<distribution-code display="yes">II</distribution-code><calendar>Calendar No. 102</calendar><congress>117th CONGRESS</congress><session>1st Session</session><legis-num>S. 111</legis-num><associated-doc role="report">[Report No. 117–29]</associated-doc><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20210128">January 28, 2021</action-date><action-desc><sponsor name-id="S345">Mr. Johnson</sponsor> (for himself, <cosponsor name-id="S404">Mr. Scott of Florida</cosponsor>, and <cosponsor name-id="S350">Mr. Rubio</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSGA00" added-display-style="italic" deleted-display-style="strikethrough">Committee on Homeland Security and Governmental Affairs</committee-name></action-desc></action><action stage="Reported-in-Senate"><action-date>July 19, 2021</action-date><action-desc>Reported by <sponsor name-id="S380">Mr. Peters</sponsor>, without amendment</action-desc></action><legis-type>A BILL</legis-type><official-title>To establish the Federal Clearinghouse on School Safety Best Practices, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Luke and Alex School Safety Act of 2021</short-title></quote>.</text></section><section id="id3288f0875cfa40f1877ff6cdb0c77263"><enum>2.</enum><header>Federal Clearinghouse on School Safety Best Practices</header><subsection id="id82d27de718414cd593088971cb61758a"><enum>(a)</enum><header>In general</header><text>Subtitle A of title XXII of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/651">6 U.S.C. 651 et seq.</external-xref>) is amended by inserting after section 2215 the following:</text><quoted-block display-inline="no-display-inline" id="id0FB0BABBDD11408D99DE6CAEF12DDEA5" style="OLC"><section id="id34a552dbfda44f5180cd9d270f5fde62"><enum>2216.</enum><header>Federal Clearinghouse on School Safety Best Practices</header><subsection id="id4016352ad07744f2bc1241d47a7faf32"><enum>(a)</enum><header>Establishment</header><paragraph id="idc4726847392745c285abb7b4ee0c1e5c"><enum>(1)</enum><header>In general</header><text>The Secretary, in coordination with the Secretary of Education, the Attorney General, and the Secretary of Health and Human Services, shall establish a Federal Clearinghouse on School Safety Best Practices (in this section referred to as the <quote>Clearinghouse</quote>) within the Department.</text></paragraph><paragraph id="id31043db299c6497db3861d7bea65ca3f"><enum>(2)</enum><header>Purpose</header><text>The Clearinghouse shall be the primary resource of the Federal Government to identify and publish online through SchoolSafety.gov, or any successor website, the best practices and recommendations for school safety for use by State and local educational agencies, institutions of higher education, State and local law enforcement agencies, health professionals, and the general public.</text></paragraph><paragraph id="idf8d60a03fd564ba38667f40a0dbacc44"><enum>(3)</enum><header>Personnel</header><subparagraph id="ide2f9eff71ec04c1fb950b3db31cd64dd"><enum>(A)</enum><header>Assignments</header><text>The Clearinghouse shall be assigned such personnel and resources as the Secretary considers appropriate to carry out this section.</text></subparagraph><subparagraph id="id4fae2b26dd514b319c79d2e48dd00846"><enum>(B)</enum><header>Detailees</header><text>The Secretary of Education, the Attorney General, and the Secretary of Health and Human Services may detail personnel to the Clearinghouse.</text></subparagraph></paragraph><paragraph id="id049780af244d493caedb5e16510c3798"><enum>(4)</enum><header>Exemptions</header><subparagraph id="ida292983bd5cf44e4965c19fd96dc1c21"><enum>(A)</enum><header>Paperwork Reduction Act</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/44/35">Chapter 35</external-xref> of title 44, United States Code (commonly known as the <quote>Paperwork Reduction Act</quote>) shall not apply to any rulemaking or information collection required under this section.</text></subparagraph><subparagraph id="id8313f1dc831d4db5889e5a96345ccb2c"><enum>(B)</enum><header>Federal Advisory Committee Act</header><text>The Federal Advisory Committee Act (5 U.S.C. App.) shall not apply for the purposes of carrying out this section.</text></subparagraph></paragraph></subsection><subsection id="id3b9de6139dab465bbe914374831fca96"><enum>(b)</enum><header>Clearinghouse contents</header><paragraph id="idf7fba3bc918a4ed684f2c1e045700d6b"><enum>(1)</enum><header>Consultation</header><text>In identifying the best practices and recommendations for the Clearinghouse, the Secretary may consult with appropriate Federal, State, local, Tribal, private sector, and nongovernmental organizations.