<section section-type="section-one" id="HE0F6DBB8B3934A59B68744B9F2F7B5DF"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Partnerships for Energy Security and Innovation Act of 2021</short-title></quote>.</text></section> <section id="H731A55E67A13431BA4208F1A44FAED15"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
<paragraph id="id7cad65bfa782424f919d1abfd93d0c92"><enum>(1)</enum><header>Board</header><text>The term <term>Board</term> means the Board of Directors described in section 3(b)(1).</text></paragraph> <paragraph id="idF6302B51D4AA4F12A52101953B86BD1C"><enum>(2)</enum><header>Department</header><text>The term <term>Department</term> means the Department of Energy.</text></paragraph>
<paragraph id="id0E29FED0822B4EB6AB08913D76B63EB3"><enum>(3)</enum><header>Executive Director</header><text>The term <quote>Executive Director</quote> means the Executive Director described in section 3(e)(1).</text></paragraph> <paragraph id="H1DD86B6CE5B34301B7F8DD09C793320D"><enum>(4)</enum><header>Foundation</header><text>The term <term>Foundation</term> means the Foundation for Energy Security and Innovation established under section (3)(a). </text></paragraph>
<paragraph id="id7fe154a102594e3cb09a98daef7b61cb"><enum>(5)</enum><header>National Laboratory</header><text>The term <term>National Laboratory</term> has the meaning given the term in section 2 of the Energy Policy Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/42/15801">42 U.S.C. 15801</external-xref>). </text></paragraph> <paragraph id="H440FAFA025334385B27305C309CCDA55"><enum>(6)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Energy.</text></paragraph></section>
<section section-type="subsequent-section" id="id02DE407F50744020BA917EC2E7D256B5"><enum>3.</enum><header>Foundation for Energy Security and Innovation</header>
<subsection id="id83706114D68C4990B8CCE62FB6CAA6C2"><enum>(a)</enum><header>Establishment</header>
<paragraph id="idE3E89874982D4E2BB6E4B29A91565A6F"><enum>(1)</enum><header>In general</header><text>Not later than 180 days after the date of enactment of this Act, the Secretary shall establish a nonprofit corporation to be known as the <quote>Foundation for Energy Security and Innovation</quote>.</text></paragraph> <paragraph id="id68316407A2F440218034D5D73906951C"><enum>(2)</enum><header>Mission</header><text>The mission of the Foundation shall be—</text>
<subparagraph id="idC8E3B00F35954AA7A3623E70F6BBE0F2"><enum>(A)</enum><text>to support the mission of the Department; and </text></subparagraph> <subparagraph id="id7940B71462CB45D7BBBABF7043B4190E"><enum>(B)</enum><text>to advance collaboration with energy researchers, institutions of higher education, industry, and nonprofit and philanthropic organizations to accelerate the commercialization of energy technologies.</text></subparagraph></paragraph>
<paragraph id="id55F99DB38D18419B9C564C87317A8961"><enum>(3)</enum><header>Limitation</header><text>The Foundation shall not be an agency or instrumentality of the Federal Government.</text></paragraph> <paragraph id="idc16400862b764b43b62768f2381af6fa"><enum>(4)</enum><header>Tax-exempt status</header><text>The Board shall take all necessary and appropriate steps to ensure that the Foundation is an organization that is described in <external-xref legal-doc="usc" parsable-cite="usc/26/501">section 501(c)</external-xref> of the Internal Revenue Code of 1986 and exempt from taxation under section 501(a) of that Code.</text></paragraph>
<paragraph id="idCD57A00409094095A578BEE143D50F40"><enum>(5)</enum><header>Collaboration with existing organizations</header><text>The Secretary may collaborate with 1 or more organizations to establish the Foundation and carry out the activities of the Foundation.</text></paragraph></subsection> <subsection id="id4FC58E6B626447DDA3BBBBE0FA77BA6B"><enum>(b)</enum><header>Board of Directors</header> <paragraph id="idA30238DF95D3466DA3EC2F53BA3DB60C"><enum>(1)</enum><header>Establishment</header><text>The Foundation shall be governed by a Board of Directors.</text></paragraph>
<paragraph id="idFFE81871AA704514910C7DC653927819"><enum>(2)</enum><header>Composition</header>
<subparagraph id="id46FB3BEC05004B2AA98DA28FF19D0037"><enum>(A)</enum><header>In general</header><text>The Board shall be composed of the ex officio nonvoting members described in subparagraph (B) and the appointed voting members described in subparagraph (C).</text></subparagraph> <subparagraph id="id251ffc0919ae49dc9afdafa1e6f23b7c"><enum>(B)</enum><header>Ex officio members</header><text>The ex officio members of the Board shall be the following individuals or designees of those individuals:</text>
<clause id="idfb6c2d64ef3445088c11d7f653a387b0"><enum>(i)</enum><text>The Secretary.</text></clause> <clause id="id33d9808befcb48d3829f6808eca46073"><enum>(ii)</enum><text>The Under Secretary for Science and Energy.</text></clause>
<clause id="id0185fcb15f3f4a72bb2bb095bc1cc486"><enum>(iii)</enum><text>The Under Secretary for Nuclear Security.</text></clause> <clause id="id162bfded996a48b48d9205cc659287ca"><enum>(iv)</enum><text>The Chief Commercialization Officer. </text></clause></subparagraph>
<subparagraph id="id3C0241586DA246B5A9CF78DCEDA8D718"><enum>(C)</enum><header>Appointed members</header>
<clause id="id565BFB6732E247D1AA0FB0E22E5D2CCE"><enum>(i)</enum><header>Initial members</header><text>The Secretary and the other ex officio members of the Board shall—</text> <subclause id="id9BF5706F82D44852A6235EF9B1C0181D"><enum>(I)</enum><text>seek to enter into an agreement with the National Academies of Sciences, Engineering, and Medicine to develop a list of individuals to serve as members of the Board who are well-qualified and will meet the requirements of clauses (ii) and (iii); and</text></subclause>
<subclause id="id61D44EE8AB7242D49E448ADA6E23A1B6"><enum>(II)</enum><text>appoint the initial members of the Board from that list, if applicable, in consultation with the National Academies of Sciences, Engineering, and Medicine.</text></subclause></clause> <clause id="id4218CF3C9F93477EB422F2D62DB12321"><enum>(ii)</enum><header>Representation</header><text>The appointed members of the Board shall reflect a broad cross-section of stakeholders from academia, industry, nonprofit organizations, State or local governments, the investment community, the philanthropic community, and management and operating contractors of the National Laboratories. </text></clause>
<clause id="id07D6027F3C7D46CABFF4CE1963ACF683"><enum>(iii)</enum><header>Experience</header><text>The Secretary shall ensure that a majority of the appointed members of the Board—</text> <subclause id="idBF7354A0B2F242789F920823C703D9AD"><enum>(I)</enum> <item commented="no" display-inline="yes-display-inline" id="idBA9B92A5B38049BA9DDA61D6D46E251F"><enum>(aa)</enum><text>has experience in the energy sector;</text></item>
