which was read twice and referred to the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To establish the Federal Clearinghouse on Safety and Security Best Practices for Faith-Based Organizations and Houses of Worship, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Pray Safe Act</short-title></quote>.</text></section><section id="id684DDF7A3D5D45F9B90B4C5BA8209B86"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act—</text><paragraph id="idFB48A44CF5F5453FB540B46D10A143DA"><enum>(1)</enum><text>the term <term>Clearinghouse</term> means the Federal Clearinghouse on Safety Best Practices for Faith-Based Organizations and Houses of Worship established under section 2220A of the Homeland Security Act of 2002, as added by section 3 of this Act;</text></paragraph><paragraph id="idACECFE83257B4CA9BAC23BD4C5C6E6FB"><enum>(2)</enum><text>the term <term>Department</term> means the Department of Homeland Security; and</text></paragraph><paragraph id="idEDDFE630B064494F94953BA8F6DCF17C"><enum>(3)</enum><text>the term <term>Secretary</term> means the Secretary of Homeland Security.</text></paragraph></section><section id="id3288f0875cfa40f1877ff6cdb0c77263"><enum>3.</enum><header>Federal Clearinghouse on Safety and Security Best Practices for Faith-Based Organizations and Houses of Worship</header><subsection id="id82d27de718414cd593088971cb61758a"><enum>(a)</enum><header>In general</header><text>Subtitle A of title XXII of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/651">6 U.S.C. 651 et seq.</external-xref>), as amended by section 9, is amended by adding at the end:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id0FB0BABBDD11408D99DE6CAEF12DDEA5"><section id="id34a552dbfda44f5180cd9d270f5fde62"><enum>2220A.</enum><header>Federal Clearinghouse on Safety and Security Best Practices for Faith-Based Organizations and Houses of Worship</header><subsection id="id4016352ad07744f2bc1241d47a7faf32"><enum>(a)</enum><header>Definitions</header><text>In this section—</text><paragraph id="id31AEE508E82C494684D1E64AF6AAB4C8"><enum>(1)</enum><text>the term <term>Clearinghouse</term> means the Clearinghouse established under subsection (b);</text></paragraph><paragraph id="id7FC0481C1AAA47DE8DB3C803243A7379"><enum>(2)</enum><text>the term <term>faith-based organization</term> means a group, center, or nongovernmental organization at risk because of religious, ideological, or spiritual beliefs; and </text></paragraph><paragraph id="idC383422DB47644CBA1A7B050C1F8E4DB"><enum>(3)</enum><text>the term <term>house of worship</term> means a place or building, including synagogues, mosques, temples, and churches, in which congregants practice their religious or spiritual beliefs. </text></paragraph></subsection><subsection id="idD81E0576503440B1A1D0F7C6181C25BC"><enum>(b)</enum><header>Establishment</header><paragraph id="idc4726847392745c285abb7b4ee0c1e5c"><enum>(1)</enum><header>In general</header><text>Not later than 270 days after the date of enactment of the <short-title>Pray Safe Act</short-title>, the Secretary, in consultation with the Attorney General, the Executive Director of the White House Office of Faith-Based and Neighborhood Partnerships, and the head of any other agency that the Secretary determines appropriate, shall establish a Federal Clearinghouse on Safety and Security Best Practices for Faith-Based Organizations and Houses of Worship within the Department. </text></paragraph><paragraph id="id31043db299c6497db3861d7bea65ca3f"><enum>(2)</enum><header>Purpose</header><text>The Clearinghouse shall be the primary resource of the Federal Government—</text><subparagraph id="id3AC4960582C1441EA16DE075C54FA734"><enum>(A)</enum><text>to educate and publish online best practices and recommendations for safety and security for faith-based organizations and houses of worship; and</text></subparagraph><subparagraph id="idBE1A28B657A04AE991AE8C4ED66643AE"><enum>(B)</enum><text>to provide information relating to Federal grant programs available to faith-based organizations and houses of worship.</text></subparagraph></paragraph><paragraph id="idf8d60a03fd564ba38667f40a0dbacc44"><enum>(3)</enum><header>Personnel</header><subparagraph id="ide2f9eff71ec04c1fb950b3db31cd64dd"><enum>(A)</enum><header>Assignments</header><text>The Clearinghouse shall be assigned such personnel and resources as the Secretary considers appropriate to carry out this section.