Russell National School Lunch Act to improve the child and adult care food program. </official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Access to Healthy Food for Young Children Act of 2021</short-title></quote>.</text></section><section id="idb09a1bc3ba7a423390b226dad84cebaa"><enum>2.</enum><header>Reimbursements</header><subsection commented="no" id="id2AD328565B104E01B5775F5FE69DCA2C"><enum>(a)</enum><header>Child care reimbursements</header><text display-inline="yes-display-inline">Section 17(c) of the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1766">42 U.S.C. 1766(c)</external-xref>) is amended—</text><paragraph id="id0472fced835d45ea85d4941022bd0eb3"><enum>(1)</enum><text>in paragraph (1), by striking <quote>the same as</quote> and inserting <quote>10 cents more than</quote>;</text></paragraph><paragraph id="id610f80676d5a403b9e6923f3b484e5c4"><enum>(2)</enum><text>in paragraph (2), by striking <quote>the same as</quote> and inserting <quote>10 cents more than</quote>; and</text></paragraph><paragraph id="id03569949a9f7438dbd3b86f6d653efbf"><enum>(3)</enum><text>in paragraph (3)—</text><subparagraph id="ide5aee56fccb84e8da8d8e3a807aa49e7"><enum>(A)</enum><text>by striking <quote>30 cents</quote> and inserting <quote>$1.01 cents</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idAF88A7006E1745D78949F60DCEEF74FD"><enum>(B)</enum><text>by striking <quote>2.75 cents</quote> and inserting <quote>$0.18 cents</quote>.</text></subparagraph></paragraph></subsection><subsection id="id9CBC1B0F84FE4678AD0EC9802DFB94D0"><enum>(b)</enum><header>Day care home reimbursements</header><text display-inline="yes-display-inline">Section 17(f)(3)(A) of the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1766">42 U.S.C. 1766(f)(3)(A)</external-xref>) is amended—</text><paragraph id="id4826406C86204A41BEF05B9D8FD7758D"><enum>(1)</enum><text>by striking <quote>Consumer Price Index for food at home</quote> each place it appears and inserting <quote>Consumer Price Index for food away from home</quote>;</text></paragraph><paragraph id="id928BBEFA52A54F4A8128095C9B1DE1B8"><enum>(2)</enum><text>in clause (ii)(III)—</text><subparagraph id="idff57b1e065a74df39d507f512eb99a19"><enum>(A)</enum><text>by striking <quote>Except as provided in subclause (IV),</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id9c016c48bcd146f6a0559856d1df2d51"><item id="idaed7031283024fdd9f4ff7002a969164"><enum>(aa)</enum><header>In general</header><text>Except as provided in item (bb) and subclause (IV),</text></item><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="id3dbbcdcd77f1498d8392d1ba8bfedbcb"><enum>(B)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id4b25bf885dc74a459adfc46634e54a10"><item id="id911f4da685594de482b991ce2f3ca14f"><enum>(bb)</enum><header>Additional reimbursement</header><text>Effective beginning July 1, 2022, the reimbursement factor for each meal and supplement under this subparagraph shall be increased by 10 cents per child served.</text></item><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idB2A45832A391415285939AC68F82C2C5"><enum>(3)</enum><text>in clause (iii)(I)(aa), by striking <quote>the reimbursement factors shall be</quote> and all that follows through <quote>supplements</quote> and inserting <quote>the reimbursement factors shall be $1.58 for meals other than breakfast, $0.58 cents for breakfasts, and $0.30 cents for supplements</quote>.</text></paragraph></subsection></section><section id="idB235336D8D444865901EB2A5B179AD06"><enum>3.</enum><header>Streamlining program paperwork in high-poverty areas</header><subsection id="id8838AF1A8A834A16B97EE1793AE28ED7"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 17(c) of the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1766">42 U.S.C. 1766(c)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id39073cc955d74ac18419bc369c27beb8"><paragraph id="idcacdd386337142b1b962ef07a4e4f58c"><enum>(7)</enum><header>Streamlining program paperwork in high poverty areas</header><subparagraph id="id37cd7df321a74ff391c259bcd7b2f39d"><enum>(A)</enum><header>Definitions</header><text>In this paragraph:</text><clause id="idf33333352162480ca8ec1cef5f2abb8a"><enum>(i)</enum><header>Eligible child care center</header><text>The term <term>eligible child care center</term> means a child care center at least 50 percent of children under the care of which qualify for free or reduced price meals or categorical eligibility as described in subsection (f)(3)(A)(iii)(III)(bb).</text></clause><clause id="id151e9ad299de44958c0206fa07bca9cf"><enum>(ii)</enum><header>Nonpricing program</header><text>The term <term>nonpricing program</term> means a program under which an eligible child center serves all children under the care of the center meals and supplements under this section without charge.