<item indent="up1" id="idF0AE3AA7C53B45989F5D6D179ABFCD37"><enum>(bb)</enum><text>has research experience in the energy field; or</text></item> <item indent="up1" id="id305335E1ABF44D1E8C229A4A4647D5D7"><enum>(cc)</enum><text>has experience in technology commercialization or foundation operations; and</text></item></subclause>
<subclause id="idA39C1854BA704AF6874E5A8C5D041122"><enum>(II)</enum><text>to the extent practicable, represents diverse regions, sectors, and communities.</text></subclause></clause></subparagraph></paragraph> <paragraph id="id92F014AAE83149FDAFAA3DEDD33B3BA5"><enum>(3)</enum><header>Chair and Vice Chair</header> <subparagraph id="id8248108EF9094B129742501A2DAA1263"><enum>(A)</enum><header>In general</header><text>The Board shall designate from among the members of the Board—</text>
<clause id="idE9270E01580F477999C40703F4F51A08"><enum>(i)</enum><text>an individual to serve as Chair of the Board; and </text></clause> <clause id="idB31761EBC4634EA6B563FB7E71C95ED1"><enum>(ii)</enum><text>an individual to serve as Vice Chair of the Board. </text></clause></subparagraph>
<subparagraph id="id3FD727F3D5CC45539A7F57393A6AFC43"><enum>(B)</enum><header>Terms</header><text>The term of service of the Chair and Vice Chair of the Board shall end on the earlier of—</text> <clause id="id8FD4786602234FD2B1475B9E3311101B"><enum>(i)</enum><text>the date that is 3 years after the date on which the Chair or Vice Chair of the Board, as applicable, is designated for the position; and</text></clause>
<clause id="id0235E7B7726046CCB71DF816BD6E396B"><enum>(ii)</enum><text>the last day of the term of service of the member, as determined under paragraph (4)(A), who is designated to be Chair or Vice Chair of the Board, as applicable. </text></clause></subparagraph> <subparagraph id="idA4096F0917824701AC605A36F85A2FCD"><enum>(C)</enum><header>Representation</header><text>The Chair and Vice Chair of the Board—</text>
<clause id="id8E3BEBC99E1F4DD2AD8A77AC678B5F40"><enum>(i)</enum><text>shall not be representatives of the same area of subject matter expertise, or entity, as applicable, under paragraph (2)(C)(ii); and</text></clause> <clause id="id3C1C7FF251FC4105A44AC957B5EAFA23"><enum>(ii)</enum><text>shall not be representatives of any area of subject matter expertise, or entity, as applicable, represented by the immediately preceding Chair and Vice Chair of the Board.</text></clause></subparagraph></paragraph>
<paragraph id="id4473E069551344989D9A6CFCC02184EC"><enum>(4)</enum><header>Terms and vacancies</header>
<subparagraph id="id656FFAFD415649DA82A1579B643DC997"><enum>(A)</enum><header>Terms</header>
<clause id="idFE511D1BF7F849109202D5E32DDFFCC0"><enum>(i)</enum><header>In general</header><text>The term of service of each appointed member of the Board shall be not more than 5 years.</text></clause> <clause id="id3709499B5C8B4FB7943670501F765AE4"><enum>(ii)</enum><header>Initial appointed members</header><text>Of the initial members of the Board appointed under paragraph (2)(C)(i), half of the members shall serve for 4 years and half of the members shall serve for 5 years, as determined by the Chair of the Board.</text></clause></subparagraph>
<subparagraph id="id1EB74CD08E594A20AF54A711BB41B0BB"><enum>(B)</enum><header>Vacancies</header><text>Any vacancy in the membership of the appointed members of the Board—</text> <clause id="id34D06B87D9344472B7806BEFCFB28236" commented="no"><enum>(i)</enum><text>shall be filled in accordance with the bylaws of the Foundation by an individual capable of representing the same area or entity, as applicable, as represented by the vacating board member under paragraph (2)(C)(ii); </text></clause>
<clause id="idFF8B0A9F6CF34CEB9C8860C862C27D3A"><enum>(ii)</enum><text>shall not affect the power of the remaining appointed members to execute the duties of the Board; and</text></clause> <clause id="id658DE5D5F6A14A7B804EDD9B962D7DD6"><enum>(iii)</enum><text>shall be filled by an individual selected by the Board.</text></clause></subparagraph></paragraph>
<paragraph id="id133E763632BA4928A23018C283D3FFC4"><enum>(5)</enum><header>Meetings; quorum</header>
<subparagraph id="idD257CA0B71764618BFD9522347C0798E"><enum>(A)</enum><header>Initial meeting</header><text>Not later than 60 days after the Board is established, the Secretary shall convene a meeting of the ex officio and appointed members of the Board to incorporate the Foundation.</text></subparagraph> <subparagraph id="id162CDB8B93E44E3E885815A34B41CD5C"><enum>(B)</enum><header>Quorum</header><text>A majority of the appointed members of the Board shall constitute a quorum for purposes of conducting the business of the Board. </text></subparagraph></paragraph>
<paragraph id="id769EBEA1B95A461AA180C234F19CDDF4"><enum>(6)</enum><header>Duties</header><text>The Board shall—</text> <subparagraph id="id142A2A292530413B937B9F16459CC392"><enum>(A)</enum><text>establish bylaws for the Foundation in accordance with paragraph (7);</text></subparagraph>
<subparagraph id="id32DC06F7C9D5435FACA28848844C1CBE"><enum>(B)</enum><text>provide overall direction for the activities of the Foundation and establish priority activities;</text></subparagraph> <subparagraph id="idB8719426FB84489191EBE0A2A60226EA"><enum>(C)</enum><text>carry out any other necessary activities of the Foundation;</text></subparagraph>
<subparagraph id="idB082631364A340AF891FA019417F0139"><enum>(D)</enum><text>evaluate the performance of the Executive Director; and</text></subparagraph> <subparagraph id="id7351BAFAAF024B0DAFAC4D461F7EA272"><enum>(E)</enum><text>actively solicit and accept funds, gifts, grants, devises, or bequests of real or personal property to the Foundation, including from private entities.</text></subparagraph></paragraph>
<paragraph id="idC293563D890948ED847A3A7615A3E7B5"><enum>(7)</enum><header>Bylaws</header>
<subparagraph id="idB2170CF75E95411BA4B35E27738AB7A6"><enum>(A)</enum><header>In general</header><text>The bylaws established under paragraph (6)(A) may include—</text> <clause id="id79E8D5C8E6E24B4EB29113105C26CC9A"><enum>(i)</enum><text>policies for the selection of Board members, officers, employees, agents, and contractors of the Foundation;</text></clause>
<clause id="id752B31FF840C4EC09960CAC02505D46E"><enum>(ii)</enum><text>policies, including ethical standards, for—</text> <subclause id="id7B69A3E8A6E2401DBBCB5714F027DD43"><enum>(I)</enum><text>the acceptance, solicitation, and disposition of donations and grants to the Foundation, including appropriate limits on the ability of donors to designate, by stipulation or restriction, the use or recipient of donated funds; and</text></subclause>
