<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>1st Session</session><legis-num>S. 1424</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20210428">April 28, 2021</action-date><action-desc><sponsor name-id="S303">Mr. Thune</sponsor> (for himself and <cosponsor name-id="S277">Mr. Carper</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSFI00">Committee on Finance</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Internal Revenue Code of 1986 to permit high deductible health plans to provide chronic disease prevention services to plan enrollees prior to satisfying their plan deductible.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Chronic Disease Management Act of 2021</short-title></quote>.</text></section><section id="H85214FD05E39427BA084BCF467079E47"><enum>2.</enum><header>Chronic disease prevention</header><subsection id="H55DE3AF18A654D419C811BF28823FA0F"><enum>(a)</enum><header>In general</header><text><external-xref legal-doc="usc" parsable-cite="usc/26/223">Section 223(c)(2)</external-xref> of the Internal Revenue Code of 1986 is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H16A029DF4C3746F1855D22CC25433A11"><subparagraph id="HF558D74351C14475B36076937AAFAED9"><enum>(F)</enum><header>Preventive care services and items for chronic conditions</header><text>For purposes of subparagraph (C)—</text><clause id="idF5A29DF27EED46C8BF03201EC04C0143"><enum>(i)</enum><text>preventive care shall include any service or item used to treat an individual with a chronic condition if—</text><subclause id="idFE7EB4FAF0AE4BEC8970E87A51E9D0B9"><enum>(I)</enum><text>such service or item is low-cost,</text></subclause><subclause id="id544CFA8769AE473598774AD02F74B96B"><enum>(II)</enum><text>in regards to such service or item, there is medical evidence supporting high cost efficiency of preventing exacerbation of the chronic condition or the development of a secondary condition, and</text></subclause><subclause id="idD619AA7C6E244500ACCA8DB2A1DF6EDC"><enum>(III)</enum><text>there is a strong likelihood, documented by clinical evidence, that with respect to the class of individuals utilizing such service or item, the specific service or use of the item will prevent the exacerbation of the chronic condition or the development of a secondary condition that requires significantly higher cost treatments, and</text></subclause></clause><clause id="idE6E5548658124B819823ECC0BB1D9D02"><enum>(ii)</enum><text>an individual who has been prescribed preventive care for any chronic condition may be presumed to have been diagnosed with such condition if such preventive care is customarily prescribed for such condition.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H182186FCDD8249CA9ABC3C652B21F025"><enum>(b)</enum><header>Effective date</header><text>The amendment made by this section shall apply to coverage for months beginning after the date of the enactment of this Act.</text></subsection></section></legis-body></bill>