</text></subparagraph><subparagraph id="id4fae2b26dd514b319c79d2e48dd00846"><enum>(B)</enum><header>Detailees</header><text>The Secretary may coordinate detailees as required for the Clearinghouse. </text></subparagraph><subparagraph id="id33FC65C7983D4F8DBB7903254C55B9F6"><enum>(C)</enum><header>Designated point of contact</header><text>There shall be not less than 1 employee assigned or detailed to the Clearinghouse who shall be the designated point of contact to provide information and assistance to faith-based organizations and houses of worship, including assistance relating to the grant program established under section 5 of the <short-title>Pray Safe Act</short-title>. The contact information of the designated point of contact shall be made available on the website of the Clearinghouse.</text></subparagraph><subparagraph id="idAF0C17BC11DB44059974F36BA7B52444"><enum>(D)</enum><header>Qualification</header><text>To the maximum extent possible, any personnel assigned or detailed to the Clearinghouse under this paragraph should be familiar with faith-based organizations and houses of worship and with physical and online security measures to identify and prevent safety and security risks.</text></subparagraph></paragraph></subsection><subsection id="id3b9de6139dab465bbe914374831fca96"><enum>(c)</enum><header>Clearinghouse contents</header><paragraph id="idEE896AC64E6A4AEFAA2D2A3EE1C19D40"><enum>(1)</enum><header>Evidence-based tiers</header><subparagraph id="id7E6951FF8494431082E703CF1EDCE2F7"><enum>(A)</enum><header>In general</header><text>The Secretary, in consultation with the Attorney General, the Executive Director of the White House Office of Faith-Based and Neighborhood Partnerships, and the head of any other agency that the Secretary determines appropriate, shall develop tiers for determining evidence-based practices that demonstrate a significant effect on improving safety or security, or both, for faith-based organizations and houses of worship. </text></subparagraph><subparagraph id="id9d949bcef35842d1b32fe5804936b2a0"><enum>(B)</enum><header>Requirements</header><text>The tiers required to be developed under subparagraph (A) shall—</text><clause id="idBA1CF173CC9C41D4885D59FC07991D28"><enum>(i)</enum><text>prioritize—</text><subclause id="id6071F6BD2CC04CAC8C643D57699C7A0E"><enum>(I)</enum><text>strong evidence from not less than 1 well-designed and well-implemented experimental study; and</text></subclause><subclause id="id37BF904F1FB9469AB184C64EE9FE38D3"><enum>(II)</enum><text>moderate evidence from not less than 1 well-designed and well-implemented quasi-experimental study; and</text></subclause></clause><clause id="id60516E9F3F4F44C59E800CC251E61F47"><enum>(ii)</enum><text>consider promising evidence that demonstrates a rationale based on high-quality research findings or positive evaluations that such activity, strategy, or intervention is likely to improve security and promote safety for faith-based organizations and houses of worship.</text></clause></subparagraph></paragraph><paragraph id="id8928950c648541c0b01553c856f442db"><enum>(2)</enum><header>Criteria for best practices and recommendations</header><text>The best practices and recommendations of the Clearinghouse shall, at a minimum—</text><subparagraph id="id08C08C2F4B5A47AFA0CB0D0436F56337"><enum>(A)</enum><text>identify areas of concern for faith-based organizations and houses of worship, including event planning recommendations, checklists, facility hardening, tabletop exercise resources, and other resilience measures;</text></subparagraph><subparagraph id="id1c9acb222d0a430dae84aa9630512df9"><enum>(B)</enum><text>involve comprehensive safety measures, including threat prevention, preparedness, protection, mitigation, incident response, and recovery to improve the safety posture of faith-based organizations and houses of worship upon implementation; </text></subparagraph><subparagraph id="id4367B6FA386D49DF91B179CEC78ABB54"><enum>(C)</enum><text>involve comprehensive safety measures, including preparedness, protection, mitigation, incident response, and recovery to improve the resiliency of faith-based organizations and houses of worship from manmade and natural disasters; </text></subparagraph><subparagraph changed="not-changed" id="idDEA99BC1682145E68500034FCBF8C3EA"><enum>(D)</enum><text>include any evidence or research rationale supporting the determination of the Clearinghouse that the best practice or rec­om­men­da­tion under subparagraph (B) has been shown to have a significant effect on improving the safety and security of individuals in faith-based organizations and houses of worship, including—</text><clause changed="not-changed" id="idFDF86B45B4E147F4B2B0749FDC64E38B"><enum>(i)</enum><text>findings and data from previous Federal, State, local, Tribal, territorial, private sector, and nongovernmental organization research centers relating to safety, security, and targeted violence at faith-based organizations and houses of worship; and </text></clause><clause