</text></paragraph><paragraph id="id8928950c648541c0b01553c856f442db"><enum>(2)</enum><header>Criteria for best practices and recommendations</header><text>The best practices and recommendations of the Clearinghouse shall, at a minimum—</text><subparagraph id="id1c9acb222d0a430dae84aa9630512df9"><enum>(A)</enum><text>involve comprehensive school safety measures, including threat prevention, preparedness, protection, mitigation, incident response, and recovery to improve the safety posture of a school upon implementation; </text></subparagraph><subparagraph changed="not-changed" id="idDEA99BC1682145E68500034FCBF8C3EA"><enum>(B)</enum><text>include any evidence or research rationale supporting the determination of the Clearinghouse that the best practice or recommendation under subparagraph (A) has been shown to have a significant effect on improving the health, safety, and welfare of persons in school settings, including—</text><clause changed="not-changed" id="idEC57C5FA16004E989304AD83B7B20682"><enum>(i)</enum><text>relevant research that is evidence-based, as defined in section 8101 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801</external-xref>), supporting the best practice or recommendation;</text></clause><clause changed="not-changed" id="id1B244D40F29947399044CD1B0567E24E"><enum>(ii)</enum><text>findings and data from previous Federal or State commissions recommending improvements to the safety posture of a school; or</text></clause><clause changed="not-changed" id="idB6F6E49B1EA04F24B3DE6B760CEA2F39"><enum>(iii)</enum><text>other supportive evidence or findings relied upon by the Clearinghouse in determining best practices and recommendations to improve the safety posture of a school upon implementation; and</text></clause></subparagraph><subparagraph id="idf6b53603a73040f1b27644804547c982"><enum>(C)</enum><text>include information on Federal grant programs for which implementation of each best practice or recommendation is an eligible use for the program.</text></subparagraph></paragraph><paragraph id="id8ee22be7b7c149699c649a09f5d57f93"><enum>(3)</enum><header>Past Commission recommendations</header><text>To the greatest extent practicable, the Clearinghouse shall present, as appropriate, Federal, State, local, Tribal, private sector, and nongovernmental organization issued best practices and recommendations and identify any best practice or recommendation of the Clearinghouse that was previously issued by any such organization or commission.</text></paragraph></subsection><subsection id="id5eccae41a29f42ec89772e2882454e15"><enum>(c)</enum><header>Assistance and training</header><text>The Secretary may produce and publish materials on the Clearinghouse to assist and train educational agencies and law enforcement agencies on the implementation of the best practices and recommendations.</text></subsection><subsection id="id82c88fa84b5e4911a8369b225c1d72c6"><enum>(d)</enum><header>Continuous improvement</header><text>The Secretary shall—</text><paragraph id="idE5F0A666A7C848828CC94FA50E58A03D"><enum>(1)</enum><text>collect for the purpose of continuous improvement of the Clearinghouse—</text><subparagraph id="idacbcc46bbc29482494daf3e1bc460159"><enum>(A)</enum><text>Clearinghouse data analytics; </text></subparagraph><subparagraph id="idd13b7bc81ef347a29d822b4fd634ce2c"><enum>(B)</enum><text>user feedback on the implementation of resources, best practices, and recommendations identified by the Clearinghouse; and</text></subparagraph><subparagraph changed="not-changed" id="id19DA5073B0214A3F9C0009F8D100E047"><enum>(C)</enum><text>any evaluations conducted on implementation of the best practices and recommendations of the Clearinghouse; and</text></subparagraph></paragraph><paragraph id="idc03bc8c3b75d4d8b94133c152f70b178"><enum>(2)</enum><text>in coordination with the Secretary of Education, the Secretary of Health and Human Services, and the Attorney General—</text><subparagraph id="id9333faf90dcc4cdda3c222e0f4a0b100"><enum>(A)</enum><text>regularly assess and identify Clearinghouse best practices and recommendations for which there are no resources available through Federal Government programs for implementation; and</text></subparagraph><subparagraph id="id1968CD6F1E514522857CD4BFF8267E1D"><enum>(B)</enum><text>establish an external advisory board, which shall be comprised of appropriate State, local, Tribal, private sector, and nongovernmental organizations, including organizations representing parents of elementary and secondary school students, to—</text><clause id="idAD72105437B943639514C3BAE8DC1503"><enum>(i)</enum><text>provide feedback on the implementation of best practices and recommendations of the Clearinghouse; and</text></clause><clause id="id915B7F6AA33F47EE866558C931D4DE46"><enum>(ii)</enum><text>propose additional recommendations for best practices for inclusion in the Clearinghouse.