<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>1st Session</session><legis-num>S. 1267</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20210421">April 21, 2021</action-date><action-desc><sponsor name-id="S353">Mr. Schatz</sponsor> (for himself and <cosponsor name-id="S288">Ms. Murkowski</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To extend certain deadlines for the 2020 decennial census.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>2020 Census Deadline Extensions Act</short-title></quote>.</text></section><section id="idb729769f9811471abbd92f3f9be95492"><enum>2.</enum><header>Census deadline modification</header><subsection id="id4E8F274C238F4A10A3BA0CE191E133DB"><enum>(a)</enum><header>Definitions</header><text>In this section—</text><paragraph id="idDB839ECAB2994C729EC443EB7180B39A"><enum>(1)</enum><text>the term <term>President</term> means the President of the United States; and</text></paragraph><paragraph id="id269FFCD0ADDE4EE3A3F1A157DBC3EE65"><enum>(2)</enum><text>the term <term>Secretary</term> means the Secretary of Commerce.</text></paragraph></subsection><subsection id="id8852A8D3FE7B49E0898562167A9F88E9"><enum>(b)</enum><header>Modified timetables and rules</header><text display-inline="yes-display-inline">Notwithstanding subsections (b) and (c) of section 141 of title 13, United States Code, and subsection (a) of section 22 of the Act entitled <quote>An Act to provide for the fifteenth and subsequent decennial censuses and to provide for apportionment of Representatives in Congress</quote>, approved June 18, 1929 (<external-xref legal-doc="usc" parsable-cite="usc/2/2a">2 U.S.C. 2a</external-xref>), the following timetables and rules shall apply to the 2020 decennial census of population:</text><paragraph id="id4e7ae502edff41e0ba2ae7ba8dfb66c1"><enum>(1)</enum><text>Not later than May 1, 2021, the Secretary shall—</text><subparagraph id="id120BAB4BEF294519B1AECE1D07CF111C"><enum>(A)</enum><text>complete the tabulation of total population by States required under subsection (a) of such section 141;</text></subparagraph><subparagraph id="idbcf20a0e663c48838a4718ebbd999f97"><enum>(B)</enum><text>report the tabulation described in subparagraph (A) to the President; and</text></subparagraph><subparagraph id="id71e0445e2c764689bb15c70e143bd561"><enum>(C)</enum><text>make the tabulation described in subparagraph (A) public.</text></subparagraph></paragraph><paragraph id="ide7610ad8927347e89b91d10bea74d942"><enum>(2)</enum><text>Not later than 14 days after receipt of the tabulation described in paragraph (1)(A), the President shall transmit to Congress the statement described in subsection (a) of such section 22.</text></paragraph><paragraph id="id3149bef15bf84489bb59b17a8359faa9" commented="no"><enum>(3)</enum><text>Each State shall be entitled, in the 118th Congress and in each Congress thereafter until the taking effect of a reapportionment under such section 22 or a subsequently enacted statute, to the number of Representatives shown in the statement described in paragraph (2), and no State shall receive less than 1 Member.</text></paragraph><paragraph id="id49ee41ef03304e3b831a89a7dbb816f8"><enum>(4)</enum><text>Not later than 15 days after receipt of the statement described in paragraph (2), the Clerk of the House of Representatives shall send to the executive of each State a certificate of the number of Representatives to which the State is entitled under paragraph (3). In the case of a vacancy in the Office of Clerk, or of the absence or inability of the Clerk to discharge that duty, that duty shall devolve upon the Sergeant at Arms of the House of Representatives.</text></paragraph><paragraph id="id02e8ff0218ec4caa97da987495744ee3"><enum>(5)</enum><text>The Secretary shall—</text><subparagraph id="idD279A5BFC1554E2FB039B07FC7ADC73B"><enum>(A)</enum><text>complete the tabulations of population required under subsection (c) of such section 141 as expeditiously as possible after the deadline described in paragraph (4) of this subsection, taking into account the deadlines of each State for legislative apportionment or districting; and</text></subparagraph><subparagraph id="id1E9387052CA047EE8284B53F3F08999E"><enum>(B)</enum><text>report the tabulations described in subparagraph (A) as required under subsection (c) of such section 141 not later than October 1, 2021.</text></subparagraph></paragraph></subsection></section></legis-body></bill>
