which was read twice and referred to the <committee-name committee-id="SSSB00">Committee on Small Business and Entrepreneurship</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To expand access to capital in underserved markets by providing resources for the Small Business Administration to approve additional Non-Federally Regulated Lenders to make business loans guaranteed by the Small Business Administration to small business concerns in low-income and moderate-income neighborhoods. </official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Fair Access to Small Business Lending Act</short-title></quote>.</text></section><section id="id591088DA9F0E406CBF67097AD9985AA8"><enum>2.</enum><header>Fair access to small business lending</header><text display-inline="no-display-inline">Section 7(a)(17) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(a)(17)</external-xref>) is amended—</text><paragraph id="id74199424AFAD4332BFA728D3FE607C12"><enum>(1)</enum><text>by striking <quote>(17) The Administration</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idA9584EDE16544465B23FAFEF45BF6487"><paragraph id="idF33CC8FCC337499F84F1C76C5A60B11F"><enum>(17)</enum><header>Authorization of lenders</header><subparagraph id="id1CA0B8F86077467B97AE26ABDA5C0EEE"><enum>(A)</enum><header>In general</header><text>The Administration</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="id2583C4CD77844FB8B70452A497199405"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id46B5134D16394ABFB89AE08192DC43D2"><subparagraph id="idBD814195902E4A068030BF7846285F6B"><enum>(B)</enum><header>Access to capital for underserved markets</header><clause id="id77D944D15D554FFB8A0BCCE6B2D03B7F"><enum>(i)</enum><header>Definitions</header><text>In this subparagraph—</text><subclause id="id5166745BF3A34CB6B891C5F3891A5200"><enum>(I)</enum><text>the term <term>covered Non-Federally Regulated Lender</term> means a Non-Federally Regulated Lender (as defined in section 120.10 of title 13, Code of Federal Regulations, or any successor thereto) that—</text><item id="id197944B1E16A4C5D9CAA068617EB9053"><enum>(aa)</enum><text>has not been approved to make loans guaranteed under this subsection; and</text></item><item id="id7555FC3EFE894900BB98245A72B56358"><enum>(bb)</enum><text>meets the applicable criteria for authorizing lenders to make loans guaranteed under this subsection; and</text></item></subclause><subclause id="id8AA4BE8461434F3491F19080895098CA"><enum>(II)</enum><text>the term <term>low or moderate-income neighborhood</term> means a neighborhood that is a low-income neighborhood or a moderate-income neighborhood, for the purposes of the Community Reinvestment Act of 1977 (<external-xref legal-doc="usc" parsable-cite="usc/12/2901">12 U.S.C. 2901</external-xref> et seq.).</text></subclause></clause><clause id="idFF253D3C009445B082A7E60D060981BC"><enum>(ii)</enum><header>Initiative</header><subclause id="idBDF92FDEEC3F46E78A11E9ABE18768EC"><enum>(I)</enum><header>In general</header><text>The Administrator, acting through the Office of Credit Risk Management, shall carry out an initiative to authorize covered Non-Federally Regulated Lenders to make loans guaranteed under this subsection that is targeted to expanding the availability of loans guaranteed under this subsection to small business concerns that are located in a low or moderate-income neighborhood.</text></subclause><subclause id="idAE034F64489842E683AB84654F755C09"><enum>(II)</enum><header>Authority</header><text>Under the initiative under subclause (I), the Administrator may not approve a covered Non-Federally Regulated Lender to only be eligible to make loans guaranteed under the Community Advantage Pilot Program of the Administration. </text></subclause><subclause id="idB0D5B67C9FA94CB99BD08A62714C44C0"><enum>(III)</enum><header>Lenders</header><text>A covered Non-Federally Regulated Lender that becomes authorized to make loans guaranteed under this subsection under the initiative under subclause (I) shall ensure that not less than 50 percent of the loans made by the covered Non-Federally Regulated Lender that are guaranteed under this subsection are made to small business concerns that are located in a low or moderate-income neighborhood.</text></subclause></clause><clause id="idA42D818F77784C9F8544C53EB697967E" commented="no" display-inline="no-display-inline"><enum>(iii)</enum><header display-inline="yes-display-inline">Funding</header><text display-inline="yes-display-inline">For fiscal year 2021, and each fiscal year thereafter, there is appropriated to the Administrator, out of any money in the Treasury not otherwise appropriated, such sums as are necessary to carry out the initiative under clause (ii).</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
