<section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>International Cy­ber­crime Prevention Act</short-title></quote>.</text></section> <section id="id600c88a9-2998-4bd5-8598-11c270248e94" changed="not-changed"><enum>2.</enum><header>Predicate offenses</header><text display-inline="no-display-inline">Part I of title 18, United States Code, is amended—</text>
<paragraph id="ida110ab36-b78f-43a1-ab85-ca9627091739" changed="not-changed"><enum>(1)</enum><text>in section 1956(c)(7)(D)—</text> <subparagraph id="idc15ee002-cf62-44fa-99a5-4b151c0b74ac" changed="not-changed"><enum>(A)</enum><text>by striking <quote>or section 2339D</quote> and inserting <quote>section 2339D</quote>; and</text></subparagraph>
<subparagraph id="idb482401b-0e87-483b-89f9-8c505a6d90ce" changed="not-changed"><enum>(B)</enum><text>by striking <quote>of this title, section 46502</quote> and inserting <quote>, or section 2512 (relating to the manufacture, distribution, possession, and advertising of wire, oral, or electronic communication intercepting devices) of this title, section 46502</quote>; and</text></subparagraph></paragraph> <paragraph id="id9117530e-3a95-4fc4-9783-54d5359b7de2" changed="not-changed"><enum>(2)</enum><text>in section 1961(1), by inserting <quote>section 1030 (relating to fraud and related activity in connection with computers) if the act indictable under section 1030 is felonious,</quote> before <quote>section 1084</quote>.</text></paragraph></section>
<section id="id639b5347-6e5b-439f-81fa-40728273bc56" changed="not-changed"><enum>3.</enum><header>Forfeiture</header>
<subsection id="idb75fc121-556d-4287-a7a5-d100beadc147" changed="not-changed"><enum>(a)</enum><header>In general</header><text>Section 2513 of title 18, United States Code, is amended to read as follows:</text> <quoted-block changed="not-changed" display-inline="no-display-inline" id="id784e320c-a91c-4268-91fa-8083a80d9878" style="USC"> <section id="id3e240a25-b85d-41f1-b4d0-78e1c5df6638" changed="not-changed"><enum>2513.</enum><header>Confiscation of wire, oral, or electronic communication intercepting devices and other property</header> <subsection id="idb7b953cd-5046-4640-a010-577b36f1e5f7" changed="not-changed"><enum>(a)</enum><header>Criminal forfeiture</header> <paragraph id="id2498a16c-76e8-49f8-af18-dd03b069bd73" changed="not-changed"><enum>(1)</enum><header>In general</header><text>The court, in imposing a sentence on any person convicted of a violation of section 2511 or 2512, or convicted of conspiracy to violate section 2511 or 2512, shall order, in addition to any other sentence imposed and irrespective of any provision of State law, that such person forfeit to the United States—</text>
<subparagraph id="id7ec51bf5-e94c-4a27-b7d2-6f2383240eb8" changed="not-changed"><enum>(A)</enum><text>such person’s interest in any property, real or personal, that was used or intended to be used to commit or to facilitate the commission of such violation; and</text></subparagraph> <subparagraph id="idd066d1c4-3839-4334-866a-f4205f6b54a8" changed="not-changed"><enum>(B)</enum><text>any property, real or personal, constituting or derived from any gross proceeds, or any property traceable to such property, that such person obtained or retained directly or indirectly as a result of such violation.</text></subparagraph></paragraph>
<paragraph id="id58d3aa71-37e4-48cb-a1f1-bbad09b4929f" changed="not-changed"><enum>(2)</enum><header>Forfeiture procedures</header><text>Pursuant to section 2461(c) of title 28, the provisions of section 413 of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/853">21 U.S.C. 853</external-xref>), other than subsection (d) thereof, shall apply to criminal forfeitures under this subsection.</text></paragraph></subsection> <subsection id="id0f54d692-5381-4620-94b2-4195492d19f0" changed="not-changed"><enum>(b)</enum><header>Civil forfeiture</header> <paragraph id="ide75eed0f-d414-43c3-ae3d-6e263f577f44" changed="not-changed"><enum>(1)</enum><header>In general</header><text>The following shall be subject to forfeiture to the United States in accordance with provisions of chapter 46, and no property right shall exist in them:</text>