<subclause id="idD344CA5EAC444F539CFA7BCF36DDB6C3"><enum>(II)</enum><text>the disposition of assets of the Foundation;</text></subclause></clause> <clause id="idE7AFDF2453B2449CB6BD4EF7FBAD6DA6"><enum>(iii)</enum><text>policies that subject all employees, fellows, trainees, and other agents of the Foundation (including ex officio and appointed members of the Board) to conflict of interest standards; and</text></clause>
<clause id="id975DBB9C1C5A4A6AB621232A76B7AAF9" commented="no" display-inline="no-display-inline"><enum>(iv)</enum><text>the specific duties of the Executive Director.</text></clause></subparagraph> <subparagraph id="idCD68D464B81A4F2286A4DAB250E3D627"><enum>(B)</enum><header>Requirements</header><text>The Board shall ensure that the bylaws of the Foundation and the activities carried out under those bylaws shall not—</text>
<clause id="id644B4AE859E74E90BA5C8918EF60B4E9"><enum>(i)</enum><text>reflect unfavorably on the ability of the Foundation to carry out activities in a fair and objective manner; or</text></clause> <clause id="id2F7371D054F34002B5C662511598F1A8"><enum>(ii)</enum><text>compromise, or appear to compromise, the integrity of any governmental agency or program, or any officer or employee employed by, or involved in, a governmental agency or program.</text></clause></subparagraph></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="id0EEDC30EFFB74F96A86C40AD23FF4EE0"><enum>(8)</enum><header display-inline="yes-display-inline">Compensation</header>
<subparagraph commented="no" display-inline="no-display-inline" id="idF1EFD84406A244E59819A527652878E5"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">No member of the Board shall receive compensation for serving on the Board.</text></subparagraph> <subparagraph id="idDE3AA98C822144CA8F4EB2D5C77C16D8" commented="no" display-inline="no-display-inline"><enum>(B)</enum><header>Certain expenses</header><text display-inline="yes-display-inline">In accordance with the bylaws of the Foundation, members of the Board may be reimbursed for travel expenses, including per diem in lieu of subsistence, and other necessary expenses incurred in carrying out the duties of the Board.</text></subparagraph></paragraph></subsection>
<subsection id="id4749464C98CF4783ABCCBD9B01B8C801"><enum>(c)</enum><header>Purposes</header><text>The purposes of the Foundation are—</text> <paragraph id="id93e9da96f6c4491e9654c96583e4dd14"><enum>(1)</enum><text>to support the Department in carrying out the mission of the Department to ensure the security and prosperity of the United States by addressing energy, environmental, and nuclear challenges through transformative science and technology solutions; and</text></paragraph>
<paragraph id="id52B3C17ECE8D49F3A370D0B3D902CD1F"><enum>(2)</enum><text>to increase private and philanthropic sector investments that support efforts to create, characterize, develop, test, validate, and deploy or commercialize innovative technologies that address crosscutting national energy challenges by methods that include—</text> <subparagraph id="id798FEC436BBE4D8A8D84E62D9CAA212A"><enum>(A)</enum><text>fostering collaboration and partnerships with researchers from the Federal Government, State governments, institutions of higher education, federally funded research and development centers, industry, and nonprofit organizations for the research, development, or commercialization of transformative energy and associated technologies;</text></subparagraph>
<subparagraph id="idA949D33711A54D45804B00B98422B76E"><enum>(B)</enum><text>strengthening and sharing best practices relating to regional economic development through scientific and energy innovation, including in partnership with an Individual Laboratory-Associated Foundation (as defined in subsection (d)(7)(A));</text></subparagraph> <subparagraph id="id8CD8FFCCF6824F79BB18B7684F804A88"><enum>(C)</enum><text>promoting new product development that supports job creation;</text></subparagraph>
<subparagraph id="idD122473D377E4B01BCC6600CA123E9F8"><enum>(D)</enum><text>administering prize competitions to accelerate private sector competition and investment; </text></subparagraph> <subparagraph id="id6ca43250975e418681be7755c8f2a9ee"><enum>(E)</enum><text>supporting programs that advance technology maturation, especially where there may be gaps in Federal or private funding in advancing a technology to deployment or commercialization from the prototype stage to a commercial stage; and</text></subparagraph>
<subparagraph id="id27fffcac26df4020bfb0a0ae686c43dd"><enum>(F)</enum><text>facilitating access to Department facilities, equipment, and human expertise to assist in tackling national challenges. </text></subparagraph></paragraph></subsection> <subsection id="idAECC3E60B8FE42DCB2F8F427185A6699"><enum>(d)</enum><header>Activities</header> <paragraph id="id08F320E97218495F8B63F2F9C4CCE2ED"><enum>(1)</enum><header>Studies, competitions, and projects</header><text>The Foundation may conduct and support studies, competitions, projects, and other activities that further the purposes of the Foundation described in subsection (c).</text></paragraph>
<paragraph id="id2F612A78F1CE4810970735D6C419EFEC"><enum>(2)</enum><header>Fellowships and grants</header>
<subparagraph id="idFB627BEAEA6646D4B781351AD67C8F40"><enum>(A)</enum><header>In general</header><text>The Foundation may award fellowships and grants for activities relating to research, development, demonstration, maturation, or commercialization of energy and other Department-supported technologies.</text></subparagraph> <subparagraph id="id7A7C54C9AB8948719AD086539C60CAC9"><enum>(B)</enum><header>Form of award</header><text>A fellowship or grant under subparagraph (A) may consist of a stipend, health insurance benefits, funds for travel, and funds for other appropriate expenses.</text></subparagraph>
<subparagraph id="id2AE6876B3CBB43C390E1F5EFE7F78796"><enum>(C)</enum><header>Selection</header><text>In selecting a recipient for a fellowship or grant under subparagraph (A), the Foundation—</text> <clause id="id45B54DA0FDA54E43ADAFB4DDE84A24B7"><enum>(i)</enum><text>shall make the selection based on the technical and commercialization merits of the proposed project of the potential recipient; and</text></clause>
<clause id="id8244D450C4274937AC49C69431073C9E"><enum>(ii)</enum><text>may consult with a potential recipient regarding the ability of the potential recipient to carry out various projects that would further the purposes of the Foundation described in subsection (c).</text></clause></subparagraph> <subparagraph id="id81479C98DC9C4D538295758D822CBEC1"><enum>(D)</enum><header>National Laboratories</header><text>A National Laboratory that applies for or accepts a grant under subparagraph (A) shall not be considered to be engaging in a competitive process.</text></subparagraph></paragraph>
