which was read twice and referred to the <committee-name committee-id="SSFI00">Committee on Finance</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title XI of the Social Security Act to establish internet website-based dashboards to allow the public to review information on spending for, and utilization of, prescription drugs and biologicals covered under the Medicare and Medicaid programs.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Prescription Drug Pricing Dashboard Act</short-title></quote>.</text></section><section id="idA36775876366414183E29E51E5D6061C"><enum>2.</enum><header>Prescription drug pricing dashboards</header><text display-inline="no-display-inline">Part A of title XI of the Social Security Act is amended by adding at the end the following new section:</text><quoted-block id="id6C7F9316EBE9467CB30CA3AEE05C8049" display-inline="no-display-inline" style="OLC"><section id="id1432BEDCA383475E9C7C7987327CFEA8"><enum>1150D.</enum><header>Prescription drug pricing dashboards</header><subsection id="id3c06c85a67b245e996fefb3024c3b8dc"><enum>(a)</enum><header>In general</header><text>Beginning not later than January 1, 2022, the Secretary shall establish, and annually update, internet website-based dashboards, through which beneficiaries, clinicians, researchers, and the public can review information on spending for, and utilization of, prescription drugs and biologicals (and related supplies and mechanisms of delivery) covered under each of parts B and D of title XVIII and under a State program under title XIX, including information on trends of such spending and utilization over time.</text></subsection><subsection id="idC0E7B5C7198C410DB4BD77934417BAE7"><enum>(b)</enum><header>Medicare part B drug and biological dashboard</header><paragraph id="id318D1F0616B844F8ACD77195DFBF934B"><enum>(1)</enum><header>In general</header><text>The dashboard established under subsection (a) for part B of title XVIII shall provide the information described in paragraph (2).</text></paragraph><paragraph id="idE7C917DF3C8F4B978E2E9974364D714A"><enum>(2)</enum><header>Information described</header><text>The information described in this paragraph is the following information with respect to drug or biologicals covered under such part B:</text><subparagraph id="idc6cbc01c3df041689a4ada73437ebc06"><enum>(A)</enum><text>The brand name and, if applicable, the generic names of the drug or biological.</text></subparagraph><subparagraph id="id4119707A34584E5695363770B64E26C0"><enum>(B)</enum><text>Consumer-friendly information on the uses and clinical indications of the drug or biological.</text></subparagraph><subparagraph id="id52C26F461207428798068D2E0C331CFA"><enum>(C)</enum><text>The manufacturer or labeler of the drug or biological.</text></subparagraph><subparagraph id="id2D28E1D95779476686FC846C2F3C43DB"><enum>(D)</enum><text>To the extent feasible, the following information:</text><clause id="id183105ba0145418492df487976b0f3ed"><enum>(i)</enum><text>Average total spending per dosage unit of the drug or biological in the most recent 2 calendar years for which data is available.</text></clause><clause id="id635b4cafc1ad4a2d8d6accf7d25d2fba"><enum>(ii)</enum><text>The percentage change in average spending on the drug or biological per dosage unit between the most recent calendar year for which data is available and—</text><subclause id="idB0E0A907A5A540ECB1C036F6CBF51777"><enum>(I)</enum><text>the preceding calendar year; and</text></subclause><subclause id="idA54AFA8AAD544FD0BCD170110B9CFFCC"><enum>(II)</enum><text>the preceding 5 and 10 calendar years.</text></subclause></clause><clause id="idfbcc639db5b84295a845a1488db12499"><enum>(iii)</enum><text>The annual growth rate in average spending per dosage unit of the drug or biological in the most recent 5 or 10 calendar years for which data is available.</text></clause><clause id="id9cae5c4a62c340c983712aaca91cc7bf"><enum>(iv)</enum><text>Total spending for the drug or biological for the most recent calendar year for which data is available.</text></clause><clause id="idbba9b57b10cd4eaab8fb4fe7e5d88343"><enum>(v)</enum><text>The number of beneficiaries receiving the drug or biological in the most recent calendar year for which data is available.</text></clause><clause id="id9101a3ec37f6407b8e9d741d2191309b"><enum>(vi)</enum><text>Average spending on the drug per beneficiary for the most recent calendar year for which data is available.</text></clause></subparagraph><subparagraph id="idE7838108410E45AEA683BE3CFCE38350"><enum>(E)</enum><text>The average sales price of the drug or biological (as determined under section 1847A) for the most recent quarter.</text></subparagraph><subparagraph commented="no" id="id0087feea00f84c5ab9198a688b96510d"><enum>(F)</enum><text>Consumer-friendly information about the coinsurance amount for the drug or biological for beneficiaries for the most recent quarter. Such information shall not include coinsurance amounts for qualified medicare beneficiaries (as defined in section 1905(p)(1)).