which was read twice and referred to the <committee-name committee-id="SSEG00">Committee on Energy and Natural Resources</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require the Secretary of Energy to establish a manufacturing clean energy and energy efficiency grant program, and for other purposes.</official-title></form><legis-body><section id="idE44512BA51A24706AEF3FBCB91F32142" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Manufacturing Clean Energy and Energy Efficiency Act of 2021</short-title></quote>.</text></section><section id="S1" section-type="subsequent-section"><enum>2.</enum><header>Manufacturing Clean Energy and Energy Efficiency Grant Program</header><subsection id="id23149df8b61a45f0be16107a3cce5103"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="id09b4011b3c8740468936188967deb66c"><enum>(1)</enum><header>Covered project</header><text>The term <term>covered project</term> means a project that—</text><subparagraph id="idCFE80AB51AF5497D8367BBB24C7DB9F6"><enum>(A)</enum><text>has been recommended in an energy assessment described in paragraph (2)(A) conducted for an eligible entity; and</text></subparagraph><subparagraph id="idA935B71752544CB1AFA20FD749335609"><enum>(B)</enum><text>with respect to the plant site of that eligible entity—</text><clause id="idB2C2175C639F42DBBC06C44E9493C730"><enum>(i)</enum><text>improves—</text><subclause id="id6427b8b4c3ee48af89ec90b034372fc8"><enum>(I)</enum><text>energy efficiency;</text></subclause><subclause id="id7602ecd9141f48e4bf2888e488aca060"><enum>(II)</enum><text>material efficiency;</text></subclause><subclause id="idfa69b985941e409d8ce290315ac5e234"><enum>(III)</enum><text>cybersecurity; or</text></subclause><subclause id="id716743925d1c4d1683de2c9768b479f4"><enum>(IV)</enum><text>productivity; or</text></subclause></clause><clause id="id59af558f349f4a1ea3196dcedf7827e1"><enum>(ii)</enum><text>reduces—</text><subclause id="id064ce40b4d5b4c5ca9c18816edb4a1d8"><enum>(I)</enum><text>waste production;</text></subclause><subclause id="id1bbdb12a892b41b2b2dee69f3b4ec8c2"><enum>(II)</enum><text>greenhouse gas emissions; or</text></subclause><subclause id="id4a870dab82384007b7a01eb8d1985f3f" commented="no" display-inline="no-display-inline"><enum>(III)</enum><text>nongreenhouse gas pollution. </text></subclause></clause></subparagraph></paragraph><paragraph id="idffe44431464845a3b99b7eb900690334"><enum>(2)</enum><header>Eligible entity</header><text>The term <term>eligible entity</term> means a small- or medium-sized manufacturer that has had an energy assessment completed—</text><subparagraph id="id9646A106B32E46E29EF852D87D90F04C"><enum>(A)</enum><text>by—</text><clause id="id3dbc350d72d849719c0381eb00ff7989"><enum>(i)</enum><text>an Industrial Assessment Center; or</text></clause><clause id="idcfc9b13972a04ebbaee952f51a800626"><enum>(ii)</enum><text>a third party assessor that provides an assessment equivalent to that of an Industrial Assessment Center, as determined by the Secretary; and</text></clause></subparagraph><subparagraph id="idA601718D30534E96A27D5047E95BCE82"><enum>(B)</enum><text>in the 5-year period preceding the date on which the small- or medium-sized manufacturer submits an application under subsection (c). </text></subparagraph></paragraph><paragraph id="id6e2f58120c4b4f68b086783b7dabd5ed"><enum>(3)</enum><header>Industrial assessment center</header><text>The term <term>Industrial Assessment Center</term> means a center located at an institution of higher education that—</text><subparagraph id="ide7f130e91033486f9852e208ac9eb472"><enum>(A)</enum><text>receives funding from the Department of Energy;</text></subparagraph><subparagraph id="id9a73a84ac5374766b0e20314f8e861f5"><enum>(B)</enum><text>provides an in-depth assessment of small- or medium-sized manufacturers to evaluate the facilities, services, and manufacturing operations of the plant sites of those manufacturers; and</text></subparagraph><subparagraph id="id5b77e90773844dd485e02ad751f9046e"><enum>(C)</enum><text>as a result of the assessment described in subparagraph (B), identifies opportunities for potential savings from, with respect to those plant sites—</text><clause id="id6a8d8221bdd94bc9a212cc2c168072a9"><enum>(i)</enum><text>energy efficiency improvements;</text></clause><clause id="ided0fcafbc04f429cbd566efffe0093a0"><enum>(ii)</enum><text>waste minimization;</text></clause><clause id="id819354fe1e194ecd94a25bdec23a521a"><enum>(iii)</enum><text>pollution prevention;</text></clause><clause id="id800132bd5a904ae0a0f9b43701189c09"><enum>(iv)</enum><text>cybersecurity improvements; and</text></clause><clause id="id532926f4988241ddb937daf0dbd27455"><enum>(v)</enum><text>productivity improvement.</text></clause></subparagraph></paragraph><paragraph id="idb20c0c7fca48443992ef94aeefb30421"><enum>(4)</enum><header>Institution of higher education</header><text>The term <term>institution of higher education</term> has the meaning given the term in section 101(a) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001(a)</external-xref>). </text></paragraph><paragraph id="id0DBF7418CA9B4924A01D9562E22004D5"><enum>(5)</enum><header>Program</header><text>The term <quote>program</quote> means the program established under subsection (b).