<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>1st Session</session><legis-num>S. 1423</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20210428">April 28, 2021</action-date><action-desc><sponsor name-id="S253">Mr. Durbin</sponsor> (for himself, <cosponsor name-id="S369">Mr. Markey</cosponsor>, <cosponsor name-id="S341">Mr. Blumenthal</cosponsor>, and <cosponsor name-id="S361">Ms. Hirono</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Children’s Online Privacy Protection Act of 1998 to give Americans the option to delete personal information collected by internet operators as a result of the person’s internet activity prior to age 13.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Clean Slate for Kids Online Act of 2021</short-title></quote>.</text></section><section id="id45b78ded731d43538d1c58463aade36a"><enum>2.</enum><header>Enhancing the Children’s Online Privacy Protection Act of 1998</header><subsection id="idC6C778FD2B72447F9017390D228739C5"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">Section 1302 of the Children's Online Privacy Protection Act of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/15/6501">15 U.S.C. 6501</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id3654D47A005045739552CE364C706594"><paragraph id="id9174626ed8984bdc972bf155e257b643"><enum>(13)</enum><header>Delete</header><text>The term <term>delete</term> means to remove personal information such that the information is not maintained in retrievable form and cannot be retrieved in the normal course of business.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id51a8ec2656fb4b6b83cc3a1314739548"><enum>(b)</enum><header>Regulation of unfair and deceptive acts and practices in connection with the collection and use of
 personal information from and about children on the internet</header><text>Section 1303 of the Children's Online Privacy Protection Act of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/15/6502">15 U.S.C. 6502</external-xref>) is amended—</text><paragraph id="id2F77D6650C774A0D8320F6D0F590C230"><enum>(1)</enum><text>in subsection (a), by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id5799A65B6F0F498BB6128A49D6FA0A95"><paragraph id="id741739e627cd439296ae424a22b55801"><enum>(3)</enum><header>Failure to delete</header><text>It is unlawful for an operator of a website or online service directed to children, or any operator that has actual knowledge that it is collecting personal information from a child, to fail to delete personal information collected from or about a child if a request for deletion is made pursuant to regulations prescribed under subsection (e).</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="idBE78EBA289A442FFB0A583C48AE239D7"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id4637062A427C43D3BAA10C6497289A42"><subsection id="id21d69fb83ca34ddea30a00200b2189f6"><enum>(e)</enum><header>Right of an individual To delete personal information collected when the person was a child</header><paragraph id="idf1cd11ed2d0d450e970cabf93845a2e8"><enum>(1)</enum><header>In general</header><text>Not later than 1 year after the date of enactment of this subsection, the Commission shall promulgate under section 553 of title 5, United States Code, regulations that require the operator of any website or online service directed to children, or any operator that has actual knowledge that it has collected personal information from a child or maintains such personal information—</text><subparagraph id="idd6d47dd1f00949848006ece924bf3250"><enum>(A)</enum><text>to provide notice in a prominent place on the website of how an individual over the age of 13, or a legal guardian of an individual over the age of 13 acting with the knowledge and consent of the individual, can request that the operator delete all personal information in the possession of the operator that was collected from or about the individual when the individual was a child notwithstanding any parental consent that may have been provided when the individual was a child;</text></subparagraph><subparagraph id="iddbe9e270ff4844629fea0cfe0d97102c"><enum>(B)</enum><text>to promptly delete all personal information in the possession of the operator that was collected from or about an individual when the individual was a child when such deletion is requested by an individual over the age of 13 or by the legal guardian of such individual acting with the knowledge and consent of the individual, notwithstanding any parental consent that may have been provided when the individual was a child;</text></subparagraph><subparagraph id="idd3d0f97f06e4472f80dc0135341cd0eb"><enum>(C)</enum><text>to provide written confirmation of deletion, after the deletion has occurred, to an individual or legal guardian of such individual who has requested such deletion pursuant to this subsection; and</text></subparagraph><subparagraph id="idc268df4150ee44aaa35a35a2eb1dcab9"><enum>(D)</enum><text>to except from deletion personal information collected from or about a child—</text><clause id="id9D5DDB0F5157431894C19DFD939B1D54"><enum>(i)</enum><text>only to the extent that the personal information is necessary—</text><subclause id="id9783e891546643e4a41921bacec491df"><enum>(I)</enum><text>to respond to judicial process; or</text></subclause><subclause id="id367ec6aacc5d43bcaad7b1a9c292910c"><enum>(II)</enum><text>to the extent permitted under any other provision of law, to provide information to law enforcement agencies or for an investigation on a matter related to public safety; and</text></subclause></clause><clause id="id154D24F562D848629E0035037F498AE6"><enum>(ii)</enum><text>if the operator retain such excepted personal information for only as long as reasonably necessary to fulfill the purpose for which the information has been excepted and that the excepted information not be used, disseminated or maintained in a form retrievable to anyone except for the purposes specified in this subparagraph.</text></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="ida7146f7c757a413a92e83b333e77ddaa"><enum>(c)</enum><header>Safe harbors</header><text>Section 1304 of the Children's Online Privacy Protection Act of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/15/6503">15 U.S.C. 6503</external-xref>) is amended—</text><paragraph id="idbff49ec140c94747b1747e258a414bb6"><enum>(1)</enum><text>in subsection (a), by striking <quote>section 1303(b)</quote> and inserting <quote>subsections (b) and (e) of section 1303</quote>; and</text></paragraph><paragraph id="id4f4fd910a6174a6581e406cadd8a2ebb"><enum>(2)</enum><text>in subsection (b)(1), by striking <quote>subsection (b)</quote> and inserting <quote>subsections (b) and (e)</quote>.</text></paragraph></subsection><subsection id="idCCC8B68B5E974B2D81493039272D2969"><enum>(d)</enum><header>Actions by States</header><text>Section 1305(a)(1) of the Children's Online Privacy Protection Act of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/15/6504">15 U.S.C. 6504(a)(1)</external-xref>) is amended by striking <quote>1303(b)</quote> and inserting <quote>subsection (b) or (e) of section 1303</quote>.</text></subsection></section></legis-body></bill>