</text></clause></subparagraph><subparagraph id="id562d3fbce70e442e9d51b912c250b825"><enum>(B)</enum><header>Election of special payments</header><clause id="iddf2151fdbde146d2987e800a8af50ce0"><enum>(i)</enum><header>In general</header><text>An eligible child care center may elect to receive special payments under this paragraph in lieu of payments otherwise made available under this section based on applications for free and reduced price meals and supplements if—</text><subclause id="id0b699d4c4a584701aaf65a53a51fdcba"><enum>(I)</enum><text>subject to clause (ii), during the 4 consecutive fiscal years beginning after the date of the election, the eligible child care center elects to operate a nonpricing program;</text></subclause><subclause id="id57b1b4bab0474313b02b109f94e13dde"><enum>(II)</enum><text>the eligible child care center pays, from sources other than funds made available to carry out the program under this section, the costs of serving the meals and supplements that are in excess of the value of assistance received under this Act; and</text></subclause><subclause id="id2b420ea0fed5432eb7101d37c6441c1a"><enum>(III)</enum><text>during the fiscal year in which the election under this clause is made, the eligible child care center had a percentage of enrolled children that meets or exceeds the threshold described in subparagraph (A)(i).</text></subclause></clause><clause id="idcb3b644e0cd24abe844c46f9040e5b98"><enum>(ii)</enum><header>Election to stop receiving payments</header><text>An eligible child care center may elect to stop receiving special payments under this paragraph for the following fiscal year by notifying the State agency not later than June 30 of the current fiscal year of the intention to stop receiving the special payments.</text></clause></subparagraph><subparagraph id="id237f145b30124a3ba82370963601bb72"><enum>(C)</enum><header>First year of option</header><clause id="id01c35f4a477541ea83d98add8dbcdc05"><enum>(i)</enum><header>In general</header><text>For each month of the first fiscal year of the 4-year period during which an eligible child care center elects to receive special payments under this paragraph, special payments at the rate for free meals and supplements shall be made under this subparagraph for all reimbursable meals and supplements served at the eligible child care center.</text></clause><clause id="idbc7ea7dbac2f46a3918d0e12a7977c00"><enum>(ii)</enum><header>Calculation</header><text>Special payments under clause (i) shall be calculated using a blended per-meal rate based on a formula that multiplies national average payment rates by the percentage of children at the eligible child care center that receive free, reduced price, and paid meals and supplements.</text></clause></subparagraph><subparagraph id="ide057e2f5565745cdbfb15315b574f4cd"><enum>(D)</enum><header>Second, third, and fourth years of option</header><clause id="id1018714713324fd091f3b8c32ba5d245"><enum>(i)</enum><header>In general</header><text>For each month of the second, third, and fourth fiscal years of the 4-year period during which an eligible child care center elects to receive special payments under this paragraph, special payments at the blended rate established for the first year of the option under subparagraph (C) shall be made under this subparagraph for all reimbursable meals and supplements served at the eligible child care center.</text></clause><clause id="id5e706a7b63b74ae5a1386793ef4c7315"><enum>(ii)</enum><header>Calculation</header><text>Special payments under clause (i) shall be equal to the product obtained by multiplying—</text><subclause id="id11ccef2386a74142a23ad58bda28cc78"><enum>(I)</enum><text>the applicable blended per-meal rate; by</text></subclause><subclause id="idac4af24f36744e3db10d7d5555098fef"><enum>(II)</enum><text>the number of meals and supplements served by the eligible child care center during the period beginning on April 1 of the prior fiscal year and ending on the last day of that fiscal year.</text></subclause></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" id="idc73a70e293cd4d5b8d80d5ae11eceb12"><enum>(b)</enum><header>Community eligibility pilot projects</header><text display-inline="yes-display-inline">Section 17(c) of the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1766">42 U.S.C. 1766(c)</external-xref>) (as amended by subsection (a)) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="ide986a5387bad4038a1ce44c03b35bd60"><paragraph id="ida0c1512be9be417e801b001736028918"><enum>(8)</enum><header>Community eligibility pilot projects</header><subparagraph id="id84f0725b6d934f9cb79d898c66fbf75c"><enum>(A)</enum><header>Definitions</header><text>In this paragraph:</text><clause commented="no" display-inline="no-display-inline" id="id0DFAA6E1812A4A7C8B901512B0DDC692"><enum>(i)</enum><header>Covered child</header><text>The term <quote>covered child</quote> means a child certified for free or reduced price meals by means of—</text><subclause commented="no" display-inline="no-display-inline" id="id25EC77F966E7431DA9F5696EE8B6F532"><enum>(I)</enum><text>direct certification under paragraph (4) or (5) of section 9(b); or</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id08AC16855D1C404EA5B3787EC0A6E066"><enum>(II)</enum><text>categorical eligibility, as described in subsection (f)(3)(A)(iii)(III)(bb).