changed="not-changed" id="idB6F6E49B1EA04F24B3DE6B760CEA2F39"><enum>(ii)</enum><text>other supportive evidence or findings relied upon by the Clearinghouse in determining best practices and rec­om­men­da­tions to improve the safety and security posture of a faith-based organization or house of worship upon implementation; and</text></clause></subparagraph><subparagraph id="idE1E405080F8245C788A71FD185495AB8"><enum>(E)</enum><text>an overview of the available resources the Clearinghouse can provide for faith-based organizations and houses of worship. </text></subparagraph></paragraph><paragraph id="id95EACA7571AE41DF9BC3E31247417C63"><enum>(3)</enum><header>Additional information</header><text>The Clearinghouse shall maintain and make available a comprehensive index of all Federal grant programs for which faith-based organizations and houses of worship are eligible, which shall include the performance metrics for each grant management that the recipient will be required to provide. </text></paragraph><paragraph id="id8ee22be7b7c149699c649a09f5d57f93"><enum>(4)</enum><header>Past recommendations</header><text>To the greatest extent practicable, the Clearinghouse shall identify and present, as appropriate, best practices and recommendations issued by Federal, State, local, Tribal, territorial, private sector, and nongovernmental organizations relevant to the safety and security of faith-based organizations and houses of worship. </text></paragraph></subsection><subsection id="id5eccae41a29f42ec89772e2882454e15"><enum>(d)</enum><header>Assistance and training</header><text>The Secretary may produce and publish materials on the Clearinghouse to assist and train faith-based organizations, houses of worship, and law enforcement agencies on the implementation of the best practices and recommendations.</text></subsection><subsection id="id82c88fa84b5e4911a8369b225c1d72c6"><enum>(e)</enum><header>Continuous improvement</header><paragraph id="id9ACD60C50483459999313C192B5AD053"><enum>(1)</enum><header>In general</header><text>The Secretary shall—</text><subparagraph id="idE5F0A666A7C848828CC94FA50E58A03D"><enum>(A)</enum><text>collect for the purpose of continuous improvement of the Clearinghouse—</text><clause id="idacbcc46bbc29482494daf3e1bc460159"><enum>(i)</enum><text>Clearinghouse data analytics; </text></clause><clause id="idd13b7bc81ef347a29d822b4fd634ce2c"><enum>(ii)</enum><text>user feedback on the implementation of resources, best practices, and recommendations identified by the Clearinghouse; and</text></clause><clause changed="not-changed" id="id19DA5073B0214A3F9C0009F8D100E047"><enum>(iii)</enum><text>any evaluations conducted on implementation of the best practices and recommendations of the Clearinghouse; and</text></clause></subparagraph><subparagraph id="idc03bc8c3b75d4d8b94133c152f70b178"><enum>(B)</enum><text>in coordination with the Faith-Based Security Advisory Council of the Department, the Department of Justice, the Executive Director of the White House Office of Faith-Based and Neighborhood Partnerships, and any other agency that the Secretary determines appropriate— </text><clause id="id9333faf90dcc4cdda3c222e0f4a0b100"><enum>(i)</enum><text>assess and identify Clearinghouse best practices and recommendations for which there are no resources available through Federal Government programs for implementation; </text></clause><clause id="idAD72105437B943639514C3BAE8DC1503"><enum>(ii)</enum><text>provide feedback on the implementation of best practices and rec­om­men­da­tions of the Clearinghouse; and</text></clause><clause id="id915B7F6AA33F47EE866558C931D4DE46"><enum>(iii)</enum><text>propose additional recommendations for best practices for inclusion in the Clearinghouse; and</text></clause></subparagraph><subparagraph id="idDC2785F7771A47779ACFE07837A60009"><enum>(C)</enum><text>not less frequently than annually, examine and update the Clearinghouse in accordance with—</text><clause id="id137887771928430FBE69E222477CAF9D"><enum>(i)</enum><text>the information collected under subparagraph (A); and</text></clause><clause id="id7DF7F496364F4E88A5D83EF7E34E3C03"><enum>(ii)</enum><text>the recommendations proposed under subparagraph (B)(iii).</text></clause></subparagraph></paragraph><paragraph id="id3F62B71D584040E7BD25896D96D8DC13"><enum>(2)</enum><header>Annual report to Congress</header><text>The Secretary shall submit to Congress, on an annual basis, a report on the updates made to the Clearinghouse during the preceding 1-year period under paragraph (1)(C), which shall include a description of any changes made to the Clearinghouse.