which was read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To exempt large cruise ships from certain requirements applicable to passenger vessels, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Safeguarding American Tourism Act</short-title></quote>.</text></section><section id="idCC71DB90EF4C406A97332404C1B7E2B0"><enum>2.</enum><header>Adjusting applicability of certain PVSA and Jones Act requirements</header><subsection id="id607A18B05CA44E9AACE103F4E6319AE0"><enum>(a)</enum><header>PVSA domestic requirements</header><text display-inline="yes-display-inline">Section 55103(a) of title 46, United States Code, is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idF064439D17A249B8A73B2A4A4AE05D00"><subsection id="id8305C062585B423EAE2BF1CE0F8A1DA8"><enum>(c)</enum><header>Nonapplicablity</header><text>This section shall not apply to any vessel with 800 or more passenger berths.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id2F5C31FA213F4AD8A24D0A6D2184BBD1"><enum>(b)</enum><header>Jones Act requirements</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/46/121">Chapter 121</external-xref> of title 46, United States Code, is amended—</text><paragraph id="id79DF057E5AC547D09DA82AC17780C943"><enum>(1)</enum><text>in section 12103, by adding at the end the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="id705AF4994F7E48C49D791DACA416CA23"><subsection id="id617ADEA363E547C583FF70566E66714D"><enum>(d)</enum><header>Nonapplicability</header><text>The requirements of this section shall not apply to any vessel with 800 or more passenger berths and that transports passengers between ports or places in the United States to which the coastwise laws apply, either directly or via a foreign port.</text></subsection><after-quoted-block>; </after-quoted-block></quoted-block></paragraph><paragraph id="id07346F637D424173B51975442378BDCE"><enum>(2)</enum><text>in section 12112(a)—</text><subparagraph id="idD3400BE8E8BB4F05AEAECC3B5C168784"><enum>(A)</enum><text>in paragraph (1), by inserting <quote>except in the case of a vessel described in subparagraph (C) of paragraph (2),</quote> before <quote>satisfies</quote>; and</text></subparagraph><subparagraph id="id03D74BCB45FA47688929F72BE87CCCAE"><enum>(B)</enum><text>in paragraph (2)—</text><clause id="idC551D94DC41F4FD797A0B8A1B1845304"><enum>(i)</enum><text>in subparagraph (A), by striking <quote>or</quote> after the semicolon;</text></clause><clause id="id1D686BAB0931454284B7FC86E7054986"><enum>(ii)</enum><text>in subparagraph (B)(iii), by striking <quote>; and</quote> and inserting <quote>; or</quote>; and</text></clause><clause id="idF82A8EDAF3174A34B920A88E5FF44EA8"><enum>(iii)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idDECA893B4CA74F13A700957449A5380A"><subparagraph id="id0099A650AEC740468A6A586DE4216AA8" indent="up1"><enum>(C)</enum><text>has 800 or more passenger berths and transports passengers between ports or places in the United States to which the coastwise laws apply, either directly or via a foreign port; and</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></clause></subparagraph></paragraph></subsection><subsection id="id7609E443BC7D436BAAEE016229E8E05D"><enum>(c)</enum><header>Adjustment of citizenship and Navy Reserve requirements</header><text>Section 8103(k) of title 46, United States Code, is amended to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idBCDABBABDF6E4F5689310C52BFC6658E"><subsection id="id0593B6B658DC48C581A66D6FE07C34B8"><enum>(k)</enum><header>Nonapplicability to certain passenger vessels</header><text>Subsections (a) and (b) shall not apply to any vessel with 800 or more passenger berths and that transports passengers between ports or places in the United States to which the coastwise laws apply, either directly or via a foreign port.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="id428B2C538C7B4056B41B39D14BDDF942"><enum>3.</enum><header>Adjustments relating to permits to land temporarily for alien crewmen</header><text display-inline="no-display-inline">Section 252(a) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1282">8 U.S.C. 1282(a)</external-xref>) is amended, in the matter preceding paragraph (1), by striking <quote>not to exceed—</quote> and all that follows through the period at the end of paragraph (2) and inserting “not to exceed the period of time during which the crewman is in possession of a valid, unexpired visa issued pursuant to such paragraph, if the immigration officer is satisfied that the crewman intends to depart—</text><quoted-block id="id0E696FC281BE44D4B685CFBE97D93DFD" display-inline="no-display-inline" style="OLC"><paragraph id="id988256AE891B4879B022298D0BB6F1A5"><enum>(1)</enum><text>on the vessel or aircraft on which the crewman arrived; or</text></paragraph><paragraph id="idBEAB92A9423D47F08380ECD0991DF66A" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text>on a vessel or aircraft other than the vessel or aircraft on which the crewman arrived.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="idD5930ED877694765A92122EAF7E01520"><enum>4.</enum><header>Rule of construction</header><text display-inline="no-display-inline">Nothing in the amendments made by this Act shall be construed to exempt a vessel that transports passengers between ports or places in the United States to which the coastwise laws apply, either directly or via a foreign port, from any applicable law of the United States except as explicitly provided in such amendments. </text></section></legis-body></bill>