</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="id1B20C183EAD44B2285BEC4EC6B8BAB44"><enum>(ii)</enum><header display-inline="yes-display-inline">Eligible child care center</header><text display-inline="yes-display-inline">The term <term>eligible child care center</term> means a child care center that—</text><subclause commented="no" display-inline="no-display-inline" id="idA567628BA39F4A848CA9B6EBCF14F140"><enum>(I)</enum><text display-inline="yes-display-inline">has a percentage of enrolled children who are covered children that meets or exceeds the threshold described in section 11(a)(1)(F)(viii); and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id9CE69687E6974DB9931DAF400020E62A"><enum>(II)</enum><text>has met or exceeded that threshold for a period of not less than 1 month in the fiscal year prior to the fiscal year in which the child care center would participate in a pilot project.</text></subclause></clause><clause id="idb0d91eb54b9641ce98b52e4701544d31"><enum>(iii)</enum><header>Eligible sponsoring organization</header><text>The term <term>eligible sponsoring organization</term> means an organization that is a public or private nonprofit organization acting as a sponsoring organization for 1 or more child care centers participating in the program authorized under this section.</text></clause><clause id="ide68f6f5b65574b8fbe4c956187543027"><enum>(iv)</enum><header>Nonpricing program</header><text>The term <term>nonpricing program</term> means a program under which an eligible child care center serves all children under the care of the center meals and supplements under a pilot project without charge.</text></clause><clause id="id407a26fc91e3445394108677fd534bbc"><enum>(v)</enum><header>Pilot project</header><text>The term <term>pilot project</term> means a pilot project carried out under subparagraph (B)(i).</text></clause><clause commented="no" id="idC8DEC91B214F412FBE57C43CA2076A34"><enum>(vi)</enum><header>Selected child care center</header><text>The term <term>selected child care center</term> means an eligible child care center selected under subparagraph (E) by a selected State and a selected sponsoring organization to implement the pilot project at that child care center.</text></clause><clause id="id04286A7C358F4360A0A7CF9B3470FB66"><enum>(vii)</enum><header>Selected sponsoring organization</header><text>The term <term>selected sponsoring organization</term> means an eligible sponsoring organization selected under subparagraph (D)(iv) by a selected State to coordinate implementation of the pilot project in that State.</text></clause><clause id="id0deed95291584cf6a255cf659634d9e7"><enum>(viii)</enum><header>Selected State</header><text>The term <term>selected State</term> means a State selected to carry out a pilot project under subparagraph (C)(i).</text></clause></subparagraph><subparagraph id="id4e3b118c7c9348b4a835a6bfa9bf53bb"><enum>(B)</enum><header>Establishment</header><clause id="id9619737701E240029F7171308A008AD6"><enum>(i)</enum><header>In general</header><text>Not later than 1 year after the date of enactment of this paragraph, the Secretary shall establish a program to carry out pilot projects in selected States under which meals and supplements are provided at no charge to every child in a selected child care center.</text></clause><clause commented="no" display-inline="no-display-inline" id="id5b7f04bdb9e340f2909cf4ed33b4ea04"><enum>(ii)</enum><header display-inline="yes-display-inline">Start date</header><text display-inline="yes-display-inline">Each pilot project shall begin in a selected State not later than 1 year after the date of enactment of this paragraph.</text></clause></subparagraph><subparagraph id="id808d2c8c572748919a34b01e3423e638"><enum>(C)</enum><header>State selection</header><clause id="id1fc45fe4ee8b4d92ac84a59c4bf5da22"><enum>(i)</enum><header>In general</header><text>The Secretary shall select not more than 6 States to each carry out a pilot project in coordination with a selected sponsoring organization.</text></clause><clause id="idaa330408a43f4d82941e64caa5c3bb5b"><enum>(ii)</enum><header>Applications</header><text>A State seeking to carry out a pilot project shall submit to the Secretary an application at such time, in such manner, and containing such information as the Secretary may require, including information about the selected sponsoring organization.