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id26f00031e8f24ee8ad62cd91b08d1d5a"><enum>(b)</enum><header>Technical Amendments</header><text>The table of contents in section 1(b) of the Homeland Security Act of 2002 (<external-xref legal-doc="public-law" parsable-cite="pl/107/296">Public Law 107–296</external-xref>; 116 Stat. 2135), as amended by section 9 of this Act, is amended by inserting after the item relating to section 2220 the following:</text><quoted-block style="OLC" id="idcb211535-0849-476e-91a6-b5f414a3f04a"><toc><toc-entry idref="id34a552dbfda44f5180cd9d270f5fde62" level="section">Sec. 2220A. Federal Clearinghouse on Safety Best Practices for Faith-Based Organizations and Houses of Worship.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="id7018f2d549ac495cae43ab049e731752"><enum>4.</enum><header>Notification of Clearinghouse</header><text display-inline="no-display-inline">The Secretary shall provide written notification of the establishment of the Clearinghouse, with an overview of the resources required as described in section 2220A of the Homeland Security Act of 2002, as added by section 3 of this Act, and section 5 of this Act, to— </text><paragraph id="idC2BDC7BFB16E47848ECE2CBDA3E1AD69"><enum>(1)</enum><text>every State homeland security advisor;</text></paragraph><paragraph id="idDB3C5A9AA99348788C344D8E94601DBE"><enum>(2)</enum><text>every State department of homeland security; </text></paragraph><paragraph id="id0BBDD0FC618841D7A5FD499481828ED5"><enum>(3)</enum><text>other Federal agencies with grant programs or initiatives that aid in the safety and security of faith-based organizations and houses of worship, as determined appropriate by the Secretary;</text></paragraph><paragraph id="id2AEFE5D0781949688B0B36C90AED2BEA"><enum>(4)</enum><text>every Federal Bureau of Investigation Joint Terrorism Task Force;</text></paragraph><paragraph id="idA67BABEDFD8149A7A4E0EE3AA164C1BB"><enum>(5)</enum><text>every Homeland Security Fusion Center; </text></paragraph><paragraph id="idB93F543DC7574B6ABAEF9B858E1E73D8"><enum>(6)</enum><text>every State or territorial Governor or other chief executive;</text></paragraph><paragraph id="idF36F802B065C43A9B8376B4406AE92C3"><enum>(7)</enum><text>the Committee on Homeland Security and Governmental Affairs and the Committee on the Judiciary of the Senate; and</text></paragraph><paragraph id="id5B5078814F27473591AF44911428B28D"><enum>(8)</enum><text>the Committee on Homeland Security and the Committee on the Judiciary of the House of Representatives.</text></paragraph></section><section id="id8244393c2e5248ccbbca72284ea66912"><enum>5.</enum><header>Grant program overview</header><subsection id="idB70AC7B94BB244CFA74D805F0F96ECD4"><enum>(a)</enum><header>DHS grants and resources</header><text display-inline="yes-display-inline">The Secretary shall include a grants program overview on the website of the Clearinghouse that shall—</text><paragraph id="id690398dfd6a74cb1a2a2df88374f0f61"><enum>(1)</enum><text>be the primary location for all information regarding Department grant programs that are open to faith-based organizations and houses of worship; </text></paragraph><paragraph id="id168d5545bb564b48a144143d47090d96"><enum>(2)</enum><text>directly link to each grant application and any applicable user guides; </text></paragraph><paragraph id="idc70d5009cf7c4ed18174c91dd2f18693"><enum>(3)</enum><text>identify all safety and security homeland security assistance programs managed by the Department that may be used to implement best practices and recommendation of the Clearinghouse;</text></paragraph><paragraph id="id6b2fde1dbfab491b956f73502b3fa223"><enum>(4)</enum><text>annually, and concurrent with the application period for any grant identified under paragraph (1), provide information related to the required elements of grant applications to aid smaller faith based organizations and houses of worship in earning access to Federal grants; and </text></paragraph><paragraph id="id146e4a8cf2974ec087618728b6dfbd12"><enum>(5)</enum><text>provide frequently asked questions and answers for the implementation of best practices and recommendations of the Clearinghouse and best practices for applying for a grant identified under paragraph (1). </text></paragraph></subsection><subsection id="id4483FC997D554658A426A84C12563FCE"><enum>(b)</enum><header>Other Federal grants and resources</header><text>Each Federal agency notified under section 4(3) shall provide necessary information on any Federal grant programs or resources of the Federal agency that are available for faith-based organizations and houses of worship to the Secretary or the appropriate point of contact for the Clearinghouse.