by the Commission; and</text></subparagraph><subparagraph id="HFE2B3B2334C749BFABB2E88D0E934E0D" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text>includes any political file that the entity is required to maintain and make available for public inspection.</text></subparagraph></paragraph></subsection><subsection id="HF6BAA10844FB4A0FB6E112A507798ADC"><enum>(b)</enum><header>Regulations</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of this Act, the Commission shall promulgate regulations that require a covered entity, to the extent that the entity is required to make material in the public inspection file of the entity available on, or upload the material to, the online public file database hosted by the Commission, to make the material available or upload the material in a format that is machine-readable.</text></subsection><subsection id="HC459406CD68747D18DE36F9B80BABB99"><enum>(c)</enum><header>Applicability</header><paragraph id="id9765F96129D7467895AA73BDDF75F127"><enum>(1)</enum><header>Covered entities</header><subparagraph id="id9C6B5B009A714284B67D2D9F87879CA7"><enum>(A)</enum><header>In general</header><text>Except as provided in subparagraph (B), the regulations promulgated under subsection (b) shall apply—</text><clause id="HC975E4208D0F412BAF92FB426F15A1B5"><enum>(i)</enum><text display-inline="yes-display-inline">to a covered entity for which an online public inspection file requirement is in effect on the date of the promulgation of such regulations—</text><subclause id="HE46062687A034C23A239BE54FF70CD7E"><enum>(I)</enum><text display-inline="yes-display-inline">with respect to the political file portion of the public inspection file, beginning not later than the date that is 60 days after the date of such promulgation; and</text></subclause><subclause commented="no" id="H47FFD4B354504788B5AEB1BCDB956585"><enum>(II)</enum><text>with respect to the other portions of the public inspection file, at the same time as the regulations apply under subclause (I) with respect to the political file portion of the public inspection file or as soon thereafter as the Commission considers practicable; and</text></subclause></clause><clause commented="no" id="HF9B4B8A4A3594EC0AAE2652EA5003B90"><enum>(ii)</enum><text display-inline="yes-display-inline">to a covered entity for which an online public inspection file requirement becomes effective after the date of the promulgation of the regulations—</text><subclause commented="no" id="H96EF60F952BB4C84BA7C22AB6031649C"><enum>(I)</enum><text display-inline="yes-display-inline">with respect to the political file portion of the public inspection file, beginning on the later of—</text><item commented="no" id="H029D03D2E0F04E088B3C1CAFEA57EF75"><enum>(aa)</enum><text>the date of applicability of the regulations under clause (i)(I); or</text></item><item commented="no" id="HE8E3A240A3B14C86A38F00C635370AD9"><enum>(bb)</enum><text display-inline="yes-display-inline">the date on which the online public inspection file requirement becomes effective for the entity; and</text></item></subclause><subclause commented="no" id="H6A8D342D78714CE4A6CD56A00AA5CDB1"><enum>(II)</enum><text display-inline="yes-display-inline">with respect to the other portions of the public inspection file, at the same time as the regulations apply under subclause (I) with respect to the political file portion of the public inspection file or as soon thereafter as the Commission considers practicable.</text></subclause></clause></subparagraph><subparagraph commented="no" id="id94D8C878FA544A7DA7980F6CD4791CBA"><enum>(B)</enum><header>Extensions for good cause</header><text>The Commission may extend a deadline under subparagraph (A) for a specific covered entity or a group of covered entities for good cause.</text></subparagraph></paragraph><paragraph commented="no" id="id639D5BB0D23A4D00A21C6748C62BC569"><enum>(2)</enum><header>New material only</header><text>The regulations promulgated under subsection (b) shall apply only to material in the public inspection file of a covered entity that is newly generated on or after the date of the promulgation of the regulations.</text></paragraph></subsection></section></legis-body></bill>