</text></clause><clause id="id3c67762f15bc489a9d0c0a17b9e1d545"><enum>(iii)</enum><header>Priority</header><text>In carrying out clause (i), the Secretary shall give priority to a State based on—</text><subclause id="id4f8e5ea8a69642dc8b047e847e7155bd"><enum>(I)</enum><text>the level of childhood poverty in the service area of the selected sponsoring organization; and</text></subclause><subclause id="idc2d4ec693f654500858dbfd4c32a0b9c"><enum>(II)</enum><text>the extent to which that sponsoring organization demonstrates expertise and capacity in, and commitment to, implementing the pilot project.</text></subclause></clause></subparagraph><subparagraph id="idb033cd6f15cd49bbb12444daa3edff5e"><enum>(D)</enum><header>Sponsoring organization selection by States</header><text>Prior to submitting an application under subparagraph (C)(ii), each State seeking to carry out a pilot project shall—</text><clause id="ida8a88f53f28e4690b0972e29e05d66e0"><enum>(i)</enum><text>identify each eligible sponsoring organization in the State;</text></clause><clause id="idb1e5c2cb8e754a36921da4d785b13635"><enum>(ii)</enum><text>inform each eligible sponsoring organization identified under clause (i) of the proposed pilot project of the State;</text></clause><clause id="id732d14fe329346eca0e619137a890a50"><enum>(iii)</enum><text>solicit applications from eligible sponsoring organizations that demonstrate the expertise, capacity, and commitment of the sponsoring organization in implementing the pilot project; and</text></clause><clause id="id85288A14254B444C95F36D158868F79C"><enum>(iv)</enum><text>select an eligible sponsoring organization to coordinate implementation of the pilot project.</text></clause></subparagraph><subparagraph id="idc14f8c8a30ce44c686460642c1668f24"><enum>(E)</enum><header>Child care center selection</header><text>Each selected State and selected sponsoring organization shall select 1 or more eligible child care centers to voluntarily participate in the pilot project in the selected State.</text></subparagraph><subparagraph id="id95297251fb4c418082117848d19defd5"><enum>(F)</enum><header>Nonpricing program</header><clause id="idfcf65d96d9554cf0a2413428c926414d"><enum>(i)</enum><header>In general</header><text>Under a pilot project, a selected child care center shall operate a nonpricing program by—</text><subclause id="idEBBA004C166347A0AA73D108FF11077F"><enum>(I)</enum><text>receiving special assistance payments under this subparagraph in lieu of any other special assistance payment made under this section; and</text></subclause><subclause id="ide07cdef64dc2460fb27da07dc7fb3fca"><enum>(II)</enum><text>using non-Federal funds to pay for the cost of meals and supplements served at the selected child care center that are not reimbursed under the pilot project or the program authorized under this section.</text></subclause></clause><clause id="id06496e8bd2c34a5c91407367b5ccbbd7"><enum>(ii)</enum><header>Election to stop participation</header><text>A selected child care center that elects to stop participating in a pilot project under clause (i) shall notify the selected State and the selected sponsoring organization not later than 3 months before the date on which the center intends to stop participation.</text></clause><clause id="id22715d76500945358c0439226d6b5284"><enum>(iii)</enum><header>First year</header><text>For each month of the first fiscal year during which a pilot project is carried out in a selected State, each selected child care center shall receive special assistance payments at the rate for free meals and supplements for a percentage of all reimbursable meals and supplements served in selected child care centers during that month in an amount equal to the product obtained by multiplying—</text><subclause id="id2eb995d145504f4d9f0deaa043646a3e"><enum>(I)</enum><text>the multiplier described in section 11(a)(1)(F)(vii); and</text></subclause><subclause id="idec80fd416f2e47df8972e7848f6ab222"><enum>(II)</enum><text>the percentage of covered children enrolled in the selected child care centers as of April 1 of the prior fiscal year, up to a maximum of 100 percent.