</text></subparagraph><subparagraph id="idc1f950fc14f040ebb5396f068e305ec6"><enum>(G)</enum><text>For the most recent calendar year for which data is available—</text><clause id="idF736542A7B734DA8B76830B5CF0F1054"><enum>(i)</enum><text>the 15 drugs and biologicals with the highest total spending under such part; and</text></clause><clause id="id1e2df3799c33495baaf2ffb7f48ddbec"><enum>(ii)</enum><text>any drug or biological for which the average annual per beneficiary spending exceeds the gross spending for covered part D drugs at which the annual out-of-pocket threshold under section 1860D–2(b)(4)(B) would be met for the year.</text></clause></subparagraph><subparagraph commented="no" id="id0727D0F40DE34568A18669A85EDCAC72"><enum>(H)</enum><text>Other information (not otherwise prohibited in law from being disclosed) that the Secretary determines would provide beneficiaries, clinicians, researchers, and the public with helpful information about drug and biological spending and utilization (including trends of such spending and utilization).</text></subparagraph></paragraph></subsection><subsection id="id1FB682792EB4494694787C7D1825ABFB"><enum>(c)</enum><header>Medicare covered part D drug dashboard</header><paragraph id="id787BA42320DF446FA1AC904DDE87DDDD"><enum>(1)</enum><header>In general</header><text>The dashboard established under subsection (a) for part D of title XVIII shall provide the information described in paragraph (2).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4EE360AAF97E4F8E91C5EF3F50EF9AD1"><enum>(2)</enum><header>Information described</header><text>The information described in this paragraph is the following information with respect to covered part D drugs under such part D:</text><subparagraph commented="no" display-inline="no-display-inline" id="id8E44B629E13E4C35AA9243A49DA84C52"><enum>(A)</enum><text>The information described in subparagraphs (A) through (D) of subsection (b)(2).</text></subparagraph><subparagraph id="idec85bcce16d345cf8f24cb1fae705e21"><enum>(B)</enum><text>Information on average annual beneficiary out-of-pocket costs below and above the annual out-of-pocket threshold under section 1860D–2(b)(4)(B) for the current plan year. Such information shall not include out-of-pocket costs for subsidy eligible individuals under section 1860D–14.</text></subparagraph><subparagraph id="id527d4938bfc5438a9bb22d5a5348575a"><enum>(C)</enum><text>Information on how to access resources as described in sections 1860D–1(c) and 1851(d).</text></subparagraph><subparagraph id="id509DBF5D449B4FE1A3EC4BDB69A057C1"><enum>(D)</enum><text>For the most recent calendar year for which data is available—</text><clause id="id1756D4CCBE114FB79FE8E860E1F6ECDC"><enum>(i)</enum><text>the 15 covered part D drugs with the highest total spending under such part; and</text></clause><clause id="idC992C2F8C3764730A9B99359EF409BBA"><enum>(ii)</enum><text>any covered part D drug for which the average annual per beneficiary spending exceeds the gross spending for covered part D drugs at which the annual out-of-pocket threshold under section 1860D–2(b)(4)(B) would be met for the year.</text></clause></subparagraph><subparagraph commented="no" id="id3D4C18130E2A42C9AADA62A7FD8FD5FF"><enum>(E)</enum><text>Other information (not otherwise prohibited in law from being disclosed) that the Secretary determines would provide beneficiaries, clinicians, researchers, and the public with helpful information about covered part D drug spending and utilization (including trends of such spending and utilization).</text></subparagraph></paragraph></subsection><subsection id="id662EF2B4096940B88338C0D034EE5F7B"><enum>(d)</enum><header>Medicaid covered outpatient drug dashboard</header><paragraph id="id7ADC7AF3609844909A588F4F5F4824D5"><enum>(1)</enum><header>In general</header><text>The dashboard established under subsection (a) for title XIX shall provide the information described in paragraph (2).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id22CF28B5799E4DA59F0D5469499A7325"><enum>(2)</enum><header>Information described</header><text>The information described in this paragraph is the following information with respect to covered outpatient drugs under such title:</text><subparagraph commented="no" display-inline="no-display-inline" id="id50B4D42604D44D0EA8FC5563491E8543"><enum>(A)</enum><text>The information described in subparagraphs (A) through (D) of subsection (b)(2).</text></subparagraph><subparagraph id="idEFB62D230C0D4CBAAB99265AE8A0A5A5"><enum>(B)</enum><text>For the most recent calendar year for which data is available, the 15 covered outpatient drugs with the highest total spending under such title.</text></subparagraph><subparagraph commented="no" id="idAA9A1703855941F38930D5A66B3D2F53"><enum>(C)</enum><text>Other information (not otherwise prohibited in law from being disclosed) that the Secretary determines would provide beneficiaries, clinicians, researchers, and the public with helpful information about covered outpatient drug spending and utilization (including trends of such spending and utilization).</text></subparagraph></paragraph></subsection><subsection id="id6ddac4d6aadf4bd9a23687e46b8bd956" commented="no" display-inline="no-display-inline"><enum>(e)</enum><header>Data files</header><text>The Secretary shall make available the underlying data for each dashboard established under subsection (a) in a machine-readable format.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