<paragraph id="id6F745940EC7F479392FB8F716C1C9273"><enum>(3)</enum><header>Accessing facilities and expertise</header><text>The Foundation may work with the Department—</text> <subparagraph id="id254977ECCD36414297BBB3FC28601331"><enum>(A)</enum><text>to leverage the capabilities and facilities of National Laboratories to commercialize technology; and</text></subparagraph>
<subparagraph id="id01EBE318A3A64FFBB30588FA0CD190F4"><enum>(B)</enum><text>to assist with resources, including by providing information on the assets of each National Laboratory that may enable the deployment and commercialization of technology.</text></subparagraph></paragraph> <paragraph id="id27AEA3CF1BC74860B76D9B01F80C82EF"><enum>(4)</enum><header>Training and education</header><text>The Foundation may support programs that provide training to researchers, scientists, and other relevant personnel at National Laboratories and institutions of higher education to help demonstrate, deploy, and commercialize federally funded technology.</text></paragraph>
<paragraph id="id78906C6FF87B4957B35CC04552664279"><enum>(5)</enum><header>Maturation funding</header><text>The Foundation shall support programs that provide maturation funding to researchers to advance the technology of those researchers for the purpose of moving products from a prototype stage to a commercial stage.</text></paragraph> <paragraph id="id713C13D2E438496FA9D040EBB1828FCC"><enum>(6)</enum><header>Stakeholder engagement</header><text>The Foundation shall convene, and may consult with, representatives from the Department, institutions of higher education, National Laboratories, the private sector, and commercialization organizations to develop programs for the purposes of the Foundation described in subsection (c) and to advance the activities of the Foundation.</text></paragraph>
<paragraph id="id4B28EA9602F74A6387E880D63E8B58AB"><enum>(7)</enum><header>Individual and Federal laboratory-associated foundations</header>
<subparagraph id="idF0664DDC1A3B4482AB4B2C2300572B66"><enum>(A)</enum><header>Definitions</header><text>In this paragraph:</text> <clause id="id30E4C99D519441EBA481A698C0BEFA0C"><enum>(i)</enum><header>Covered foundation</header><text>The term <quote>covered foundation</quote> means each of the following:</text>
<subclause id="id5AEEB44D68BB453F96E765BD0E56255A"><enum>(I)</enum><text>An Individual Laboratory-Associated Foundation.</text></subclause> <subclause id="idD6306849024F4FA793452C2B98981F77" commented="no"><enum>(II)</enum><text>a Federal Laboratory-Associated Foundation established pursuant to section 4(a).</text></subclause></clause>
<clause id="id39F3B540C8794C6CB300ACA4C4C863AB"><enum>(ii)</enum><header>Individual Laboratory-Associated Foundation</header><text>The term <quote>Individual Laboratory-Associated Foundation</quote> means a Laboratory Foundation established by an operating contractor of a National Laboratory.</text></clause></subparagraph> <subparagraph id="idC4A8C0F867B84718A7A13819C8B97302"><enum>(B)</enum><header>Support</header><text display-inline="yes-display-inline">The Foundation shall provide support to and collaborate with covered foundations.</text></subparagraph>
<subparagraph id="id2AD948EF27A54638920D1BF31DAC143A"><enum>(C)</enum><header>Guidelines and templates</header><text>For the purpose of providing support under subparagraph (B), the Secretary shall establish suggested guidelines and templates for covered foundations, including—</text> <clause id="idC4CEFE23328D4F1094A6B3BAEAF0A7F8"><enum>(i)</enum><text>a standard adaptable organizational design for responsible management;</text></clause>
<clause id="id10613E8CB0954595892F85B2ACBEE695"><enum>(ii)</enum><text>standard and legally tenable bylaws and money-handling procedures; and</text></clause> <clause id="id566FD3D7F9564E9A847BB3CA90BCE24D"><enum>(iii)</enum><text>a standard training curriculum to orient and expand the operating expertise of personnel employed by covered foundations.</text></clause></subparagraph>
<subparagraph id="id667F29570C9F4C3F8F86B72EDE1DD40B"><enum>(D)</enum><header>Affiliations</header><text>Nothing in this paragraph requires—</text> <clause id="id19CA04DE05724FC8A684EB194D6634DC"><enum>(i)</enum><text>an existing Individual Laboratory-Associated Foundation to modify current practices or affiliate with the Foundation; or</text></clause>
<clause id="id974E9CB6014D4F3A80621F6345BE60DA"><enum>(ii)</enum><text>a covered foundation to be bound by charter or corporate bylaws as permanently affiliated with the Foundation.</text></clause></subparagraph></paragraph> <paragraph id="HB85477D7CB9D4788A9CDC267A50C0C3A"><enum>(8)</enum><header>For-profit subsidiaries</header> <subparagraph id="id29c1a8f95e204e98b4b7be25a11977a0"><enum>(A)</enum><header>In general</header><text>The Foundation may establish 1 or more for-profit subsidiaries, including an impact investment fund—</text>
<clause id="idd7862e4e5fe5468fb9490e0db6d83ca9"><enum>(i)</enum><text>to stimulate economic development activities relating to the purposes of the Foundation described in subsection (c); and</text></clause> <clause id="iddaea2a25ce5a407fbb26ff0d0e3b316e"><enum>(ii)</enum><text>to attract for-profit investment partners for technology translation and commercialization activities.</text></clause></subparagraph>
<subparagraph id="id82cf8a4cd9c846cba87b5da40282846c"><enum>(B)</enum><header>Authorities of the for-profit subsidiary</header>
<clause id="id516a7bbf7556413793114d4542f9efb1"><enum>(i)</enum><header>In general</header><text>Subject to clause (ii), a for-profit subsidiary established under subparagraph (A) may—</text> <subclause id="idc866314e38b74080af53deef9ae98279"><enum>(I)</enum><text>enter into a partnership with an economic development corporation, including an incubator, accelerator, or small business investment company;</text></subclause>
<subclause id="ida1eaa175eb6f4d058ca74d2416104fcd"><enum>(II)</enum><text>pay for the cost of building and administering a facility, including a microlab or incubator, to support the activities of the Foundation described in this subsection; and</text></subclause> <subclause id="id2a638f6753ac48f4a02f5d71edf5ddd8"><enum>(III)</enum><text>provide funding to a startup.</text></subclause></clause>
<clause id="id453542005f834056a90206a85f53fecf"><enum>(ii)</enum><header>Cost recovery requirements</header><text>A for-profit subsidiary established under subparagraph (A) shall—</text> <subclause id="ida27908ff5ca1486ea381ccd3b50a2924"><enum>(I)</enum><text>ensure that the Foundation owns any intellectual property rights generated through activities funded by the for-profit subsidiary, if appropriate; and</text></subclause>