<subparagraph id="id8abff043-f040-4a26-a75c-ed968e68d7ab" changed="not-changed"><enum>(A)</enum><text>Any property, real or personal, used or intended to be used, in any manner, to commit, or facilitate the commission of a violation of section 2511 or 2512, or a conspiracy to violate section 2511 or 2512.</text></subparagraph> <subparagraph id="ide9c85a11-4c18-441d-a259-e63781fb9304" changed="not-changed"><enum>(B)</enum><text>Any property, real or personal, constituting, or traceable to the gross proceeds taken, obtained, or retained in connection with or as a result of a violation of section 2511 or 2512, or a conspiracy to violate section 2511 or 2512.</text></subparagraph></paragraph>
<paragraph id="ideecca9e5-724a-436e-a169-8bde9f54a1d4" changed="not-changed"><enum>(2)</enum><header>Forfeiture procedures</header><text>Seizures and forfeitures under this subsection shall be governed by the provisions of chapter 46, relating to civil forfeitures, except that such duties as are imposed on the Secretary of the Treasury under the customs laws described in section 981(d) shall be performed by such officers, agents, and other persons as may be designated for that purpose by the Secretary of Homeland Security or the Attorney General.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="id581864dd-687b-4557-a684-421cd1e7b366" changed="not-changed"><enum>(b)</enum><header>Technical and conforming amendment</header><text>The table of sections for chapter 119 is amended by striking the item relating to section 2513 and inserting the following:</text>

<section id="id88a47fca-cbd4-4dbd-957e-56f3963d1777" changed="not-changed"><enum>4.</enum><header>Shutting down botnets</header>
<subsection id="id2c5b6bfb-3e4b-4e15-95fd-9fe7f151ada0" changed="not-changed"><enum>(a)</enum><header>Amendment</header><text>Section 1345 of title 18, United States Code, is amended—</text> <paragraph id="id6dbe3a61-ed03-4a0d-b4e7-8a54c2ed0922" changed="not-changed"><enum>(1)</enum><text>in the heading, by inserting <quote><header-in-text level="section" style="USC">and abuse</header-in-text></quote> after <quote><header-in-text level="section" style="USC">fraud</header-in-text></quote>;</text></paragraph>
<paragraph id="id1c9fa159-5f3a-4d4a-bb0c-9fd6e19da64b" changed="not-changed"><enum>(2)</enum><text>in subsection (a)—</text> <subparagraph id="id8db99379-ffc7-4d1e-8375-6b572a8711f0" changed="not-changed"><enum>(A)</enum><text>in paragraph (1)—</text>
<clause id="id5e2c404b-95f8-4d23-9948-3cde44c7436a" changed="not-changed"><enum>(i)</enum><text>in subparagraph (B), by striking <quote>or</quote> at the end;</text></clause> <clause id="id7ed8f3c9-ae52-41eb-90bc-109f85edec85" changed="not-changed"><enum>(ii)</enum><text>in subparagraph (C), by inserting <quote>or</quote> after the semicolon; and</text></clause>
<clause id="id17989333-75fc-473a-be35-c99dd807be64" changed="not-changed"><enum>(iii)</enum><text>by inserting after subparagraph (C) the following:</text> <quoted-block changed="not-changed" display-inline="no-display-inline" id="idf26f78f9-1122-4902-94c9-ccad03d97bda" style="OLC"> <subparagraph id="id18717600-618f-4358-a56b-cdb72ed420ba" changed="not-changed"><enum>(D)</enum><text>violating or about to violate section 1030(a)(5) of this title where such conduct has caused or would cause damage (as defined in section 1030) without authorization to 100 or more protected computers (as defined in section 1030) during any 1-year period, including by—</text>
<clause id="id7e5ef908-c54b-4f05-a93f-2908ee757b77" changed="not-changed"><enum>(i)</enum><text>impairing the availability or integrity of the protected computers without authorization; or</text></clause> <clause id="ide14da856-622d-4acd-820d-c9286505ce95" changed="not-changed"><enum>(ii)</enum><text>installing or maintaining control over malicious software on the protected computers that, without authorization, has caused or would cause damage to the protected computers;</text></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph>
<subparagraph id="id7223ec8a-184e-4831-b9f2-3647205561c3" changed="not-changed"><enum>(B)</enum><text>in paragraph (2), in the matter preceding subparagraph (A), by inserting <quote>, a violation described in subsection (a)(1)(D),</quote> before <quote>or a Federal</quote>; and</text></subparagraph></paragraph> <paragraph id="ide6eaf020-5c4a-4109-855b-4086f7d6fbe2" changed="not-changed"><enum>(3)</enum><text>by adding at the end the following:</text>
<quoted-block changed="not-changed" display-inline="no-display-inline" id="idd38c9043-de35-455a-82e6-9bce911274b4" style="OLC">