</text></paragraph><paragraph id="idda63bff06ac64d4596c397ecf427e3ad"><enum>(6)</enum><header>Small- or medium-sized manufacturer</header><text>The term <term>small- or medium-sized manufacturer</term> means a manufacturing firm—</text><subparagraph id="ida70c3896a1bd4a26897f456553949243"><enum>(A)</enum><text>the gross annual sales of which are less than $100,000,000;</text></subparagraph><subparagraph id="id6a2a596293424fc1b438a0b379e28153"><enum>(B)</enum><text>that has fewer than 500 employees at the plant site of the manufacturing firm; and</text></subparagraph><subparagraph id="id244a8b6be96a4d70a66c2181a371cfa6" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text>the annual energy bills of which total more than $100,000 but less than $2,500,000.</text></subparagraph></paragraph></subsection><subsection id="id969bda20554c420ebd89eebea11ed014"><enum>(b)</enum><header>Establishment</header><text>The Secretary shall establish a program within the Office of Energy Efficiency and Renewable Energy under which the Secretary shall provide grants to eligible entities to implement covered projects.</text></subsection><subsection id="ide48474661c1f41a2a89143ed960ee4f3"><enum>(c)</enum><header>Application</header><text>An eligible entity seeking a grant under the program shall submit to the Secretary an application at such time, in such manner, and containing such information as the Secretary may require, including a demonstration of need for financial assistance to implement the proposed covered project.</text></subsection><subsection id="idafa626967bc040929f95e15aed205206"><enum>(d)</enum><header>Priority</header><text>In awarding grants under the program, the Secretary shall give priority to eligible entities that—</text><paragraph id="id879a05882f3c48bf8b5cbb2f738448af"><enum>(1)</enum><text>have had an energy assessment completed by an Industrial Assessment Center; and</text></paragraph><paragraph id="id41d4d5bd8a09415f9a10a086b4321933"><enum>(2)</enum><text>propose to carry out a covered project with a greater potential for—</text><subparagraph id="id3ac62d7fd0b2440384a3401834f7cbec"><enum>(A)</enum><text>energy efficiency gains; or</text></subparagraph><subparagraph id="idb610ae1fd83a4205a36f1390bc5a570d" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text>greenhouse gas emissions reductions. </text></subparagraph></paragraph></subsection><subsection id="id16f52928663b44bcb954b1acc38a11c5"><enum>(e)</enum><header>Grant Amount</header><paragraph id="id0349edb36a0342939a535b14a90b6baa"><enum>(1)</enum><header>Maximum amount</header><text>The amount of a grant provided to an eligible entity under the program shall not exceed $300,000.</text></paragraph><paragraph id="id69be6b3bd6234cdb930a32cef054a102"><enum>(2)</enum><header>Federal share</header><text>A grant awarded under the program for a covered project shall be in an amount that is not more than 50 percent of the cost of the covered project.</text></paragraph><paragraph id="id7b742d17fb9d42daa1684f154ec0e3cb"><enum>(3)</enum><header>Supplement</header><text>A grant received by an eligible entity under the program shall supplement, not supplant, any private or State funds available to the eligible entity to carry out the covered project. </text></paragraph></subsection><subsection id="idb8ba99eb92444979b45c9ab880dcc64a"><enum>(f)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to the Secretary to carry out this section $100,000,000 for each of fiscal years 2022 through 2026, to remain available until expended.</text></subsection></section><section id="idFADBB471092243A486E63ECC7ED197C5"><enum>3.</enum><header>Industrial assessment center technical assistance</header><text display-inline="no-display-inline">Section 452 of the Energy Independence and Security Act of 2007 (<external-xref legal-doc="usc" parsable-cite="usc/42/17111">42 U.S.C. 17111</external-xref>) is amended—</text><paragraph id="idFCD9CF38CCB64997B68ACEF20672C42D"><enum>(1)</enum><text>in subsection (a), by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id3B9BCA93FE5F4CE5A59E53E5C1E653D9"><paragraph id="id85C1789D61F549BA867BEB30A7D117F1"><enum>(6)</enum><header>Small- or medium-sized manufacturer</header><text>The term <term>small- or medium-sized manufacturer</term> means a manufacturing firm—</text><subparagraph id="id25FCDC4DD2D1463A95DBA93B6D5ACB40"><enum>(A)</enum><text>the gross annual sales of which are less than $100,000,000;</text></subparagraph><subparagraph id="id2C393AAB807140F2BDD029CE85D790D1"><enum>(B)</enum><text>that has fewer than 500 employees at the plant site of the manufacturing firm; and</text></subparagraph><subparagraph id="idAC761111D9174E4C8021A79AADA77A76" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text>the annual energy bills of which total more than $100,000 but less than $2,500,000.</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="id8E1B46F8D98B4BC29F9D721825EEE18D"><enum>(2)</enum><text>in subsection (e)—</text><subparagraph id="id2FA4357C30FA4AAB9C66A6D5AB9EC8B9"><enum>(A)</enum><text>in paragraph (4), by striking <quote>and</quote> at the end;</text></subparagraph><subparagraph id="id3CFDBD97DD87485FB2A2576FBC0A27BB"><enum>(B)</enum><text>in paragraph (5), by striking the period at the end and inserting <quote>; and</quote>; and</text></subparagraph><subparagraph id="idCA5A2703F15A47458641757B435AC420"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id5D3F6E100C3241A7A4358B1F3D88D8D7"><paragraph id="idbb1a162131074fbc963bc6192e4cb936"><enum>(6)</enum><text>to provide technical assistance to small- and medium-sized manufacturers, for which the industrial research and assessment center has completed an energy assessment, to upgrade, retrofit, or replace systems or infrastructure consistent with recommendations made in the energy assessment.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></section></legis-body></bill>