<subclause id="id5d73e22ac84b4b88b56ab08f129d6ab7"><enum>(II)</enum><text>own an equity stake in any startup invested in by the for-profit subsidiary.</text></subclause></clause></subparagraph></paragraph> <paragraph id="id833310B997A14024BC1400EB0D1F81BD"><enum>(9)</enum><header>Supplemental programs</header><text>The Foundation may carry out supplemental programs—</text>
<subparagraph id="id0D226065A29D4104B921367F1833CDC4"><enum>(A)</enum><text>to conduct and support forums, meetings, conferences, courses, and training workshops consistent with the purposes of the Foundation described in subsection (c);</text></subparagraph> <subparagraph id="idCBF972B3B9D64754B207D24522E11A88"><enum>(B)</enum><text>to support and encourage the understanding and development of—</text>
<clause id="idB5A1703070D44754B2CB6AB3D97D9D86"><enum>(i)</enum><text>data that promotes the translation of technologies from the research stage, through the development and maturation stage, and ending in the market stage; and</text></clause> <clause id="id4149E406833B4C96AD9482FAF084F30C"><enum>(ii)</enum><text>policies that make regulation more effective and efficient by leveraging the technology translation data described in clause (i) for the regulation of relevant technology sectors;</text></clause></subparagraph>
<subparagraph id="id6BAC26E420384072B4F202501CA0A52E"><enum>(C)</enum><text>for writing, editing, printing, publishing, and vending books and other materials relating to research carried out under the Foundation and the Department; and</text></subparagraph> <subparagraph id="idEE5D3040C261449189D042965FB39D3A"><enum>(D)</enum><text>to conduct other activities to carry out and support the purposes of the Foundation described in subsection (c).</text></subparagraph></paragraph>
<paragraph id="id8A1386A9F3584660A2C77D51CFB879A7"><enum>(10)</enum><header>Evaluations</header><text>The Foundation shall support the development of an evaluation methodology, to be used as part of any program supported by the Foundation, that shall—</text> <subparagraph id="idFE5B384D90004894BA66D6C2FACF9ADE"><enum>(A)</enum><text>consist of qualitative and quantitative metrics; and</text></subparagraph>
<subparagraph id="id750356954C3543E0BC2FB8D8CA49C98D"><enum>(B)</enum><text>include periodic third party evaluation of those programs and other activities of the Foundation.</text></subparagraph></paragraph> <paragraph id="idBDEBA2D5802B432692A7FD38FCDB95B0" commented="no" display-inline="no-display-inline"><enum>(11)</enum><header>Communications</header><text>The Foundation shall develop an expertise in communications to promote the work of grant and fellowship recipients under paragraph (2), the commercialization successes of the Foundation, opportunities for partnership with the Foundation, and other activities. </text></paragraph>
<paragraph id="id40C1013117AE4575AB78998F8A54A33A"><enum>(12)</enum><header>Solicitation and use of funds</header><text>The Foundation may solicit and accept gifts, grants, and other donations, establish accounts, and invest and expend funds in support of the activities and programs of the Foundation. </text></paragraph></subsection> <subsection id="idFDE44CCC841A4DC8B5195CFA0B7D58FA"><enum>(e)</enum><header>Administration</header> <paragraph id="idA737BFCA9BF74174A4DEAF5B74C73E25"><enum>(1)</enum><header>Executive director</header><text>The Board shall hire an Executive Director of the Foundation, who shall serve at the pleasure of the Board.</text></paragraph>
<paragraph id="id8574493F8FD349D7B596857F46A23D2C"><enum>(2)</enum><header>Administrative control</header><text>No member of the Board, officer or employee of the Foundation or of any program established by the Foundation, or participant in a program established by the Foundation, shall exercise administrative control over any Federal employee.</text></paragraph> <paragraph id="id372DEE00995A41F5A9F86857CB0930F7"><enum>(3)</enum><header>Strategic plan</header><text>Not later than 1 year after the date of enactment of this Act, the Foundation shall submit to the Committee on Energy and Natural Resources of the Senate and the Committee on Science, Space, and Technology of the House of Representatives a strategic plan that contains—</text>
<subparagraph id="id03B6FD9DD5FC44CB84C32C39843D9EEC"><enum>(A)</enum><text>a plan for the Foundation to become financially self-sustaining in fiscal year 2023 and thereafter (except for the amounts provided each fiscal year under subsection (l)(1)(C));</text></subparagraph> <subparagraph id="id04524EC695F848E4A82F54C50B77F140"><enum>(B)</enum><text>a forecast of major crosscutting energy challenge opportunities, including short- and long-term objectives, identified by the Board, with input from communities representing the entities and areas of subject matter expertise, as applicable, described in subsection (b)(2)(C)(ii); </text></subparagraph>
<subparagraph id="id8673CC55CF0E461BA20CD55B5A310480"><enum>(C)</enum><text>a description of the efforts that the Foundation will take to be transparent in the processes of the Foundation, including processes relating to—</text> <clause id="id042E728B0EFB460C86BFB19BA89D3E13"><enum>(i)</enum><text>grant awards, including selection, review, and notification;</text></clause>
<clause id="idAA99B1899A594B21B0F209F61E3B7976"><enum>(ii)</enum><text>communication of past, current, and future research priorities; and</text></clause> <clause id="idE66F0CD47ACA44FDBFDC7881DD13D77F"><enum>(iii)</enum><text>solicitation of and response to public input on the opportunities identified under subparagraph (B); </text></clause></subparagraph>
<subparagraph id="id8A0EB6F64D7846D5B74D48331280B1E1" commented="no" display-inline="no-display-inline"><enum>(D)</enum><text>a description of the financial goals and benchmarks of the Foundation for the following 10 years; and</text></subparagraph> <subparagraph display-inline="no-display-inline" commented="no" id="idA909B3DB6FAD4EB6BD7A4D3B92F59179"><enum>(E)</enum><text>a description of the efforts undertaken by the Foundation to ensure maximum complementarity and minimum redundancy with investments made by the Department.</text></subparagraph></paragraph>
<paragraph id="id0615B4C65EFD4925BA5D934BB0CBA98E"><enum>(4)</enum><header>Annual report</header><text>Not later than 1 year after the date on which the Foundation is established, and every 2 years thereafter, the Foundation shall submit to the Committee on Energy and Natural Resources of the Senate, the Committee on Science, Space, and Technology of the House of Representatives, and the Secretary a report that, for the year covered by the report— </text> <subparagraph id="idFFF5C0EA22F844A1958A0D78AF71B6E3"><enum>(A)</enum><text>describes the activities of the Foundation and the progress of the Foundation in furthering the purposes of the Foundation described in subsection (c);</text></subparagraph>