</text></subclause></clause><clause id="id79D3A760CAED4782BE75EF6046F9F1F1"><enum>(iv)</enum><header>Second and subsequent years</header><text>For each month of the second fiscal year and each subsequent fiscal year during which a pilot project is carried out in a selected State, each selected child care center shall receive special assistance payments at the rate for free meals and supplements for a percentage of all reimbursable meals and supplements served in selected child care centers during that month in an amount equal to the product obtained by multiplying—</text><subclause id="id4099e923e5ca47bfbe3fb2dcdb67c663"><enum>(I)</enum><text>the multiplier described in section 11(a)(1)(F)(vii); and</text></subclause><subclause id="id846d0c733deb413187b07b543d8b2d9b"><enum>(II)</enum><text>the higher of—</text><item id="id64afb3a2ded34f10aa1cf15b80b5c68d"><enum>(aa)</enum><text>the percentage of covered children enrolled in the selected child care centers as of April 1 of the prior fiscal year, up to a maximum of 100 percent; and</text></item><item id="id6277940499954bad9c1e8188b3d2ffaf"><enum>(bb)</enum><text>the percentage of covered children enrolled in the selected child care centers as of April 1 of the fiscal year prior to the first fiscal year in which the selected child care center participates in the pilot project, up to a maximum of 100 percent.</text></item></subclause></clause><clause id="id62d83ba9cac5441b91934e7917bbd3bd"><enum>(v)</enum><header>Payment for other meals</header><text>Any meal or supplement served under the program authorized under this section that is not part of a pilot project shall be reimbursed at the rates established under subsection (c).</text></clause></subparagraph><subparagraph id="id9b52ac8dc75043f1b14dd1ae54db6e3b"><enum>(G)</enum><header>Implementation</header><clause id="idDD2BFA8CBE804F9793EC10D55B479CA3"><enum>(i)</enum><header>No applications</header><text>In participating in a pilot project, a selected sponsoring organization or selected child care center shall not collect enrollment forms or applications for free and reduced price meals and supplements under this Act or section 4 of the Child Nutrition Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/42/1773">42 U.S.C. 1773</external-xref>).</text></clause><clause id="id6A50F7C084E045808CE22ECBF866AA2C"><enum>(ii)</enum><header>Administration</header><text>The selected sponsoring organization in a selected State shall be responsible for administering the pilot project, including—</text><subclause id="id27D4B0F753614432AABE458AD5C736EE"><enum>(I)</enum><text>distributing special assistance payments to selected child care centers; and</text></subclause><subclause id="id5AEC326032B34E519276F760221E0F66"><enum>(II)</enum><text>conducting oversight of and reporting on the pilot project.</text></subclause></clause><clause id="idf548ad14c98f4d0aa1fd34b51fa445c4"><enum>(iii)</enum><header>Information dissemination</header><text>A selected State and selected sponsoring organization shall—</text><subclause id="id6A6565B6263C4B24935C59FFE3A6E91E"><enum>(I)</enum><text>notify each eligible child care center in the State about the pilot project, including the reimbursement rates, timeline, and procedures under the pilot project; and</text></subclause><subclause id="id4FC3AEC6194D400B80CFCA46B5F0166A"><enum>(II)</enum><text>provide information about the pilot project to parents or guardians of children attending eligible child care centers.</text></subclause></clause></subparagraph><subparagraph id="id1f7a23ed02794cad9e54785de7f7540b"><enum>(H)</enum><header>Report</header><text>Not later than 1 year after the start date of the last pilot project commenced during the first year of the program established under subparagraph (B)(i), and annually thereafter, the Secretary shall submit to the Committee on Agriculture, Nutrition, and Forestry of the Senate and the Committee on Education and Labor of the House of Representatives a report describing—</text><clause id="idD8407D0402184B17814CEC7AA1A3F735"><enum>(i)</enum><text>the status of each active pilot project; and</text></clause><clause id="id6AAFB053DE9C46038AC5E6FA034F08B4"><enum>(ii)</enum><text>the manner in which the funds authorized under subparagraph (I) are used to carry out this paragraph.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7bdc8086af774b0b97360e757cd3b85d"><enum>(I)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to carry out this paragraph $20,000,000 for the period of fiscal years 2022 through 2026.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="id6C816E489B9A4B0E92F12C865AC33F01"><enum>4.