<subsection id="ide75aed90-3d99-49a1-82fe-28716c72d834" changed="not-changed"><enum>(c)</enum><text>A restraining order, prohibition, or other action described in subsection (b), if issued in circumstances described in subsection (a)(1)(D), may, upon application of the Attorney General—</text> <paragraph id="ideb45a978-0b47-4acc-85b1-d25d5415e4b4" changed="not-changed"><enum>(1)</enum><text>specify that no cause of action shall lie in any court against a person for complying with the restraining order, prohibition, or other action; and</text></paragraph>
<paragraph id="idf83eb6fb-270e-4201-bd81-1c83d46f4fd9" changed="not-changed"><enum>(2)</enum><text>provide that the United States shall pay to such person a fee for reimbursement for such costs as are reasonably necessary and which have been directly incurred in complying with the restraining order, prohibition, or other action.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> <subsection id="idba8d2a61-29e4-43d1-9926-38dc97cd1f54" changed="not-changed"><enum>(b)</enum><header>Technical and conforming amendment</header><text>The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/63">chapter 63</external-xref> of title 18, United States Code, is amended by striking the item relating to section 1345 and inserting the following:</text>

<section id="id0b4097ac-0341-4dce-b8e9-c01527120348" changed="not-changed"><enum>5.</enum><header>Aggravated damage to a critical infrastructure computer</header>
<subsection id="id136fdd80-2d30-40d9-81bc-21c8da90ba9a" changed="not-changed"><enum>(a)</enum><header>In general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/47">Chapter 47</external-xref> of title 18, United States Code, is amended by inserting after <external-xref legal-doc="usc" parsable-cite="usc/18/1030">section 1030</external-xref> the following:</text> <quoted-block changed="not-changed" display-inline="no-display-inline" id="id4b358ae9-8884-49aa-8570-a2123937766d" style="USC"> <section id="idc54abe34-4198-45dd-9daa-59c7d81d43d5" changed="not-changed"><enum>1030A.</enum><header>Aggravated damage to a critical infrastructure computer</header> <subsection id="idc7772875-a72b-4d93-b315-73831f061570" changed="not-changed"><enum>(a)</enum><header>Offense</header><text>It shall be unlawful, during and in relation to a felony violation of section 1030, to knowingly cause or attempt to cause damage to a critical infrastructure computer, if such damage results in (or, in the case of an attempted offense, would, if completed, have resulted in) the substantial impairment—</text>
<paragraph id="id955493b9-f8d9-47f0-b754-d60176b151d6" changed="not-changed"><enum>(1)</enum><text>of the operation of the critical infrastructure computer; or</text></paragraph> <paragraph id="ide59bba50-3908-49ae-bb44-aacfb28deb0b" changed="not-changed"><enum>(2)</enum><text>of the critical infrastructure associated with such computer.</text></paragraph></subsection>
<subsection id="id3244c23e-1404-4335-b891-4ac82ef1e6ce" changed="not-changed"><enum>(b)</enum><header>Penalty</header><text>Any person who violates subsection (a) shall, in addition to the term of punishment provided for the felony violation of section 1030, be fined under this title, imprisoned for not more than 20 years, or both.</text></subsection> <subsection id="id13154cc9-bd60-43b7-baed-d4bd8f13b70e" changed="not-changed"><enum>(c)</enum><header>Consecutive sentence</header><text>Notwithstanding any other provision of law—</text>
<paragraph id="id7a8dcbdf-7701-4431-abfe-309d5679336d" changed="not-changed"><enum>(1)</enum><text>a court shall not place any person convicted of a violation of this section on probation;</text></paragraph> <paragraph id="id22a3b4c2-4bb9-4fa9-af2b-24aa05b81eeb" changed="not-changed"><enum>(2)</enum><text>except as provided in paragraph (4), no term of imprisonment imposed on a person under this section shall run concurrently with any term of imprisonment imposed on the person under any other provision of law, including any term of imprisonment imposed for the felony violation of section 1030;</text></paragraph>
