<committee-name committee-id="SSFI00">Committee on Finance</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Internal Revenue Code of 1986 to provide a credit to small employers for covering military spouses under retirement plans.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause" id="HF1B8FAFE414E4F939D169E76D73A9E2B"><section section-type="section-one" id="id6EB91E42F7BE4846BD9BC2C5545AB791"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Military Spouses Retirement Security Act</short-title></quote>.</text></section><section id="idC2AB466624434820A48FB1413441B396"><enum>2.</enum><header>Credit for small employers providing retirement plans for military spouses</header><subsection id="id62ee921c6dac497f90455ea4e2d64f78"><enum>(a)</enum><header>In general</header><text>Subpart D of part IV of subchapter A of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/1">chapter 1</external-xref> of the Internal Revenue Code of 1986 is amended by adding at the end the following new section: </text><quoted-block style="OLC" display-inline="no-display-inline" id="id8F76B4F9983E49A0A90F0A5B78ABE356"><section id="id839D34E2239745FB9E82D3A27F757E86"><enum>45U.</enum><header>Small employer provision of retirement savings for military spouses</header><subsection id="id2C78AFFCD5CF4C5EB7855DB87A4FED8C"><enum>(a)</enum><header>In general</header><text>For purposes of section 38, in the case of a covered small employer, the military spouse employee retirement plan credit determined under this section for the taxable year is an amount equal to the sum of—</text><paragraph id="idFB3A6D75A2DF424FBEF09E1EA06B36D9"><enum>(1)</enum><text>$200 for each eligible military spouse employee who is eligible to participate in an eligible employer plan during the plan year ending with or within such taxable year, plus</text></paragraph><paragraph id="idB818160689CD46EF8DE274076551CB8C"><enum>(2)</enum><text>with respect to each eligible military spouse employee participating in such plan, the lesser of—</text><subparagraph id="id70741C15DFFF47129C67E0A8069407CE"><enum>(A)</enum><text>the amount of employer contributions (other than any contribution described in subparagraph (B) or (C) of section 25B(d)(1)) made under all eligible employer plans on behalf of such eligible military spouse during the plan year ending with or within such taxable year, or</text></subparagraph><subparagraph id="id1216E7D8B60F4964BFC7C8EA54484764"><enum>(B)</enum><text>$300.</text></subparagraph><continuation-text continuation-text-level="paragraph">In the case of a defined benefit plan, the amount treated as an employer contribution under paragraph (2)(A) shall be the increase in the participant’s nonforfeitable accrued benefit (determined by using the rules of section 417(e)(3)) reduced by the amount of such increase attributable to employee contributions.</continuation-text></paragraph></subsection><subsection id="id41ED2F5BD1CF41BE99A3492F7DE858A4"><enum>(b)</enum><header>Eligible employer plan</header><text>For purposes of this section, the term <term>eligible employer plan</term> means a qualified employer plan (within the meaning of section 4972(d)) in which all eligible military spouse employees of the covered small employer—</text><paragraph id="id004DEEADAFEC47CF908E664EC9E34361"><enum>(1)</enum><text>are eligible to participate as of the later of the first day of the first plan year of the plan or the date the employee has been employed for at least 2 months, </text></paragraph><paragraph id="id82B3BFC1741A4C6CB7B06823C6E2AA04"><enum>(2)</enum><text>are eligible to receive matching contributions (as defined in section 401(m)) and nonelective contributions in the same manner as an employee (other than a highly compensated employee) with at least 2 years of service, and</text></paragraph><paragraph id="idD1E2873650E04BB095EE8F368FD0FD97"><enum>(3)</enum><text>are fully vested in their accrued benefit under the plan upon commencement of participation.</text></paragraph></subsection><subsection id="id2f79d7c707e9467f8b3d79753ab6ca1b"><enum>(c)</enum><header>Covered small employer</header><text>For purposes of this section, the term <term>covered small employer</term> means an eligible employer (within the meaning of section 408(p)(2)(C)(i)). </text></subsection><subsection id="id6CAEF045CC7944158A7C81A867103D01"><enum>(d)</enum><header>Eligible military spouse employee</header><paragraph id="id62E993B53F7C41AE9A0106E0F416B524"><enum>(1)</enum><header>In general</header><text>The term <term>eligible military spouse employee</term> means any employee of the covered small employer who—</text><subparagraph id="id456948A59DEF4029B5381563B97A6F43"><enum>(A)</enum><text>has been employed by the employer for more than 2 months, </text></subparagraph><subparagraph id="id0FC0F19F454D4E7B9E5520EB5098DA59"><enum>(B)</enum><text>is not a highly compensated employee (within the meaning of section 414(q)), and</text></subparagraph><subparagraph id="idD619D0BDDA9D4E16AC5D7987738E425D"><enum>(C)</enum><text>makes a certification to the small employer that, as of the date such employee is hired by the employer, such employee is married to an individual who has performed service in the uniformed services (as defined in <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/43">chapter 43</external-xref> of title 38, United States Code) while on active duty for a period of more than 30 days (including the date such employee is hired). </text></subparagraph><continuation-text continuation-text-level="paragraph">Any certification under subparagraph (C) shall include the servicemember's name, rank, and military branch and the employee's uniformed services identification card number.</continuation-text></paragraph><paragraph id="idBA14EE8511F241A5B691E3F23AE96FAA"><enum>(2)</enum><header>Limitation</header><text>An individual may not be treated as an eligible military spouse with respect to any covered small employer for more than 3 taxable years.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="idb30d58f3034d44bebe00f0432aee753a"><enum>(b)</enum><header>Credit To be part of general business credit</header><text><external-xref legal-doc="usc" parsable-cite="usc/26/38">Section 38(b)</external-xref> of the Internal Revenue Code of 1986 is amended by striking <quote>plus</quote> at the end of paragraph (32), by striking the period at the end of paragraph (33) and inserting <quote>, plus</quote>, and by adding at the end the following new paragraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id35ec5a7eada14979a13c2c33951b99fd"><paragraph id="id196600cf90484dadaa5edbad8cbfde07"><enum>(34)</enum><text>the military spouse employee retirement plan credit determined under section 45U(a).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id64383b3c30df488695af844c1019498d"><enum>(c)</enum><header>Clerical amendment</header><text>The table of sections for subpart D of part IV of subchapter A of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/1">chapter 1</external-xref> of the Internal Revenue Code of 1986 is amended by adding at the end the following new item:</text><quoted-block style="OLC" id="id61fe62d3-5d7f-43d5-a24c-b271db09f80c"><toc><toc-entry level="section" idref="id839D34E2239745FB9E82D3A27F757E86">Sec. 45U. Small employer provision of retirement savings for military spouses.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="idEC5589DC8997412AA6BF6694BE6B4B83"><enum>(d)</enum><header>Effective date</header><text>The amendments made by this section shall apply to taxable years beginning after the date of the enactment of this Act. </text></subsection></section></legis-body></bill>