</enum><header>Fourth meal service option</header><text display-inline="no-display-inline">Section 17(f)(2) of the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1766">42 U.S.C. 1766(f)(2)</external-xref>) is amended—</text><paragraph id="ide5e64b0d329440f5b4971491e381323d"><enum>(1)</enum><text>by striking <quote>(2)(A) Subject to subparagraph (B) of this paragraph</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id05359902a99b411180857e885aa5a349"><paragraph id="id82979cb68fd4492884b9b6d0e41610d6"><enum>(2)</enum><header>Disbursements</header><subparagraph id="id8eb0427dd1664b6aac6fe1eb6969e51f"><enum>(A)</enum><header>In general</header><text>Subject to subparagraph (B)</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="id11138198f62241a1a45d37dc8ebca1e2"><enum>(2)</enum><text>by striking subparagraph (B) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id64b22efc98a64f5ebc0f192da8fa84f0"><subparagraph id="idf59201dd65464b7d9e4a7d1ebd06cc88"><enum>(B)</enum><header>Limitation</header><text>No reimbursement may be made to any institution under this paragraph, or to any family or group day care home sponsoring organization under paragraph (3), for more than—</text><clause id="id47563b01611841149603c3849e3cd6e7"><enum>(i)</enum><subclause commented="no" display-inline="yes-display-inline" id="id7890AE1FFB59404283AEFA1DDC5FD26F"><enum>(I)</enum><text>2 meals and 1 supplement per day per child; or</text></subclause><subclause id="id2691622A2DA14791982A9B8B3D5EBAB6" indent="up1"><enum>(II)</enum><text>1 meal and 2 supplements per day per child; or</text></subclause></clause><clause id="id44774f50b85f49ac83e7d35590ac97e2"><enum>(ii)</enum><text>in the case of child care during which there are 8 or more hours between the beginning of the first meal service period and the beginning of the fourth meal service period—</text><subclause id="idA1E6A86B2D0F4962974B33E505E27275"><enum>(I)</enum><text>3 meals and 1 supplement per day per child;</text></subclause><subclause id="id26902969810B4FE2BE76BE3CA28A0366"><enum>(II)</enum><text>2 meals and 2 supplements per day per child; or</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id9DDEFD12032849F0BB0FE7C01BB1BDC2"><enum>(III)</enum><text>1 meal and 3 supplements per day per child.</text></subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="id04EACC35FFD54208A5D006B0929A12FE"><enum>5.</enum><header>Expanding area eligibility</header><text display-inline="no-display-inline">Section 17(f)(3)(A)(ii)(I) of the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1766">42 U.S.C. 1766(f)(3)(A)(ii)(I)</external-xref>) is amended by striking <quote>50 percent</quote> each place it appears and inserting <quote>40 percent</quote>.</text></section><section id="id6c142c38fc664c029deea778235c79e8"><enum>6.</enum><header>Reducing paperwork and improving program administration</header><subsection id="id94fc21c0cbba4e25b7a179f83d373b66"><enum>(a)</enum><header>Eligibility certification criteria for proprietary child care centers</header><text display-inline="yes-display-inline">Section 17(a)(6) of the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1766">42 U.S.C. 1766(a)(6)</external-xref>) is amended—</text><paragraph id="id7eb84816db0d4f44872e99010f76ade8"><enum>(1)</enum><text>in the matter preceding subparagraph (A), by striking <quote>unless it satisfies the following criteria:</quote> and inserting <quote>unless—</quote>;</text></paragraph><paragraph id="iddee54013f6d445aa86fa84ad486706fb"><enum>(2)</enum><text>in each of subparagraphs (A) and (B), by inserting <quote>the institution</quote> after the subparagraph designation;</text></paragraph><paragraph id="id9d9b27f48cd6458c9b20c1aabb444d87"><enum>(3)</enum><text>in subparagraph (C)(i), by inserting <quote>the institution</quote> before <quote>will provide</quote>;</text></paragraph><paragraph id="idea9ae447c38942949aa2a9508e9d36b4"><enum>(4)</enum><text>in subparagraph (E), by striking <quote>and</quote> at the end;</text></paragraph><paragraph id="id40338d48745d47588bd4cd8b994ea2f9"><enum>(5)</enum><text>in subparagraph (F), by striking the period at the end and inserting <quote>; and</quote>; and</text></paragraph><paragraph id="id98094a87e354422a9da6d4fcf8f28164"><enum>(6)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id1d764c8fd7a24a19af0a94c6aaf127f3"><subparagraph commented="no" display-inline="no-display-inline" id="id10a68050e0754e3f96f1d69feacfc36c"><enum>(G)</enum><text>in the case of an institution described in paragraph (2)(B), eligibility is determined annually.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id4B216DC8641743AA96E567C6D6F2D956"><enum>(b)</enum><header>Advisory committee on paperwork reduction</header><text display-inline="yes-display-inline">Section 17 of the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1766">42 U.S.C. 1766</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id968196a2166c44d79d9f87e3d92548c8"><subsection id="id1880acc4d99d44cb9611a2046b3e936a"><enum>(v)</enum><header>Advisory committee on paperwork reduction</header><paragraph id="id0f39123b0c3044aa8511834493f652bc"><enum>(1)</enum><header>Establishment</header><text>Not later than 180 days after the date of enactment of this subsection, the Secretary shall establish an advisory committee (referred to in this subsection as the <quote>Advisory Committee</quote>) to carry out the duties described in paragraph (2).