<paragraph id="id624b8538-9f4f-4110-8800-5c5dcc415c6a" changed="not-changed"><enum>(3)</enum><text>in determining any term of imprisonment to be imposed for the felony violation of section 1030, a court shall not in any way reduce the term to be imposed for such violation to compensate for, or otherwise take into account, any separate term of imprisonment imposed or to be imposed for a violation of this section; and</text></paragraph> <paragraph id="id7366db5e-40f0-4359-b7f5-086b4c9619ba" changed="not-changed"><enum>(4)</enum><text>a term of imprisonment imposed on a person for a violation of this section may, in the discretion of the court, run concurrently, in whole or in part, only with another term of imprisonment that is imposed by the court at the same time on that person for an additional violation of this section, if such discretion shall be exercised in accordance with any applicable guidelines and policy statements issued by the United States Sentencing Commission pursuant to section 994 of title 28.</text></paragraph></subsection>
<subsection id="id501c9c75-c08f-4f22-92ce-2091ad4a6701" changed="not-changed"><enum>(d)</enum><header>Definitions</header><text>In this section—</text> <paragraph id="id0615dffb-ccbc-4fd1-af85-c1c92bfbea18" changed="not-changed"><enum>(1)</enum><text>the terms <term>computer</term> and <term>damage</term> have the meanings given the terms in section 1030; and</text></paragraph>
<paragraph id="id8e2ffade-fa33-476f-a7df-bccb2099f102" changed="not-changed"><enum>(2)</enum><text>the term <term>critical infrastructure</term> means systems and assets, whether physical or virtual, so vital to the United States that the incapacity or destruction of such systems and assets would have catastrophic regional or national effects on public health or safety, economic security, or national security, including voter registration databases, voting machines, and other communications systems that manage the election process or report and display results on behalf of State and local governments.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="id1383d101-96ef-4067-aec2-fb912e14f478" changed="not-changed"><enum>(b)</enum><header>Table of sections</header><text>The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/47">chapter 47</external-xref> of title 18, United States Code, is amended by inserting after the item relating to <external-xref legal-doc="usc" parsable-cite="usc/18/1030">section 1030</external-xref> the following:</text>

<section id="id3d3476ca-9525-4091-a234-e25c24f48850" changed="not-changed"><enum>6.</enum><header>Stopping trafficking in botnets; forfeiture</header><text display-inline="no-display-inline">Section 1030 of title 18, United States Code, is amended—</text> <paragraph id="idf259bf7f-6afa-4ac5-a480-ac57bbfda10a" changed="not-changed"><enum>(1)</enum><text>in subsection (a)—</text>
<subparagraph id="idb8473d0c-aeab-4ee7-b9cc-1be38f6416dd" changed="not-changed"><enum>(A)</enum><text>in paragraph (7), by adding <quote>or</quote> at the end; and</text></subparagraph> <subparagraph id="id060a22a4-de31-4291-b3aa-3e1cd7a5e408" changed="not-changed"><enum>(B)</enum><text>by inserting after paragraph (7) the following:</text>

<paragraph id="idf355ecb6-c8fe-4b1f-ad30-43fd9ff67bc5" changed="not-changed"><enum>(8)</enum><text>intentionally traffics in the means of access to a protected computer, if—</text> <subparagraph id="id110e11b9-a8a0-4b8c-8628-a97bffc5fd96" changed="not-changed"><enum>(A)</enum><text>the trafficker knows or has reason to know the protected computer has been damaged in a manner prohibited by this section; and</text></subparagraph>
<subparagraph id="idaeb66706-e98b-4e5f-acbc-5d6bca7147fc" changed="not-changed"><enum>(B)</enum><text>the promise or agreement to pay for the means of access is made by, or on behalf of, a person the trafficker knows or has reason to know intends to use the means of access to—</text> <clause id="idb55b803a-e98d-430f-9568-8f0cd05d7b9b" changed="not-changed"><enum>(i)</enum><text>damage a protected computer in a manner prohibited by this section; or</text></clause>
<clause id="idad5816fb-123d-46a5-817a-c9c1ead62f0f" changed="not-changed"><enum>(ii)</enum><text>violate section 1037 or 1343;</text></clause></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph> <paragraph id="id9a17cdd7-2407-47f3-9752-26381d7147dd" changed="not-changed"><enum>(2)</enum><text>in subsection (c)(3)—</text>
<subparagraph id="idc318031d-1e26-4256-a446-48927c24f817" changed="not-changed"><enum>(A)</enum><text>in subparagraph (A), by striking <quote>(a)(4) or (a)(7)</quote> and inserting <quote>(a)(4), (a)(7), or (a)(8)</quote>; and</text></subparagraph> <subparagraph id="id14b01b16-4578-4fb4-8761-730d4e7783db" changed="not-changed"><enum>(B)</enum><text>in subparagraph (B), by striking <quote>(a)(4), or (a)(7)</quote> and inserting <quote>(a)(4), (a)(7), or (a)(8)</quote>; </text></subparagraph></paragraph>