</text></clause></subparagraph></paragraph></subsection><subsection id="idaada27283a744ac990003105a8ae07a3"><enum>(e)</enum><header>Parental Assistance</header><text>The Clearinghouse shall produce materials to assist parents and legal guardians of students with identifying relevant Clearinghouse resources related to supporting the implementation of Clearinghouse best practices and recommendations.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id26f00031e8f24ee8ad62cd91b08d1d5a"><enum>(b)</enum><header>Technical Amendments</header><text>The table of contents in section 1(b) of the Homeland Security Act of 2002 (<external-xref legal-doc="public-law" parsable-cite="pl/107/296">Public Law 107–296</external-xref>; 116 Stat. 2135) is amended by inserting after the item relating to section 2215 the following:</text><quoted-block id="idcb211535-0849-476e-91a6-b5f414a3f04a" style="OLC"><toc><toc-entry idref="id34a552dbfda44f5180cd9d270f5fde62" level="section">Sec. 2216. Federal Clearinghouse on School Safety Best Practices.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="id7018f2d549ac495cae43ab049e731752"><enum>3.</enum><header>Notification of Clearinghouse</header><subsection id="idb76d7e84bccf44de83d6e5fb83cabc8b"><enum>(a)</enum><header>Notification by the Secretary of Education</header><text>The Secretary of Education shall provide written notification of the publication of the Federal Clearinghouse on School Safety Best Practices (referred to in this section and section 4 as the <term>Clearinghouse</term>), as required to be established under section 2216 of the Homeland Security Act of 2002, as added by section 2 of this Act, to—</text><paragraph id="id71A05E74F0F041F090446475D93739F3"><enum>(1)</enum><text>every State and local educational agency; and</text></paragraph><paragraph id="id346F4DC149C54F4E971F31619275E723"><enum>(2)</enum><text>other Department of Education partners in the implementation of the best practices and recommendations of the Clearinghouse, as determined appropriate by the Secretary of Education.</text></paragraph></subsection><subsection id="ideb0503a9c4304b4a8ff84ae2548f2d8a"><enum>(b)</enum><header>Notification by the Secretary of Homeland Security</header><text>The Secretary of Homeland Security shall provide written notification of the publication of the Clearinghouse, as required to be established under section 2216 of the Homeland Security Act of 2002, as added by section 2 of this Act, to—</text><paragraph id="idC2BDC7BFB16E47848ECE2CBDA3E1AD69"><enum>(1)</enum><text>every State homeland security advisor;</text></paragraph><paragraph id="idDB3C5A9AA99348788C344D8E94601DBE"><enum>(2)</enum><text>every State department of homeland security; and</text></paragraph><paragraph id="id0BBDD0FC618841D7A5FD499481828ED5"><enum>(3)</enum><text>other Department of Homeland Security partners in the implementation of the best practices and recommendations of the Clearinghouse, as determined appropriate by the Secretary of Homeland Security.</text></paragraph></subsection><subsection id="idc21bce8575c448bb832a926f1af9cf58"><enum>(c)</enum><header>Notification by the Secretary of Health and Human Services</header><text>The Secretary of Health and Human Services shall provide written notification of the publication of the Clearinghouse, as required to be established under section 2216 of the Homeland Security Act of 2002, as added by section 2 of this Act, to—</text><paragraph id="id87BAB22ADF3D4B1CA678F09A4B822671"><enum>(1)</enum><text>every State department of public health; and</text></paragraph><paragraph id="id8DE8D907BD4243ABA329CC2549246B98"><enum>(2)</enum><text>other Department of Health and Human Services partners in the implementation of the best practices and recommendations of the Clearinghouse, as determined appropriate by the Secretary of Health and Human Services.</text></paragraph></subsection><subsection id="id2317d3ae6e7c4e678ac456d584e7c478"><enum>(d)</enum><header>Notification by the Attorney General</header><text>The Attorney General shall provide written notification of the publication of the Clearinghouse, as required to be established under section 2216 of the Homeland Security Act of 2002, as added by section 2 of this Act, to—</text><paragraph id="idBE383602B7524DD08738965532498CEE"><enum>(1)</enum><text>every State department of justice; and</text></paragraph><paragraph id="idDBF929C9292D402D9A845E3EA4D30582"><enum>(2)</enum><text>other Department of Justice partners in the implementation of the best practices and recommendations of the Clearinghouse, as determined appropriate by the Attorney General.