</text></paragraph><paragraph id="ida98b6adf957f4f578560542603da3090"><enum>(2)</enum><header>Duties</header><text>The duties of the Advisory Committee shall be—</text><subparagraph id="idea5e4899653547f69e2f35706982f757"><enum>(A)</enum><text>to examine the feasibility of reducing unnecessary or duplicative paperwork resulting from regulations and recordkeeping requirements, including paperwork resulting from additional State requirements, for entities participating or seeking to participate in the program under this section, including State agencies, family child care homes, child care centers, and sponsoring organizations; and</text></subparagraph><subparagraph id="id46b92dc9f9504193bc7af548ce2a070b"><enum>(B)</enum><text>to provide recommendations to reduce paperwork for participants in the program under this section while ensuring that proper accountability and program integrity are maintained.</text></subparagraph></paragraph><paragraph id="idb325b15e360749bea7ed5914ff5ad715"><enum>(3)</enum><header>Membership</header><text>The Advisory Committee shall be composed of—</text><subparagraph id="id5EAF18E05D8846AAB0B7BBC9F3F7836F"><enum>(A)</enum><text>not less than 1 member representing each of—</text><clause id="id9500980d3f8c43238339178e63cada75"><enum>(i)</enum><text>a public nonprofit center;</text></clause><clause id="idf0dbd4a76ba240f392d3815c38541a20"><enum>(ii)</enum><text>a private nonprofit center;</text></clause><clause id="id735eb2e8b19b4891b85c26878c56b59f"><enum>(iii)</enum><text>a family or group day care home;</text></clause><clause id="idc4e210316e5e4c4083309d0027cac6e8"><enum>(iv)</enum><text>a Head Start center;</text></clause><clause id="ida6d331c00d8a4ce6bcd70d3401ecf74e"><enum>(v)</enum><text>a for-profit center;</text></clause><clause id="idf91dcb2b8bf444a5a7e78254e1869f50"><enum>(vi)</enum><text>an emergency shelter;</text></clause><clause id="id34608a168092445b986d2205bd50d4ef"><enum>(vii)</enum><text>an adult day care center;</text></clause><clause id="idc23f2c468fe4471fb201cfc4e045a0f4"><enum>(viii)</enum><text>a State agency;</text></clause><clause id="idbbd31ffebe88473da136e93d1ac571ca"><enum>(ix)</enum><text>a sponsoring organization for child care centers;</text></clause><clause id="idfd7421aed79a4bb19c3b84b713b49ab8"><enum>(x)</enum><text>a sponsoring organization of family or group day care homes;</text></clause><clause id="id7facc0b7077346c79b26fb9b9f6678fc"><enum>(xi)</enum><text>an anti-hunger advocacy organization;</text></clause><clause id="id7d683b19f57d48c6acbf99eb27398e3b"><enum>(xii)</enum><text>an after school program for at-risk youth; and</text></clause><clause id="idba2771642fde4477a037e1c4b3f7e702"><enum>(xiii)</enum><text>a child care advocacy organization; and</text></clause></subparagraph><subparagraph id="id5DCF188352DF453991DEB2A2E4229A41"><enum>(B)</enum><text>any other members, as the Secretary determines to be appropriate.</text></subparagraph></paragraph><paragraph id="idd54ecb40d202428fb9d33645438d09ca"><enum>(4)</enum><header>Considerations</header><text>In developing recommendations under paragraph (2)(B), the Advisory Committee shall consider—</text><subparagraph id="id447bfd248cb94afaa7166de5482d00b4"><enum>(A)</enum><text>information, recommendations, and reports from the Child and Adult Care Food Program Paperwork Reduction Work Group established pursuant to section 336 of the Healthy, Hunger-Free Kids Act of 2010 (<external-xref legal-doc="usc" parsable-cite="usc/42/1766">42 U.S.C. 1766</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/111/296">Public Law 111–296</external-xref>); and</text></subparagraph><subparagraph id="id93bc5052d9df45189d1f03e95aa8829b"><enum>(B)</enum><text>the use of electronic systems and recordkeeping technologies to reduce paperwork for program participants and program operators.</text></subparagraph></paragraph><paragraph id="id489d9cf8eaf9405280aaf795af165588"><enum>(5)</enum><header>Guidance and regulations</header><text>Not later than 1 year after the date of enactment of this subsection, the Secretary shall issue guidance and, as appropriate, regulations, based on the recommendations made under paragraph (2)(B), for streamlined and consolidated paperwork and recordkeeping requirements for the program, including—</text><subparagraph id="id79C5BA4311B347CEB29AF436271E5F35"><enum>(A)</enum><text>streamlining and modernizing applications, monitoring, and auditing;</text></subparagraph><subparagraph id="idbfb28c376b1b4d85978757c2d8eb0142"><enum>(B)</enum><text>eliminating the use of an enrollment form;</text></subparagraph><subparagraph id="id28ef02b9f29e4032be9497638ded9331"><enum>(C)</enum><text>allowing the use of direct certification in all States;</text></subparagraph><subparagraph id="idca0719cb6209467a9737281ec3c0dfa3"><enum>(D)</enum><text>requiring States to accept digital forms, digitized and electronic signatures, and electronic records as documentation;</text></subparagraph><subparagraph id="idd205c8b9d8ee4fce9d1539d1983a821d"><enum>(E)</enum><text>allowing the use of electronic data collection systems, in accordance with Federal standards;</text></subparagraph><subparagraph id="idf4d44bcb055b4ac082944f66f8f02d9a"><enum>(F)</enum><text>streamlining duplicative State-specific requirements; and</text></subparagraph><subparagraph id="id943f17c6e2384f868c552883180d96af"><enum>(G)</enum><text>encouraging the adoption in the program of generally accepted technologies from other domains.