</text></subsection><subsection id="id03EBEB0CF149455B9F69ADEB8D278E44"><enum>(c)</enum><header>State grants and resources</header><paragraph id="id771DAC4F904B490D818B3D59E8F7A6FB"><enum>(1)</enum><header>In general</header><text>Any State notified under paragraph (1), (2), or (6) of section 4 may provide necessary information on any grant programs or resources of the State available for faith-based organizations and houses of worship to the Secretary or the appropriate point of contact for the Clearinghouse. </text></paragraph><paragraph id="id32E3F79D72AC4151A19953EBF3980B84"><enum>(2)</enum><header>Identification of resources</header><text>The Clearinghouse shall, to the extent practicable, identify, for each State— </text><subparagraph id="id53dc30ed03db420eab8070a141ce8979"><enum>(A)</enum><text>each agency responsible for safety for faith-based organizations and houses of worship in the State, or any State that does not have such an agency designated;</text></subparagraph><subparagraph id="idb1319186a12241ca9abc855ff8fe72fc"><enum>(B)</enum><text>any grant program that may be used for the purposes of implementing best practices and recommendations of the Clearinghouse; and</text></subparagraph><subparagraph id="idbef00afdb56b40bdbd0106dc27bdd896"><enum>(C)</enum><text>any resources or programs, including community prevention or intervention efforts, that may be used to assist in targeted violence and terrorism prevention.</text></subparagraph></paragraph></subsection></section><section id="idD12DB4E1AB6C40669E2359681BFDAE9C"><enum>6.</enum><header>Other resources</header><text display-inline="no-display-inline">The Secretary shall, on the website of the Clearinghouse, include a separate section for other resources that shall provide a centralized list of all available points of contact to seek assistance in grant applications and in carrying out the best practices and recommendations of the Clearinghouse, including—</text><paragraph commented="no" id="idde60b9d0654744d0bc60b6bb1dcda41e"><enum>(1)</enum><text>a list of contact information to reach Department personnel to assist with grant-related questions;</text></paragraph><paragraph commented="no" id="id92679c1e7d694de89ced37e577654cbf"><enum>(2)</enum><text>the applicable Cybersecurity and Infrastructure Security Agency contact information to connect houses of worship with Protective Security Advisors;</text></paragraph><paragraph commented="no" id="idc6f593a15e224f5e9c285d1aacb07198"><enum>(3)</enum><text>contact information for all Department Fusion Centers, listed by State;</text></paragraph><paragraph commented="no" id="id6fcb5da039fd406f96a837086f068730"><enum>(4)</enum><text>information on the If you See Something Say Something Campaign of the Department; and</text></paragraph><paragraph commented="no" id="idaa4ca784674c42dcbcaa1ee757cc80fc"><enum>(5)</enum><text>any other appropriate contacts.</text></paragraph></section><section changed="not-changed" id="id20C4DBB20F6F47CD8CD72AB3052093B6"><enum>7.</enum><header>Rule of construction</header><text display-inline="no-display-inline">Nothing in this Act or the amendments made by this Act shall be construed to create, satisfy, or waive any requirement under Federal civil rights laws, including—</text><paragraph id="id7FEE248914AA4BDCB0A18B49E7E601F1" changed="not-changed"><enum>(1)</enum><text display-inline="yes-display-inline">title II of the Americans With Disabilities Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12131">42 U.S.C. 12131 et seq.</external-xref>); or</text></paragraph><paragraph id="id70673d94623945e2a9c71f2fd3ce10f1" changed="not-changed"><enum>(2)</enum><text>title VI of the Civil Rights Act of 1964 (<external-xref legal-doc="usc" parsable-cite="usc/42/2000d">42 U.S.C. 2000d et seq.</external-xref>).</text></paragraph></section><section changed="not-changed" id="idAFBABB73505A4BF29BF252F43BCC1062"><enum>8.</enum><header>Exemption</header><text display-inline="no-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/44/35">Chapter 35</external-xref> of title 44, United States Code (commonly known as the <quote>Paperwork Reduction Act</quote>) shall not apply to any rulemaking or information collection required under this Act or under section 2220A of the Homeland Security Act of 2002, as added by section 3 of this Act. </text></section><section id="id40AC375D1E084D9487F19E6E026A60A5"><enum>9.</enum><header>Technical corrections</header><subsection id="id6AF3A14D1BFB46EC8ED936170A4FECF2"><enum>(a)</enum><header>Redesignations</header><text display-inline="yes-display-inline">Subtitle A of title XXII of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/651">6 U.S.C. 651 et seq.</external-xref>) is amended—</text><paragraph id="id2CB9453152214B97841F7F0515F9070B"><enum>(1)</enum><text>by redesignating section 2217 (<external-xref legal-doc="usc" parsable-cite="usc/6/665f">6 U.S.C. 665f</external-xref>) as section 2220;