</text></paragraph></subsection></section><section id="id8244393c2e5248ccbbca72284ea66912"><enum>4.</enum><header>Grant program review</header><subsection id="idB70AC7B94BB244CFA74D805F0F96ECD4"><enum>(a)</enum><header>Federal grants and resources</header><text display-inline="yes-display-inline">The Secretary of Education, the Secretary of Homeland Security, the Secretary of Health and Human Services, and the Attorney General shall each—</text><paragraph id="id576f84a8293441b0bd1a4709a1198dbb"><enum>(1)</enum><text>review grant programs administered by their respective agency and identify any grant program that may be used to implement best practices and recommendations of the Clearinghouse;</text></paragraph><paragraph id="idfd608b91586a449d87f378ecfc3371f9"><enum>(2)</enum><text>identify any best practices and recommendations of the Clearinghouse for which there is not a Federal grant program that may be used for the purposes of implementing the best practice or recommendation as applicable to the agency; and</text></paragraph><paragraph id="id85f2ca8f4d8c42fa850c9e24f2b8651a"><enum>(3)</enum><text>periodically report any findings under paragraph (2) to the appropriate committees of Congress.</text></paragraph></subsection><subsection id="id03EBEB0CF149455B9F69ADEB8D278E44"><enum>(b)</enum><header>State grants and resources</header><text>The Clearinghouse shall, to the extent practicable, identify, for each State—</text><paragraph id="id53dc30ed03db420eab8070a141ce8979"><enum>(1)</enum><text>each agency responsible for school safety in the State, or any State that does not have such an agency designated;</text></paragraph><paragraph id="idb1319186a12241ca9abc855ff8fe72fc"><enum>(2)</enum><text>any grant program that may be used for the purposes of implementing best practices and recommendations of the Clearinghouse; and</text></paragraph><paragraph id="idbef00afdb56b40bdbd0106dc27bdd896"><enum>(3)</enum><text>any resources other than grant programs that may be used to assist in implementation of best practices and recommendations of the Clearinghouse.</text></paragraph></subsection></section><section changed="not-changed" id="id20C4DBB20F6F47CD8CD72AB3052093B6"><enum>5.</enum><header>Rules of construction</header><subsection changed="not-changed" id="id6B1CA1D36C1949568B30C2232D54A0F9"><enum>(a)</enum><header>Waiver of requirements</header><text display-inline="yes-display-inline">Nothing in this Act or the amendments made by this Act shall be construed to create, satisfy, or waive any requirement under—</text><paragraph id="id7FEE248914AA4BDCB0A18B49E7E601F1" changed="not-changed"><enum>(1)</enum><text display-inline="yes-display-inline">title II of the Americans With Disabilities Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12131">42 U.S.C. 12131 et seq.</external-xref>);</text></paragraph><paragraph id="idF13BDE53FBAE40139E8C59E604F3961A" changed="not-changed"><enum>(2)</enum><text display-inline="yes-display-inline">the Rehabilitation Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/29/701">29 U.S.C. 701 et seq.</external-xref>);</text></paragraph><paragraph id="id70673d94623945e2a9c71f2fd3ce10f1" changed="not-changed"><enum>(3)</enum><text>title VI of the Civil Rights Act of 1964 (<external-xref legal-doc="usc" parsable-cite="usc/42/2000d">42 U.S.C. 2000d et seq.</external-xref>);</text></paragraph><paragraph id="idEB645EC35C844093971FF318345B66BF" changed="not-changed"><enum>(4)</enum><text>title IX of the Education Amendments of 1972 (<external-xref legal-doc="usc" parsable-cite="usc/20/1681">20 U.S.C. 1681 et seq.</external-xref>); or</text></paragraph><paragraph id="id2D2FCB165D28462696CEAC517FB21676" changed="not-changed"><enum>(5)</enum><text>the Age Discrimination Act of 1975 (<external-xref legal-doc="usc" parsable-cite="usc/42/6101">42 U.S.C. 6101 et seq.</external-xref>).</text></paragraph></subsection><subsection id="id9fda4ddc7e83441db97a69c1fdcbe8d6"><enum>(b)</enum><header>Prohibition on federally developed, mandated, or endorsed curriculum</header><text>Nothing in this Act or the amendments made by this Act shall be construed to authorize any officer or employee of the Federal Government to engage in an activity otherwise prohibited under section 103(b) of the Department of Education Organization Act (<external-xref legal-doc="usc" parsable-cite="usc/20/3403">20 U.S.C. 3403(b)</external-xref>).</text></subsection></section></legis-body><endorsement><action-date>July 19, 2021</action-date><action-desc>Reported without amendment</action-desc></endorsement></bill>