<subparagraph id="id98EF7DE08AD14EB197B372B8339942F5"><enum>(B)</enum><text>provides a specific accounting of the source and use of all funds made available to the Foundation to carry out those activities to ensure transparency in the alignment of Department missions and policies with national security;</text></subparagraph> <subparagraph id="id534FD816089C457EB41EF41354E169B7"><enum>(C)</enum><text>describes how the results of the activities of the Foundation could be incorporated into the procurement processes of the General Services Administration; and</text></subparagraph>
<subparagraph id="idACEA5B58177849DFBB663174819C9754"><enum>(D)</enum><text>includes a summary of each evaluation conducted using the evaluation methodology described in subsection (d)(10).</text></subparagraph></paragraph> <paragraph id="idf7769caaaed14f7a9ac86b000db2f4d5"><enum>(5)</enum><header>Evaluation by Comptroller General</header><text>Not later than 5 years after the date on which the Foundation is established, the Comptroller General of the United States shall submit to the Committee on Energy and Natural Resources of the Senate and the Committee on Science, Space, and Technology of the House of Representatives—</text>
<subparagraph id="id74AF277CB39C4B088E5B8246D5B59988"><enum>(A)</enum><text>an evaluation of—</text> <clause id="id051DAE9F3B4747D48D8E52D6808B268B"><enum>(i)</enum><text>the extent to which the Foundation is achieving the mission of the Foundation; and </text></clause>
<clause id="id5E70EC33F5EE4D30B40783F9F68E6680"><enum>(ii)</enum><text>the operation of the Foundation; and</text></clause></subparagraph> <subparagraph id="id1D634FCCE4DE43B48339ECE331CF66F8"><enum>(B)</enum><text>any recommendations on how the Foundation may be improved. </text></subparagraph></paragraph>
<paragraph id="id274D20D829CD4AD4852A40F5A8B4D549"><enum>(6)</enum><header>Audits</header><text>The Foundation shall—</text> <subparagraph id="idBBC6221BAFA04BE2B1E28778B5D5100D"><enum>(A)</enum><text>provide for annual audits of the financial condition of the Foundation; and</text></subparagraph>
<subparagraph id="id3A07BB1A934F48348D0901763B6BC1B6" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text>make the audits, and all other records, documents, and papers of the Foundation, available to the Secretary and the Comptroller General of the United States for examination or audit. </text></subparagraph></paragraph> <paragraph id="id68517EB934474D94B1FBFE777D1C8CD4"><enum>(7)</enum><header>Separate fund accounts</header><text>The Board shall ensure that any funds received under subsection (l)(1) are held in a separate account from any other funds received by the Foundation.</text></paragraph>
<paragraph id="idAAEEFD8783AE4D55AB52C45BE89E9AE5"><enum>(8)</enum><header>Integrity</header>
<subparagraph id="idEE4397338FCA46C4A7D43E4FB41F4791"><enum>(A)</enum><header>In general</header><text>To ensure integrity in the operations of the Foundation, the Board shall develop and enforce procedures relating to standards of conduct, financial disclosure statements, conflicts of interest (including recusal and waiver rules), audits, and any other matters determined appropriate by the Board.</text></subparagraph> <subparagraph id="id6AEE95778B664A28930FA411D4ECDA53"><enum>(B)</enum><header>Financial conflicts of interest</header><text>Any individual who is an officer, employee, or member of the Board is prohibited from any participation in deliberations by the Foundation of a matter that would directly or predictably affect any financial interest of—</text>
<clause id="id8683AA4675824B65AA9FE44D9BBDF056"><enum>(i)</enum><text>the individual;</text></clause> <clause id="idF9605DBE7A914909BF17C99F108CE7A4"><enum>(ii)</enum><text>a relative (as defined in <external-xref legal-doc="usc-act" parsable-cite="usc-act/Ethics in Government Act of 1978 /109">section 109</external-xref> of the Ethics in Government Act of 1978 (5 U.S.C. App.)) of that individual; or</text></clause>
<clause id="idEA867FF540B34F40B2D7B50E8B0A7576"><enum>(iii)</enum><text>a business organization or other entity in which the individual has an interest, including an organization or other entity with which the individual is negotiating employment.</text></clause></subparagraph></paragraph> <paragraph id="idD9854648333642149E8833B8C1AE4299"><enum>(9)</enum><header>Intellectual property</header><text>The Board shall adopt written standards to govern the ownership and licensing of any intellectual property rights—</text>
<subparagraph id="id5DA765748F2541E680648717175751CD"><enum>(A)</enum><text>developed by the Foundation through activities funded by a for-profit subsidiary established under subsection (d)(8); or</text></subparagraph> <subparagraph id="id663FF871739942B9AA76A1A18B4EF7C8"><enum>(B)</enum><text>otherwise derived from the collaborative efforts of the Foundation.</text></subparagraph></paragraph>
<paragraph id="id314A855DC49048C09BEA7F68095ED890"><enum>(10)</enum><header>Liability</header>
<subparagraph id="id7D4CC47F50C24589ABF58C2DBD90659E"><enum>(A)</enum><header>In general</header><text>The United States shall not be liable for any debts, defaults, acts, or omissions of—</text> <clause id="id2F1B280C32A54169B7A9016A80765059"><enum>(i)</enum><text>the Foundation;</text></clause>
<clause id="idC3E45CC3D0CB4E5196045074CD70661B"><enum>(ii)</enum><text>a Federal entity with respect to an agreement of that Federal entity with the Foundation; or</text></clause> <clause id="idD839476D82204D8EBA14E1D294DCFD31"><enum>(iii)</enum><text>an Individual Laboratory-Associated Foundation (as defined in subsection (d)(7)(A)) with respect to an agreement of that Federal entity with the Foundation.</text></clause></subparagraph>
<subparagraph id="id04A5BF910C82491EA61EEFB75BD8D14B"><enum>(B)</enum><header>Full faith and credit</header><text>The full faith and credit of the United States shall not extend to any obligations of the Foundation.</text></subparagraph></paragraph> <paragraph id="idE9377FCEDE844EA4A0269ABF24FCC903"><enum>(11)</enum><header>Nonapplicability of FACA</header><text>The Federal Advisory Committee Act (5 U.S.C. App.) shall not apply to the Foundation. </text></paragraph></subsection>
<subsection id="id22F179DF895C419E87D1DF8EB71B7030"><enum>(f)</enum><header>Department collaboration</header>
<paragraph id="idF285B346AF6D42CA91CED0274A31395D"><enum>(1)</enum><header>National Laboratories</header><text display-inline="yes-display-inline">The Secretary shall collaborate with the Foundation to develop a process to ensure collaboration and coordination between the Department, the Foundation, and National Laboratories—</text> <subparagraph id="id9977E419811D469CAEF5FD9EBBF88DCD"><enum>(A)</enum><text>to streamline contracting processes between National Laboratories and the Foundation, including by—</text>