<paragraph id="idd5c49c15-a860-4a2b-b834-93a06cd96e32" changed="not-changed"><enum>(3)</enum><text>in subsection (e)—</text> <subparagraph id="id1d899516-f146-4386-8bbf-a58276da306e" changed="not-changed"><enum>(A)</enum><text>in paragraph (13), by striking <quote>and</quote> at the end;</text></subparagraph>
<subparagraph id="idefeef851-81c7-473e-a531-3afa9c3bc67f" changed="not-changed"><enum>(B)</enum><text>in paragraph (14), by striking the period at the end and inserting <quote>; and</quote>; and</text></subparagraph> <subparagraph id="id6aa87287-6178-4e9c-ae2d-78b328158a25" changed="not-changed"><enum>(C)</enum><text>by adding at the end the following:</text>
<quoted-block changed="not-changed" display-inline="no-display-inline" id="id58dedfa5-9da7-4445-9ee1-b48af74963f7" style="OLC">
<paragraph id="id583f8375-8131-4c95-98ba-72f4621a680c" changed="not-changed"><enum>(15)</enum><text>the term <term>traffic</term>, except as provided in subsection (a)(6), means transfer, or otherwise dispose of, to another as consideration for the receipt of, or as consideration for a promise or agreement to pay, anything of pecuniary value.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph> <paragraph id="iddefb7206-3176-4785-9548-65070952bfaf" changed="not-changed"><enum>(4)</enum><text>in subsection (g), in the first sentence, by inserting <quote>, except for a violation of subsection (a)(8),</quote> after <quote>of this section</quote>; and</text></paragraph>
<paragraph id="id988103c3-ab8c-4573-a346-fde35395dbea" changed="not-changed"><enum>(5)</enum><text>by striking subsections (i) and (j) and inserting the following:</text> <quoted-block id="id5a961db9-98d3-41cb-bdf1-f9a4c43dd82d" changed="not-changed" display-inline="no-display-inline" style="OLC"> <subsection id="idded2bfa6-9136-417e-8875-fc4ffea113eb" changed="not-changed"><enum>(i)</enum><header>Criminal forfeiture</header> <paragraph id="idcf5fb1b4-f59e-48c9-baf0-c70222ba6f30" changed="not-changed"><enum>(1)</enum><header>In general</header><text>The court, in imposing sentence on any person convicted of a violation of this section, or convicted of conspiracy to violate this section, shall order, in addition to any other sentence imposed and irrespective of any provision of State law, that such person forfeit to the United States—</text>

<paragraph id="idd4b64d3c-37de-43f8-8e77-4bd9973c9c92" changed="not-changed"><enum>(2)</enum><header>Applicable provisions</header><text>The criminal forfeiture of property under this subsection, including any seizure and disposition of the property, and any related judicial or administrative proceeding, shall be governed by the provisions of section 413 of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/853">21 U.S.C. 853</external-xref>), except subsection (d) of that section.</text></paragraph></subsection> <subsection id="id68a2713c-2a0e-4d5a-bf3c-3dffe9fc6f65" changed="not-changed"><enum>(j)</enum><header>Civil forfeiture of property used in the commission of an offense</header> <paragraph id="id434a8252-0902-48e8-9ce9-a104c989c10d" changed="not-changed"><enum>(1)</enum><header>In general</header><text>Any personal property, including any Internet domain name or Internet Protocol address, that was used or intended to be used to commit or to facilitate the commission of any violation of this section, or a conspiracy to violate this section shall be subject to forfeiture to the United States, and no property right shall exist in such property.</text></paragraph>
<paragraph id="id5ddc0d7d-a5de-4f28-af6d-5280938e7e1e" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header>Applicable provisions</header><text>Seizures and forfeitures under this subsection shall be governed by the provisions of chapter 46 relating to civil forfeitures, except that such duties as are imposed on the Secretary of the Treasury under the customs laws described in section 981(d) shall be performed by such officers, agents, and other persons as may be designated for that purpose by the Secretary of Homeland Security or the Attorney General.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> </legis-body> </bill>