</text></subparagraph></paragraph><paragraph id="idb1614aae3e59444688316ea8983e03c6"><enum>(6)</enum><header>Report</header><subparagraph id="idf50d77210e64455a8235a14140fb9548"><enum>(A)</enum><header>In general</header><text>Not later than 180 days after issuing guidance and regulations under paragraph (5), the Secretary shall submit to the Committee on Agriculture, Nutrition, and Forestry of the Senate and the Committee on Education and Labor of the House of Representatives a report containing the information described in subparagraph (B).</text></subparagraph><subparagraph id="id1653dd5fcbcb4d9fba4444c174c05815"><enum>(B)</enum><header>Contents</header><text>The report under subparagraph (A) shall contain the following:</text><clause id="idcbbb8d7914de4b3091f7cbcef857823c"><enum>(i)</enum><text>In each case in which the Secretary did not implement a recommendation of the Advisory Committee, an explanation for why the recommendation was not implemented.</text></clause><clause id="id8f92449c11cf43d1ba8f9daaae810b8f"><enum>(ii)</enum><text>Recommendations for legislative action that may strengthen and streamline the program application and monitoring processes and reduce administrative burdens on grantees, program participants, the Federal Government, and local and State governments.</text></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="id0b562039d0b641c9a22c8aedb409ae95"><enum>7.</enum><header>Funding to support nutrition access for young children</header><text display-inline="no-display-inline">Section 17(n) of the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1766">42 U.S.C. 1766(n)</external-xref>) is amended—</text><paragraph id="ida325cf5de3554596af03f99ca60650e2"><enum>(1)</enum><text>by striking <quote>(n) There are hereby</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idae64c3e9c3ca4bbbbdea6b5324c2f857"><subsection id="ida1e0124deefb4e96aa09b1d1cf7eaf97"><enum>(n)</enum><header>Funding</header><paragraph id="id9c9ba337868849b69ef3c423d6b4da74"><enum>(1)</enum><header>In general</header><text>There are</text></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="idbf37eda2f4cb4d0ba1224cdf83e0df55"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id86fd664c92a44da4a93796e98ca8e399"><paragraph commented="no" id="id940898553208410b8ef4b11b95a3895e"><enum>(2)</enum><header>Funding to support nutrition access for children</header><subparagraph commented="no" id="idAACCD439A1504654A430ED71492685CB"><enum>(A)</enum><header>In general</header><text>On October 1, 2021, and October 1, 2022, out of any funds in the Treasury not otherwise appropriated, the Secretary of the Treasury shall transfer to the Secretary $5,000,000, to remain available until expended—</text><clause commented="no" id="idab09971da62b4f63a0e3201ae0cb6912"><enum>(i)</enum><text>to provide training and technical assistance under the program—</text><subclause commented="no" id="id608806B999B14AEA8F438299F2857CEF"><enum>(I)</enum><text>to support healthy meal patterns of children; and</text></subclause><subclause commented="no" id="id7AFA519DDFE54FDE84F8C320AAA839F4"><enum>(II)</enum><text>with respect to best practices for—</text><item commented="no" id="id0fb155f6f0bc4a368f15b9ab83265810"><enum>(aa)</enum><text>increasing consumption by children of vegetables, fruits, whole grains, and healthy beverages;</text></item><item commented="no" id="idBB68974127A14842B1065DB41A6B895B"><enum>(bb)</enum><text>reducing consumption by children of added sugars and saturated fats; and</text></item><item commented="no" id="id49D8AFE6B02E4DB59F9A0245DADC72DC"><enum>(cc)</enum><text>eliminating consumption by children of beverages sweetened with sugar; and</text></item></subclause></clause><clause commented="no" id="id4167aa1b56d34b66abea386bf215bab0"><enum>(ii)</enum><text>to increase participation in the program of children from underserved communities.</text></clause></subparagraph><subparagraph id="id8d06e7c211d646f3ad8ea986cf7e19ab"><enum>(B)</enum><header>Receipt and acceptance</header><text>The Secretary shall be entitled to receive, shall accept, and shall use to carry out this paragraph the funds transferred under subparagraph (A), without further appropriation.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