<clause id="idD7CC4B210CA54247845039C5B4EAE6FD"><enum>(i)</enum><text>streamlining the ability of the Foundation to transfer equipment and funds to National Laboratories;</text></clause> <clause id="idC6BE1C3BC2E24A45A522D766CD6D7BB4"><enum>(ii)</enum><text>standardizing contract mechanisms to be used by the Foundation in engaging with National Laboratories; and</text></clause>
<clause id="id67A8EDE827FA453284F4BE870F713189"><enum>(iii)</enum><text>streamlining the ability of the Foundation to fund endowed positions at National Laboratories;</text></clause></subparagraph> <subparagraph id="id254509E228FF4DBF822FECD2E156D3F1"><enum>(B)</enum><text>to allow a National Laboratory or site of a National Laboratory—</text>
<clause id="id72FB2B3CD7E74BCCBBE97CC5BC140279"><enum>(i)</enum><text>to accept and perform work for the Foundation, consistent with provided resources, notwithstanding any other provision of law governing the administration, mission, use, or operations of the National Laboratory or site, as applicable; and</text></clause> <clause id="id18C59783E17D4EF4BD5349B845C08D31"><enum>(ii)</enum><text>to perform that work on a basis equal to other missions at the National Laboratory; and</text></clause></subparagraph>
<subparagraph id="id1D1BC4BFAC3F4B66BE760BBBFE54BA2D"><enum>(C)</enum><text>to permit the director of any National Laboratory or site of a National Laboratory to enter into a cooperative research and development agreement or negotiate a licensing agreement with the Foundation pursuant to section 12 of the Stevenson-Wydler Technology Innovation Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/15/3710a">15 U.S.C. 3710a</external-xref>).</text></subparagraph></paragraph> <paragraph id="id9101FE2E06C44D9DBD908FB6D85D5BF0"><enum>(2)</enum><header>Department liaisons</header><text>The Secretary shall appoint liaisons from across the Department to collaborate and coordinate with the Foundation, including not less than 1 liaison from the Office of Technology Transitions, who shall ensure that the Foundation works in conjunction with the Technology Commercialization Fund of the Department.</text></paragraph>
<paragraph id="id2D2B32E190B74D5C9104DD790025FF31"><enum>(3)</enum><header>Administration</header><text>The Secretary shall leverage appropriate arrangements, contracts, and directives to carry out the process developed under paragraph (1).</text></paragraph></subsection> <subsection id="id7F56F266582F473AB7FE84E84456EBE9"><enum>(g)</enum><header>National security</header><text>Nothing in this section exempts the Foundation from any national security policy of the Department.</text></subsection>
<subsection id="id4C2DE03D0DDA42339A413EBC8A9D6CB2"><enum>(h)</enum><header>Support services</header><text>The Secretary shall provide facilities, utilities, and support services to the Foundation if it is determined by the Secretary to be advantageous to the research programs of the Department.</text></subsection> <subsection id="id6b4bb27772e743f1ae74009c214d5266"><enum>(i)</enum><header>Anti-Deficiency Act</header><text>Subsection (a)(1) of section 1341 of title 31, United States Code (commonly referred to as the <quote>Anti-Deficiency Act</quote>), shall not apply to any Federal officer or employee carrying out any activity of the Foundation using funds of the Foundation. </text></subsection>
<subsection id="id571EC9D6FCC34256947843117093C738"><enum>(j)</enum><header>Preemption of authority</header><text>This section shall not preempt any authority or responsibility of the Secretary under any other provision of law.</text></subsection> <subsection id="ide4e16e79e2754b37bb03cbefd35335fd"><enum>(k)</enum><header>Transfer funds</header><text>The Foundation may transfer funds to the Department, which shall be subject to all applicable Federal limitations relating to federally funded research. </text></subsection>
<subsection id="idE64004D5883447A9A28261C150694CB7"><enum>(l)</enum><header>Authorization of appropriations</header>
<paragraph id="id5A31B2EAB2D6474499344946FC29FA25"><enum>(1)</enum><header>In general</header><text>There are authorized to be appropriated—</text> <subparagraph id="id0ED0F1A2663142FC86D8289C296B5C61"><enum>(A)</enum><text>to the Secretary, not less than $1,500,000 for fiscal year 2022 to establish the Foundation;</text></subparagraph>
<subparagraph id="idEB5EED807E9D4AFE9CDAB5D932CA7BA4"><enum>(B)</enum><text>to the Foundation, not less than $30,000,000 for fiscal year 2023 to carry out the activities of the Foundation; and</text></subparagraph> <subparagraph id="idEC71A4537F57412588233CB1D01EEDCD"><enum>(C)</enum><text>to the Foundation, not less than $3,000,000 for fiscal year 2024, and each fiscal year thereafter, for administrative and operational costs.</text></subparagraph></paragraph>
<paragraph id="id76FAD68C69FD4DC9A0D43F36B13BAFD3" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header>Cost share</header><text>Funds made available under paragraph (1)(B) shall be required to be cost-shared by a partner of the Foundation other than the Department. </text></paragraph></subsection></section> <section id="id2fe37dbc07544d2483dee57c9f4b6328" commented="no"><enum>4.</enum><header>National Energy Technology Laboratory-Associated Foundation</header> <subsection id="idaf6b520a2f7d4fc09a02cc0ea8ceebb5"><enum>(a)</enum><header>Establishment</header> <paragraph id="id1E778AD82C7D43E8A71B0A4AD70585D1"><enum>(1)</enum><header>In general</header><text>Notwithstanding any other provision of law, the National Energy Technology Laboratory may establish, or enter into an agreement with a nonprofit organization to establish, a Federal Laboratory-Associated Foundation (referred to in this section as a <quote>Laboratory Foundation</quote>) to support the mission of the National Energy Technology Laboratory. </text></paragraph>
<paragraph id="id72129E779DFB47238E6804343B668EF3"><enum>(2)</enum><header>Not agency or instrumentality</header><text>A Laboratory Foundation shall not be an agency or instrumentality of the Federal Government. </text></paragraph> <paragraph id="id590BF34C82DF4EDE85B6015A5CDEB724"><enum>(3)</enum><header>Governance structure</header><text>A Laboratory Foundation established under paragraph (1) shall have a separate governance structure from, and shall be managed independently of, the National Energy Technology Laboratory.</text></paragraph></subsection>
<subsection id="id36f9c7ba8659427e8e48b06c4deac459"><enum>(b)</enum><header>Activities</header><text>Activities of a Laboratory Foundation may include—</text> <paragraph id="idcf24df7667ab4e0388cffeee91871acb"><enum>(1)</enum><text>conducting support studies, competitions, projects, research, and other activities that further the purpose of the Laboratory Foundation;</text></paragraph>
<paragraph id="idf193730b3f6d48ca97ef97f0bad9e149"><enum>(2)</enum><text>carrying out programs to foster collaboration and partnership among researchers from the Federal Government, State governments, institutions of higher education, federally funded research and development centers, and industry and nonprofit organizations relating to the research, development, and commercialization of federally supported technologies;</text></paragraph> <paragraph id="ida3288fe25c7a41018b3397812c515cff"><enum>(3)</enum><text>carrying out programs to leverage technologies to support new product development that supports regional economic development;</text></paragraph>
<paragraph id="id066dd1ee2ad04427887b2c0ca4066de8"><enum>(4)</enum><text>administering prize competitions to accelerate private sector competition and investment;</text></paragraph> <paragraph id="id9e7f4331844542ee825332a5b274b10d"><enum>(5)</enum><text>providing fellowships and grants to research and development personnel at, or affiliated with, federally funded centers, in accordance with subsection (c); </text></paragraph>
<paragraph id="id0fe3ea59197948279bf915a780cb94bb"><enum>(6)</enum><text>carrying out programs—</text> <subparagraph id="idc7ee0d11e2004ae297a1b7ab499a2c73"><enum>(A)</enum><text>that allow scientists from foreign countries to serve in research capacities in the United States or other countries in association with the National Energy Technology Laboratory;</text></subparagraph>
<subparagraph id="id81957a9a02964ac38661da3c9f69eb54"><enum>(B)</enum><text>that provide opportunities for employees of the National Energy Technology Laboratory to serve in research capacities in foreign countries;</text></subparagraph> <subparagraph id="idc421f324acd648a0a145ea147be6a2c8"><enum>(C)</enum><text>to conduct studies, projects, or research in collaboration with national and international nonprofit and for-profit organizations, which may include the provision of stipends, travel, and other support for personnel;</text></subparagraph>
<subparagraph id="id2b518e3ccd1149b3b194d788c8550d35"><enum>(D)</enum>
<clause commented="no" display-inline="yes-display-inline" id="id47FA0153666D4ABAAFE6C49D567F2726"><enum>(i)</enum><text>to hold forums, meetings, conferences, courses, and training workshops that may include undergraduate, graduate, post-graduate, and post-doctoral accredited courses; and </text></clause> <clause id="idBBF74A03A4824EF2B5380B567104AE7A" indent="up1"><enum>(ii)</enum><text>for the accreditation of those courses by the Laboratory Foundation at the State and national level for college degrees or continuing education credits;</text></clause></subparagraph>
<subparagraph id="ida89e3488fe2146d588117cb57f1f4695"><enum>(E)</enum><text>to support and encourage teachers and students of science at all levels of education;</text></subparagraph> <subparagraph id="id5145E89722184F19A6DF9EA2D4E20202"><enum>(F)</enum><text>to promote an understanding of science amongst the general public;</text></subparagraph>
<subparagraph id="id9744edcf97b94809929a1fe985439fc6"><enum>(G)</enum><text>for writing, editing, printing, publishing, and vending of relevant books and other materials; and</text></subparagraph> <subparagraph id="id9e630c95d52b41169b65f3ad5f9b5529"><enum>(H)</enum><text>for the conduct of other activities to carry out and support the purpose of the Laboratory Foundation; and</text></subparagraph></paragraph>
<paragraph id="id50ea792443b843f39f3fdeba642d9796"><enum>(7)</enum><text>receiving, administering, soliciting, accepting, and using funds, gifts, devises, or bequests, either absolutely or in trust of real or personal property or any income therefrom, or other interest or equity therein for the benefit of, or in connection with, the mission of the applicable Federal laboratory, in accordance with subsection (d). </text></paragraph></subsection> <subsection id="id4694505E86334773ABE9D1F1494F7D11"><enum>(c)</enum><header>Fellowships and grants</header> <paragraph id="idA3BB54CF234F49C7A921DE351FB0E1EA"><enum>(1)</enum><header>Selection</header><text>Recipients of fellowships and grants described in subsection (b)(5) shall be selected—</text>
<subparagraph id="idD162C3C906724B95987F0FA0095070BC"><enum>(A)</enum><text>by the donors of a Laboratory Foundation and a Laboratory Foundation;</text></subparagraph> <subparagraph id="id33021AC5879C4681BCFFEB2D3E3E0757"><enum>(B)</enum><text>subject to the agreement of the head of the agency the mission of which is supported by a Laboratory Foundation; and</text></subparagraph>
<subparagraph id="id045132315B0A4E8DB3090974735378EB"><enum>(C)</enum><text>in the case of a fellowship, based on the recommendation of the employees of the National Energy Technology Laboratory at which the fellow would serve. </text></subparagraph></paragraph> <paragraph id="id273A891BA8C34C99B7B2A1FBDEF6FD24"><enum>(2)</enum><header>Expenses</header><text>Fellowships and grants described in subsection (b)(5) may include stipends, travel, health insurance, benefits, and other appropriate expenses. </text></paragraph></subsection>
<subsection id="id75474DC4580844F7A0FFCAD41C272CF1"><enum>(d)</enum><header>Gifts</header><text>An amount of funds, a gift, a devise, or a bequest described in subsection (b)(7) may be accepted by a Laboratory Foundation regardless of whether it is encumbered, restricted, or subject to a beneficial interest of a private person if any current or future interest of the funds, gift, devise, or bequest is for the benefit of the research and development activities of the National Energy Technology Laboratory. </text></subsection> <subsection id="id8C71AF97EBFD4372A2DEE1515F50952A"><enum>(e)</enum><header>Ownership by Federal Government</header><text>A contribution, gift, or any other transfer made to or for the use of a Laboratory Foundation shall be regarded as a contribution, gift, or transfer to or for the use of the Federal Government.</text></subsection>
<subsection id="idE7D08806F6C84D41B146DF5EF4BFD89C" commented="no" display-inline="no-display-inline"><enum>(f)</enum><header>Liability</header><text>The United States shall not be liable for any debts, defaults, acts, or omissions of a Laboratory Foundation. </text></subsection> <subsection id="idcff633cf08cd440597ad544a5df07521"><enum>(g)</enum><header>Transfer of funds</header><text>Notwithstanding any other provision of law, a Laboratory Foundation may transfer funds to the National Energy Technology Laboratory and the National Energy Technology Laboratory may accept that transfer of funds.</text></subsection>
<subsection id="id5f67663a6428401a8c0f5780dac371f8"><enum>(h)</enum><header>Other laws</header><text>This section shall not alter or supersede any other provision of law governing the authority, scope, establishment, or use of nonprofit organizations by a Federal agency. </text></subsection></section> </legis-body> </bill>
